III. Approval of Minutes from November 1, 2017 Meeting
Mr. Valle moved to approve the minutes of the November 1, 2017 meeting as presented. Second by
Mr. Mulhere. Carried unanimously 9 - 0.

IV. DSAC Position Vacancy Review & Vote

Mr. Valle moved to recommend the Board of County Commissioners appoint Clay Brooker to the
Development Services Advisory Committee. Second by Mr. Foley. Carried unanimously 10 – 0.
2. Re-appoint Chris Mitchell Category: Engineer
Mr. Valle moved to recommend the Board of County Commissioners appoint Chris Mitchell to the
Development Services Advisory Committee. Second by Mr. Mulhere. Carried unanimously 10 –
0.
3. Re-appoint James Boughton Category: Architect
Mr. Mulhere moved to recommend the Board of County Commissioners appoint James Boughton
to the Development Services Advisory Committee. Second by Mr. Foley. Carried unanimously 10
– 0.

A. Emergency Fee Schedule [Jamie French] (this item was heard after item IV.)
Mr. French presented the Executive Summary “Recommendations to approve targeted reductions
in the Collier County Growth Management Department Services Fee Schedule related to application
and plan review fees in the event of a Board of County Commissioners – declared disaster” dated
December 6, 2017 for consideration. He noted:
• The Board of County Commissioners requested Staff to develop a policy for reducing
building fee applications for residential building repairs during times of emergency events.
• Staff developed a draft of the policy and met with the Subcommittee who provided input on
the proposal.
• Based on the input, Staff finalized the draft and the policy would include future emergency
events.
Mr. Mulhere moved to recommend the Board of County Commissioners approve targeted
reductions in the Collier County Growth Management Department Services Fee Schedule related

to application and plan review fees in the event of a Board of County Commissioners – declared
disaster. Second by Mr. Valle. Carried unanimously 11 – 0.

VI. Staff Announcements/Updates
A. Code Enforcement Division update – [Mike Ossorio]
Mr. Ossorio provided the report “Code Enforcement Division Monthly Report October 22, –
November 21, 2017 Highlights” for information purposes. He noted Staff continues community
outreach activities including events such as toy or food drives at St. Mathews, Salvation Army, meet
and greets, etc. and has been participating in training courses for hurricane events.
B. Public Utilities Division update – [Tom Chmelik or designee]
Mr. Fey reported:
• The final day for curbside collection of debris related to Hurricane Irma will be December
15th at which time residents will be required to begin utilizing regular curbside debris
disposal in accordance with County policy.
• On December 22nd, the County’s public “drop off” locations for debris will close.
• The estimate of debris removed as a result of the storm is currently 4.2M cubic yards.
• The County’s acquisition of Golden Gate City’s FGUA (Florida Governmental Utility
Facility) is slated for March 1, 2018.
• The Utilities Subcommittee discussion group will meet on December 19th at 3:00pm.
Ms. Spurgeon DeJohn arrived at 3:14pm.
C. Growth Management Department/Transportation Engineering and/or Planning – [Jay Ahmad
or designee]
Ms. Lantz provided a PowerPoint “Pine Ridge Corridor Congestion Study” which outlined options
for improvements to the Pine Ridge Road, Livingston Road, I-75 interchange corridor area. She
noted:
• The concepts under consideration for improvements at the intersection of Livingston Road
and Pine Ridge Road include an overpass, jug handle or continuous flow traffic operation.
• A “Divergent Diamond” layout is under consideration for the I-75 interchange area.
• The goal would be to reduce conflict points and enhance public safety with the work
including improvements for bicyclists and pedestrians.
• The extension of Whooperwill Lane to Livingston Road is also under consideration and the
County will be seeking input from the public on the proposals.
• The final decisions for the improvements will also factor in right of way constraints and
cost/benefit of the various concepts.
D. County Fire Review update – [Shar Hingson and/or Shawn Hanson]
Ms. Hingson reported site plan reviews are at a 2 day turn around and building plan review is at a 3
day turn around. Continuing education classes are scheduled for 12/18/17; 1/9/18; 2/6/18 and
4/17/18.

