EXECUTIVE SUMMARY
Recommendation to approve targeted reductions in the Collier County Growth Management
Department Development Services Fee Schedule related to application and plan review fees in the
event of a Board of County Commissioners (Board)-declared disaster, and to apply the targeted
reductions retroactively to the fees identified in the petition related to the Lee Williams fire
presented to the Board at the October 10, 2017 meeting under item 11G and to homeowners
impacted by Hurricane Irma.

OBJECTIVE: To implement a limited-timeframe 50% reduction of application and plan review fees for
residential and residential mobile home repairs as defined by the Florida Building Code and outlined in
the Collier County Growth Management Department (GMD) Development Services Fee Schedule (Fee
Schedule) in the event of a Board-declared disaster and as directed by the Board.
CONSIDERATIONS: Acting on the directive issued by the Board at the October 10, 2017 meeting,
item 11H, GMD staff worked with the the Development Services Advisory Committee (DSAC)
subcommittee, along with the Executive Director of the Collier Building Industry Association (CBIA), on
November 17, 2017 at a publicly advertised meeting to create and review a post declaration disaster fee
schedule. The fee schedule was approved unanimously and was scheduled for presentation and
consideration at the regularly scheduled December 6, 2017 full DSAC meeting.
On December 6, 2017, the DSAC approved the request.
The fee schedule provides for a 50% reduction of the application and plan review fees for repairs related
to a Board-declared disaster affecting Collier County residents. The intent is to offer financial re lief to
victims experiencing damage resulting in a threat to life and/or safety in their primary dwelling. This fee
schedule reduction applies only to primary residential structures, excluding damages to outbuildings and
accessory structures. The provision also excludes multi-family dwellings consisting of more than two
units except those defined as a townhouse under the Florida Building Code Residential Code, which can
be multiple units.
The disaster relief fee reductions would apply to permit application and review fees as specified in section
OO in the attached Fee Schedule and include application fees for building permits, as well as fees for
structural, electrical, plumbing and gas, mechanical, and planning review. In addition, a permit fee
reduction would be applied to the repair and full replacement of a mobile/manufactured home.
Eligibility:
Eligibility for fee reductions would be contingent upon the applicant providing the following:
1) Proof of ownership and occupancy as a primary residence
2) Damage assessment report from property’s insurance adjuster, Collier County Building Official,
or authorized FEMA/FDEM representative
3) Photographs depicting the declared disaster-related damage
4) Attestation that damage was caused during the declared disaster, signed by the owner
5) Owner verification that no other monetary aid from the Board has been or will be applied in
relation to disaster relief
Timeframe:
12/12/2017
The window for the fee reductions would be 180 days from the date of disaster declaration by the Board.
In addition, it is proposed that there would be an additional 90-day period beyond the initial 180 days for
application during which an eligible resident who paid the full fees could apply for a refund of 50% of the
applicable application and plan review fees. These targeted reductions would also apply retroactively to
the fees identified in the petition related to the Lee Williams fire presented to the Board at the October 10,
2017 meeting under item 11G and to homeowners impacted by Hurricane Irma.
FISCAL IMPACT: Extrapolating from initial figures, approximately 2,000 residential homes may have
been impacted by Hurricane Irma. Based on an average permit cost of $450 for permitted repairs, the
disaster relief fee reduction could result in an approximate $450,000 reduction of income primarily to
Fund 113 (the “Building” fund) and to a lesser extent, Fund 131 (the “Land Development” fund).
Preparations will be made during the budget process to allocate this funding as a separate reserve line
item in the FY19 budget. It should be noted that so long as Fund 113 and Fund 131 reserves are available
to support this program, no General Fund dollars would be used to support the proposed fee reductions.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. - SAS
RECOMMENDATION: To approve the resolution amending the Collier County Growth Management
Department Development Services Fee Schedule to include a Disaster Permit Fee Relief program that
reduces application and plan review fees by 50% for residential and residential mobile home repairs as
defined by the Florida Building Code for a period of 180 days following a Board declaration of a disaster,
as directed by the Board, and allowing for a 90-day period provision beyond the 180 days where an
eligible resident paid the full fees within the initial 180-day period, and to apply the targeted reductions
retroactively to the fees identified in the petition related to the Lee Williams fire presented to the Board at
the October 10, 2017 meeting under item 11G and to homeowners impacted by Hurricane Irma.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, AMENDING THE COLLIER
COUNTY GROWTH MANAGEMENT DEPARTMENT
DEVELOPMENT SERVICES FEE SCHEDULE.
WHEREAS, on June 13, 2017, the Board of County Commissioners (Board) approved
Resolution 2017-107, establishing a revised Collier County Growth Management Department
Development Services Fee Schedule (Fee Schedule); and
WHEREAS, the Board desires to revise the Fee Schedule to add new provisions
relating to certain permit application and plan review fee reductions in the event of Board -
declared disaster.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners hereby amends Fee Schedule as set forth in the
attached Fee Schedule, which shall become effective on January 1, 2018.
BE IT FURTHER RESOLVED that the Board declares that these fees are all fair and
reasonable sums to be assessed to the Land Development Code and the County's
corresponding development review and permitting process.
BE IT FURTHER RESOLVED that Resolution 2017-107 is hereby superseded and
replaced in its entirety by this Resolution.
THIS RESOLUTION ADOPTED after motion, second and majority vote on this

RESOLUTION, AND CANNOT BE WAIVED OR SUSPENDED WITHOUT AN ACTION BY THE BOARD.
ANY QUESTIONS CONCERNING THE APPLICABILITY OF FEES SHALL BE CONCLUSIVELY
DETERMINED BY THE DIRECTOR OF THE APPROPRIATE DIVISION, AS APPLICABLE. WHERE AS PART
OF A REZONING, PLAT OR SIMILAR APPLICATION TYPE, THE BOARD DIRECTS APPROVAL OF
FUTURE DEVELOPMENT ORDERS DIFFERENT FROM THE STANDARD TYPE OF APPROVAL

