MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. Okay. So I guess we're going to start out with the stips. And for -- we have new computers here. We don't have volumes of paper. You can see the stips. They'll be displayed on the two screens here, or if you'd push the little magical button on the right-hand side of the screen, you can find your way there as well. Okay. MS. ADAMS: Okay. The first stipulation is No. 2, Item 5C2, Case CELU20150022309, Highland Properties of Lee and Collier. (The speaker was duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Good morning. MS. GIGUERE: Good morning. October 27, 2017 Page 6 CHAIRMAN KAUFMAN: I guess you have a stipulation that you'd like to present? MS. GIGUERE: Yes, I do. Therefore, it is agreed between the parties that the respondent shall: Pay operational costs in the amount of $65.82 occurred in the prosecution of this case within 30 days of this hearing; Two, abate all violations by: Remove any and all prohibited and/or unauthorized storage of materials, vehicles, litter, trash, and the like, from the vacant property to a place intended for such storage/disposal within 90 days of this hearing, or a fine of $100 a day will be imposed until the violation is abated; Three, the respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the investigator perform a site inspection to confirm compliance; and, Four, that if the respondent fails to abate the violation, the county may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this agreement, and all costs of abatement shall be assessed to the property owner. CHAIRMAN KAUFMAN: Okay. The only question I have is this case goes back to 2015. MS. GIGUERE: It does, yes. Originally the complaint had come in for multiple issues on the property with inoperable commercial vehicles, vegetative piles of debris, and the representative for property, who signed the stip here, had a vegetation removal permit for the property. So he complied temporarily by removing any inoperable commercial vehicles that were on the property and all the litter that was there that did not pertain to what they were doing, and all he was left with were the vegetative piles of debris. The permit was valid for several months. He got an extension before it expired. Then we had a burn ban last summer, if you guys October 27, 2017 Page 7 remember, in May, so that kind of took some time from that as well. And so he's been kind of moving slowly with these, but we've just gotten to the point where we need to get these piles that are left, the vegetative debris, removed off the property. That's all that remains at this time. CHAIRMAN KAUFMAN: Okay. Any questions, comments from the Board? Motions? MR. LAVINSKI: Motion to accept. MR. ASHTON: Motion to accept the stipulation as written. MR. LAVINSKI: Second. CHAIRMAN KAUFMAN: We have a motion and a second. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. MS. GIGUERE: Thank you. MS. ADAMS: The next stipulation is No. 13 from hearings, Item 5C13, Case CESD20170008234, 11222 Tamiami, LLC. (The speakers were duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Good morning. MR. PURCIELO: Good morning. CHAIRMAN KAUFMAN: Jonathan, you'd like to read a stipulation into the record? MR. MUSSE: Yes, sir. Good morning. For the record, October 27, 2017 Page 8 Jonathan Musse, Collier County Code Enforcement. It is agreed between the parties that the respondent shall pay operational costs in the amount of $66.27 incurred in the prosecution of this case within 30 days of this hearing. Abate all violations by obtaining all required Collier County approvals, building permits, inspections, and certificate of completion for the dumpster enclosure and relocate the dumpster to a location within 90 days of this hearing, or a fine of $100 per day will be imposed until the violation's abated. Respondent must notify Code Enforcement within 24 hours of abatement of this violation and request the investigator to perform a site inspection to confirm compliance; that if the respondent fails to abate the violation, the county may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this agreement, and all costs of abatement shall be assessed to the property owner. CHAIRMAN KAUFMAN: Okay. Respondent is present. Do you have any comments? You understand the stipulation as written? MR. PURCIELO: Yes, sir. CHAIRMAN KAUFMAN: You agree to that? MR. PURCIELO: Yes, sir. CHAIRMAN KAUFMAN: Okay. Why don't you state your name on the mike for the record. MR. PURCIELO: Yes, I'm sorry. Steven Purcielo. CHAIRMAN KAUFMAN: Okay. Any questions from the Board? (No response.) CHAIRMAN KAUFMAN: Hearing none, any motions from the Board? MR. LAVINSKI: Motion to accept. October 27, 2017 Page 9 MR. DOINO: Second. CHAIRMAN KAUFMAN: We have a motion and a second. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. MR. MUSSE: Thank you. MR. PURCIELO: Thank you. MS. ADAMS: The next case going in order of those that are present is going to be Item 5C7, Case CESD20170007136, Sandra C. Fulton. (The speakers were duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Good morning. MS. PULSE: Good morning. CHAIRMAN KAUFMAN: Good morning. MS. FULTON: Good morning. CHAIRMAN KAUFMAN: Could you state your name on the microphone for us. MS. FULTON: My name is Sandra Fulton. CHAIRMAN KAUFMAN: Okay. And you have the case to describe to us? MS. PULSE: Yes, sir. Good morning. For the record, Dee Pulse, Collier County Code Enforcement investigator. October 27, 2017 Page 10 This is in reference to Case No. CESD20170007136 dealing with the violation of the Collier County Land Development Code 04-41, as amended, 10.02.06(B)(1)(a) for Permit No. B -- PRBD20130204009 that is expired and did not receive a certificate of completion, located at 1462 Churchhill Circle, Unit 103, Naples, Florida, 34116; Folio No. 25305003127. Service was given on June 8th, 2017. I would like to present case evidence in the following exhibits: An aerial view of the development from the Collier County Property Appraiser website. CHAIRMAN KAUFMAN: Has the respondent seen that? MS. PULSE: Yes, sir. CHAIRMAN KAUFMAN: Do you have any problem with that being used? MS. FULTON: No, sir. CHAIRMAN KAUFMAN: Okay. Could I get a motion from the Board to accept. MR. LAVINSKI: Motion to accept. MR. ASHTON: Second. CHAIRMAN KAUFMAN: Motion and a second. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. October 27, 2017 Page 11 MS. PULSE: Okay. The complaint was received from the Building Department stating that permit PRBD20130204009 for interior demo was expired. Review of permit information shows also there is a CO hold on the permit with the following condition: A CO hold until permit pulled for reconstruction. I made contact with the owner to advise, and a notice of violation was issued. As of October 26th, the permit remains in expired status. CHAIRMAN KAUFMAN: Okay. Kerry or Danny, from a computer perspective, if we want to see that, we use the same process that we did to look at the stips? MR. BLANCO: Yes. CHAIRMAN KAUFMAN: Okay. And the purpose of this picture is to show where the facility is? MS. PULSE: Yeah, just a general location. CHAIRMAN KAUFMAN: Okay. Anybody have any questions of the county? (No response.) CHAIRMAN KAUFMAN: Hearing none, good morning. MS. FULTON: Good morning, Mr. Chairman and to the Board. My name is Sandra Fulton, as I stated earlier. I am not here to shirk responsibility. I am well aware that this matter needs to be taken care of, and it is long overdue. I am here to ask you if you would please consider giving me time to go ahead and get this properly done with a contractor so that this matter can be rectified. I have not been in the home for a very long time. I just want to give you a little bit of background information as to what delayed me. At the time that the dwelling came damaged with a flood and water, we had received notice that my sister, who was in the military at that time, had been struck, driving her car, by a drunk driver. October 27, 2017 Page 12 