WHEREAS, Frederick E. Hood, AICP of Davidson Engineering, Inc. representing Eagle
Creek Golf & Country Club, Inc., petitioned the Board of County Commissioners of Collier
County, Florida, to amend Ordinance 96-79, the Eagle Creek PUD, as amended.
WHEREAS, prior to 1996, the Board of County Commissioners adopted Ordinance Nos.

The purpose of this Section is to set forth the regulations for the area designated on the

SECTION FOUR: Repeal of prior Ordinances.
This Ordinance supercedes and repeals Ordinance Nos. 81-4, 81-114, 82-53 and 85-8,
except to the extent a structure was previously constructed in accordance with a prior ordinance,
it may remain as a conforming use according to those regulations.
SECTION FIVE: Effective Date.
This Ordinance shall become effective upon filing with the Department of State.

APPLICATION NUMBER: PUDA-20170001320 Review 3
APPLICATION NAME: Eagle Creek Planned Unit Development (PUD) Amendment
REQUEST. To amend Eagle Creek PUD, approved via Ordinance #96-79, to change a land use
designation of a portion of Tract B from Residential to Golf Course; creating a new sub -tract `H-1' by
converting a portion of Tract B2 and B3. Golf Course uses will allow: Golf Course, Golf Course Driving
Range, Short Game Practice Area, Golf Course Maintenance Areas (no vertical structures permitted), and
Water Management. Submittal 3 included a more legible Master Plan, as requested by County Staff.
The Eagle Creek Updated Master Plan shows a decrease of Residential acreage by ±0.5 for Tract 'B-2',
with a revised total of 98.0 Residential acres. The Golf Course acreage on the Updated Master Plan shows
a ±0.5 acre reduction on Tract "H" and a ±1.0 acre increase with the newly created Tract `H-1'. The total
number of acres shown on the Updated Master Plan are ±298.0 acres, which is the same number of total
acres approved via Ordinance #96-79.
The second submittal of this petition updates the Master Plan for additional clarity and shows a revised
date, the text shows the exact acreage of 1.14 acres for Tract `H -P, and the Master Plan reflects the 1.14
acres in the Project Summary and depicts the exact location of Tract `H-1'.
LOCATION: The (298.0 -acres Eagle Creek PUD property is located on the west side of Collier Blvd.
(CR 95 1) and abuts the southern boundary of the Shoppes at Eagle Creek, approximately 900 feet south of
Tamiami Trail East (US 41), in Section 3 and 4, Township 51 South, Range 26 East. The I -acre subject site
(Tract `H-1') of this PUDA is located approximately in the center of the Eagle Creek PUD.
COMPREHENSIVE PLANNING COMMENTS: The subject property, containing approximately
±298.0 acres, is designated Urban, Urban Mixed -Use District, Urban Coastal Fringe Subdistrict and within
the Coastal High Hazard Area (CHHA), as depicted on the Future Land Use Map of the Growth
Management Plan. According to the Future Land Use Element (FLUE), the Urban designation areas will
accommodate a variety of residential and non-residential uses, including recreational uses (such as golf
courses).

According to the FLUE, "The purpose of this Subdistrict is to provide transitional densities between the
Conservation designated area (primarily located to the south of the Subdistrict) and the remainder of the
Urban designated area (primarily located to the north of the Subdistrict)."
Section 2.07 Permitted Variations of Dwelling Units in Ordinance #96-79 stated, "Permitted residential unit
types may be mixed within Residential Tracts provided that total number of dwelling units shall not exceed
470." This equates to a density of approximately 1.58 dwelling units per gross acre (470 dwelling units
/298 acres = 1.577 DU/A). The PUD is eligible for 3 DU/A (base of 4 DU/A less 1 DU/A for lying within
the CHHA = 3 DU/A). Since this PUDA does not increase or decrease the number of total acres or the
number of requested dwelling units, no change is proposed to the Eagle Creek PUD density. The Eagle
Creek PUD is essentially built -out.
Select FLUE Policies are given below, followed with [bracketed staff analysis].
FLUE Policy 5.4
"New developments shall be compatible with, and complementary to, the surrounding land uses, as set
forth in the Land Development Code (Ordinance 04-41, adopted June 22, 2004 and effective October 18,
2004, as amended). " [It is the responsibility of the Zoning and Land Development Review staff, as
part of their review of the petition in its entirety, to perform the compatibility analysis+
FLUE Objective 7 and Relevant Policies
Due to the minor changes proposed (no changes in permitted uses, densities, or intensities) beyond the
currently approved Eagle Creek PUD, and because the PUD is essentially built -out, staff is of the opinion
that a re-evaluation of FLUE policies under Objective 7 (pertaining to access, interconnections, walkability,
etc.) is not necessary.
CONCLUSION
Based upon the above analysis, staff concludes the proposed Planned Unit Development Amendment
may be deemed consistent with the Future Land Use Element (FLUE).