BB) FAILURE TO OBTAIN A PERMIT
1) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where such action was cited by Code Enforcement or by Contractor Licensing and resulted in a finding of
violation from either the Code Enforcement Board, the Special Magistrate, or the Contractor Licensing Board,
the fees herein specified shall be 2x the regular fee, as defined in this fee schedule, unless otherwise directed
by the Collier County Board of County Commissioners.
2) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where a contractor or agent/provider where the building official or zoning official or his/her designee, (for
cases involving land use development) deems that the contractor/provider should have known that a permit
was required but voluntary seeks voluntary compliance by obtaining the necessary permits to abate the
violation, the fees herein specified shall be 2x the regular fee, as defined in this fee schedule.
3) Where work for which a permit is required is started or proceeded with prior to obtaining said permit, and
where the unpermitted work may or may not have been completed by the property owner, and where the
current owner seeks voluntary compliance by obtaining said permit to assure compliance with all applicable
codes, the fees will be assessed at the regular rate as defined in this fee schedule.
4) The payment of such fee shall not relieve any person from fully complying with the requirements of any
applicable construction code or ordinance in the execution of the work, or from any penalty prescribed within
any construction code, law or ordinance of Collier County.
5) The fees within section EE shall not be applicable for the re -issuance of any missing permit, missing certificate
of occupancy, or missing certificate of completion that was presumed to be issued prior to April 1, 1997, upon
the verification of such items presented by the property owner, or his/her designee, to the building official, or
his/her designee; but shall be applicable for all reviews requiring inspection, review of plans, and all other
applicable fees associated with the issuance of said permit(s), certificate of occupancy, or certificate of
completion, as determined by the building official, or his/her designee, in addition to the zoning director, or
his/her designee (for cases involving land use development), as defined within this fee schedule.

FF) PERMIT FEE REFUNDS
A) Building Permit Review Standards apply to all internal Growth Management Department, Development
Services reviews for building permit applications with previously approved site plans, including all
required trade reviews, along with any required Zoning, Engineering and Impact Fee reviews. Reviews
external to Growth Management Department, Development Services, such as a Fire, are excluded. The
performance standard time frame begins upon submission of the application, and runs until either
issuance of a comment letter or at approval. Review standard guarantees require the submission of a
sufficient number of plan sets (to be determined by the Building Department) to accommodate parallel
trade reviews.
1) New Residential construction reviews will be completed within 5 business days (if longer than 5
business days 50% of review fee refunded).
2) New Commercial construction reviews will be completed within 15 business days (if longer than 15
business days 50% of review fee refunded).
3) Alterations, Additions and Minor Permits:
a. Residential permit application reviews will be completed within 5 business days (if
longer than 5 business days 50% of review fee refunded).

B) Annual Fee Adjustments:
1) Proposed Annual Fee adjustments for Building Department fees shall equal the average personnel
cost change (COLA plus average merit) approved by the BCC as part of that fiscal year's budget,
adjusted for any change in staffing levels.
2) Annual fee adjustments will become effective on Jan 1 of each fiscal year ifapproved.
3) Annual fee adjustments require full review and recommendation to the BCC from the
Development Services Advisory Committee. Annual fee adjustments also require full BCC
approval.
4) Annual fee adjustments require Building Fund total reserves to be less than 6 months of the
Building Fund operating budget for that fiscal year. If reserves exceed six months of budgeted
operating expenses, no annual adjustment can be requested.
C) Special Fee Adjustment:
1) If Building Fund total reserves are projected to exceed six months of operating expenses in the
proposed budget of any upcoming fiscal year, fees will be lowered in sufficient amount to insure
Building Fund reserves remain under six months of budgeted expenses.
2) If Building Fund total reserves are projected to fall below three months of operating expenses in
the proposed budget of any upcoming fiscal year, a special fee increase in sufficient amount to
insure Building Fund total reserves remain over three months of budgeted expenses will be
proposed for full Development Services Advisory Committee review and BCC approval.
3) Six months following any fee adjustment, other than annual increases, a full review of resulting
revenue will be presented for the review of the Development Services Advisory Committee. The
committee can make a recommendation to the BCC to lower fees if revenue exceeds either revenue
projections used in fee adjustment calculations or targeted reserve levels.
GG) RECORD RETRIEVAL

Staff, who will prepare an executive summary for consideration by the Board. Such requests shall include a
statement indicating the reason for the fee waiver request and, if applicable, the nature of the organization
requesting the fee waiver.
KK) REFUND PROVISIONS
1) PAYMENT OF FEES: Full payment of fees is required for a complete application. Department policy
requires full payment of fees at the time of application submittal. No work will begin on staff review of
the application until all fees are paid in full. If full payment of fees is not received within 14 calendar
days of application submittal, the application will be considered void. At this point, a new application and
full payment of fees will be required to proceed with a project.
2) There will be no refund of Building, Planning, Environmental, or Engineering related fees, except those
applications which have been deemed not sufficient for staff review or inspection and withdrawn by the
applicant. Either the applicant or payer may, within 4 years of the date of payment apply for a refund for
only those staff review or inspection services that were not performed. Failure to make timely application
for a refund shall waive any right to a refund.
The application for a refund shall be filed with the County Manager of his/her designee and shall contain
the following:
a. The name and address of the applicant
b. The location of the property upon which the development was proposed
c. The date the specified fee was paid
d. A copy of receipt of payment; and
e. Payment of a non-refundable "refund processing fee" equal to one percent (I%) of the refund requested,
except that the minimum processing fee shall be $25.00 and the maximum processing fee will not exceed
$250.00
Refund requests totaling $25,000.00 or more cannot be approved administratively and must be submitted
to the Board for approval.
3) In no cases will there be refunds for pre -application fees, data conversion fees, appeals ofadministrative
decisions, or appeals to the Board of Zoning Appeals or Building Board of Adjustment.
4) If staff error causes the inappropriate or unnecessary filing of an application and payment of fees, 100
percent of all inappropriate fees, shall be refunded upon written request and with the concurrence of
Department management.
LL) ADDITIONAL FEE PROVISIONS
1) In those cases where alternative methods or timing of payments for Growth Management Department
services and/or fees listed in this schedule associated with SBR reviews are deemed to best serve the public
good, the Growth Management Department, Department Head will have the authority to approve such
alternatives. Such alternatives must be in writing and signed by all principals involved. In no case shall final
C.O. or such certifications of project completeness be issued until payments due the Growth Management
Department are received in full.
2) All hourly fees are computed and charged from actual Divisional time tracking records.
3) All acreage totals used in fee calculations will be rounded up to the nearest whole acre.
4) When deemed essential for project review or approval, there will be no additional charge for any