So when we left the area, I had no idea that my place had flooded. So when I came back, it was flooded. I went ahead and got the permit to have the demolition done. And, unfortunately, during that time I've had some other hardships with some personal health issues, financial issues. I've had a source that was going to loan me the funds that I needed to pull out. And at that time, just dealing with other personal things, I did not take care to take care of the matter; however, I have been in contact with the association since the beginning. I have maintained my mortgage payments and my association fees. As a matter of fact, upon speaking with someone down at the association, they are going to be in contact with an insurance adjustor on Monday at 9:00 so that I can get additional assistance. But it is my desire to take care of this as soon as possible, and I'm asking you to please consider -- and I know that it is up to the Board. A year would be good, but six months is really what I need so that I can make sure that everything is done from start to finish and the way that it needs to be. Because I do apologize for not having it done sooner. So if you would please hear me and at least consider my request. CHAIRMAN KAUFMAN: Okay. Were any inspections done on the property? MS. PULSE: Yes. All the inspections have been completed and passed for the demolition. CHAIRMAN KAUFMAN: Okay. So what's left is drywall, flooring, et cetera? MS. FULTON: Yes, sir. MR. LEFEBVRE: So it's down to studs or concrete block is what -- MS. FULTON: Yes, sir. It's completed gutted. CHAIRMAN KAUFMAN: Do you have any idea how long it's going actually going to take to do this? October 27, 2017 Page 13 MS. FULTON: I'm thinking perhaps six months. It may take up to a year, but I'm looking at at least six months, sir. CHAIRMAN KAUFMAN: Okay. And I guess the first thing you're going to wind up doing is pulling a permit to do this -- MS. FULTON: Yes, sir. CHAIRMAN KAUFMAN: -- or you're going to have a contractor? MS. FULTON: I'm going to have a contractor take care of that for me as soon as possible. MR. LEFEBVRE: Was this your primary residence prior? MS. FULTON: Yes, sir. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: I make a motion that there is, in fact, a violation. CHAIRMAN KAUFMAN: Okay. Do we have a second on that? MR. LAVINSKI: Second. CHAIRMAN KAUFMAN: We have a second. Any discussion on the motion? (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. October 27, 2017 Page 14 Just to let you know that there is a violation there. MS. FULTON: Yes, sir. CHAIRMAN KAUFMAN: Now, how do we resolve the violation? MR. LEFEBVRE: Let me just further ask a question. MS. FULTON: Yes, sir. MR. LEFEBVRE: It's a violation because the unit -- because she hasn't completed the permit or completed the inspections for the demo? MS. PULSE: No, sir. All those inspections have been completed. The stipulation on the demo permit was that a replacement permit be issued so that they can -- MR. LEFEBVRE: A building permit to put everything back together? MS. PULSE: Yes, to -- yes. MR. LEFEBVRE: Okay. MS. CURLEY: Is that normal? Is that normal? MS. PULSE: They do that for single-family dwellings, multifamily dwellings, yes. CHAIRMAN KAUFMAN: So the -- under the description of the violation, the permit requires -- have not been completed. It's been completed except for the CO. MS. PULSE: Yes. CHAIRMAN KAUFMAN: If -- this is somewhat hypothetical. If the CO -- do you give a CO on a place that's been gutted? MR. ASHTON: No. CHAIRMAN KAUFMAN: So on that particular permit, it's not a CO that's required. It's all the other work that needs to be done and CO'ed. MS. PULSE: Right. CHAIRMAN KAUFMAN: Okay. I understand. Well, anybody like to come up with some time frames or whatnot October 27, 2017 Page 15 that we can do? MS. PULSE: Did you want me to read my recommendation? CHAIRMAN KAUFMAN: I do. MS. PULSE: We recommend that the Code Enforcement Board orders the respondent to pay all operational costs in the amount of $64.45 incurred in the prosecution of this case within 30 days, and abate all violations by: No. 1, obtaining all required Collier County building permits or demolition permit to satisfy the conditions set forth in the previously issued demolition permit requesting all inspections and issuance of a certificate of completion/occupancy within blank days of this hearing, or a fine of blank per day will be imposed till a violation is abated; Number 2, the respondent must notify the code enforcement investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the respondent fails to abate the violation, the county may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement shall be assessed to the property owner. CHAIRMAN KAUFMAN: Okay. Anybody like to take a shot at filling in the blanks? MS. CURLEY: I have a question. CHAIRMAN KAUFMAN: Yes. MS. CURLEY: So if she signs a stipulation, does this become a record? CHAIRMAN KAUFMAN: Are you concerned with her getting a loan? MS. CURLEY: Because if she's trying to access funds on the apartment, then that might be in the way. So I was thinking, is there a way we can just extend this case? CHAIRMAN KAUFMAN: Well, there's no violation until the October 27, 2017 Page 16 date that this thing would become past due. So right now it's just the same status it is right now. So I don't think that would -- in other words, if you said you have seven days to do it and on the eighth day you're looking for funds, that's a problem. But in this particular case, depending upon the time frame that's granted, that problem doesn't exist until after that time. And also at that time if a continuance was granted, it would extend it even farther. Which brings us back to would someone like to take a shot at filling out the -- MS. CURLEY: I'll take a stab at it. CHAIRMAN KAUFMAN: Sure. MS. CURLEY: I would -- Item No. 1, I would like to insert "within 270 days," which is nine months. CHAIRMAN KAUFMAN: Okay. MS. CURLEY: And I'll ask for some assistance on the dollar amount if it exceeds that 270 days. I'm not sure -- MR. LEFEBVRE: I was right on the mark at 270 days also. I was thinking $150 -- MS. CURLEY: Okay. MR. LEFEBVRE: -- a day. CHAIRMAN KAUFMAN: Okay. MS. CURLEY: So we're good with that. So let's do the motion: To Item No. 1, obtain all Collier County building permits or demolition permit to satisfy the conditions set forth as the previously issued demolition permit requesting all inspections and issuance of certificate of completion/occupancy within 270 days of this hearing, or a fine of $150 per day will be imposed until the violation is abated. CHAIRMAN KAUFMAN: Okay. MR. L'ESPERANCE: Second that, Mr. Chairman. CHAIRMAN KAUFMAN: We have a motion and a second. Any discussion on the motion? October 27, 2017 Page 17 (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. So you have nine months. MS. FULTON: Yes, sir. CHAIRMAN KAUFMAN: If it's not done in nine months, I suggest -- MS. FULTON: It will be done. CHAIRMAN KAUFMAN: -- prior to that you come back here so we can act accordingly. MS. FULTON: Thank you very much. Thank you. MS. PULSE: Thank you. MS. ADAMS: The next case is No. 5C8, Case CESD20170001553, Armando Santiestabon. (Danny Blanco, the Interpreter herein, was sworn to truly and correctly translate English into Spanish and Spanish into English, and indicated in the affirmative.) (The speaker was duly sworn and indicated in the affirmative.) MS. CHINCHILLA: Yes, I do. CHAIRMAN KAUFMAN: Could you state on the microphone. MS. CHINCHILLA: Yes, I do. CHAIRMAN KAUFMAN: Okay. And could you give us your October 27, 2017 Page 18 name on the microphone. MS. CHINCHILLA: Merilin Tatinana Castro Chinchilla. CHAIRMAN KAUFMAN: Could you spell that for our court reporter, and for me. THE INTERPRETER: I'm going to go ahead and spell it out. M-e-r-i-l-i-n, Tatinana, T-a-t-i-n-a-n-a, Castro, C-a-s-t-r-o, Chinchilla, C-h-i-n-c-h-i-l-l-a. MS. CURLEY: Just for some clarification, what -- CHAIRMAN KAUFMAN: Pull your mike down so we