Roll Call Chairman Poteet called the meeting to order at 9:00AM. Roll call was taken and a quorum was established. II. Approval of Agenda Ms. Sherry moved to approve the Agenda. Second by Mr. Seef. Carried unanimously 8—0. III. Approval of August 14,2017 minutes Mr. Seef moved to approve the minutes of the August 14, 2017 meeting as presented. Second by Ms. Sherry 8-0. IV. Old Business A. Offsite preservation LDC amendment status Ms. Sulecki provided the"Draft CCPC Memo Pages 1-11, Draft BCC Executive Summary Pages 12-13" for information purposes noting: • Three recommendations for Offsite Preservation were brought forth(Conservation Collier Land Acquisition Advisory Committee(CCLAAC). Collier Planning Commission(CCPC) and the Development Services Advisory Committee(DSAC)) to the Collier County Planning Commission(CCPC) for consideration at their meeting on October 5, 2017 and, upon CCPC recommendation, for subsequent presentation to the Board of County Commissioners in December 2017 • At the October 5th The CCPC meeting, the item was postponed until the next meeting due to time constraints. • The CLAAC and DSAC recommendations were previously developed(as outlined in the above referenced Executive Summary)before the item was heard by the CCPC. • The CCPC recently completed their review of the item and has recommended off site preservation only be allowed for parcels %2 acre or less, with only a monetary payment option and for them to be an administrative approval. The monetary donation recommendation would be that required to meet the AUIR(Annual Update Inventory Report) value for community and regional park land($178,000/acre)with the value updated annually. B. Hack parcel update-acceptance into cycle Ms. Sulecki presented the "Hack Property Location dated 10/9/17"and reported: • An application has been filed proposing the acquisition of two parcels (17.85 acres and 10.61 acres) located adjacent to the Sandpiper Bay Club. • The properties were previously offered to the Program and placed on the"C-List" in 2003 as it was determined at the time,they could not be developed. • The properties are now under contract for sale with a developer who believes 6 residential units may be constructed on the property. • The Committee reviewed the application at a previous meeting and requested Staff to provide more information on the costs associated with constructing improvements on the parcels to provide public access (boardwalk,parking areas, etc.). • Initial investigations yields the following costs required to improve the property and provide public access: Site Improvement Plan/Consultant Fees- $28,000;Parking Area— $20,000; Sidewalk- $9.92 SQ FT$100,000;Boardwalk 6 ft wide, 1,700 to 3,000 ft. @ $300/LF-$510,000 to $900,000;DEP Permitting Costs (mitigation based on UMAM) - 2 October 9, 2017 $35,000; SFWMD Review Fee- $2,500; Collier County Review Fee $2,500; Total Estimated Cost$698,000 to $1,088,000 +. • She provided an overview of the Initial Criteria Screening Report as presented at the July 2017 meeting which indicated the parcels meet the criteria for acquisition. Speakers Dick Klaas, representing Clay Winfield, contract purchaser of the property reported Mr. Hack is the title holder with the application being brought forth by Mr. Winfield on behalf of Mr. Hack. Mr. Winfield is awaiting a decision on the application before proceeding with filing any development applications. Jennifer Belpedio,Assistant County Attorney reported there are no obstacles for the Committee in evaluating the application in its current state(given it is under contract for purchase) and any County contract would be executed with the owner. Tom Evans is an abutting landowner in favor of the acquisition as the property should remain in its natural state and preserved. Dee Brandt,President,Naples Sandpiper Bay Club noted the community is in favor of the acquisition expressing concerns on impacts on traffic and infrastructure should it be developed. Gary Kluckhuhn, abutting landowner spoke in favor of the acquisition due to the lands environmental quality and potential alleviation of storm surge on adjacent lands. Committee Member discussion noted if the parcel may be developed for public use and now has the potential to be developed for residential use, it should be considered for acquisition. Mr. Dewrell moved to deem the application a qualified proposal and move it ahead in the process for a complete evaluation. Second by Ms. Sherry. Carried unanimously 8—0. V. New Business A. Application for CLAAC—Jason Bennett Ms. Sulecki requested additional information from the applicant on his environmental qualifications and had not heard back at this time. Ms. Winge moved to continue the item until the next meeting. Second by Mr. Dewrell. Carried unanimously 8—0. B. All Applications—show map Ms. Sulecki provided the "Conservation Collier Cycle 9 Map—Applications Received dated 10/9/17." She provided an overview of the properties proposed for acquisition under the current cycle available for consideration in the ranking process and those in the multi parcel project areas which may be purchased via previous direction from the BCC. Mr. Dewrell moved to recommend the Board of County Commissioners purchase the properties located in the multi project parcels with the recommendation that any Conservation Collier shortfall in acquisition funds be covered by the County. Second by Ms. Sherry. Carried unanimously 8—0. Ms. Sulecki noted Staff is working on an analysis of future population levels in the County. 