00) BOARD DECLARED DISASTER PROVISIONS
1) When a disaster declaration is announced by the Collier County Board of County Commissioners,
and Board -declared provisions are enacted by the Board, the permit application and plan review
fees referenced in Sections L - Q and T (Zoning, Building, Structural, Electrical, Plumbing and
Gas, Mechanical and Mobile Home/Other Trailer), and domestic water heaters, shall be reduced by
50%. The reduction applies only to Florida Building Code residential structures and
mobile/manufactured homes that are considered primary residences including their attached
garages and carports. Excluded from the provision are all other structures not identified above or
not within the Florida Building Code residential code, non -primary residences, damages to
outbuildines and accessory structures, including but not limited to sheds, detached carports, guest
houses, and pool caees. Also excluded from this provision are inspection fees.
2) Eligibility criteria under the Board Declared Disaster Provisions are as follows:
• Proof of ownership and occupancy as a primary residence
• Damage assessment report from property's insurance adjuster, Collier County Building
Official, or authorized FEMA/FDEM representative
• Photographs depicting declared disaster -related damaee
• Attestation that damage was caused by the declared disaster, signed by owner
• Owner verification that no other monetary aid from the Collier County Board of County
Commissioners has been or will be applied in relation to disaster relief
3) Eligible applicants will have 180 days following the Board declaration of a disaster to apply for
reduced fees. There will be an additional 90 -day period beyond the initial 180 days for application
during which an eligible applicant who paid the full fees could apply for a refund of 50% of the
applicable permit application and plan review fees.

FEES ARE ESTABLISHED BY THE COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS (BOARD)
RESOLUTION, AND CANNOT BE WAIVED OR SUSPENDED WITHOUT AN ACTION BY THE BOARD.
ANY QUESTIONS CONCERNING THE APPLICABILITY OF FEES SHALL BE CONCLUSIVELY
DETERMINED BY THE DIRECTOR OF THE APPROPRIATE DIVISION, AS APPLICABLE. WHERE AS PART
OF A REZONING, PLAT OR SIMILAR APPLICATION TYPE, THE BOARD DIRECTS APPROVAL OF
FUTURE DEVELOPMENT ORDERS DIFFERENT FROM THE STANDARD TYPE OF APPROVAL
PROCESSES REQUIRED, THE DIRECTOR OF THE APPROPRIATE DIVISION SHALL DETERMINE THE
FEES TO BE APPLIED TO THE PROCESS NECESSARY TO MEET THE BOARDS REQUIREMENTS. THE
APPLICABLE FEES SHALL BE THOSE WHICH MOST CLOSELY RESEMBLE THOSE CHARGED FOR

2) Multiple signs of the same type (i.e., wall signs) and for a single project may be allowed per one permit, however
an appropriate fee shall be charged for each sign in accordance with the schedule set forth in the above subsection 1
of Sign Permit Fees.

X) REVISION AND AS BUILT PLAN REVIEW FEES; CORRECTIONS TO PLANS
1) PERMIT AND PLAN REVISIONS: the fee for each permit revision submitted after permit issuance shall be

to permitted projects shall be $50.00.

AA) INSPECTION AND REINSPECTION FEES
1) All required and partial inspections: $45.00 per inspection
2) Re-inspections for any type of building permit shall result in an additional fee of $60.00 per re-inspection
3) An inspection fee of $90.00 shall be assessed for all inspections on a time specified basis
BB) FAILURE TO OBTAIN A PERMIT
1) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where such action was cited by Code Enforcement or by Contractor Licensing and resulted in a finding of
violation from either the Code Enforcement Board, the Special Magistrate, or the Contractor Licensing Board,
the fees herein specified shall be 2x the regular fee, as defined in this fee schedule, unless otherwise directed
by the Collier County Board of County Commissioners.
2) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where a contractor or agent/provider where the building official or zoning official or his/her designee, (for
cases involving land use development) deems that the contractor/provide r should have known that a permit
was required but voluntary seeks voluntary compliance by obtaining the necessary permits to abate the
violation, the fees herein specified shall be 2x the regular fee, as defined in this fee schedule.
3) Where work for which a permit is required is started or proceeded with prior to obtaining said permit, and
where the unpermitted work may or may not have been completed by the property owner, and where the
current owner seeks voluntary compliance by obtaining said permit to assure compliance with all applicable
codes, the fees will be assessed at the regular rate as defined in this fee schedule.
4) The payment of such fee shall not relieve any person from fully complying with the requirements of any
applicable construction code or ordinance in the execution of the work, or from any penalty prescribed within
any construction code, law or ordinance of Collier County.
5) The fees within section EE shall not be applicable for the re-issuance of any missing permit, missing certificate
of occupancy, or missing certificate of completion that was presumed to be issued prior to April 1, 1997, upon
the verification of such items presented by the property owner, or his/her designee, to the building official, or
his/her designee; but shall be applicable for all reviews requiring inspection, review of plans, and all other
applicable fees associated with the issuance of said permit(s), certificate of occupancy, or certificate of
completion, as determined by the building official, or his/her designee, in addition to the zoning director, or
his/her designee (for cases involving land use development), as defined within this fee schedule.