can hear you. MS. CURLEY: Are we on case No. 8? CHAIRMAN KAUFMAN: Yes, we are. Okay. Now, this case was listed as Santiestabon; is that correct? MS. CURLEY: Armando. CHAIRMAN KAUFMAN: Okay. What is the relationship between -- can I call you Merilin for short? (No response.) CHAIRMAN KAUFMAN: Okay. What is the relationship between you and the name that is on the document? MS. CHINCHILLA: Husband. THE INTERPRETER: Her husband. CHAIRMAN KAUFMAN: Okay. And do you have his permission to represent him at this meeting? THE INTERPRETER: Yes, she does. CHAIRMAN KAUFMAN: All right. So let us begin. You go first. Have you been sworn in? (The speaker was duly sworn and indicated in the affirmative.) MS. RODRIGUEZ: Good morning. For the record, Maria Rodriguez, Collier County Code Enforcement. This is in reference to Case No. CESD20170001553 dealing with violations of Collier County Land Development Code 04-41, as October 27, 2017 Page 19 amended, Section 10.02.06(B)(1)(a) dealing with a converted garage into an efficiency with electric, plumbing, and A/C. A new opening for a window was erected. They removed the interior door leading into the primary structure all without first obtaining the authorization of the required permits, inspections, and certificate of occupancy as required by the Collier County building. Located at 2290 Robin Drive, Naples, Florida, 34117; Folio No. 61735281052. Service was given on May 5th, 2017. I would now like to present case evidence of the following exhibits: B1 through B7. Photos were taken by me on April 3rd, 2017. CHAIRMAN KAUFMAN: Has the respondent seen these photos? MS. RODRIGUEZ: Yes. THE INTERPRETER: Yes, she has. CHAIRMAN KAUFMAN: And does she have any problem with those being shown now? MS. CHINCHILLA: No. CHAIRMAN KAUFMAN: Okay. MR. LAVINSKI: Motion to accept. MR. LEFEBVRE: Second. CHAIRMAN KAUFMAN: We have a motion and a second to accept. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. October 27, 2017 Page 20 CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. Thank you. That's a little blurry. MS. ADAMS: Hang on. CHAIRMAN KAUFMAN: It looks like a snowstorm. MS. ADAMS: Is that upside down? MS. RODRIGUEZ: No, that's right. That is part of the bedroom in the efficiency room. CHAIRMAN KAUFMAN: That was -- in other words -- MS. RODRIGUEZ: It's a bedroom. CHAIRMAN KAUFMAN: -- what you're saying is that's -- in the garage, that's what it's been converted to? MS. RODRIGUEZ: Yes. CHAIRMAN KAUFMAN: Okay. That's a shower that you take from the bottom. MS. ADAMS: Sorry. MR. RODRIGUEZ: That's the shower, sink, kitchen sink, window, A/C unit, electric, and that's just the other door, which I believe that's the door that led into the main primary house. CHAIRMAN KAUFMAN: Okay. It used to go from the garage into the house? MR. RODRIGUEZ: Yeah. CHAIRMAN KAUFMAN: Okay. Have any permits on this conversion been pulled? MR. RODRIGUEZ: They applied for a permit on July 25th, 2017. Permit was rejected on August 8th. They resubmitted corrections and got rejected again. On October 3rd, they resubmitted again, got rejected again. He resubmitted yesterday and, of course, it's pending right now. So I don't know if it's going to get rejected or if they're going to October 27, 2017 Page 21 approve it. I don't know. CHAIRMAN KAUFMAN: Do you know the reason it was rejected to begin with it? MR. RODRIGUEZ: He was missing -- I guess when he tried to put the corrections in, he didn't bubble up what the actual -- they're really specific when they come to corrections. And he didn't bubble up with the notes as to what he was doing, so they rejected it, and then this is the last time. So I'm hoping that this is it. CHAIRMAN KAUFMAN: Hopefully it's not the floor elevation. MS. RODRIGUEZ: No, it's not. CHAIRMAN KAUFMAN: Okay. So -- and you've been in contact with the respondent? MS. RODRIGUEZ: I have. CHAIRMAN KAUFMAN: And they're making their effort to pull the permit, et cetera? MR. RODRIGUEZ: She is. CHAIRMAN KAUFMAN: Okay. All right. Now, Merilin -- close -- what does she have to say in this case? THE INTERPRETER: She would like to request some time to get the permits that she needs. CHAIRMAN KAUFMAN: Okay. Does she have any idea of how much time she needs? You probably should have both voices on the microphone. MS. CHINCHILLA: Three months. CHAIRMAN KAUFMAN: Okay. Most of the work has already been completed? MS. CHINCHILLA: Yes. CHAIRMAN KAUFMAN: So once the permit is issued, then the inspections will take place, and then hopefully everything passes, and she would receive a CO. October 27, 2017 Page 22 MS. CHINCHILLA: Yes. CHAIRMAN KAUFMAN: Okay. So, now, does a violation exist from the Board? MR. LEFEBVRE: Well, I guess I have a question. Does this have to be a permit by affidavit? So an engineer would have to look at it, an architect, and so forth? MR. RODRIGUEZ: Well, it has. That's part of what she's going through. MR. LEFEBVRE: Oh, okay. MS. RODRIGUEZ: But because the window she installed wasn't the correct window, that was an issue, and she had to go and get another window, and then they were asking for specs, and it was back and forth. CHAIRMAN KAUFMAN: You have to be able to fit through the window and, in my case, that's a problem. MS. RODRIGUEZ: Yes. And it was a really small window. MR. LEFEBVRE: Okay. So they already have all the -- MS. RODRIGUEZ: Pretty much. MR. LEFEBVRE: -- professionals? Okay. So this should be a relatively, relatively -- MR. RODRIGUEZ: Relatively. I don't know financially if she can afford it at this point or not, you know. She still has to get the permit. I don't know how much it's going to be. CHAIRMAN KAUFMAN: Okay. First things first. Does -- MR. LEFEBVRE: Make a motion that a violation does exist. MS. ASHTON: Second. CHAIRMAN KAUFMAN: We have a motion and a second. Any discussion on the motion? (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. October 27, 2017 Page 23 MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. You've explained to her what we just did? Okay. Now, do you have a suggestion for us going forward? MR. RODRIGUEZ: Recommendation: That the Code Enforcement Board orders the respondent to pay all operational costs in the amount of $66.27 incurred in the prosecution of this case within 30 days and abate all violations by obtaining all required Collier County building permits or demolition permit, inspections, and certificate of occupancy/completion to either retain or remove the garage conversion improvements within blank days of this hearing, or a fine of blank per day will be imposed until the violation is abated. The respondent must notify the code enforcement investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the respondent fails to abate the violation, the county may abate the violation using any methods to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement shall be assessed to the property owner. CHAIRMAN KAUFMAN: Okay. Before we go any further, Danny, can you do me a favor? Come around and show Sue how to pull up that stipulation on her machine. We have new computers, and this is new. You know how to do that, Gerald? There's a button on the October 27, 2017 Page 24 right-hand side, and you change the view. MS. ADAMS: Arrow, and then HDMI. MR. LEFEBVRE: That will be for next meeting. CHAIRMAN KAUFMAN: Okay. Do you need some instruction also? MS. NICOLA: I touch it, and then it asks me for a log-in, so I just haven't been touching it. See, that's what comes up. CHAIRMAN KAUFMAN: Yes, we need our Superman glasses. That's much better. MS. NICOLA: Thank you. CHAIRMAN KAUFMAN: Okay. So we have your suggestion. Would anybody on the Board like to take a stab at this? The respondent has said that she needed three months, which I don't think is unreasonable. MR. LEFEBVRE: Question of the respondent. