CCPC Minutes 12/04/2003 SDecember 4, 2003 TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY PLANNING COMMISSION/LDC AMENDMENTS Naples, Florida, December 4, 2003 LET IT BE REMEMBERED, that the Collier County Planning Commission in and for the County of Collier, having conducted business herein, met on this date at 5:05 PM in SPECIAL SESSION in Building "F of the Government Complex, East Naples, Florida, with the following members Present: CHAIRMAN: Russell A. Budd VICE-CHAIRMAN, Mark Strain SECRETARY, Lindy Adelstein Paul Midney Brad Schiffer Robert Murray Kenneth L. Abernathy George Evans Absent: Dwight Richardson ALSO PRESENT: Patrick White, Assistant County Attorney Marjorie Student, Assistant County Attorney Russell Webb, Principal Planner Susan Murray, Current Planning Manger December 4, 2003 The meeting was called to order by Chairman Russell A. Budd at 5:05 P.M. Roll call was taken - a quorum established. Patrick White, Assistant County Attorney, submitted a faxed copy of the Notice of Land Development Code Change which has been advertised properly in the Naples Daily News. LDC Amendment re Moratorium on Building Height STAFF Russell Webb, Principal Planner, Community Development and Environmental Services Division, amendment is thc extension of the moratorium, if necessary. Susan Murray, Current Planning Manager,- Moratorium expires January 31, 2004. If the moratorium expires, we would revert back to the current RT zoning district standards, permit applications could be accepted, this is a safety measure. PUBLIC SPEAKERS Diane Ketcham, President, Vanderbilt Beach and Bay Association, would like to see this reach a conclusion on overlay while majority of property owners are in residence. Fewer people are here in June and would not be able to participate. Does not want moratorium extended, but will understand if it must be extended. Bruce Burkhard, Director, Vanderbiit Beach Property Owners Association, agrees with Ms. Ketcham. If moratorium must be extended, would like it extended until January 2005, one year extension, so people will be present to fully represent their interests. Dr. Richard Bing, Chairman, Vanderbilt Beach Zoning Committee, had concerns about timeliness of BCC hearing. Would like established scheduled followed. If moratorium must be extended, should be extended one year rather than six months. Joseph Connolly, Director, Vanderbilt Beach and Bay Association and Vice- President of Save Vanderbilt Beach Fund, staff is slow doing its job, it is time to get it finished. Does not want this completed in June, it should be completed now or January of next year. Richard Yovanovich, Representing Vanderbilt Inn, decision does not need to be made on moratorium yet. June is okay. Could there be a special cycle only including one topic, the overlay, and get it accomplished by the end of March if an extension is necessary. Patrick White, indicated that would take a super majority vote of the BCC to have a special cycle. 2 December 4, 2003 Dwight Nadew, representing Vanderbilt Inn, support comments made by Mr. Yovanovich. Does not want extension of moratorium, would like to have public hearing. Nothing would be gained by extending into January 2005. Doug Fee, President, North Bay Civic Association, supports residents to the south in their efforts to determine their future. An extension of moratorium is proper and Commission is urged to do so. DISCUSSION -Effective date of overlay could be date of adoption. -Steps have been taken to make sure there are no gaps where there is no protection. -Shorter period for moratorium would be better for both sides. Mr. Murray made a motion to extend moratorium to June 30, provision is consistent with Growth Management Plan, only one hearing is required for this provision, motion was seconded by Mr. Adelstein, motion carried 8-0.
