Council in and for the County of Collier, having conducted business herein,
met on this date at 9:00 AM in REGULAR SESSION in Building "F of the
Government Complex, East Naples, Florida, with the following members

The meeting was called to order by Commissioner Donna Fiala at 9:10
AM. Pledge of Allegiance was recited.
Roll Call - a quorum was established with Mr. Galleberg, Ms. Becker,
Mr. Tucker, and Joe Dinunzio being excused.
Changes & Approval of Agenda
VI. 1-with no public access to Hideaway Beach Jack Wert suggested
postponing the designation and recommendation from the TDC until that
designation is in place. Would like to have discussion at a later date when
there is eligibility for the project.
Under New Business - add "Review of the Category Grant Application"
Ms. Saunders moved to approve the Agenda as amended. Second by
Mr. Dictor. Carried unanimously 5-0.

Ms. Saunders moved to approve the Minutes of December 22, 2003.
Second by Mr. Dictor. Carried unanimously 5-0.
Staff Reports
1. Directors Report - Jack Wert - gave report as follows: (Attached)

· Will attend show in Washington DC
· Official 2004 Visitors Guide will be ready soon
· Trade Show Booth was a success with rave reviews and will be
displayed at the Inn on 5th on January 29th.
· Tourist tax continues to show growth - up 3% from 2002 (highest on
record)
· The golf market continues to be lucrative.

· Trade Show Booth has drawn many

· Working with Hooters Airline developing packages/promotions
· Continue with Group leads - reunions etc.

Approx. $34,000 was spent on the Booth with $10,000 funded by the
Collier County Lodging Association.

IV. Category "A" Beach Projects - Ron Hovell Public Utilities Engineering Dept.
1. Hideaway Beach Designation as Vital Tourism Area Subject to Abnormal
Erosion - Mr. Wert mentioned it may not be the time to do a
recommendation at this time but to have discussion relating to the subject as
the CAC did designate Hideaway Beach as a vital tourism area with a caveat.
Mr. Hovell stated the Coastal Advisory Committee recommended that
Hideaway Beach be designated a vital tourism area subject to abnormal
erosion. They will need to meet the "funding policy" - paragraph 4 "a" in
"eligibility" addressing at least one public access point from a public street, and 4
"b" talking about beach park facility or that a vital tourism area subject to
abnormal erosion. He asked if they want to deal with the subject as one issue or
an overall budget issue. Staff feels they should package it all together before
taking it to the Board of County Commissioners.
SPEAKER
John Arceri - representing the City of Marco Island
He discussed the two requirements for Hideaway to be eligible and mentioned the
designation of it being a tourism area subject to abnormal erosion does not make it
eligible for any funds. The other is a need to put in a separate pathway. With the two it
would be designated as a low use beach and would be subject to partial funding. He was
surprised that the TDC wasn't going to consider it. The City of Marco does realize they
need a pathway. Hideaway needs to take some measures of voting and setting up special
taxing district to allow the City of Marco to collect tax funds from Hideaway as their
contribution to the renourishment project. If the TDC did not declare Hideaway eligible
under the criteria of "vital tourism area subject to abnormal erosion" there would be no
reason to proceed with the pathway or the special taxing district. He did not want to go
back to the City of Marco and explain why the process is not moving forward at this time.
The TDC would just be making a declaration that Hideaway Beach is a vital tourism area
subject to abnormal erosion. The decision does not make Hideaway eligible for a dollar
amount of funding, but to let everyone know there is support for designation.

Mr. Dictor stated he concurred with Mr. Arceri and assumed there are professional
studies presenting facts and felt they should proceed and vote on the declaration put
before them.
Ms. Saunders wanted to know if voting on the subject would lock them into any funding
issues at this time. (It would not)
Commissioner Fiala stated she would hate to stop moving forward with the pathway
being installed if they did not vote on the declaration.
Mr. Loving discussed the situation of Sand Dollar Island and taking sand from one area
to another.
Mr. Durkin stated the answers are not all there and would be more comfortable when all
the answers are before them.
Mr. Loving stated this is a step in the fight direction. A lengthy discussion pursued
concerning the access.
Heidi Ashton - Assistant County Attorney - asked the members to look at their packet
concerning the eligible policy under Section 4 - Eligibility - "eligible beach area has at
least one public access point from a public street and is no more than one-half mile from
a beach park facility, public access point, hotel, motel or is a vital tourism area subject to
abnormal erosion." By designating it as a vital tourism area, Hideaway Beach would
quality if it has at least one access point and is a vital tourism area. Wouldn't be
requiring it to be a half mile from a beach park facility.
More discussion followed with stating the motion needs to be very specific. They are
only designating it as a vital tourism area, and need the public street access in order for it
to be eligible. They are adopting a policy only and not to commence work.
Mr. Dictor moved to designate Hideaway Beach as a vital tourism area subject to
abnormal erosion. Second by Ms. Saunders.
The motion and second was amended to include "the public access".
Carried 4-1. Mr. Durkin voting "no".
Hideaway Beach Monitoring - 2004 Engineering Services
Proposal has been submitted by Humiston & Moore for engineering
services for approx. $85,000 to conduct the permit required 7th year
monitoring.
Ms. Saunders moved to approve the $85,252 as a work order to be
issued to Humiston & Moore engineers. Second by Mr. Dictor.
Carried unanimously 5-0.
3. County/City of Naples Public Information Program - Phase 2 Proposal

Proposal submitted by Coastal Planning & Engineering for developing and
maintaining a website during their renourishment program as part of Phase
2. This is for public information and the amount of meetings were
discussed. The amount is $56,474.
Heidi Ashton - Assistant County Attorney - had some concerns with
the item in question, and at a minimum, they would have to make a
finding that this qualifies as finance for beach improvement or restoration.
As part of the permitting project it is customary to have public information
meetings. Her concern is with the website and media exposure because
there is no funding for operational and promotional activities under this
Category. The details will be worked out with Mr. Wert and herself
before it goes to the BCC.
Ms. Saunders stated it sounds like a great PR program but doesn't see a
need for it. Staff is more qualified than Coastal Planning representatives
and they can contact Naples Daily News and let them know about the
project.
Ms. Saunders moved to deny the work order for the updating on
public information for the County/Naples Major Renourishment
Phase 2 Proposal. Second by Mr. Durkin. Carried unanimously 5-0.
Information Items

Submitted the permit application, received first request for
additional information and working on resubmitting. Mr. Hovell
covered some of the different items of information that is needed.
Monthly updates will be given. Permits could be issued close to
October.

Beginning to apply the mandatory items listed in the policy.
Reserves line - major renourishment reserves and Vanderbilt Parking
Garage was discussed.

All interest goes to the General Fund
Discussion followed on eamings for the Beach Reserves staying in the
Beach Reserves account to keep up with inflation. There were issues with
Mr. Brock's office, but not sure it was with this particular account. Heidi
Ashton will check and give a report at the next meeting.

Review Category "A" Grant Applications
- The grant application form was reviewed and will be used for the new
season. It was suggested to add "monitoring."
Mr. Dictor moved to approve the grant application form with the
suggestion of adding "monitoring." Second by Ms. Saunders.
Carried unanimously 5-0.

Announcements - Workshop will be held at 1:00 PM in Building "H"
Second floor, 216 conference Room.
