EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve an
extension of one year for completion of subdivision improvements associated with Fiddler's Creek
Phase 3, Unit One (AR-1607) pursuant to Section 10.02.05 C of the Collier County Land
Development Code.
OBJECTIVE: To have the Board of County Commissioners (Board) approve a one year extension
for the completion of subdivision improvements associated with Fiddler's Creek Phase 3, Unit One.
CONSIDERATIONS: On June 25, 2002, the Board of County Commissioners approved the
construction plans and final plat for Fiddler's Creek Phase 3, Unit One. On February 24, 2004, the
plat was recorded in the public records. Section 10.02.05 C.2 requires that construction must be
completed within 36 months of approval of a subdivision plat. The Land Development Code allows
for 2—two year extensions. The developer has utilized all of the extensions available to him through
the County as well as through certain House Bills and Senate Bills. The owner has requested an
extension for completion of construction which would extend to April 29, 2016. Since this request
goes beyond what is allowed in the Land Development Code, the Board of County Commissioners
must approve the request. The project is currently scheduled to expire on April 29,2015.
FISCAL IMPACT: The County will realize revenues as follows:

Revenue generated by this project: Total: $150.00 Extension Fees
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires
a majority vote for Board approval. - SAS
RECOMMENDATIONS:
1. That the Board accepts the applicant's extension request together with the appropriate fees.
2. Approve a one year extension until April 29, 2016 for Fiddler's Creek Phase 3, Unit One (AR-
1607) so that the developer may be in compliance with the time limit requirements of the Land
Development Code.
3. The extension approval is subject to the terms and conditions contained in the original approval
letter.

Please be advised that the Collier County Board of County Commissioners,at its regularly scheduled
meeting of June 25,2002 has approved the plat for the referenced project with certain stipulations(see
attached Exhibit"A").
Engineering Review has reviewed the construction plans for the referenced project and has no objection
to the construction of water., sewer,paving and drainage aspects of the project subject to the following
stipulations:

hours prior to the start of construction.
1. General
a) CHANGES IN USE AND/OR DESIGN OF THIS PLAN ARE NOT AUTHORIZED
WITHO[rT WRITTEN APPROVAL BY THE COUNTY. CHANGES SHALL
REQUIRE RE-REVIEW IN ACCOIW A,]\CE WITH ALL CURRENT COUNTY
CODES INCLUDING PARKING FACILITIES,UTILITI[IES,TRANSPORTATION
AND THE LIKE.
b) The Completion Certificate for preliminary acceptance shall be based on information
provided by the project Surveyor,and the Engineer's own observations,and NOT
based on information provided by the contractor(3.2.6.4.3)..
c) All PUt)related stipulations shall apply to this project.
d) Permits from other.agencies having jurisdiction over this; project shall be obtained prior to
start of construction.
e) This construction plan and plat is approved conditionally upon the Waiver and Release
executed by the Owner with respect to Collier County Ordinance No. 93.82 for Adequate
Public Facilities. Be advised that building permits cannot be issued for this property until a
Concurrency Certificate is issued.

development may utilize the same name or a similar sounding name as arty existing
subdivision,street,building,condominium or development, except that the major street within
a subdivision may utillize the name of the subdivision. Any changes to the project name shall
be reviewed and approved by Community Dev. and Environmental Svcs. Addressing
Department.

This project:is approved with the stipulation that Florida.#1 plant material is installed.

1. All on-site water, sewer and lift station shall be owned and operated by the applicant, his
successors or assigns.
2. Owner should have ba.ckflow prevention assembly certified by Collier County Cross
Connection Control Section prior to preliminary acceptance of any water main, and tested on
an annual basis by a certified AWWA backflow prevention device technician with results
submitted directly to the Collier County Utilities Water Operations Director. Failure to meet
the requirement for the annual certification will result: in termination of water service.
Should the back:flow prevention device fail for any reason, the developer is required to have
the backflow prevention device repaired. immediately.
3. Representatives of the Utilities Division Operations Department and the Compliance Section,
Development Services Division are to meet with your office and the Contractor for a
pre-con st:ruction conference. Scheduling can be arranged by contacting Clyde Fugate at
643-8417, or Randy Casey at 643-8418:. Advise in writing with 48 hours notice of time and
date. Conference shall be conducted at the Development Services Building,.
4. Inspections during construction required by the Collier County Utilities Division.,that must be
coordinated by the Operations Department are listed below. Scheduling of date,time,
method and material can be arranged by calling 434-5050 with a minimum of 48 hours
written notice.
a) Usage of water from the District water facilities for filling, :flushing and testing
purposes. Prio•approval of time and method of usage is mandatory.
b) Flushing;,using.approved methods and materials for all water mains.
c) Bacteriological sampling,of all water mains.
d) Testing, clearance and certification of backflow device.
5. Inspections during construction required by the Utilities Division, that must be coordinated
through the Compliance Services,are listed below. Time: and date can be arranged by calling
Clyde Fugate at 643-8417 or Randy Casey at 64:3-8418. A minimum of 48 hours written
notice is required to arrange scheduling.

6. Prior to the conveyance of documents for acceptance by the Board of County Commissioners,
the following shall occur.

7. All inspections of the completed utility work prior to the conveyance shall be coordinated
through the Compliance Service with a 48 hour written notice requesting the facility
inspection.
8. Prior to the issuance of Certificates of Occupancy and/or final acceptance of this project into
the County system,the following shall be completed:
a) Actual field testing of water mains for domestic and fire flow demands, shall occur.
Final approval and acceptance of the prcject is contingent upon joint approval by the
applicable Fire Control District and the Utilities Division.
9. This project shall require a water meter 2" or less to be set by the County Utilities Division
on existing main. The meter may be set prior to board acceptance of utilities. Certificate of
occupancy will be withheld until such time as utilities facilities have been. accepted.
10. Attached is a copy of the Utilities Division check list which indicates the items which must
be submitted upon completion of the proposed utiility facilities for acceptance by the Board of
County Commisso:ne:rs. Also attached are one(1) each of executed DER]Drinking Water
Distribution System and Wastewater Collection/Transmission System General Permit
Applications.
11. Approval of the construction drawings as shown does not constitute approval of the meter
sizing as shown. The Utility Division shall size the meters at time of application.
12. if there are any changes made to the approved construction plans by the I)EP, the changes
shall be resubmitted to ERS for a.ddit:ional review and approval.
