EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20170002997 to disclaim, renounce and vacate the County and the public interest
in the Raw Water Well Easement, located in Tract F of Heritage Bay Vistas Subdivision, Plat Book
50, Page 33 of the Public Records of Collier County, Florida. The subject property is located on the
north side of Bellaire Bay Drive, approximately one third mile east of the Immokalee Road and
Collier Boulevard intersection, in Section 23, Township 48 South, Range 26 East, Collier County,
Florida, and to accept a replacement utility easement.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the Raw Water
Well Easement, located in Tract F of Heritage Bay Vistas Subdivision, Plat Book 50, Page 33 of the
Public Records of Collier County, Florida, located in Section 23, Township 48 South, Range 26 East,
Collier County, Florida, being more specifically shown in Exhibit A, and to accept a replacement
easement.
CONSIDERATIONS: Petition VAC-PL20170002997 has been received by the Development Review
Division from Michelle Salberg, P.E., of Quattrone & Associates, as agent for the property owner,
CPI/Watercrest Bellaire RE LLC. This request is to vacate the Raw Water Well Easement, located in
Tract F of Heritage Bay Vistas Subdivision, Plat Book 50, Page 33 of the Public Records of Collier
County, Florida, located in Section 23, Township 48 South, Range 26 East, Collier County, Florida.
According to the Property Appraiser’s website, CPI/Watercrest Bellaire RE LLC has fee simple title to
the real property where the subject easement is located. The applicant proposes to vacate the existing 110’
x 90’ Raw Water Well Easement on Tract F of Heritage Bay Vistas, and replace it with an approximately
176’ x 85’ utility easement. The Raw Water Well Easement was dedicated to the Collier County Water
Sewer District on the Heritage Bay Vista subdivision plat (Plat Book 50, Page 33). The Board of County
Commissioners (Board), as ex-officio governing body of the District, is authorized to vacate this
easement.
As determined by Collier County Utilities Project Management Division, the proposed replacement
easement will accommodate the County’s future plan for construction of a well site on the parcel, while
meeting all required setbacks. The relocation provides the opportunity for a better designed site plan on
the subject parcel with respect to access and circulation, as well as minimizes the potential impact to the
proposed development from the well site. Additionally, the relocation provides additional buffering
between the well site and adjacent developments and the right-of-way, providing a benefit to the public.
There is no public detriment caused by the vacation because there are no existing facilities within the Raw
Water Well Easement, and a replacement easement has been provided to accommodate f uture facilities
required by Public Utilities. A copy of the replacement easement is attached hereto and will be recorded
upon approval by the Board of this vacation request.
The applicant has received letters of no objection from the Heritage Bay Commons Association, Inc., and
the Quarry Community Development District which are attached hereto.
The Development Review Division has reviewed this petition and found no reason for objection.
FISCAL IMPACT: The application fee of $2,000 covers staff review and processing. The applicant is
also responsible for advertising fees.

GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.
LEGAL CONSIDERATIONS: Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101,
the Board may adopt resolutions vacating plat's in whole or in part of subdivisions in Collier County,
returning the property covered by such plat's either in whole or in part into acreage, when the following
criteria are met:
1. The request is in the interest of the general public welfare, or no public detriment is established;
2. The request does not invade or violate individual property rights;
3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be
vacated;
4. The vacation will not affect the ownership or right of convenient access of persons owning other
parts of the subdivision.
This item has been approved as to form and legality and requires a majority vote for Board approval. -