3 • October 9, 2017 The Committee requested Ms. Sulecki forward a copy of an email recently circulated on the Hussey property to the Members. C. Hurricane Irma Damage Report Ms. Sulecki and Ms. Henning provided an update on the following properties: Logan Woods—Anticipated to open in January of 2018; the area is wet and 4 pine trees fell on residential pool cages adjacent to the property. Otter Mound—Anticipated to open in January of 2018; cleanup yielded artifacts in the root balls of trees which are proposed to be collected and donated to the Marco Island Historical Society— The Committee requested Staff to update representatives for the City of Marco Island on findings on the property. Caracara Prairie Preserve,Alligator Flag Preserve, Rivers Road Preserve—Anticipated opening- January of 2018. Freedom Park—Cleanup underway by the Parks and Recreation Division, anticipated opening- December 2017. Gordon River Greenway—Open, clean up conducted by Parks and Recreation Division. Nancy Payton Preserve—Anticipated opening-December 2017. Panther Walk Preserve—Open. Pepper Ranch—Anticipated opening—November 2017 (on schedule). Red Root Preserve-anticipated to open-December of 2017. Staff has applied for any funds available from FEMA for the cleanup of lands held in the program. VI. Coordinator Communications A.BCC Items Ms. Sulecki reported on the following BCC meetings: 9/26/17— Memorandum of Understanding with the Florida Fish and Wildlife Conservation Commission approved for Youth Hunts at Pepper Ranch-Wild Hog(December 8-10, 2017)and Turkey(February 22-25, 2018). 10/10/17—Off site preservation donation of$17,114 to be considered. 10/24/17 - Consideration of proposal to donate artifacts recovered at Otter Mound Preserve. B. Misc. Items Ms. Sulecki: • Provided a letter from the Land for Public Trust in support of the acquisition of the Gore parcels. • Reported Operations Coordinator Gary Bigelow is no longer on Staff and a search is underway for additional staffmg. VII. Subcommittee Reports A. Lands Evaluation &Management—Chair-Tracey Dewrell; Members-Bill Poteet,Patricia Sherry,Michael Seef None B. Outreach-Jacob Winge,John Psaras, Susan Calkins,Michael Seef Mr. Seef reported: 4 October 9, 2017 • He met with the Board of Directors of the Future Citizens, Inc. to determine any opportunities available for public access to Cocohatchee Creek Preserve. • They notified him they are not in favor of allowing public access to their fenced in areas as the lands are used by various organizations such as the Boy Scouts of America. • He also researched the possibility of developing parking on other lands including that owned by the Germain auto dealership. During Committee discussion the following was noted: • The dealership had previously approached Conservation Collier on acquiring a portion of the preserve lands for expansion of their business. • A determination was made at the time Conservation Collier property may only be transferred to another entity for conservation purposes. • The construction of a boardwalk on the property is feasible; however given the lack of on site parking, it has not been pursued. The Committee: 1. Requested Staff research any opportunities available with Germain for land transfers under the "Exceptional Benefit"clause of the Ordinance. 2. Determined the item should be addressed by the Lands Evaluation and Management Subcommittee. Mr. Seef reported the Subcommittee also: • Discussed the distribution of rack cards,updates to the website and the development of "Apps." • Investigating opportunities for public presentation on the Program(i.e.Naples Native Plant Society, etc.). C. Ordinance Policy and Rules-Chair-Patricia Sherry; Members-Jacob Winge,John Psaras, Ms. Sherry reported the Subcommittee met in August and direction should be sought from the BCC on land acquisition priorities and policy initiatives. Speaker Commissioner Saunders addressed the Committee noting the BCC transferred$17M of the $35M in the Program's management fund. The funds will be returned via Ad Valorem tax revenue or monies potentially available from the new program following the voter referendum in 2018. This leaves up to$17M available for land acquisition at this time. VIII. Chair Committee Member Comments Chairman Poteet reported he will be meeting with Commissioner McDaniel to discuss the program and will provide a report to the Committee on the meeting. IX. Roll Call Chairman Poteet called the meeting to order at 1:30PM. Roll call was taken and a quorum was established. II. Approval of Agenda Ms. Sherry moved to approve the Agenda. Second by Mr. Winge. Carried unanimously 5—0. III. New Business A. Conservation Collier Criteria 1. Current Acquisition Cycle Ms. Sulecki presented the Resolution titled "A Resolution of the Collier County Board of County Commissioners