EXECUTIVE SUMMARY
Recommendation to accept the conveyance of two Drainage Access and Maintenance Easements
for the SR-29 Drainage Canal. Fiscal Impact: $55.40.
OBJECTIVE: To accept the conveyance and record in the public records two Drainage Access and
Maintenance Easements conveyed to Collier County by Collier Land Holdings Ltd. and CDC Land
Investments, Inc. (“the entities”) that will allow the perpetual maintenance of the drainage canal that runs
along the easterly right-of-way of State Road (SR) 29.
CONSIDERATIONS: Collier County and the South Florida Water Management District (SFWMD)
will soon be entering into an agreement providing for reimbursement to Collier County for one half (1/2)
of the cost of maintaining the SR-29 Drainage Canal. The easements being conveyed to Collier County
by the entities cover approximately five (5) miles of the SR-29 Drainage Canal. These easements are
being granted with the understanding that they will be publicly maintained for proper drainage. Should
the County and the SFWMD fail to maintain the drainage in these easements, the property owner expects
the encumbrance to be removed.
Access and Maintenance Easements were previously recorded in the Official Records of Collier County,
Florida in OR Book 5385 at Page 1974, et seq., and OR Book 5385 at Page 1978, et seq. However, these
easements did not include the required drainage provision. The new easements will supersede and
replace the previously recorded Access and Maintenance Easements.
FISCAL IMPACT: The estimated fiscal impact associated with the approval of this item is $55.40 in
recording fees and documentary stamp taxes. Funds are available in the Transportation Services Fund
(101) Aquatic Maintenance cost center. The annual maintenance costs estimated between $60,000 and
$80,000, depending on the rate of vegetation growth and rainfall.
A recommendation to approve an Interlocal Agreement between the SFWMD and Collier County setting
forth the terms of the sharing of costs to maintain a portion of the SR-29 Drainage Canal will be brought
to the Board of County Commissioners (Board) at a later date.
GROWTH MANAGEMENT IMPACT: This work is consistent with the Drainage sub-element of
the Growth Management Plan. There is no Growth Management Impact associated with this item.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval . - ERP
RECOMMENDATION: 1) To accept the conveyance of said Drainage Access and Maintenance
Easements, which supersede and replace those certain Access and Maintenance Easements recorded in
the Official Records of Collier County, Florida, in OR Book 5385, Page 1974, et seq., and OR Book
5385, Page 1978, et seq., and 2) to authorize the County Manager or his designee to record same in the
public records of Collier County, Florida.