FF) PERMIT FEE REFUNDS
A) Building Permit Review Standards apply to all internal Growth Management Department, Development
Services reviews for building permit applications with previously approved site plans, including all
required trade reviews, along with any required Zoning, En gineering and Impact Fee reviews. Reviews
external to Growth Management Department, Development Services, such as a Fire, are excluded. The
performance standard time frame begins upon submission of the application, and runs until either
issuance of a comment letter or at approval. Review standard guarantees require the submission of a
sufficient number of plan sets (to be determined by the Building Department) to accommodate parallel
trade reviews.
1) New Residential construction reviews will be completed within 5 business days (if longer than 5
business days 50% of review fee refunded).
2) New Commercial construction reviews will be completed within 15 business days (if longer than 15
business days 50% of review fee refunded).
3) Alterations, Additions and Minor Permits:
a. Residential permit application reviews will be completed within 5 business days (if
longer than 5 business days 50% of review fee refunded).

b. Commercial permit applications requiring only a single trade review and will be
completed within 5 business days (if longer than 5 business days 50% of review fee
refunded).
c. Commercial permit applications requiring 2 or 3 trade reviews will be completed within

B) Annual Fee Adjustments:
1) Proposed Annual Fee adjustments for Building Department fees shall equal the average personnel
cost change (COLA plus average merit) approved by the BCC as part of that fiscal year’s budget,
adjusted for any change in staffing levels.
2) Annual fee adjustments will become effective on Jan 1 of each fiscal year if approved.
3) Annual fee adjustments require full review and recommendation to the BCC from the
Development Services Advisory Committee. Annual fee adjustments also require full BCC
approval.
4) Annual fee adjustments require Building Fund total reserves to be less than 6 months of the
Building Fund operating budget for that fiscal year. If reserves exceed six months of budgeted
operating expenses, no annual adjustment can be requested.
C) Special Fee Adjustment:
1) If Building Fund total reserves are projected to exceed six months of operating expenses in the
proposed budget of any upcoming fiscal year, fees will be lowered in sufficient amount to insure
Building Fund reserves remain under six months of budgeted expenses.
2) If Building Fund total reserves are projected to fall below three months of operating expenses in
the proposed budget of any upcoming fiscal year, a special fee increase in sufficient amount to
insure Building Fund total reserves remain over three months of budgeted expenses will be
proposed for full Development Services Advisory Committee review and BCC approval.
3) Six months following any fee adjustment, other than annual increases, a full review of resulting
revenue will be presented for the review of the Development Services Advisory Committee. The
committee can make a recommendation to the BCC to lower fees if revenue exceeds either revenue
projections used in fee adjustment calculations or targeted reserve levels.
GG) RECORD RETRIEVAL
1) No charge for normal retrieving of records from inactive or remote storage including microfilmed documents

1) Requests for fee waivers may only be approved by the Board. Waiver requests for development review
and building permit fees shall be submitted in writing directly to the appropriate Development Services

Staff, who will prepare an executive summary for consideration by the Board. Such requests shall include a
statement indicating the reason for the fee waiver request and, if applicable, the nature of the organization
requesting the fee waiver.
KK) REFUND PROVISIONS
1) PAYMENT OF FEES: Full payment of fees is required for a complete application. Department policy
requires full payment of fees at the time of application submittal. No work will begin on staff review of
the application until all fees are paid in full. If full payment of fees is not received within 14 calendar
days of application submittal, the application will be considered void. At this point, a new application and
full payment of fees will be required to proceed with a project.
2) There will be no refund of Building, Planning, Environmental, or Engineering related fees, except those
applications which have been deemed not sufficient for staff review or inspection and withdrawn by the
applicant. Either the applicant or payer may, within 4 years of the date of payment apply for a refund for
only those staff review or inspection services that were not performed. Failure to make timely application
for a refund shall waive any right to a refund.
The application for a refund shall be filed with the County Manager of his/her designee and shall contain
the following:
a. The name and address of the applicant
b. The location of the property upon which the development was proposed
c. The date the specified fee was paid
d. A copy of receipt of payment; and
e. Payment of a non-refundable “refund processing fee” equal to one percent (1%) of the refund requested,
except that the minimum processing fee shall be $25.00 and the maximum processing fee will not exceed
$250.00
Refund requests totaling $25,000.00 or more cannot be approved administratively and must be submitted
to the Board for approval.
3) In no cases will there be refunds for pre-application fees, data conversion fees, appeals of administrative
decisions, or appeals to the Board of Zoning Appeals or Building Board of Adjustment.
4) If staff error causes the inappropriate or unnecessary filing of an application and payment of fees, 100
percent of all inappropriate fees, shall be refunded upon written request and with the concurrence of
Department management.
LL) ADDITIONAL FEE PROVISIONS
1) In those cases where alternative methods or timing of payments for Growth Management Department
services and/or fees listed in this schedule associated with SBR reviews are deemed to best serve the public
good, the Growth Management Department, Department Head will have the authority to approve such
alternatives. Such alternatives must be in writing and signed by all principals involved. In no case shall final
C.O. or such certifications of project completeness be issued until payments due the Growth Management
Department are received in full.
2) All hourly fees are computed and charged from actual Divisional time tracking records.
3) All acreage totals used in fee calculations will be rounded up to the nearest whole acre.
4) When deemed essential for project review or approval, there will be no additional charge for any
meetings requested by Growth Management Department staff.