E. North Naples Fire Review update – [Dale Fey]
Mr. Fey reported in November plan reviews were completed at an average of 7 day turn around and
inspections are currently conducted in a 1 – 2 day timeframe.
F. Operations & Regulatory Mgmt. Division update [Ken Kovensky]
Mr. Kovensky submitted the “Collier County November 2017 Monthly Statistics” which outlined
building plan and land development review activities. The following was noted during his report:
• November 2017 generated 4,700 permit applications and the County is attempting to identify
those related to storm damage.
• Electronic permitting now accounts for 45 percent of applications.
• Inspections averaged 877/day in November 2017.
• The Florida Building Code changes will require the County to close down their internet
portal beginning on 12/29/17 at 5:00pm so Staff may address any changes required to the
platform.
• The County is implementing a new credit card security system on December 15th.
G. Development Review Division update [Matt McLean]
Mr. McLean reported the task force which reviews internal processes and levels of services will be
meeting in 2018. The participants will include Staff, representatives of the Collier Building
Industry Association, consultants, etc.
VII. New Business
A. DSAC recommendation for 2017/2018 LDC Amendments [Jeremy Frantz]
Mr. Frantz presented the Memorandum “DSAC Recommendation for 2017/2018 LDC
Amendments” dated November 29, 2017 for consideration. The Memorandum included the
proposed amendments and an analysis on the rationale for the changes. He noted they were
reviewed by the DSAC Land Development Review Subcommittee who provided input on the
proposals and recommended the proposed amendments be adopted per their discussions.
Mr. Brooker, Chairman of the Subcommittee reported the changes mainly consist of clarifications
and updates to the existing Land Development Code.
Mr. Brooker moved to recommend the Board of County Commissioners adopt the amendment
proposed to Section 4.02.06 (PL20160003642) which adds an exemption to standards for
development in airport zones. Second by Mr. Foley. Carried unanimously 11 – 0. Mr. Mulhere
abstained.
Mr. Brooker moved to recommend the Board of County Commissioners adopt the following Land
Development Code amendments:
• Section 2.03.08: Modifications to the RFMUD and Rural Fringe Areas Map.
• Section 2.03.08 & 3.05.07: Modifications to the provisions of the NBMO.
• Section 4.02.14: Modifications to the Big Cypress ACSC and 5 zoning maps.
• Section 6.01.05: Requiring soil erosion and sediment control Best Management Practices for
1&2-family, townhouses, and underground utility construction.
• Section 4.03.04: Clarifying Procedures for Lot Line Adj. and Lot Splits.
• Section 10.01.02: Clarifying criteria for EWAs.
• Section 10.02.13 & 10.03.06: Clarifying PDI approval process.

• Section 2.03.07, 4.02.01, 4.02.03, 4.02.04 & 4.02.06: Clarifying dimensional standards for
accessory buildings and structures.
• Section 10.02.09: Removing limits on texts amendments to the LDC.
• Section 9.04.04: Establishing an exception from an Administrative Variance for Minor After-
the-Fact Encroachments.
• Section 2.03.03 & 2.03.04: Establishing martial arts, gymnastics, and dance as permitted
uses in C-3 zoning district.
• Section 1.08.02 & 9.03.03: Re-codifying definition for “nonconforming lot of record.”
Second by Mr. Mulhere. Carried unanimously 12 – 0.
VIII. Old Business
B. LDC amendment to preservation standards and Conservation Collier land donations [Jeremy
Frantz]
Mr. Frantz presented the Memorandum “LDC amendment to preservation standards and
Conservation Collier land donations” dated November 29, 2017 for information purposes. He noted
the proposed amendment was pulled from the Board of County Commissioner’s December 12, 2017
Consent Agenda and will be reviewed as a discussion item. Staff will be making a presentation
which will include recommendations on the proposed amendment developed by the various advisory
boards including the DSAC.
Committee discussion occurred on whether any further recommendations should be provided to the
BCC.
The Committee determined no further recommendations are required, however requested Staff to
relay the concern the final contents of the proposed amendment are far beyond the original scope
of proposed amendment which was to ensure adequate funds remained into perpetuity for
maintaining lands held in the Conservation Collier program.
Mr. Foley left at 4:00pm
C. Chapter 1 Amendments for the new 6th Edition [Jon Walsh]
Mr. Walsh provided a draft of the amended County ordinance intended to address changes to the
Florida Building Code effective December 31, 2017. The changes are intended to provide
clarifications and updates to the existing ordinance and Staff will be allowed to close out any permit
that has been “open” for greater than 10 years as long as it is not deemed a life safety issue.
The Committee recommended the language for the 10 year “close out” allowance ensure the
permit in question may not be “fire related” and reference any fire codes as necessary.
Mr. Walsh reported he would be returning with the draft for additional comments at a future
meeting.