Approving a Criteria Weighting Strategy for the Conservation Collier Land Acquisition Program's Ninth Property Selection Cycle; Providing for and Effective Date"for consideration. She noted: • The County Manager's Office requested the Committee provide direction to the Board of County Commissioners on the strategy for this and future years land acquisition cycles. • The Subcommittee met on the issue and requested Staff to draft a resolution for consideration by the full Committee with the intent of prioritizing criteria and the identifying types of properties to be targeted for acquisition. • Staff developed a resolution to address this years acquisition cycle for consideration by the Committee. • The Resolution is intended to be used as a guide, while still retaining the ability to nominate any parcel for acquisition.. • The ranking process usually occurs at the December meeting, however given recent events, has been extended until no later than April of 2018 Chairman Poteet reported he met individually with Commissioner's Saunders and McDaniel who indicated they favored targeting urban area properties and environmentally sensitive lands. Speaker Meredith Barnard, Conservancy of Southwest Florida they are opposed on introducing the ability to "weight"properties as the process is not provided for in the existing Ordinance. She favors the current process whereby the individual properties are evaluated on their own merits. Brad Cornell,Audubon of the Western Everglades agreed with Ms. Barnard expressing concern the process will become more objective and the Committee may"box themselves in" when evaluating properties for potential acquisition. The existing process has an inherent weighting process given the Committee evaluate parcels on a case by case basis with ability to selectively choose the parcels they wish to acquire. He recommended they wait until after the referendum vote to consider any changes to the process. The Committee noted: • It is not the intent to propose major changes to the process as the Resolution will not be incorporated into the existing Ordinance governing the Committee. • The Resolution would be utilized in the existing process as additional guidance when evaluating properties proposed for acquisition. • The proposed acquisitions are prioritized in an A, B, and C list at the end of the cycle allowing further discretion by the Committee when selecting properties. 2 October 26, 2017 The Committee reviewed the proposed Resolution while soliciting comments from the speakers in an attempt to address any concerns. Staff incorporated "real time" changes to the document. Mr. Winge move to recommend the following changes to the proposed Resolution presented by Staff 1. Addition of"Whereas #6" - "The Conservation Collier Land Acquisition Advisory Committee uses various tools to evaluate properties, including a scoring format." 2. Addition of language to "Whereas #7"— "However, the goals and primary criteria of Conservation Collier may not be modified except by countywide referendum vote." 3. Section 1.A, line 3 from "...cycles to provide a more targeted focus within the Program for meeting..." to "...cycles to provide a more targeted focus within the Program scoring format for meeting..." 4. Section 1.B, line 1 -2 from "...recommends giving additional weight to certain existing criteria..."to "...recommends adjusting the scoring format used in evaluation of the qualified proposals to certain existing criteria..." 5. Section 1.B, line 4, addition of the sentence - "The scoring sheet is only one tool used in the evaluation of a qualified proposal." Second by Ms. Sherry. Carried unanimously 5— 0. Ms. Sherry moved to forward the proposed Resolution to the Board of County for their consideration. Second by Mr. Winge. Carried unanimously 5— 0. 2. Future Acquisition Cycle Speaker Brad Cornell, Audubon of the Western Everglades noted the Committee should ensure they are using the best available environmental data when evaluating properties and should target parcels which contain rare species or environmentally unique lands. Ms. Sulecki noted the FLUCCS (Florida Land Use, Cover and Forms Classification System) and the FNAI (Florida Natural Areas Inventory) are utilized when evaluating parcels. The Committee noted the criteria utilized for land acquisition in future cycles should be reviewed by the Subcommittee. Any changes proposed should be forwarded to the full Committee for consideration. The review should include an evaluation of the land management fee structure. Mr. Winge moved to recommend the County continue to use the existing acquisition criteria with minor changes. Prior to the 2018 voter referendum on the program, the Committee will be reviewing the Program's requirements for land management fees to identify any deficiencies and recommend changes as necessary. Second by Mr. Seef Carried unanimously 5— 0. IV. Chair Committee Member Comments None V. Public General Comments Speaker Joe Popp reported he has contracted to purchase a 20 acre property adjacent to Rivers Road Preserve and may be developing the parcel. He queried if Cycle 9, which is now closed for applications could 3 October 26, 2017 