reduction applies only to Florida Building Code residential structures and mobile/manufactured homes
that are considered primary residences including their attached garages and carports. Excluded from the
provision are all other structures not identified above or not within the Florida Building Code residential
code, non-primary residences, damages to outbuildings and accessory structures, including but not limited
to sheds, detached carports, guest houses, and pool cages. Also excluded from this provision are
inspection fees.
2) Eligibility criteria under the Board Declared Disaster Provisions are as follows:
Proof of ownership and occupancy as a primary residence
Damage assessment report from property’s insurance adjuster, Collier County Building Official,
or authorized FEMA/FDEM representative
Photographs depicting declared disaster-related damage
Attestation that damage was caused by the declared disaster, signed by owner
Owner verification that no other monetary aid from the Collier County Board of County
Commissioners has been or will be applied in relation to disaster relief
3) Eligible applicants will have 180 days following the Board declaration of a disaster to apply for reduced
fees. There will be an additional 90-day period beyond the initial 180 days for application during which
an eligible applicant who paid the full fees could apply for a refund of 50% of the applicable permi t
application and plan review fees.

ANY QUESTIONS CONCERNING THE APPLICABILITY OF FEES SHALL BE CONCLUSIVELY

2) Re-inspections for any type of building permit shall result in an additional fee of $60.00 per re-inspection

BB) FAILURE TO OBTAIN A PERMIT
1) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where such action was cited by Code Enforcement or by Contractor Licensing and resulted in a finding of
violation from either the Code Enforcement Board, the Special Magistrate, or the Contractor Licensing Board,
the fees herein specified shall be 2x the regular fee, as defined in this fee schedule, unless otherwise directed
by the Collier County Board of County Commissioners.
2) Where work for which a permit is required is started or proceeded with prior to obtaining said permit and
where a contractor or agent/provider where the building official or zoning official or his/her designee, (for
cases involving land use development) deems that the contractor/provide r should have known that a permit
was required but voluntary seeks voluntary compliance by obtaining the necessary permits to abate the
violation, the fees herein specified shall be 2x the regular fee, as defined in this fee schedule.
3) Where work for which a permit is required is started or proceeded with prior to obtaining said permit, and
where the unpermitted work may or may not have been completed by the property owner, and where the
current owner seeks voluntary compliance by obtaining said permit to assure compliance with all applicable
codes, the fees will be assessed at the regular rate as defined in this fee schedule.
4) The payment of such fee shall not relieve any person from fully complying with the requirements of any
applicable construction code or ordinance in the execution of the work, or from any penalty prescribed within
any construction code, law or ordinance of Collier County.
5) The fees within section EE shall not be applicable for the re-issuance of any missing permit, missing certificate
of occupancy, or missing certificate of completion that was presumed to be issued prior to April 1, 1997, upon
the verification of such items presented by the property owner, or his/her designee, to the building official, or
his/her designee; but shall be applicable for all reviews requiring inspection, review of plans, and all other
applicable fees associated with the issuance of said permit(s), certificate of occupancy, or certificate of
completion, as determined by the building official, or his/her designee, in addition to the zoning director, or
his/her designee (for cases involving land use development), as defined within this fee schedule.

FF) PERMIT FEE REFUNDS
A) Building Permit Review Standards apply to all internal Growth Management Department, Development
Services reviews for building permit applications with previously approved site plans, including all
required trade reviews, along with any required Zoning, En gineering and Impact Fee reviews. Reviews
external to Growth Management Department, Development Services, such as a Fire, are excluded. The
performance standard time frame begins upon submission of the application, and runs until either
issuance of a comment letter or at approval. Review standard guarantees require the submission of a
sufficient number of plan sets (to be determined by the Building Department) to accommodate parallel
trade reviews.
1) New Residential construction reviews will be completed within 5 business days (if longer than 5
business days 50% of review fee refunded).
2) New Commercial construction reviews will be completed within 15 business days (if longer than 15
business days 50% of review fee refunded).
3) Alterations, Additions and Minor Permits:
a. Residential permit application reviews will be completed within 5 business days (if
longer than 5 business days 50% of review fee refunded).

b. Commercial permit applications requiring only a single trade review and will be
completed within 5 business days (if longer than 5 business days 50% of review fee

B) Annual Fee Adjustments:
1) Proposed Annual Fee adjustments for Building Department fees shall equal the average personnel
cost change (COLA plus average merit) approved by the BCC as part of that fiscal year’s budget,
adjusted for any change in staffing levels.
2) Annual fee adjustments will become effective on Jan 1 of each fiscal year if approved.
3) Annual fee adjustments require full review and recommendation to the BCC from the
Development Services Advisory Committee. Annual fee adjustments also require full BCC
approval.
4) Annual fee adjustments require Building Fund total reserves to be less than 6 months of the
Building Fund operating budget for that fiscal year. If reserves exceed six months of budgeted
operating expenses, no annual adjustment can be requested.
C) Special Fee Adjustment:
1) If Building Fund total reserves are projected to exceed six months of operating expenses in the
proposed budget of any upcoming fiscal year, fees will be lowered in sufficient amount to insure
Building Fund reserves remain under six months of budgeted expenses.
2) If Building Fund total reserves are projected to fall below three months of operating expenses in
the proposed budget of any upcoming fiscal year, a special fee increase in sufficient amount to
insure Building Fund total reserves remain over three months of budgeted expenses will be
proposed for full Development Services Advisory Committee review and BCC approval.
3) Six months following any fee adjustment, other than annual increases, a full review of resulting
revenue will be presented for the review of the Development Services Advisory Committee. The
committee can make a recommendation to the BCC to lower fees if revenue exceeds either revenue
projections used in fee adjustment calculations or targeted reserve levels.
GG) RECORD RETRIEVAL
1) No charge for normal retrieving of records from inactive or remote storage including microfilmed documents

