Recommendation to approve Petition VAC-PL20170000727 to disclaim, renounce and vacate the County and the Public interest in the 20 foot Utility Easement recorded in Official Record Book 2699, Page 2204 of the Public Records of Collier County, Florida. The subject property is located on the south side of Livingston Woods Lane, north of the intersection of Pine Ridge Road and Whippoorwill Lane, in Section 7, Township 49 South, Range 26 East, Collier County, Florida; and to accept a replacement county utility easement. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the 20-foot Utility Easement recorded in Official Record Book 2699, Page 2204 of the Public Records of Collier County, Florida, located in Section 7, Township 49 South, Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A; and to accept a replacement county utility easement. CONSIDERATIONS: Petition VAC-PL20170000727 has been received by the Development Review Division from Kristina Johnson of J.R. Evans Engineering, P.A., as agent for the property owner , JSF Kramer Drive, LLC. This request is to vacate the 20-foot Utility Easement recorded in Official Record Book 2699, Page 2204 of the Public Records of Collier County, Florida, located in Section 7, Township 49 South, Range 26 East, Collier County, Florida. According to the Property Appraiser’s website, JSF Kramer Drive, LLC is fee simple owner of the real property underlying the subject utility easement. The applicant proposes to vacate the existing 20-foot utility easement and will provide a replacement county utility easement to the County. The original utility easement was granted to the County in 1999 prior to the installation of county utility facilities, but the utility facilities were inadvertently installed by the owner outside of the easement area. As such, the applicant wishes to vacate the existing easement and provide a replacement easement over the location of the existing utility facilities. There is no public detriment caused by the vacation because the existing county utility faciliti es will remain and the County will be granted a new easement over the correct location of the facilities. A copy of the replacement easement is attached hereto and will be recorded upon approval by the Board of County Commissioners (Board) of this vacation request. A new Warranty Deed and Bill of Sale will also be provided administratively to the County subsequent to this vacation approval, in order to properly convey the personal property (i.e-utility facilities) to the County over the correct legal description. The applicant has received letters of no objection from various entities, copies of which are attached hereto. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: The application fee of $2,000 covers staff reviews and processing. The applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 12/12/2017 and 125.37, the Board may adopt resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat, when the following criteria are met: 1. Public benefit is established or no public detriment is established. 2. The Petitioner owns the fee simple title to the whole or that part of the parcel on which a public or County dedicated easement is sought to be extinguished.
