Agenda 12/12/2017 Item #16D1712/12/2017 EXECUTIVE SUMMARY Recommendation to ratify the administrative transfer and assumption of countywide affordable housing impact fee deferrals from the developer, Habitat for Humanity, to forty -nine (49) owner occupied, single family homeowners in the Legacy Lakes community under the authority set forth in Section 74-401 of the Collier County Code of Ordinances. OBJECTIVE: To support the affordability of housing in Collier County through the County Impact Fee Deferral Program and complete the process of individual homebuyers assuming a 15-year impact fee deferral on their new, affordable single-family homes. CONSIDERATIONS: Pursuant to Section 74-401 of the Collier County Code of Ordinances the County shall defer the payment of the impact fees for any new owner-occupied dwelling unit which qualifies as affordable housing. Section 74-401(3) of the Code authorizes the County Manager to enter into an impact fee deferral agreement with the developer or owner. The deferred impact fees shall be a lien on the property and the agreement shall be accepted by the County in lieu of prompt payment of the impact fee that would otherwise then be due and payable but for the agreement. A developer may have up to 50 impact fee deferrals in their organization’s name at one time. As the units are built and sold to income qualified households, the impact fee deferral lien is transferred from the developer and assumed by the homebuyer. In 2016 and 2017, Habitat for Humanity built homes in the Legacy Lakes subdivision. Forty-nine (49) of these homes had affordable housing impact fee deferrals issued to Habitat for Humanity. These homes have been sold to income-qualified, first-time homebuyers in accordance with the requirements of Sec. 74-401. At the time of closing, each of the 49 single family homebuyers signed a Lien Agreement for Deferral of 100% of Collier County Impact Fees for Owner Occupied Affordable Housing Dwelling Units and Release of Developer from Lien Agreement. In these agreements, the new property owner is responsible to comply with the terms of the deferral and the former owner, Habitat for Humanity is no longer responsible. These deferred impact fees are a lien on the 49 homes and are required to be paid to the County in full upon: a) the sale of the dwelling unit; b) the refinancing of the dwelling unit; c) a loss of the homestead exemptions; or d) the first occurrence of any sale or transfer of any part of the affected real property. The impact fees deferred for these individual homeowners is $16,430.16 per property as outlined in Exhibit B attached to each lien agreement. These 49 lien agreements have been signed by all parties and recorded with the Clerk of Courts in accordance with the Affordable Housing Impact Fee Deferral program. The attached spreadsheet identifies the 49 households assuming the lien agreements and the recording information. Since the Lien Agreement for Deferral of 100% of Collier County Impact Fees for Owner Occupied Affordable Housing Dwelling Units and Release of Developer from Lien Agreement has been executed by the County in accordance with Section 74-401 of the Collier County Code of Ordinances Board signature is not required. FISCAL IMPACT: Collier County impact fees have been deferred in the amount of $16,430.16 on each of the 49 homes for a total of $805,077.84. Upon future resale of individual properties, repayment of county impact fees shall include any accrued interest computed at the rate of five percent per annum, but in no event, shall the interest exceed 25 percent of the total impact fee amount. 12/12/2017 GROWTH MANAGEMENT IMPACT: Efforts are consistent and support the Housing Element of the Collier County Growth Management Plan by providing housing assistance to very low- to moderate- income residents of the community.