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: Is anyone living in there right now? MS. CHINCHILLA: No. CHAIRMAN KAUFMAN: Okay. Anybody like to take a shot at how many -- how much time and what the fine would be assessed if they do not meet that requirement. MR. ASHTON: I'll take a shot. Recommend that the respondent pay the 62.27 for the operational cost, and obtain all building permits and CO within 90 days, or a fine of $100 a day will be imposed. CHAIRMAN KAUFMAN: Okay. Do we have a second on that motion? MR. L'ESPERANCE: I'll second that. CHAIRMAN KAUFMAN: We have a second from Lionel. Any comments on the motion? October 27, 2017 Page 25 MS. CURLEY: I think that maybe if we doubled that number of days just because there might be some, you know, understanding issues. They've spent three months trying to get the permits right, and so it might be helpful for them to have some more time. It might be a learning curve for them, so -- MR. ASHTON: Ninety days. MS. CURLEY: A contractor could get it done in 90 days, but not an individual. MS. RODRIGUEZ: Her husband is out of town, or out of the state. He won't be back until December, like towards the end of December, so maybe. MR. LEFEBVRE: But if there's a contractor already engaged, there's an engineer engaged -- MR. ASHTON: Yeah. It's already in process, already in process. MR. LEFEBVRE: Right. It's not like we're starting from scratch. I was thinking 120, but -- MS. CURLEY: Also, you can stretch out the financing of the situation over six months also. CHAIRMAN KAUFMAN: Nobody said that they need to finance this at this point, or maybe I missed it. So finance is not an issue right now. MR. LEFEBVRE: I don't think she means, like, physically finance it, but pay for it. MS. CURLEY: Like, have the funds available. You could have funds -- six months' worth of funds rather than three months' worth of funds. CHAIRMAN KAUFMAN: Okay. Gerald is suggesting 120 days to the motion. MR. ASHTON: I will amend it to 120. MR. L'ESPERANCE: And I will amend my second. October 27, 2017 Page 26 CHAIRMAN KAUFMAN: Okay. Are you happy with that? MS. CURLEY: Happier. CHAIRMAN KAUFMAN: Happier. Okay. MR. LEFEBVRE: Also, how about no one lives in there until they do get the permits? I think that would be something that should be added in there. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: I know it's kind of hard to enforce, but... CHAIRMAN KAUFMAN: Okay. We have a motion, and we have a second. Any comments on the motion now? (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. THE INTERPRETER: Excuse me, Mr. Chairman. Could you repeat the fine amount? CHAIRMAN KAUFMAN: The fine is $100 a day after 120 days. So she asked for 90 days. The Board granted her 120 days. MR. L'ESPERANCE: Please be sure she understands that fine does not go into affect until -- CHAIRMAN KAUFMAN: After. Now, if -- MS. NICOLA: February 24th, 2019. CHAIRMAN KAUFMAN: If it's -- if it's not done prior to the October 27, 2017 Page 27 120 days, that date in February, we suggest that she come back here and let us know what's going on, why it hasn't been met, and if she needs additional time, the Board would be certainly happy to hear it. Okay. Thank you. MS. CHINCHILLA: Thank you. MS. ADAMS: The next case that we have someone present is going to be Item 6A3 on the agenda. Case CESD20160002752, James Gadsden and Scottie L. Gadsden, Guardian. CHAIRMAN KAUFMAN: Okay. This is in the imposition of fines. (The speakers were duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Okay. Are you on board? We're going to pause for a second. We're just overcoming our novice approach to this. Okay. You want to read this into the record, or do we want to hear from the respondent first? MR. LOPEZ-SILVERO: The respondent would like to make a request. CHAIRMAN KAUFMAN: Okay. Could you state your name on the microphone for us? MR. GADSDEN: Scottie Gadsden. CHAIRMAN KAUFMAN: Okay. You may want to put that up. They adjusted it for me, and I'm short. Okay. MR. GADSDEN: Scottie Gadsden. CHAIRMAN KAUFMAN: Okay. Why don't you let us know what you're looking for. MR. GADSDEN: I'm looking for just if you can understand my -- some months as far as trying to get this building up to code. And I just recently got with a contractor, and he just -- I guess he submitted for us trying to get the permit, as far as getting the -- you know, trying to get the work done. October 27, 2017 Page 28 CHAIRMAN KAUFMAN: Okay. I'm reading here, this originally came in in September of 2016, and then the Board granted an extension -- a continuance. What has happened since -- it was April 28th when the continuance was granted. Has there been any progress? MR. GADSDEN: Well, it had been -- not really. But the biggest thing is financially. Now since I got a -- I just recently got a contractor now, so I'm -- you know, he say he willing to work with me as far as the financial part of trying to get permits pulled and the work done. And so I think he just submitted the permit this past -- this week. You know, it's in the process of being pulled now. I don't know how long it's actually going to take to get -- you know, to be pulled. CHAIRMAN KAUFMAN: Okay. MR. LOPEZ-SILVERO: I would like to add something. Good morning. For the record, Steven Lopez-Silvero, Collier County Code Enforcement. There was a building permit applied for earlier this week for upgrading and the repairing of the interior, which is what the violation is for. The permit, of course, has a six-month expiration, so it will expire about April 2018. I don't know if any interior work has been done up till now, but they've at least shown some type of progress by at least applying for the permit. CHAIRMAN KAUFMAN: Gerald? MR. LEFEBVRE: Has the permit been granted yet? MR. LOPEZ-SILVERO: What was that, sir? MR. LEFEBVRE: Has a permit been granted? MR. LOPEZ-SILVERO: It's in pending status. MR. LEFEBVRE: Okay. So it's in -- okay. It took a long time to get that permit submitted; 13 months, almost. October 27, 2017 Page 29 CHAIRMAN KAUFMAN: That's correct. I'm -- my take on this is a permit -- there is progress recently, this week. I would like to review this in a short period of time to see that work is going on and this thing is going to be completed, not to grant an extended period of time. How long do you think this is going to take to go through the process of getting the work done and getting the inspections done and, ultimately, getting a CO? MR. GADSDEN: I would say at least three or four months, at least once we get the permit pulled, and I don't know how long that going to take, you know, for us to actually get the permit pulled and start the work. Once we get that done, then I can, you know, start; work need to be done on the building. CHAIRMAN KAUFMAN: Okay. You say "building." This is the interior of a home or a -- MR. GADSDEN: No, it's a commercial building. It's commercial. CHAIRMAN KAUFMAN: Okay. So they're doing electrical, drywall and plumbing and air? MR. GADSDEN: Yes, yes. CHAIRMAN KAUFMAN: Okay. Any other comments from the Board? MR. LEFEBVRE: Has this work already been started? MR. GADSDEN: What you mean -- as far as work was done on the building? MR. LEFEBVRE: Just -- I'm reading the description. It says, interior remodeling including, but not limited to, new drywall, new framing, electrical, plumbing, flooring, installation of central air-conditioning system, all which were observed on improved unoccupied commercial property. Has this work been done? MR. GADSDEN: No. The work need to be done. October 27, 2017 Page 30 MR. LEFEBVRE: Okay. So it was started, and then someone saw that the work was being done, and they stopped? MR. GADSDEN: Right. MR. LEFEBVRE: Okay. CHAIRMAN KAUFMAN: And as far as the use, it's not being used now? MR. GADSDEN: No, it's not being used. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: I make a motion -- if we continue, the fines -- CHAIRMAN KAUFMAN: A continuance, go ahead. MR. LEFEBVRE: Okay. I'd like to make a motion to continue this case for three months. MR. DOINO: Second that. CHAIRMAN KAUFMAN: Okay. We have a motion to continue -- a continuance for three months, and a second. Any comments on the motion? (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. In three months I doubt seriously where everything is going to be completed. We can always be hopeful. But I would suggest that in three months if you come back because it's not done, that you can October 27, 2017 Page 31 show the Board that there has been an effort to, A, get the permit completed -- the status of the permit be active and that some work is going on here to finish this job. MR. GADSDEN: Okay. CHAIRMAN KAUFMAN: Okay. MR. GADSDEN: Thank you. CHAIRMAN KAUFMAN: Okay. Thank you. MR. LOPEZ-SILVERO: Thank you. MS. ADAMS: The next item is No. 5C1 on the agenda, Case CESD20160007274, Real Estate of Tienda Mexicana, Incorporated. And that's Steven's case, so -- he just walked out for a minute. CHAIRMAN KAUFMAN: We can wait for him. (The speaker was duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Good morning. Haven't seen you in a while. MR. LOPEZ-SILVERO: Good morning. For the record, Steven Lopez-Silverio, Collier County Code Enforcement. This is in reference to Case No. CESD20160007274 dealing with a violation of Collier County Land Development Code 04-41, as amended, Section 10.02.06(B)(1)(a), unpermitted exterior alterations being conducted to a structure on improved occupied commercial property located at 217 North 15th Street, Immokalee, Florida, 34142; the folio, 00131360004. Personal service was provided on June 3rd, 2016. I would like to present case evidence in the following exhibits: Three -- correction -- three pictures taken by myself on May 19th, 2016, and October 25th, 2017. CHAIRMAN KAUFMAN: Let's pause one second. Yes, sir? MR. GADSDEN: I'm just wanting to hear this. That's all. CHAIRMAN KAUFMAN: Are you involved in this particular October 27, 2017 Page 32 case? MR. GADSDEN: It's not -- MR. LOPEZ-SILVERO: No. This is for a different case, but I'll be right with you. MR. GADSDEN: Oh, okay. MR. LEFEBVRE: Unless you want to be involved in this case. MR. GADSDEN: No. CHAIRMAN KAUFMAN: Okay. You have some pictures to present. Can I get a motion from the Board? Let's show that the respondent is not present. Can I get a motion to accept the exhibits? MR. DOINO: Motion to accept. MR. LAVINSKI: Second. CHAIRMAN KAUFMAN: Motion and a second. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. MR. LOPEZ-SILVERO: This first picture was taken May 19th, 2016. This was when construction first started on the fascia of the property. This is -- currently it's occupied, and it's a supermarket. CHAIRMAN KAUFMAN: Okay. MR. LOPEZ-SILVERO: The second picture is just recently, earlier this week, of the after-construction. They added a covered October 27, 2017 Page 33 terrace, concrete posts or pillars out front, and they've updated or upgraded the fascia up top. CHAIRMAN KAUFMAN: Okay. MR. LOPEZ-SILVERO: On May 4th, 2016, said case was referred to our office from the Contractors Licensing Division for further follow-up and enforcement. Said division did not find any licensing violations at the time and has since completed their investigation. On May 19th, 2016, mentioned violation was observed. I met with the store manager to advise of the violation and provide the correction -- the corrective action needed for compliance. Property history research relieved that a building permit, PRBD20150826986, to replace and/or repair canopy and entry doors had been obtained but is currently in expired status with no recent activity. As of August 26th, 2017, the building permit in question remains expired -- correction -- remains in expired status, and the violation remains. CHAIRMAN KAUFMAN: Okay. Have you spoken with the respondent? MR. LOPEZ-SILVERO: Not recently, sir. They were advised of today's hearing. CHAIRMAN KAUFMAN: Okay. Has anybody from Code Enforcement had the opportunity to touch base with the respondent? MR. LOPEZ-SILVERO: In email exchange, but not -- I feel he's -- the property owner's kind of dragging his feet on this case, because it's been -- this case was initiated back in May of 2016. CHAIRMAN KAUFMAN: Right. The notice of violation was June 3rd, '16. MR. LOPEZ-SILVERO: And the permit in question has been expired and reactivated several times back and forth. October 27, 2017 Page 34 CHAIRMAN KAUFMAN: Okay. Anybody want to find if this is in violation or not? MR. LAVINSKI: Well -- MR. LEFEBVRE: Did they feel that because they got a permit, that would get rid of the violation? Is that what their thinking was? MR. LOPEZ-SILVERO: I believe he's aware, and I've spoken also to his contractor just to advise of the permit status. They're aware that inspections are pending and also pending certificate of completion. CHAIRMAN KAUFMAN: You said they have inspections pending? MR. LOPEZ-SILVERO: They do -- before the permit was expired -- CHAIRMAN KAUFMAN: Okay. MR. LOPEZ-SILVERO: -- they had commenced inspections, and then the permit had expired. CHAIRMAN KAUFMAN: Okay. So does a violation exist? MR. ASHTON: Make a motion a violation exists. MR. LAVINSKI: Second. CHAIRMAN KAUFMAN: We have a motion and a second that a violation exists. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. MR. LEFEBVRE: I have another question. October 27, 2017 Page 35 CHAIRMAN KAUFMAN: Shoot. MR. LEFEBVRE: If an inspection's done, doesn't that extend the permit? MR. LOPEZ-SILVERO: It does, and it did extend the permit till it expired. They let the timeline lapse. CHAIRMAN KAUFMAN: After an inspection, I believe they have six months. Am I correct, Jeff? MR. LETOURNEAU: That's correct. CHAIRMAN KAUFMAN: Okay. So there was an inspection done more than six months ago, and then -- MR. LEFEBVRE: The permit expired in August. MR. LETOURNEAU: No. The permit expired on July 18th of this year, yes. MR. LEFEBVRE: So then there was an inspection done sometime at the beginning of the year. MR. LOPEZ-SILVERO: Yes, sir. That's correct -- MR. LETOURNEAU: Correct. MR. LEFEBVRE: -- at the minimum, and then extended it, and -- MR. LOPEZ-SILVERO: Yes, sir. CHAIRMAN KAUFMAN: Well, a violation exists. The respondent is not present even though they were notified. They were notified by mail. Did you post the building or -- MR. LOPEZ-SILVERO: I provided personal service of the notice. CHAIRMAN KAUFMAN: So you did hand them the NOV? MR. LOPEZ-SILVERO: Yes, sir. CHAIRMAN KAUFMAN: And they knew this was going to be brought before us today? MR. LOPEZ-SILVERO: That's correct. CHAIRMAN KAUFMAN: Okay. All right. Do you have a October 27, 2017 Page 36 suggestion for us? MR. LOPEZ-SILVERO: I do; that the Code Enforcement Board order the respondent to pay -- correction -- to pay operational costs in the amount of $65.36 incurred in the prosecution of this case within 30 days and abate all violations by, No. 1, completing building permit PRBD20150826986 to repair/replace canopy and entry doors to include inspections and certificate of completion/occupancy or obtain a demolition permit, inspections, certificate of completion/occupancy within blank days of this hearing, or a fine of blank dollars per day will be imposed until the violation is abated. Number 2, the respondent must notify the code enforcement investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. Anybody want to take a stab at filling in the blanks? MR. LAVINSKI: I'll do this one. CHAIRMAN KAUFMAN: Okay. MR. LAVINSKI: Make a motion that the 65.36 be paid within the 30 days; that the violations be corrected within 90 days, or a fine of $250 a day be imposed. MR. LEFEBVRE: Second. CHAIRMAN KAUFMAN: We have a motion and a second. Any discussion on the motion? (No response.) CHAIRMAN KAUFMAN: Hearing none, all those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. October 27, 2017 Page 37 MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. Thanks, Steven. MR. LOPEZ-SILVERO: Thank you. MS. ADAMS: The next case is Item 5C9, Case CESD20160020044, Teresa Scoppettone. CHAIRMAN KAUFMAN: Which is this again, C? MS. ADAMS: C9. (The speaker was duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: How are your fingers, by the way? THE COURT REPORTER: I'm good. CHAIRMAN