Lindsay Release of Deed Restrictions RELEASE OF DEED RESTRICTIONS
Whereas William Lindsay, as Trustee of the William Lindsay Charitable Remainder Unitrust
dated April 14, 2015 ("Seller") and Collier County ("Buyer") have entered into an Agreement
for Sale and Purchase dated July 11, 2017 for the property described in Exhibit A attached hereto
("Property"),the parties hereby agree as follows:
Buyer shall release the following deed restrictions:
1. Deed Restrictions and Reservation of right-of-way easement for ingress and egress as set
forth that certain deed dated March 30, 1980 and recorded April 4, 1960 in Official
Records Book 61, Page 79, of the Public Records of Collier County, Florida. Note:
Restrictive Covenants are not enforceable against the insured during its period of
ownership. (Ryan v. the Town of Manalapan, 414 So. 2d 193)
2. Deed Restrictions and Reservation of right-of-way easement for ingress and egress as set
forth that certain deed dated April 18, 1960 and recorded April 29, 1960 in Official
Records Book 62, Page 597, as re-stated on August 6, 1981 in Official Records Book
932, Page 773, both of the Public Records of Collier County, Florida. Note: Restrictive
Covenants are not enforceable against the insured during its period of ownership. (Ryan
v. the Town of Manalapan, 414 So. 2d 193)
3. Deed Restrictions and Reservation of right-of-way easement for ingress and egress as set
forth in that certain deed dated April 27, 1960 and recorded May 6, 1960 in Official
Records Book 63, Page 260, of the Public Records of Collier County, Florida. Note:
Restrictive Covenants are not enforceable against the insured during its period of
ownership. (Ryan v. the Town of Manalapan, 414 So. 2d 193)
