EXECUTIVE SUMMARY
Recommendation to approve Amendment No. 1 to a Joint Participation Agreement (JPA) between
the State of Florida, Department of Transportation (FDOT) and Collier County, in which the
original reimbursement amount of $759,125 is divided, with $744,125 for the construction phase
and $15,000 for the Construction Engineering and Inspection (CEI) phase; for the Countywide
State Highway System Signal Priority Preemption Expansion. Project FM #435338-1-58/68-01(SAP
Project No. 33458).
OBJECTIVE: To designate separate funding amounts of $744,125 for the construction phase and
$15,000 for the CEI phase from the original JPA reimbursement amount of $759,125 for the Countywide
State Highway System Signal Priority Preemption Expansion Project.
CONSIDERATIONS: The Board of County Commissioners (Board) on March 22, 2017, under item No.
16A11, approved the Joint Participation Agreement (FPID 435338) and Resolution (2016-50) for
Countywide State Highways (SHS) Signal Priority Preemption installations. FDOT executed the
Agreement on April 8, 2016, and issued a Notice to Proceed to construction. The Agreement’s Scope of
Services, identified as Exhibit “A,” states, “The general objective is for Collier County to provide contract
administration, management services, construction engineering services and quality acceptance reviews of
all work associated with the acquisition and installation of the associated improvements at as many of the
sixty-seven (67) intersection locations as possible up to the funded amount of $759,125.”
The Board approved the construction contract on October 11, 2016, under item 16A14. The final
contracted price for the project was $735,275. The difference between the grant-funded amount
($759,125) and the cost of the construction contract ($735,275) left $23,850 for CEI services, an
insufficient amount to outsource the CEI services. For this reason, it was necessary to perform CEI
services using an in-house staff (force account). County funds are used to pay for the work and
reimbursements are invoiced to FDOT. For proper grant administration of the reimbursements, timesheet
submittals are required to account for the CEI tasks. However, because the original Agreement’s, Exhibit
“B” (Estimated Schedule of Funding) did not itemize the construction and CEI funding amounts
separately, and only provided a lump-sum reimbursement for the entire project, an amendment is required
to ensure that the County can invoice for the CEI services.
By this Amendment No. 1, the construction phase is hereby allocated in the amount of $744,125, and the
CEI phase is allocated in the amount of $15,000.00. The total of these two phases is still equal to the
original Agreement amount of, $759,125. The difference in the funds for construction ($744,125) and the
amount of the construction contract ($735,275) is $8,850. This amount will be set aside for allowances to
expedite change orders if any are necessary.
FISCAL IMPACT: On March 22, 2017, under item 16A11, the Board approved a budget amendment
for the original reimbursement amount of $759,125 for the construction services and CEI phases for FY
2016 in Transportation Grant Fund 711, Project 33458. The funding source is FDOT via the JPA
agreement.
The estimated useful life of the signal preemption system is ten years with repair costs during that
duration of time.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority
vote for Board approval. -SRT

GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary.
RECOMMENDATION: To approve Amendment No. 1 to a Joint Participation Agreement with the
Florida Department of Transportation in which Collier County will be reimbursed up to $744,125 for the
construction phase and $15,000 for the CEI phase, for a total reimbursement of $759,125 for the
acquisition, installation, and inspection of a signal priority preemption system on the State Highway
System within Collier County and authorize the Chair to sign Amendment No. 1.