be re-opened and the deadline extended so he may offer the County the opportunity to acquire the property. Ms. Sulecki noted she has had requests from other owners wishing to propose properties for acquisition after the deadline passed and she has notified them the applications will not be accepted. The Committee discussed the request with some Members favoring extending the Cycle given opportunities to acquire properties shouldn't be discouraged, especially if they are strategically located in the County. Others noted the deadline has passed and expressed concern on increasing Staff's workload by introducing new parcels into the Cycle. Mr. Winge moved to not extend the application deadline for Cycle 9. Second by Ms. Sherry. Motion carried 3 "yes"and 2 "no." Chairman Poteet and Mr. Seef voted "no." VI. Conservation Collier Land Acquisition Program Initial Screening Criteria BCP LLLP Parcel a. 00132960005 —289.57 acres Nominations to the Conservation Collier Program are based on satisfying at least two of the initial screening criteria below. Qualified sites shall then be further prioritized by secondary evaluative criteria. 1. Are any of the following unique and endangered plant communities found on the property? Order of preference as follows: Ord.2002-63,Sec.10(1)(a) YES Yes No a. Hardwood hammocks ❑ b. Xeric oak scrub ❑ c. Coastal strand ❑ d. Native beach ❑ e. Xeric pine ❑ f. High marsh(saline) ❑ g. Tidal freshwater marsh ❑ h. Other native habitats ® n Other native habitats include Pine flatwoods,Mixed wetland hardwoods,Mixed wetland hardwoods-shrubs, Cypress. Cypress-mixed hardwoods,Mixed wetland forest and Freshwater marsh. The owner believes there is also tropical hardwood hammock on this parcel. 2.Does land offer significant human social values,such as equitable geographic distribution,appropriate access for nature-based recreation, and enhancement of the aesthetic setting of Collier County? Residential properties are located along the Southeast boundary and a few along the northeast border and trails could be used by residents. There is a closed class 1 landfill on the western side of the property. It was last inspected in 2012,when the 20 year long term care period was terminated,with no adverse indications. 3.Does the property offer opportunities for protection of water resource values,including aquifer recharge, water quality enhancement,protection of wetland dependant species habitat,and flood control? Ord.2002-63, Sec.10(1)(c) ®Yes FINo Hydric soils are mapped over the majority of the property,which lies over an identified slough and could support wetland dependent species. It contributes minimally to the Lower Tamiami Aquifer(0-<7 inches annually)and moderately to the surficial aquifer(31-<43 inches annually). The CLIP 4 map for Surface water priorities show this area as a priority 4—a lower priority statewide,but locally, these are important,as the slough connects them with Lake Trafford and associated wetlands to the west(Including CREW lands),where it likely serves to buffer lake wetlands from urban runoff,and additionally,connects to Okaloacoochee Slough and Florida Panther National Wildlife Refuge wetlands to the west.Because there are adjoining residential lands,the property likely provides some level of flood protection. Parcel a is adjacent to a 7.8-acre parcel acquired by the County in 1990 as mitigation for wetland loss associated with the Collier Village development. 4.Does the property offer significant biological values,including biodiversity,listed species habitat,connectivity, restoration potential and ecological quality? Ord.2002-63,Sec.10(1)(d) ®Yes LINo This property likely meets this criterion. It is mapped with the CLIP4 Biodiversity layer as being#1 priority habitat for biodiversity,and is within Priority#1 FWC panther habitat,a listed species. FWC panther telemetry does not show much use,but there is likely some. The owner advises that the parcel is within the core 1 2 Conservation Collier 11-13-17 Agenda Item V.a. foraging area of five wood stork colonies and within USFWS consultation area for the Florida bonneted bat(a federally endangered species). Given these qualities, it is likely to have ecological quality and restoration potential through active habitat management. 5.Does the property enhance and/or protect the environmental value of current conservation lands through function as a buffer,ecological link or habitat corridor? Ord.2002-63,Sec.10(1)(e) ®Yes ❑No This parcel is likely serving to protect the environmental value of current conservation lands adjoining Lake Trafford, in addition to protecting the Lake itself, from urban runoff. It serves as an ecological link and habitat corridor with lake Trafford and CREW lands farther to the west,and Okaloacoochee slough and FPNWR to the east. The vegetation appeared to be more of an upland nature. So I do not think it has wetlands onsite and likely does not have wetland dependent species habitat. Due to its location next to the 1-75 canal, it may help protect water quality in the canal by filtering it if it filters south into the canal. It does provide moderate surficial aquifer recharge of 43 to <56 inches annually.