statement indicating the reason for the fee waiver request and, if applicable, the nature of the organization
requesting the fee waiver.
KK) REFUND PROVISIONS
1) PAYMENT OF FEES: Full payment of fees is required for a complete application. Department policy
requires full payment of fees at the time of application submittal. No work will begin on staff review of
the application until all fees are paid in full. If full payment of fees is not received within 14 calendar
days of application submittal, the application will be considered void. At this point, a new application and
full payment of fees will be required to proceed with a project.
2) There will be no refund of Building, Planning, Environmental, or Engineering related fees, except those
applications which have been deemed not sufficient for staff review or inspection and withdrawn by the
applicant. Either the applicant or payer may, within 4 years of the date of payment apply for a refund for
only those staff review or inspection services that were not performed. Failure to make timely application
for a refund shall waive any right to a refund.
The application for a refund shall be filed with the County Manager of his/her designee and shall contain
the following:
a. The name and address of the applicant
b. The location of the property upon which the development was proposed
c. The date the specified fee was paid
d. A copy of receipt of payment; and
e. Payment of a non-refundable “refund processing fee” equal to one percent (1%) of the refund requested,
except that the minimum processing fee shall be $25.00 and the maximum processing fee will not exceed
$250.00
Refund requests totaling $25,000.00 or more cannot be approved administratively and must be submitted
to the Board for approval.
3) In no cases will there be refunds for pre-application fees, data conversion fees, appeals of administrative
decisions, or appeals to the Board of Zoning Appeals or Building Board of Adjustment.
4) If staff error causes the inappropriate or unnecessary filing of an application and payment of fees, 100
percent of all inappropriate fees, shall be refunded upon written request and with the concurrence of
Department management.
LL) ADDITIONAL FEE PROVISIONS
1) In those cases where alternative methods or timing of payments for Growth Management Department
services and/or fees listed in this schedule associated with SBR reviews are deemed to best serve the public
good, the Growth Management Department, Department Head will have the authority to approve such
alternatives. Such alternatives must be in writing and signed by all principals involved. In no case shall final
C.O. or such certifications of project completeness be issued until payments due the Growth Management
Department are received in full.
2) All hourly fees are computed and charged from actual Divisional time tracking records.
3) All acreage totals used in fee calculations will be rounded up to the nearest whole acre.
4) When deemed essential for project review or approval, there will be no additional charge for any
meetings requested by Growth Management Department staff.

OO) BOARD DECLARED DISASTER PROVISIONS
1) When a disaster declaration is announced by the Collier County Board of County Commissioners,

fees referenced in Sections L - Q and T (Zoning, Building, Structural, Electrical, Plumbing and
Gas, Mechanical and Mobile Home/Other Trailer), and domestic water heaters, shall be reduced by
50%. The reduction applies only to Florida Building Code residential structures and
mobile/manufactured homes that are considered primary residences including their attached
garages and carports. Excluded from the provision are all other structures not identified above or
not within the Florida Building Code residential code, non-primary residences, damages to
outbuildings and accessory structures, including but not limited to sheds, detached carports, guest
houses, and pool cages. Also excluded from this provision are inspection fees.
2) Eligibility criteria under the Board Declared Disaster Provisions are as follows:
Proof of ownership and occupancy as a primary residence
Damage assessment report from property’s insurance adjuster, Collier County Building
Official, or authorized FEMA/FDEM representative
Photographs depicting declared disaster-related damage
Attestation that damage was caused by the declared disaster, signed by owner
Owner verification that no other monetary aid from the Collier County Board of County
Commissioners has been or will be applied in relation to disaster relief

CONSIDERATIONS: Dunng the Board of County Commissioners (Board) meeting on September 26,
2017, agenda item 64 under the public petition, the Board directed the County Manager to bnng back an
agenda item for consideration regarding the refund of permitting fees paid by two wildlands fire victims.

The subject properties are included in the attached OfIice of Agricultural Law Enforcement Case Master
Report 17-912, which includes property descriptions and comments on fire damage. The report conhrms
that the above listed properties, along with various out buildings, a boat and trailer and small vehicles (all-
terrain vehicle, golf cart and 2 wheeled trailers) were completely consumed by the wildlands fire. Staff is
unaware of insurance coverages or claims for either of the properties.
Fees collected for building and development permits are utilized to fund the full cost of operation for the
majority of the Growth Management Department, Development Services element. Fees collected for
permitting and inspection services performed are considered to be non-refundable. A decision to approve
this request would set precedence for future refund requests, which could include large projects, such as
the YMCA project which incurred major fire damage and the permitting fees totaling $182,991.99. Future
approvals of this nahrre could result in significant costs to the taxpayers of Collier County.
FISCAL IMPACT: The fiscal impact consists of permitting fees, totaling $4,772.27, which will be
refunded from the General Fund. However, the precedence of this request may have potentially large
fiscal repercussions for the County's General Fund.
GROWTH MANAGEMENT IMPACT: There is no groMh management plan impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attomey, raises no legal

