EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens with an accrued value of
$108,594.39 for payment of $10,000 in the code enforcement actions entitled Board of County
Commissioners v. GMAC Mortgage, LLC, Code Enforcement Board Case Nos. CESD20130011486
and CEPM20160007563 relating to property located at 5071 19th Ct SW, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners (Board) to accept an offer to release two code
enforcement liens with an accrued value of $108,594.39 for payment of $10,000 in relation to the Code
Enforcement Board Case Nos. CESD20130011486 and CEPM20160007563.
CONSIDERATIONS: As a result of code violations, the Code Enforcement Board ordered the
imposition of two liens against GMAC Mortgage, LLC., in Case Nos. CESD20130011486 and
CEPM20160007563 for code violations at 5071 19th Ct SW, consisting of replacing an exterior door and
frame without first obtaining a valid Collier County permit and an unsecured vacant dwelling with a
broken slider door window. The liens were recorded in the Official Records on September 22, 2014, at
O.R. Book 5078, Page 377, (CESD20130011486) and on December 12, 2016, at O.R. Book 5342, Page
678, (CEPM20160007563). The lien amount of $57,113.88 (CESD20130011486) is based on 1,140 days
of accrued fines ($50 per day from March 8, 2014 through April 20, 2017) plus operational costs in the
amount of $113.88. The second lien in the amount of $51,480.51, (CEPM20160007563) is based on 205
days of accrued fines ($250 per day from October 3, 2016 through April 25, 2017) plus operational costs
in the amount of $230.51. The property was brought into compliance in case no. CESD20130011486 on
April 20, 2017 and in case no. CEPM20160007563 on April 25, 2017. The property was acquired by
Everbank, via Corporate Quit-Claim Deed, recorded on June 19, 2017.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code
enforcement lien encumbers property that is under new ownership an d compliance has been achieved
within 30 days. The new owner is actively maintaining the property and $10,000 has been paid in
settlement of fines. The owner is requesting a waiver of $98,594.39 in accrued fines. There are currently
no known violations.
FISCAL IMPACT: Payment of $10,000 has been made, representing $9,655.61 in fines and $344.39 in
operational costs. If approved by the Board, accrued fines in the amount of $98,594.39 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. - KN
RECOMMENDATION: To waive the fines in the amount of $98,594.39, accept payment amount of
$10,000, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien
for recording in the Official Public Records.

2. An Order was entered by the Special Magistrate ordering Respondent to abate the violation on or
before March 7, 2014, or a fine of $50.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5010,
PG 3459). On April 4, 2014, a Continuance was granted. (A copy of the Order is recorded at OR
5027, PG 2363).
3. Operational costs of $115.33 incurred by the County in the prosecution of this case have been
paid.
4. Respondent, having been duly noticed for the public hearing regarding the County's Motion, did
not appear at the public hearing, and no legal defense to the Motion was presented.
5. No Request for Re -hearing or Appeal pursuant to Ordinance 2007-44, as amended, has been
timely filed.
6. The violation has not been abated as of the date of the hearing.

KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA is the owner and holder of a certain lien against all real and
personal property owned by:
GMAC Mortgage, LLC,
Respondent
The lien was recorded on September 22, 2014, in Official Records Book 5078, Page 377, in the
Official Records of Collier County, State of Florida. The lien secures the principal sum of fifty
seven thousand one hundred thirteen and eighty eight cents ($57,113.88), plus accrued interest
and penalties, if any, and imposes certain obligations against real property situated in Collier
County, Florida.
Collier County, a political subdivision of the State of Florida, by execution of this Release and
Satisfaction of Lien, acknowledges payment as approved by the Board of County Commissioners
as satisfaction of the lien and hereby cancels and releases said lien.
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction of Lien in
the Official Records of Collier County, Florida, to acknowledge that the lien ceases to exist.