The Committee determined to cancel the regularly scheduled January 2018 meeting.

1. Call to order
Mr. Brooker called the meeting to order at 3:00pm
2. Approve agenda
The Subcommittee approved the Agenda as presented.
3. Approve June 21, 2017, meeting minutes
Mr. Schiffer moved to approve the minutes of the June 21, 2017, meeting as presented. Second
by Mr. Mulhere. Carried unanimously 3 – 0.
4. Review of LDC amendments
a. Section 4.02.06: Privately Initiated Amendment to Standards for Development in Airport
Zones.
Robert Mulhere introduced the amendment noting it is privately initiated to address an
application in the Mini-Triangle project.
Change: To expressly identify an exemption (applicable to the Mini-Triangle project) to the
LDC Airport Zone height limitations, generally utilizing the same format previously used
to identify an exemption for the Marco Shores Golf Course Community, and to renumber/reformat
the related paragraphs.
Reason: The proposed amendments are necessary to reflect the height exemption (from the
applicable Airport Zone building height limitations), so anyone utilizing the LDC to determine
limitations for properties within the designated “Airport Zones” would see the Mini-Triangle has a
limited exemption (from the height limitations) and would understand the need to review the
referenced ordinance number for the Mini-Triangle MPUD to determine the exact nature of the
exemption.
Mr. Mulhere reported:
The proposed amendment is consistent with the current exemption for the Marco Shores
Development.
The proposed amendment is consistent with recommendations by Staff including the
County Attorney’s office.
The FAA has issued a “Determination of No Hazard” for the proposed project.
The Naples Airport Authority supported the project once the FAA letters were received.
One of the existing cell phone towers located on site is 196 feet high, taller than the height
of the proposed structures.
The Mini-Triangle Project is generally located at the intersection of U.S. 41, Davis
Boulevard, and Commercial Drive.
He is abstaining from voting on the item and has filed the necessary documentation, Form
8B, memorandum of voting conflict with Staff.
Mr. Booker suggested the applicant to look at the agreement between Johnson Bay Development
Corporation, Collier County Airport Authority, and the BCC, dated August 8, 1995, mentioned in
the exemption for the Marco Shores Development, to determine if there were any additional
changes that may need to be addressed by this amendment.

Mr. Schiffer moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment. Second by Chairman Brooker.
Carried unanimously 3 – 0. Mr. Mulhere abstained.
* Mr. Foley arrived at 3:35pm, after preliminary discussion of the item had taken place. The item
was “recapped” for his benefit and the official vote was taken at this time.
b. Section 2.03.08: Modifications to the RFMUD and Rural Fringe Areas Map.
Mr. Weeks presented three proposed amendments and reported all of these Items b, c, and d are
“housekeeping items” to clarify sections of the code for consistency with a GMP amendment that
removed a property from the Rural Fringe Mixed Use District.
SUMMARY: To modify provisions related to the Rural Fringe Mixed Use District and the Rural
Fringe Areas map for clarity and compatibility with the Growth Management Plan (GMP).
Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment. Second by Mr. Schiffer. Carried
unanimously 3 – 0.
c. Sections 2.03.08 & 3.05.07: Modifications to the provisions of the NBMO.
SUMMARY: To modify provisions related to the North Belle Meade Overlay specific only to
Section 24, Township 49 South, Range 26 East, for compatibility with the Collier County Growth
Management Plan (GMP).
Mr. Mulhere asked for clarification regarding the reference to a settlement. Mr. Weeks responded
that the amendment references a partial stipulated settlement that is related to an agreement with
the Department of Economic Opportunity (DEO).
Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment. Second by Mr. Schiffer. Carried
unanimously 3 – 0.
d. Section 4.02.14: Modifications to the Big Cypress ACSC and 5 zoning maps.
ZONING MAPS: 522930, 2033N, 2033S, 2034N, 2034S
Mr. Weeks presented the amendment stating that an administrative rule exempted these areas in
the 1970’s and this exemption was recently discovered by Staff.
Mr. Mulhere asked whether any property owners have been impacted. Mr. Weeks stated that the
four sections are owned by the State.
SUMMARY: To modify provisions related to the Big Cypress Area of Critical State Concern
(ACSC) and five zoning maps within Township 52 South, Range 30 East, in order to ensure
consistency with the Growth Management Plan (GMP).

Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment. Second by Mr. Schiffer. Carried
unanimously 3 – 0.
e. Section 6.01.05: Requiring soil erosion and sediment control Best Management Practices for
1 & 2-family, townhouses, and underground utility construction
Mr. Henderlong presented the proposed amendment and introduced staff members from
Stormwater Management and Pollution Control who are present to answer any questions.
SUMMARY: The amendment proposes to include Best Management Practices (BMPs) for soil
erosion and sediment control to developments such as single-family, two-family, townhouse
structures and underground construction activities.
Mr. Schiffer asked what types of BMPs would prevent the issues presented in the amendment.
Mr. Preston answered that any method that works may be used, including hay bales, sediment
fences or construction phasing.
Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment subject to Section 6.01.05.B.3 reading
“Debris generated on site, including but not limited to building materials, concrete truck wash
out…”. Second by Mr. Schiffer. Carried unanimously 3 – 0.
f. Section 4.03.04: Clarifying Procedures for Lot Line Adjustments and Lot Splits.
Mr. Henderlong presented the proposed amendment.
SUMMARY: The amendment clarifies the review and timely recording procedure for both
lot line adjustments and lot splits, and clarifies that lot splits are applicable in all zoning districts.
Subcommittee discussion occurred on:
Section 4.03.04 A – The requirement to file the lot line adjustment or lot split with the
County Clerk’s office within 12 months of approval. Concern was expressed the time
frame may be too long and consideration could be given to shortening it.
Section 4.03.04 A – Removing the word “specifically" from line 3 of Section 4.03.04.A.
Section 4.03.04 A – The first sentence is long and may be confusing and could be revised
for grammar and clarity.
Mr. Foley arrived at 3:35pm
Staff reported they would research the timeframe for filing with the County Clerk and report
back to the DSAC when the item is heard. Staff will also make corrections to the narrative that
currently states lot splits and lot line adjustments are limited to the Rural Agricultural (A) and
Estates (E) zoning districts.
Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment subject to staff reviewing the
rationale for the 12-month requirement referenced above and reporting back to the full

Committee; Section 4.03.04 A to read “Generally. Only lot line adjustments or lot split requests
meeting the applicable land development regulations, including the minimum lot area and
dimensions…” and; the first sentence in Section 4.03.04 A to be broken up for grammar and
clarity. Second by Mr. Schiffer. Carried unanimously 4 – 0.
g. Section 10.01.02: Clarifying criteria for Early Work Authorizations.
Mr. Henderlong presented the proposed amendment, stating it is a clean-up item from a change to
the process that occurred in 2006.
SUMMARY: The amendment proposes to remove the requirement for a determination of legal
sufficiency for an Early Work Authorization (EWA) permit agreement.
Mr. Brooker noted that there is a repeated paragraph in the narrative.
Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of
County Commissioners adopt the proposed amendment subject to removing the duplicate
paragraph (starts “Since 2005, EWA….”) from the introduction. Second by Mulhere. Carried
unanimously 4 – 0.
h. Section 10.02.13 & 10.03.06: Clarifying Planned Unit Development Insubstantial Change
approval process.
Mr. Frantz presented the proposed amendment, noting the amendment was generated due to a
Board of County Commissioners directive to ensure the County complies with the Florida Statutes.
The proposal includes any necessary amendments to the Administrative Code.
SUMMARY: The amendment adds a requirement for PUD insubstantial changes (PDIs) and
PUD minor changes (PMCs) to be heard by the Board of County Commissioners (Board) to
approve the ordinance amendment.
The Subcommittee discussed the process of approval of ordinances and Mr. Bosi clarified that the
CCPC and HEX approve the ordinance amendment, and the BCC affirms the amendment.
Mr. Schiffer moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment and Chapter 3, Section G.3 and G.4
(or any others as necessary to fulfill the requirements) of the Administrative Code. Second by
Mr. Mulhere. Carried unanimously 4 – 0.
i. Sections 2.03.07, 4.02.01, 4.02.03, 4.02.04 & 4.02.06: Clarifying dimensional standards for
accessory buildings and structures.
Mr. Frantz presented the proposed amendment, stating it began in response to a variance hearing
but staff has also added changes to improve the usability of the two existing tables.
SUMMARY: To reorganize the dimensional standards tables for accessory structures to clarify
several provisions and highlight swimming pool and screen enclosure setbacks.
Staff noted that a change to the structure to structure setback was described in the amendment
narrative, but was not recorded in the amendment.

