CCLAAC Minutes 11/13/2017November 13, 2017 MINUTES OF THE CONSERVATION COLLIER LAND ACQUISITION ADVISORY COMMITTEE MEETING Naples, Florida, November 13, 2017 LET IT BE REMEMBERED, the Conservation Collier Land Acquisition Advisory Committee in and for the County of Collier, having conducted business herein, met on this date at 9:00 A.M. in REGULAR SESSION at Administrative Building "F", 3rd Floor, Collier County Government Complex Naples, Florida with the following members present: CHAIRMAN: VICE CHAIRMAN: Bill Poteet Pat Sherry Tracey Dewrell (Excused) Susan Calkins Michael Seef John Psaras Jacob Winge (Excused) Carol Pratt (Vacancy) ALSO PRESENT: Alexandra Sulecki, Conservation Collier Coordinator, Program Manager Jennifer Belpedio, Assistant County Attorney Christal Segura, Environmental Specialist November 13, 2017 I. Roll Call Chairman Poteet called the meeting to order at 9:OOAM. Roll call was taken and a quorum was established. II. Approval of Agenda Ms. Sherry moved to approve the Agenda. Second by Mr. Seef. Carried unanimously 6 — 0. III. Approval of Minutes a. October 9, 2017 Meeting Minutes Mr. Seef moved to approve the minutes of the October 9, 2017 meeting as presented Second by Mr. Calkins. Carried unanimously 6 — 0. b. October 26, 2017 Special Meeting Minutes Ms. Sherry moved to approve the minutes of the October 26, 2017 special meeting as presented. Second by Mr. Psaras. Carried unanimously 6 — 0. IV. Old Business a. Offsite Preservation LDC Amendment Status Ms. Sulecki reported on December 12, 2017 the Board of County Commissioners will hear the proposed amendment. Recommendations from the Committee, as well as those from the Collier County Planning Commission and Development Services Advisory Committee will be under consideration. V. New Business a. Initial Criteria Qualification - Barron Collier Partnership LLLP — Parcels a. and b. Ms. Sulecki presented the "Barron Collier Properties LLLP parcels a. and b. Initial Screening Criteria " noting: • There are two parcels (Parcel a — 289 +/- acres and Parcel b — 111 acres +/-) associated with the application and five Committee members need to deem the parcels as qualified proposals for them to be moved forward in the acquisition process. • The Critical Lands and Waters Identification (CLIP) project, Florida Natural Areas Inventory (FNAI), University of Florida and Florida Fish and Wildlife Conservation Commission data sets are utilized by Staff to assist in the evaluation. There are 5 criteria that are evaluated during the desktop screening as follows: 1. Are any of the following unique and endangered plant communities found on the property? - YES • Native habitats include pine flatwoods, mixed wetland hardwoods, and shrubs, cypress, cypress mixed hardwoods and others are located on the parcels. 2. Does land offer significant human social values, such as equitable geographic distribution, appropriate access for nature -based recreation, and enhancement of the aesthetic setting of Collier County? - YES • The parcels are 4 miles from Pepper Ranch and in the Immokalee Water and Sewer District who maintains a roadway bisecting parcel which serves their facilities. • "Parcel a" contains a successfully closed unlined landfill that was operated by Collier County from 1947 to 1992. There were 20 years of monitoring successfully completed in 2012. 2 November 13, 2017 • The landfill site is fenced in and continues to be maintained by the County in the form of mowing, etc. • There is a grazing lien through 2018 and hunting lien through 2017 on the parcels as well as right of way easements for the sewer district roadway. Does the property offer opportunities for protection of water resource values, including aquifer recharge, water quality enhancement, protection of wetland dependant species habitat, and flood control? — YES • Hydric soils are mapped over a majority of the property. • The parcels are within the confines of Collier County wellfield protection zones and "Parcel a" is adjacent to mitigation lands. 4. Does the property offer significant biological values, including biodiversity, listed species habitat, connectivity, restoration potential and ecological quality? - YES • The parcels contain foraging areas for wood stork and habitat for the bonneted bat. 5. Does the property enhance and/or protect the environmental value of current conservation lands through function as a buffer, ecological link or habitat corridor? - YES • The parcels provide ecological links and habitat corridors with Lake Trafford and CREW lands to the west and Florida Panther National Wildlife Refuge and the Okaloacoochee Slough to the east. The property is not within the boundary of another agency's acquisition project. During Committee discussion, the following was noted: • Concern was expressed the Conservation Collier (should they acquire the parcels) could be responsible for any liability associated with the landfill which could have been disposal sites for commercial solvents, petroleum based products, etc. which may pollute aquifers in the future. • It may be beneficial to determine any groundwater monitoring data available before moving the parcel forward in the process. • The area in question is 7 — 8 acres and the County Attorney's office could determine any liability for the program if an issue arises after the acquisition. • A Phase II Environmental Assessment could be conducted if the parcels are moved forward in the process. Mr. Seef moved for the Committee to deem the application a qualified proposal. Second by Ms. Pratt. Motion carried 5 "yes" —I "no." Ms. Sherry voted "no." The Committee recommended Staff determine any information available on any commercial entities that utilized the landfill. b. Initial Criteria Qualification — Mayr and Berman Trust (I-75 Group) Ms. Sulecki presented the "I--75 Project Berman and Mayr. Initial Screening Criteria " noting: • There are two parcels (Berman 2.23 acres and Mayr 6.7 acres) associated with the application and five Committee members need to deem the parcels as qualified proposals for them to be moved forward in the acquisition process. • There are located in the "I-75 project," and area not deemed a multi parcel project, but named to identify the location of the variety of parcels in the area that may be considered for acquisition. November 13, 2017 X. Staff Comments Mr. Segura recognized the Florida Mud Cutters for their recent trail maintenance work at Pepper Ranch. There being no further business for the good of the County, the meeting was adjourned by order of the chair at 10:11A.M.