On 03lOGl2077, at approximately 1730hrs, I was contacted about a large wildland flre located
within the Picayune Strand State Forest in Collier County Florida. The Florida Forest Service
assigned incident number 2017-17-0088 and named it Lee Williams Road (11).
A review of the weather conditions reported by the Florida torest Service revealed that on
March 5, 2017, the winds at the Caloosahatchee Forestry Office were from the ENE at 18mph,
the temperature was 77 degrees Fahrenheit with a relative humidity of 38%. Fire Readiness
was at a Level 2. The acreage ofthe fire at initialcontact by FFS was 33 acres. Wind conditions
and dry fuels quickly increased the size to several hundred aqes On 03/1^212017, the total
acreage ofthe fire was 7,230 acres.
lnvertiEation
On O3/o712077,1 arrived at the scene. An incident command cent€r had been established at
8075 Lely Cultural Parkwa, Naples, Florida. I contacted the Florida Forest Service to inform
them of my presence and to advise that I would be the primary lnvestiSator on the case. I was
briefed on the incident by tFS Park Ranger, William Muirhead. I followed Ranger Muirhed to
the suspected origin area, located at 5700 Lee Williams Rd., Naples, FL 34117. I then exited my
vehicle and began my investiSation by walking the perimeter of the possible origin area
Fire indicators and weather conditions revealed that the fire moved in a west-southwest
direction. An examination of charrinS, protection and foliage freeze in the burned area led to
the possible area of oritin ofthe fire appearing to be located on lhe prope.ty. The head fire
moved west from this location, iumped Lee Williams Road, and continued moving west. The
fire burned down a barbed wire fence on the propeny as it moved west and crossed a
chain-link fence to the south. Strong winds at the time of the fire aided in the fir€ moving and
spreading quickly. Charring was evident on most of the trees up to at least 20 ft. or more,
indicating that the fire grew in strength from the area of origin No ignition sources,
accelerants, or evidence of arson was located at the scene. There was no lightning reported in
the area on the date of the fire and the fire was not near a railway. A power pole was located
just outside the burned area, but it was not damaged.

The evident charring and protection on the palm and pine trees in the area, foliage freeze and
evident backing fire indicate that area of origin is in the northeastern area of the burned area
on the property
on O3lOBl2O77, Lts. Hochuli and Raulerson met me at the fire scene and conducted an oriSin
and cause investigation. Their findings were also consistent with my original findings which is a
probable origin area on the northeastern side of the property located at 5700 Lee Williams
Road. A search of the area of origin area was again conducted, but no ignition sources could
be located.
On O3l1Ol2O77, FFS Rangers Fischer, Garcia and Nicoletti accompanied Lt. Hochuli and I to the
area of origin They were the first ranSers to respond to the fire. RanSer Garcia stated that the
area to the south of the area of origin was already burned when he arrived on scene, however,
the property at 5700 Lee Williams Rd. was fully involved. The Rangers further advised the
same south area on the properiy in question had burned about a year p.ior and may not have
had much fuel, making it burn more quickly. Ranger Garcia began his suppression efforts by
cutting a line around the burning area which included the propeny at 5700 and to the south of
the property. He then began cutting a line from Lee Williams Rd. to the west beginning just
north of the 5700 Lee williams Rd. property gate. The rangers stated that fire was burnint at a
hiSh rate when they arrived and had already.rossed Lee Williams Rd. to the west and was
moving at a hi8h rate of speed.
lnterviews and Damaae Assessment
On 03lO7 /2077,lnr. Feiner interviewed Wayne Wood., residing at 985 Snake Rd Naples, tL

stated he sustained no property damage due to the fire Welkins stated that he had trouble
with his nei8hbor Don Cure in the past and is suspicious Cure started the fire Welkins did
admit however that he has no evidence.

Road, Naples, FL 34117, Tel 1239) 253-1223 relative to the wildfire damage he sustained Mr.
Hous€ stated he was not interested in continuing the conversation because he was not
interested at all. An inspection of the property showed approximately 50yds of barbed wire
fence and poles destroyed. Damage estimated at S1,000.00.

and scene documentation of additional damage incurred by the wild fire For further details

Conclusions
No i8nition sources were found in or around the area of origin of the fire. There was no
lightning reponed in the area on o3lo5l2l77, and the area of oriSin is not near any railroad
tracks. There is one powerline pole next to the burned area, but it was undamaged. No
witnesses to the fire stanin8 have been located and no persons were observed in the area on
the date of the fire. However, human causes cannot be ruled out. HiEh winds, dry conditions
and plentiful fuel caused the fire to burn quickly and move rapidlY from east to west-southwest
and jump several lines established by the FFS. An investiSation of the fire scene, burn
indicators and weather conditions conclude that the area of origin of the fire is most likely
located on the northeastern side near the driveway and gate area located at 5700 Lee Williams
Rd., Naples, FL 34117, map coordinates Lal26'7'47", Lon 81;34;51". This is a vacant lot
owned by Hugh House. The cause of this fire is undetermined.

Wildland fire in Collier County, FL.
lwas assigned this incident by Lt. Hochuli at 9:00am on 3-9-2017. Upon arrival at the
Collier County EOC at '10:00am of the same date, I was met by a representative of
Forestry and advised that the bumed dwellings were located on LeBuff Road.
I responded to LeBuff Road and located the fi[st burned up house at 4980 LeBuff
Road. There were no people at the scene. I walked around lhe burned area and took
photos of the buildings and the burned vehicles. The photos are attached to this report.
Estimated loss is $215,000.00.
I then responded to 5000 LeBuff Road (next door) and was met by Mr. Laurence
LeBuff, the owner of 5000 LeBuff Road. Mr. LeBuff advised that he had evacuated the
premises on Sunday and when he came back on Wednesday, the fire had destroyed
his house and barn. He went on to say that he was uninsured. Mr. LeBuff stated that his
neighbor at 4980 LeBuff was named Drew Harrison but did not know Harrison's date of
bi(h, telephone number or current whereabouts. I took photos of the fire scene and
attached same to this report. Estimated loss is $500,000.00.

