PARTIAL RELEASE OF MORTGAGE
THIS PARTIAL RELEASE OF MORTGAGE is given this day of t,N-err -P,.) ,,
2017 by Wilton Land Company, LLC, a Florida limited liability company whose post
office address is 206 Dudley Road, Wilton, CT 06897 (hereinafter referred to as
"Mortgagee"), in favor of COLLIER COUNTY, a political subdivision of the State of
Florida, its successors and assigns, whose post office address is 3335 East Tamiami
Trail, Suite 101, Naples, Florida 34112 (hereinafter referred to as "Collier County").
Mortgagee is used as singular or plural, as the context requires.
WITNESSETH:
WHEREAS, Mortgagee is the owner and holder of that certain Mortgage and
Security Agreement executed by and between Hacienda Lakes of Naples, LLC, a
Florida limited liability company and Wilton Land Company, LLC, a Florida limited
liability company, dated December 27, 2012 and recorded December 28, 2012 in
Official Records Book 4870, Page 268 of the Public Records of Collier County, Florida;
Subordination Agreement recorded June 6, 2013 in Official Records Book 4928, Page
3915; Mortgage Special Assessment Acknowledgement recorded June 27, 2013 in
Official Records Book 4937, Page 3225; Subordination Agreement recorded April 21,
2014 in Official Records Book 5028, Page 1969; Collateral Assignment of Permits,
Contracts and Rights executed by Hacienda Lakes of Naples, LLC, a Florida limited
liability company, in favor of Wilton Land Company, LLC, a Florida limited liability
company dated December 27, 2012 and recorded December 28, 2012 in Official
Records Book 4870, Page 295, of the Public Records of Collier County, Florida; UCC-1
Financing Statement executed by Hacienda Lakes of Naples, LLC, a Florida limited
liability company, in favor of Wilton Land Company, LLC, recorded December 28, 2012
in Official Records Book 4870, Page 306, all of the Public Records of Collier County,
Florida (hereinafter collectively referred to as "Mortgage"), encumbering the premises
legally described therein (hereinafter referred to as the "Encumbered Property");
WHEREAS, Collier County has requested and received from the fee simple owner
of the Encumbered Property a fee simple interest in a portion of the Encumbered
Property, which portion of the Encumbered Property is legally described in Exhibit "A"
attached hereto and incorporated herein by virtue of this reference (which premises are
hereinafter referred to as the "Parcel"); and
WHEREAS, Collier County has requested that Mortgagee release the Parcel from
the lien of its Mortgage to which request Mortgagee has agreed.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Mortgagee does hereby release and exonerate the Parcel from the
lien and operation of its Mortgage, provided however said Mortgage shall remain in full
force and effect except as to the released premises (the Parcel).
IN WITNESS WHEREOF, the Mortgagee has set its hand and seal the date and