KAUFMAN: You're okay? So far. I have one suggestion on this -- MS. GIGUERE: Okay. CHAIRMAN KAUFMAN: -- before we do anything. Under the description of violation -- MS. GIGUERE: Yes. CHAIRMAN KAUFMAN: -- it says, interior renovations, alterations done to interior including, but not limited to, kitchen countertops blah, blah, blah, blah, blah. Work done, electrical, et cetera, et cetera. You should say in there, if it is the case, without a permit. MS. GIGUERE: Okay. CHAIRMAN KAUFMAN: Okay. MS. GIGUERE: Sure. October 27, 2017 Page 38 CHAIRMAN KAUFMAN: Just wanted to -- and is that the case in this one? MS. GIGUERE: Yes. CHAIRMAN KAUFMAN: Okay. Because you're allowed to do lots of work -- MS. GIGUERE: Originally. CHAIRMAN KAUFMAN: -- you just need to get a permit. MS. GIGUERE: Yes, originally. Good morning, for the record, Vicky Giguere, Collier County Code Enforcement. This is in reference to Case No. CESD20160020044 dealing with violation of Collier County Land Development Code 04-41, as amended, Section 10.02.06(B)(1)(a), interior renovations and alterations including, but not limit to, kitchen countertops, cabinets, sink, bathroom cabinets, countertops, toilet, tile work. Work done includes electrical, plumbing, structural, et cetera, all prior to obtaining a Collier County building permit, located at 1714 Kings Lake Drive, Unit 201, Naples, Florida, 34112; Folio 46770280004. Service was given on December 15th, 2016. I would like to now present case evidence in the following exhibits: Two photos taken by Contractor Licensing on August 16th, 2016. CHAIRMAN KAUFMAN: Okay. MR. LAVINSKI: Motion to accept. CHAIRMAN KAUFMAN: Show that the respondent is not present. Do we have a motion to accept? MR. DOINO: Second. CHAIRMAN KAUFMAN: And a second. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. October 27, 2017 Page 39 CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It's hard for me to keep up with these guys, they're so fast. Okay. Why don't you show the photos. MS. GIGUERE: So this complaint originated from the Contractor Licensing Department where they went on site and observed multiple unlicensed contractors working with no permits on file. On October 3rd, 2016, the building official, Jonathan Walsh, determined permits were required for the work being done. The notice of violation was issued, and contact was made with the owner. Permit PRBD20161039954 was applied for and issued in January of 2017. The permit expired due to lack of activity in August of 2017. The permit was actually reactivated after the notice of hearing was posted and mailed on October 20th and is now valid until February of 2018. CHAIRMAN KAUFMAN: Okay. So January they applied for a permit to do this work, six months goes by, that takes you to June or so, and then at that time this thing was put on the calendar for -- to be brought before the Board. MS. GIGUERE: Yes. Actually in September, but the hearing was canceled. CHAIRMAN KAUFMAN: I don't know why, but okay. And then it -- and then knowing that this was coming before the Board, they reactivated the permit. October 27, 2017 Page 40 MS. GIGUERE: (Nods head.) CHAIRMAN KAUFMAN: So my question to the county is, if the permit is now active, what are we hearing? MR. LETOURNEAU: Well, I mean -- for the record, Jeff Letourneau, Collier County Code Enforcement. I just felt that because they had allowed it to expire for three months and then all of a sudden they get a hearing notice, and then they rush down here to get it reapp'ed and reissued, I felt that we should bring it before the Board because they were dragging their feet on this thing, obviously. CHAIRMAN KAUFMAN: Okay. MS. GIGUERE: If I may, I've also attempted contact with the contractor multiple times, and he doesn't respond to my attempts. And when they had it issued, they just didn't do anything with it. They just let it sit there, and that's why it expired. MR. LETOURNEAU: I'm just afraid if we don't hold their feet to the fire at this point, they're going to let it expire again. CHAIRMAN KAUFMAN: Well, I don't disagree with you. I just -- I'm concerned on how we hold their feet to the fire if they have a valid permit right now. And they pulled the permit when, did you say? This week or last week? MS. GIGUERE: They reactivated it on October 20th. Excuse me. CHAIRMAN KAUFMAN: So they have six months to have at least one inspection? MS. GIGUERE: Correct. If they don't do anything with it, it will expire in February. CHAIRMAN KAUFMAN: Okay. So I'm trying to grasp at straws now. MR. LETOURNEAU: If you're uncomfortable, we can withdraw it. That's no issue. I just -- we were just going to ask for October 27, 2017 Page 41 a -- to see if there was a violation and make sure they get the CO within a certain amount of time. CHAIRMAN KAUFMAN: And I agree with you. I'm just trying to figure a way -- what could be done since there is an active permit right now. MS. CURLEY: So this case was one that was postponed because of last month's meeting? CHAIRMAN KAUFMAN: That's correct. MS. CURLEY: So they wouldn't have had this permit active as of last month's meeting. MR. LEFEBVRE: But since we had this meeting now, they beat us to the punch. MS. CURLEY: Right. CHAIRMAN KAUFMAN: It's hard to turn the clock back. Tami? MS. NICOLA: I'm concerned a little bit about the notice, because the normal person reading this notice might think that by obtaining the permit that the violation has been cured. So that's probably why they rushed out and got the permit. MS. GIGUERE: Well, I know that I made -- the notice of violation that's originally issued states specifically on there that you have to have your permit all the way through a certificate of completion to be in compliance. And so when they don't do that within the time frame, that's when we prep it for a hearing, and that's where we are today as far as it was expired up until they got the notice and said, oh, well, maybe if I just reactivate it, they'll leave it alone, but they're still not technically in compliance because they haven't gotten any inspections, let alone a certificate of completion. CHAIRMAN KAUFMAN: But the rule is that you have six months to have an inspection, unless I'm missing the ball here. MS. GIGUERE: No, that is correct. October 27, 2017 Page 42 CHAIRMAN KAUFMAN: So by them reactivating the permit in October, they're actually in compliance right now; is that correct? MR. LETOURNEAU: I wouldn't say that, because I'm looking at the actual ordinance that we cited, and no building or structure shall be erected, moved, added to, altered, utilized, allowed to exist, blah, blah, blah, without first obtaining the authorization of the required permits, inspections, and certificate of occupancy as required by the Collier County building. They haven't obtained inspections, they haven't obtained a certificate of occupancy. They hired unlicensed contractors, got busted by Contractor Licensing, pulled the permit, did nothing, and let it expire, and then when they get a hearing notice, they rush out and get it reissued. I think they're -- I think they're in violation right now. I do, but -- MS. CURLEY: So they didn't call for any inspections on the first permit which was opened and expired, so that's what -- MR. LETOURNEAU: I have to look at that permit. MS. GIGUERE: I do believe that is correct. CHAIRMAN KAUFMAN: They couldn't have because they're unlicensed. MS. CURLEY: No, no. This was after the unlicensed people. MS. GIGUERE: Right. So Contractor Licensing found contractors that had no licenses and no permit doing work. That was -- the pictures are what the state of the unit was by the time Contractor Licensing was notified. So they had clearly started on a lot of work without any permits, and then they hired a contractor who obtained a permit in January, but there was no activity done with it whatsoever, and it expired in July. And they let it sit expired from July until they got the hearing notice in October. MS. CURLEY: So then the violation exists that they had a permit