This is a case of a Wild Land Fire in an area of collier County Florida with several
destroyed homes and property. lnvestigator Hopkins was assigned to assist in the
damage assessment of the properties in the Le Butf Road and Benfield Road area
5180 Benfield Road, Naples, Florida, The home, which had been a stilt home, was
destroyed as were property surrounding the home including a 1987 Chevrolet Pickup
Truck. The property owner was present at the scene and is Todd Waldeck, W/M DOB
0212511961 . The scene was documented using digital photography and those photos
are attached to this report Total property loss is estimated at $200,000.00.
4895 Le Butf Road, Naples, Florida; The home, a two-story home, was destroyed as
was a Boat and trailer adjacent to the home and two out buildings. According to the
neighbor across the street, Laurence Le Butf, the owner at 4895 might be a Jim Kurth

Lee Williams Road Fire
On 318/2077 I was requested by my chain of command to assist lnv. Feiner with a fire origin and cause
investigation in Collier County. The fire occurred in or around the Picayune Strand State Forest and was
assigned Florida Forest Service (FFS) number 2017-17-0088. The address for the origin of the fire was
relayed to me as 5700 Lee Williams Rd. Naples, FL.
On the same date at approximately 11:00 am I arrived at 5700 Lee Williams Rd. I approached the area
from the south on Lee Williams Road and stopped at the edge of the burned area. There I met with lnv.
Feiner and Lt. Hochuli. We discussed the facts and circumstances related to the fire and weather
conditions on 315/2077 , the date of the fire. FFS reported that at the time the fire was reported the
winds were out of the ENE at 18mph and the relative humidity was 38%. A check of the Florida
Automated Weather Network historical data showed that the ENE winds with speeds ranging from 17
to 27 mph were present for most ofthe day on 3/517017.
From Lee Williams Road I looked east and was able to observe approximately a third of an acre that had
burned. This area was bordered on the west by Lee Williams Road. The south side property was
bordered by a chain link fence and power line that paralleled the property line. The east side of the
burned area was bordered by unburned vegetation. On the north side of the fire was a path/driveway
for enterinB and exiting the property from Lee Williams Road. The entrance from Lee Williams to the
property was gated. During Fire suppression activities FFS firefighters had cut in a plow line around the
entire burned area at 5700 Lee Williams Road.
I entered the burned area from Lee Williams along the south side of the burn. As I walked to the east I
observed burn patterns, charring and freezing that would indicate I was in the area of a flanking fire. As I
continued to the east I observed the power pole, carrying the powerline, was well clear of the burned
area to the east and showed no signs of damage or arcing. As I proceeded, I began to turn to the north
transitioning to the heel of the fire. All indicators showed this to be an area of backing fire. I continued
around the fire and as I approached the driveway on the north side of the fire the indicators again
revealed a flanking fire. As lfollowed the driveway toward Lee Williams road, lentered an area were
the intensity of the fire was very low.
I conducted a closer examination of this area. This area had a thick layer of pine needles that burned
only on the top layer of needles. lf the ground in this area was disturbed it revealed unburned fuel. This
burned area was outside of the line cut in by FFS. I followed it north for approximately 20 feet to the
center of the driveway. On the driveway was a spot approximately 18 inches in diameter, where the
debris on the ground was almost completely consumed. This spot was about 15 feet from the entrance
gate to the property. When standing on the north side of the driveway, behind the burned area there
appears to be a "V" pattern that burned to the south to the area of the main fire. I was able to
determine that this area is in the area of origin but it is unclear if this area burned before or after the
plow line was cut in by FFS personnel. This area of ori8in is consistent with a low intensity fire that

burned from this area of oriBin to the South, 20 to 30 feet, until finding sufficient fuel to flare up and
have the prevailing ENE winds cause the fire to spot over Lee Williams Road. After spotting over the
road the fire created a head fire that continued to burn to the WSW.
A thorough search of the origin area was conducted and no evidence of an ignition source was located.
Based on investigative findings, equipment use, normal human activity nor intentional lighting of the
fire can be ruled out as a cause of this fire. Therefore, the cause of this fire is undetermined

EXECUTIVE SUMMARY
Recommendation to direct staff to meet with the Development Services Advisory Committee
(DSAC) and the Collier Building lndustry Association (CBIA) to explore potential emergency
permitting processes and building permit fee considerations during declared disasters and provide
subsequent recommendations to the Board.
OBJECTIYE: To evaluate the need to provide assistance to community members who have incurred
damage during declared disasters by providing emergency permitting processes and building permit fee
considerations.
CONSIDERATIONS: Staff is requesting to work with DSAC, CBIA, and the County Attomey's Office
(CAO) to determine the requirement for a recommendation to the Board for establishing emergency
permitting processes and building permit fee considerations during declared disasters. Meetings with
DSAC and CBIA will be publicly advertised, and will be held at the Development Services building at
2800 N. Horseshoe Drive. Staff will continue to contact other Florida Counties to identifu measures and
best practices implemented tkoughout the State.
It should be noted that a Board-approved reduction totaling $1.6 million in building permitting and
inspection fee revenue was implemented on October 1,",2017. The result of the proposed meetings and
direction to act upon future decisions may fudher impact enterprise fee revenue within the Growth
Management Department. No General Fund contributions are made to these enterprise funds (113, l3l).
Staff antrcipates presenting recommendations developed with DSAC, CBIA, and the CAO at a future
Board meeting during the 2nd quarter of fiscal year 2018. Any recommendations that may be adopted by
the Board may be applied retroactively to previously declared emergencies.
FISCAL IMPACT: There is no direct fiscal impact associated with this executive sunmary; however,
future established policies and fee considerations could impact enterprise fund operations.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attomey, is approved as to
form and legality, and requires majority votc for approval. -JAK
