1/27/2015 16.A.9. EXECUTIVE SUMMARY Recommendation to approve seven releases of code enforcement liens with a combined accrued value of $767,504.15 for payment of $4,954.15, in the code enforcement actions entitled Board of County Commissioners v. Michael Hernandez and Adrianna Garcia and Board of County Commissioners v. Juan Hernandez and Adrianna Garcia, Code Enforcement Special Magistrate Case Nos. 2005020051, CEAU20110008432, CENA20110009062, CEV20110009199, CENA20120015717 and Code Enforcement Board Case Nos. 2006081209 and CEPM20130011083, relating to property located at 1521 Golden Gate Blvd.W.,Collier County,Florida. OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release seven code enforcement liens with a combined accrued value of $767,504.15, for payment of $4,954.15, in relation to Code Enforcement Special Magistrate Case Nos. 2005020051, CEAU20110008432, CENA20110009062, CEV20110009199, CENA20120015717 and Code Enforcement Board Case Nos. 2006081209 and CEPM20130011083 CEPM20100007875 and CEPM20120006379. CONSIDERATIONS: As a result of various code violations at 1521 Golden Gate Blvd. W., as reflected below, the Special Magistrate and Code Enforcement Board ordered the imposition of seven liens against Michael Hernandez and Adrianna Garcia and Juan Hernandez and Adrianna Garcia as follows (in chronological order based on lien recording date): The lien in Case No. 2005020051 was recorded in the Official Records on November 8, 2007, at O.R. Book 4300, Page 2812 (unlicensed/Inoperable vehicles). The lien amount of$17,035.83 is based on 339 days of accrued fines ($50 per day from May 3, 2005 through April 7, 2006), plus operational costs of$85.83. The property was brought into compliance on April 7, 2006. The lien in Case No. 2006081209 was recorded in the Official Records on February 4, 2009, at O.R. Book 4425, Page 0524 (garage converted/enclosed without the appropriate Collier County permits). The lien amount of$431,087.44 is based on 2,155 days of accrued fines ($200 per day from November 29, 2008 through October 24, 2014), plus $87.44 in operational costs. The property was brought into compliance on October 24, 2014. The lien in Case No. CEAU20110008432 was recorded in the Official Records on December 14, 2011, at O.R. Book 4745, Page 2989 (wood fence on property in disrepair). The lien amount of $42,362.20 is based on 418 days of accrued fines ($100 per day from October 15, 2011 through December 5,2012), plus $112.20 in operational costs and a$450 fine. The property was brought into compliance on December 5, 2012. The lien in Case No. CENA20110009062 was recorded in the Official Records on August 20, 2012, at O.R. Book 4827, Page 2117 (weeds and grass in excess of 18 inches and litter consisting of tires, auto parts, metal, plastic, wood and general debris). The lien amount of$24,487.38 is based on 231 days of accrued fines ($100 per day from October 15, 2011 through June 1, 2012), plus $112.38 in operational costs and $1,275 in abatement costs. The lien in Case No. CEV20110009199 was recorded in the Official Records on December 14, 2011, at O.R. Book 4745, Page 2984 (unlicensed and inoperable motorcycles and a Dodge Neon on property). The lien amount of$9,262.20 is based on 183 days of accrued fines ($50 per day from October 11, 2011 through April 10, 2012), plus $112.20 in operational costs. The property was brought into compliance on April 10, 2012. The lien in Case No. CENA20120015717 was recorded in the Official Records on March 20, 2013, at O.R. Book 4898, Page 2919 (litter and debris consisting of old clothing, broken television, old furniture, metal, plastic, and household trash). The lien amount of$10,112.38 is based on 36 days of accrued fines ($250 per day from December 11, 2012 through January 15, 2013), plus $112.38 in operational costs and $1,000 in abatement costs. The property was brought into compliance on January 15, 2013. The lien in Case No. CEPM20130011083 was recorded in the Official Records on December 20, 2013, at O.R. Book 4994, Page 1172 (an unsecured vacant home with a hole in the wall). The lien amount of$233,156.72 is based on 47 days of accrued fines ($500 per day from August 29, 2013 through October 14, 2013 for order items 1 & 3) and 417 days of accrued fines ($500 per day from September 22, 2013 through November 12, 2014 for order items 2 & 4), plus $81.72 in operational costs and $1,075 in abatement costs. The property was brought into compliance on October 14, 2013 for order items 1 & 3 and on November 12, 2014 for order items 2 &4. Following a foreclosure (Case No. 2012-CA-2933), a Certificate of Title was recorded on June 24, 2014 in favor of The Bank of New York Mellon, et al. The bank then sold the property to Donald Ward on November 26, 2014. Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code enforcement lien encumbers property that is under new ownership, the new owner has diligently pursued abatement, and compliance has been achieved within 30 days. The property is being actively maintained and the owner has paid $4,954.15. The new owner is requesting a waiver of$762,550 in accrued fines. FISCAL IMPACT: Payment of the $4,954.15 fine has been made, representing $450 in fines, $704.15 in operational costs and $3,800 in abatement costs. If approved by the Board, accrued fines in the amount of$762,550 would be waived. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution 2012-46. It is the responsibility of the appealing party to obtain a transcribed record of the hearing from the Clerk of Courts.