open that it expired with no calls for inspections? October 27, 2017 Page 43 MS. GIGUERE: Correct. MR. LEFEBVRE: But we go back to the violation. MS. CURLEY: What would we have done a month ago before this new permit was pulled? CHAIRMAN KAUFMAN: There was a violation a month ago. That was before the permit was pulled. I'm -- MR. LEFEBVRE: I think -- two ways of going on this. One would be we find that there's no violation currently, or the county withdraws the case. CHAIRMAN KAUFMAN: I agree with you. MR. LEFEBVRE: The county withdraws the case. CHAIRMAN KAUFMAN: The county withdraw the case and bring it back. MR. DOINO: I say withdraw it. MS. NICOLA: That would be my suggestion. CHAIRMAN KAUFMAN: Well, let's -- MS. GIGUERE: The county concurs. CHAIRMAN KAUFMAN: So you're going to withdraw it? MS. GIGUERE: We will withdraw. CHAIRMAN KAUFMAN: And -- MS. CURLEY: Tell me what happens to the unlicensed people. Is that something that happens behind the scenes? MS. GIGUERE: Yeah. Contractor Licensing would handle those. Basically, when they find someone on site, they require them to provide them their licensing and any information. If they don't have any licensing, they are issued citations. MR. CURLEY: Just curious. CHAIRMAN KAUFMAN: Then they go before a firing squad. MS. CURLEY: Thank you. MS. GIGUERE: Thank you. CHAIRMAN KAUFMAN: Fingers check. October 27, 2017 Page 44 THE COURT REPORTER: I'm good. CHAIRMAN KAUFMAN: You're good. Okay. MR. LEFEBVRE: Do we want to skip to -- MS. NICOLA: If I'm looking at this correctly, I think we have two cases left. Am I wrong? CHAIRMAN KAUFMAN: Someone came in. MS. ADAMS: Two left. Okay. The next case under old business, Item 6A4, Case CESD20170002326, Jordan A. Thompson. (The speaker was duly sworn and indicated in the affirmative.) MR. SHORT: Good morning. For the record, Supervisor Eric Short, Collier County Code Enforcement. This is -- CHAIRMAN KAUFMAN: Good morning. MR. SHORT: -- in regards to violations of the Collier County Land Development Code 04-41, as amended, Section 10.02.06(B)(1)(a). Location is 672 92nd Avenue North Naples; Folio 627045600047. Description: Garage converted to living space and a screen room enclosed without required permits, inspections, and certificate of occupancy. Past orders: On May 25th, 2017, the Code Enforcement Board issued a finding of fact, conclusion of law and order. Respondent was found in violation of the referenced ordinances and ordered to correct the violation. See the attached order of the board, OR Book 5400, Page 3534, for more information. The violation has not been abated as of October 27th, 2017. Fines and costs to date are as follows: Fines have accrued at a rate of $200 per day for the period from August 24th, 2017, to October 27th, 2017, 65 days, for a total fine amount of $13,000. Fines continue to accrue. Previously assessed operational costs of $65.01 have been paid. October 27, 2017 Page 45 Operational costs for today's hearing, $63.09, for a total amount of $13,063.09. CHAIRMAN KAUFMAN: Okay. Has anybody been in contact with the respondent? MR. SHORT: Yeah. Before -- this was scheduled for the September hearing, and obviously that was -- that hearing was not held, but they did ask for more time at that time because they were going to be out of the town, and they were going to work on pulling a permit, but no compliance efforts have been done. CHAIRMAN KAUFMAN: So they have not pulled a permit; they have not applied for a permit? MR. SHORT: That's correct. CHAIRMAN KAUFMAN: Okay. MR. LAVINSKI: Motion to impose. MR. ASHTON: Second. CHAIRMAN KAUFMAN: We have a motion and a second to impose the fine. All those in favor? MS. CURLEY: Aye. MR. DOINO: Aye. MR. LAVINSKI: Aye. CHAIRMAN KAUFMAN: Aye. MR. LEFEBVRE: Aye. MR. L'ESPERANCE: Aye. MR. ASHTON: Aye. CHAIRMAN KAUFMAN: Opposed? (No response.) CHAIRMAN KAUFMAN: It carries unanimously. Thanks, Eric. MR. SHORT: Thank you. MS. ADAMS: The next case is Item 6A5, Case CESD20150017888, Julian Francois, LLC. October 27, 2017 Page 46 (The speakers were duly sworn and indicated in the affirmative.) CHAIRMAN KAUFMAN: Could you bend the microphone towards you so we can hear. MS. FRANCOIS: I do, sir. CHAIRMAN KAUFMAN: Okay. You're before us now. This is an old case that dates back to July of '16, so it's over a year old. This has to do with unpermitted interior/exterior improvements on a structure, et cetera. And I know you've been before us before, if I'm not mistaken. MS. FRANCOIS: Yes. CHAIRMAN KAUFMAN: So we're all ears. MS. FRANCOIS: I applied for the permit. There were two things going on. I applied for the permit. They had issued me -- they said that there were some things wrong with it. The guy went back and refixed the permit. So the permit, it's in there now, you know, so I could just call for the -- MR. LEFEBVRE: Inspection. MS. FRANCOIS: Yeah, inspection, but everything's already been through. The drawing already been submitted, which is here. He gave me a copy, and the receipt. So I'm just waiting to -- you know, to finish with it. CHAIRMAN KAUFMAN: So all the work has been done, the electrical, windows, all of that is completed? MS. FRANCOIS: Yeah, yeah. CHAIRMAN KAUFMAN: And it's been inspected? MS. FRANCOIS: No, it's not inspected. CHAIRMAN KAUFMAN: Because you haven't gotten the permit yet. MS. CURLEY: When you got the permit and you fixed it, then when you resubmitted it, it was approved? MS. FRANCOIS: No, it wasn't approved the first time, ma'am. October 27, 2017 Page 47 It wasn't. They had sent a paperwork that said what needed to be fixed, and the guy went back and fixed it, and -- MS. CURLEY: Then it got approved? MS. FRANCOIS: No, it haven't -- I think it is. I should know by this afternoon, because he told me to go ahead call him. I should know by the end of this afternoon. CHAIRMAN KAUFMAN: So as far as the work, there's just two things. The work is done, but without the permit, the inspections can't be done, if I'm not mistaken, so that's what -- we're waiting for the permit so that the inspections can be done. Is that -- MR. LOPEZ-SILVERO: That's correct, sir. CHAIRMAN KAUFMAN: That's correct, okay. MS. CURLEY: And this was your son's -- this property was in your son's name? MS. FRANCOIS: Uh-hmm. MS. CURLEY: Yeah. There was a little bit of a delay because she wasn't able to put the permits in because it wasn't in her name. MS. FRANCOIS: No. He had to give me a paper to sign, and he had to come here with it. And he's in school. So he had to give me a paper to sign so I could pull the permit, which was fine. And then we had another issue, too, due to the fact that the they put the property under the LLC. It had to be a construction, had to do -- the guy from the construction have to come in, I think, look at it, but he did come. CHAIRMAN KAUFMAN: On this case, I'd almost like the county to pull it for one month. Let's see if the permit gets approved, et cetera. We'll be in a lot better position to address this case, in a month. (The speaker was duly sworn and indicated in the affirmative.) MS. PEREZ: Yes. For the record, Cristina Perez, Collier County Code Enforcement. October 27, 2017 Page 48 The permit itself was submitted on October 11th. It was rejected on October 18th, and there are no current revisions that have been resubmitted as of right now when I checked the permit. There's -- in reviewing the correction letter, there's some concerns on the county's behalf that they refer to it as a commercial building and that it requires a site plan. So I don't know if the information that they've submitted confused the process, thinking that it's a commercial building. And I know that they want to use it as a residential building. So that's one of the rejections on there that it says, you know, for commercial buildings there has to be an approved site plan. That's one of the holdups. And then it also requests for plans showing what the existing building was prior to them making the corrections, and then it wants specifications on the rooms that are, you