Subcommittee discussion occurred on the rationale for allowing an exception to setbacks for
generators rather than modifying the setback itself. It was discussed that the table should identify
the general setback for the use first as “SPS,” and then provide exceptions for certain
circumstances. However, it was determined that the exception could be noted differently in the
table.
The Subcommittee recommended the following changes:
1. Revise the reference to davits, hoists and lifts from “SPS” to “None.”
2. Provide a footnote within applicable sections of the table and an explanation within the table

j. Section 10.02.09: Removing limits on texts amendments to the LDC.
Mr. Frantz presented the proposed amendment.
SUMMARY: The amendment proposes to modify the number of times amendments to the Land
Development Code (LDC) may be made.
Staff noted the proposal is to remove the two times a year limit that amendments may be proposed.
The proposal includes amendments to the Administrative Code as well, which was not previously
identified in the narrative.
The Subcommittee requested Staff to contact the County Attorney’s office to ensure the proposal
is compliant with State Statutes. The Subcommittee also requested Staff research why the
original limit was in place.
Mr. Foley suggested considering whether the ability to request a waiver from the pre-application
meeting requirement in the Administrative Code should be identified.
Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of
County Commissioners adopt the proposed amendment and those proposed to Chapter 2,
Section B (or other as necessary to fulfill the requirements) of the Administrative Code. Second
by Mr. Mulhere. Carried unanimously 4 – 0.
k. Section 9.04.04: Establishing an exception from an Administrative Variance for Minor After-
the-Fact Encroachments
Ms. Summers presented the proposed amendment, and clarified that the exemption does not apply
to foundations that encroach on required yards.
SUMMARY: To create an exception from the requirement to pursue an Administrative Variance
for residential structures with setback encroachments of three inches or less that result from the
application of exterior wall treatments.

l. Sections 2.03.03 & 2.03.04: Establishing martial arts, gymnastics, and dance as permitted
uses in C-3 zoning district.
Mr. Bellows presented the proposed amendment, stating that this amendment addresses common
questions from the public by codifying an existing staff memo.
SUMMARY: The amendment proposes to clarify “martial arts” and “ dance, gymnastics, judo,
and karate instructions,” as permitted uses in the C-3 and Industrial zoning districts where physical
fitness facilities are also permitted uses. It clarifies “outdoor” amusement and recreation services
are conditional uses in the C-3 zoning district and reinstate an omitted Standard Industrial
Classification Code in the C-4 zoning district.
Mr. Schiffer moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment. Second by Mr. Mulhere. Carried
unanimously 4 – 0.
m. Sections 1.08.02 & 9.03.03: Re-codifying definition for “nonconforming lot of record”
Mr. Bellows presented the proposed amendment.
SUMMARY: To reinstate the definition for a “nonconforming lot of record” as previously
codified by Ordinance 91-102 and amended by Ordinance 99-6.
Staff reported the amendment is to clarify ambiguities in the types of non conformity.
Mr. Brooker asked for clarification regarding the removal of the language proposed to be
removed which said, “except as my then be allowed by this Code.” Staff responded that the
language could be retained.
Mr. Mulhere asked for clarification regarding the effective date of this Code.” Mr. Bellows
responded that this language sometimes refers to a date in 1974. The Subcommittee suggested that
staff contact the County Attorney’s Office to determine any language changes that may be required
to clarify the “effective date of this Code” references contained in the proposed amendment.
The Subcommittee reviewed the proposed amendment and recommended the following changes:
1. Correct two typos in the narrative.
2. Section 9.03.03A.4 – reinsert the language proposed to be removed “except as may then be
allowed by this Code.”
3. Use the appropriate date rather than the phrase “effective date of this Code.”
Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board
of County Commissioners adopt the proposed amendment subject to the recommendations listed
above. Second by Mr. Schiffer. Carried unanimously 3 – 0.

Mr. Brooker enquired as to the latest Board action and timing of the moratorium on medical
marijuana dispensaries. Staff noted that the Board directed staff to extend the moratorium for an
additional six months and monitor whether the Legislature provides local governments with the ability
to regulate dispensaries. Mr. Brooker noted that extending moratoriums beyond one year can be
problematic legally.
There being no further business for the good of the County, the meeting was adjourned by the order
of the Chair at 4:25PM.