know, within the building. So there's still some corrections that need to be submitted. As of right now that has not been completed. So the permit is still in rejection status. The other issue that came up when we presented this as an imposition of fines before was that there was people living in this building, and there has been electrical alterations, you know, along with the structural alterations. We did give her additional time for her to be able to get her son's authorization to do an eviction notice with the Sheriff's Office, where she claimed that her husband was the one who allowed these people to be here. I drove by the building on Tuesday, and there were still people utilizing the building as living quarters. MS. FRANCOIS: That is true what Ms. -- CHAIRMAN KAUFMAN: Perez. MS. FRANCOIS: -- Perez say. That is true. The people that are living there -- the first people had moved out. They went to live on October 27, 2017 Page 49 2nd Street across the casino. And the -- we got four people living -- one is living, like, in the -- she just sleeps there, you know, like in the back room. She just sleep there, because her trailer -- FEMA supposed to bring her a new trailer on -- this month. The reason they haven't bring it in is the -- they say the -- there's something with the land. It has -- I think it's -- what she said? CHAIRMAN KAUFMAN: It really doesn't matter. If someone's there -- MS. FRANCOIS: There is. There's someone there, sir, Mr. Robert. And I have the evictions. CHAIRMAN KAUFMAN: Okay. But they're there. And if you have evictions and you have the ability to contact the Sheriff to get them out, has that been done? MS. FRANCOIS: Oh, yeah. The -- when the first people -- they did move out with the Sheriff help. They did move out, because they had put a sticker there. They did move out. Now it's -- I had allowed her to come stay, because she didn't have no where to go, and I thought that would be a good -- because she just didn't have nowhere to go. CHAIRMAN KAUFMAN: I'm sorry, but that's -- you're confusing the issue. MS. FRANCOIS: Yes, sir. CHAIRMAN KAUFMAN: Okay? There's no reason in the world that anybody should be permitted to stay in a place that's unsafe. I don't care if they have to apply to the government to put them in FEMA housing or whatever. That's a problem. MS. FRANCOIS: Okay. CHAIRMAN KAUFMAN: Okay. That's number one. Number two, you said you're waiting for a call from somebody. And Ms. Perez said that there's nobody that's going to call from you the county to say that this is okay; am I correct? October 27, 2017 Page 50 MS. PEREZ: I think she said that her contractor had asked her to call her -- call him this afternoon in regards to the permit. But he needs to first resubmit the plans for the county to review them, and then, you know, they'll know if it's approved or denied again. CHAIRMAN KAUFMAN: Okay. MS. CURLEY: So just for clarification, so you allowed somebody to temporarily sleep there. Were they displaced because of the hurricane? MS. FRANCOIS: Yeah. I mean -- CHAIRMAN KAUFMAN: Doesn't matter. MS. CURLEY: That's what I was just wanting -- you didn't say that, but I wanted to clarify that. You know that that's not a good idea? MS. FRANCOIS: Well -- yeah. It's -- because I had to -- because I had put my stuff there, and they were getting stoled. And so she told me, can she stay there till she get her trailer? And it's right -- her trailer, it's right across the property, so... MS. CURLEY: Get her out of there. MS. FRANCOIS: Okay. I'll take care of that. MR. LEFEBVRE: The issue we have, if we pull this to next meeting, it's only, roughly, three weeks off, a lot more than three weeks, so it's probably not going to give her enough time to resubmit for the permit and go ahead and get everything permitted. And then we don't have a meeting in December. So that, time-wise -- MS. CURLEY: Is there an office in Immokalee where the permitting is -- do they have -- does the county have an office out there? MS. PEREZ: Yes, we do. I believe our permit runner works out here in Naples, you know, does the primary work out here. So he may be submitting the work out here. But at any time they can go to the Immokalee office. We are there Monday through Friday. MS. NICOLA: I think if the Board gave her 90 days, it would October 27, 2017 Page 51 be -- it would make it to January 25th. I'm not sure when the January meeting is. But I'm just looking at my timeline, so I just thought I'd bring that up. CHAIRMAN KAUFMAN: They left on your position the -- MR. LEFEBVRE: The 26th. MS. NICOLA: Okay. So it would get us to the January meeting. MR. LEFEBVRE: But it won't give time to prepare the case. CHAIRMAN KAUFMAN: Okay. Jeff? MR. LETOURNEAU: The county has no issue withdrawing this until January; however, I'd just like to point out that we're reluctantly doing it. She's been here a lot of times. MR. LEFEBVRE: Right. MR. LETOURNEAU: And she hasn't really followed through with anything she was going to say, even though they did try to get a permit here. So I would hope the Board really -- if nothing gets done by January, I would really hope the Board would make a decision at that point. CHAIRMAN KAUFMAN: I would say that if it's not done in January, that the fines will be imposed, probably. MR. LETOURNEAU: Okay. So we'll withdraw, having said that, till January. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: I'm just going to make a comment that come January, I am not going to be in favor of extending this any further. MS. FRANCOIS: Yes, Mr. Gerald. MR. LEFEBVRE: And I'm just going to be very clear about that. MS. FRANCOIS: Yes, sir. Thank you very much, sir. CHAIRMAN KAUFMAN: Okay. So the county's withdrawing it until January? October 27, 2017 Page 52 MR. LETOURNEAU: Yes, sir. CHAIRMAN KAUFMAN: Okay. We're done. MS. PEREZ: Thank you. MS. ADAMS: Motion to adjourn. CHAIRMAN KAUFMAN: Next? MS. ADAMS: That's the last item. We don't have any other items on the agenda. CHAIRMAN KAUFMAN: Okay. MR. LEFEBVRE: The next meeting the 17th; is that correct? MS. ADAMS: Yes. It's a Friday; Friday November 17th. CHAIRMAN KAUFMAN: Any questions from the Board? Any comments? So -- yes. MR. LAVINSKI: Is there any way to make it easier for us to get to see what's on these screens rather than go through these gyrations? MS. ADAMS: Unfortunately, this is not -- MS. CURLEY: Well, I have a question also to that. On the indexing, the bookmarks on the left, that font, I don't know how to make that bigger. So I'm appreciative of this big screen, that I can make the font bigger, but I can't see this tiny little indexing screen. So it -- MR. LAVINSKI: That's two votes. MS. CURLEY: Yeah. I mean, like -- MR. LAVINSKI: That almost disappears. MS. CURLEY: It's like -- and I even stretched it so I could read it more. CHAIRMAN KAUFMAN: It needs to be bold to begin with. MS. CURLEY: Can we -- CHAIRMAN KAUFMAN: Bold print. If you just made it bold, we'd be able to see it. MR. LEFEBVRE: If we just pull it out. It's very light. MS. CURLEY: We should be able to -- as an administrative past October 27, 2017 Page 53 person on this, we should be able to make the bookmark font bigger or bold or something. MS. ADAMS: I'll ask about it. I don't know if there's anything I can -- I know I can't do anything about that, but I'll ask the people that set up the computer. CHAIRMAN KAUFMAN: Okay. If they can make it bold and bigger. MS. ADAMS: Okay. CHAIRMAN KAUFMAN: If you take a look on the right-hand side, you can see that plain as day. I made my screen bigger. I don't know if you did, Sue. MS. CURLEY: I did, very much so, and I stretched the column out. MR. LEFEBVRE: It makes it better. MS. CURLEY: This is great. So now I have higher expectations of the bookmark. CHAIRMAN KAUFMAN: Okay. MS. CURLEY: So now you've set yourself up. We want it bigger. MS. ADAMS: I mean, it may involve, like, changing the entire, like, computer programming to change it, because this is a whole computer system, a brand new computer system. But I'll definitely look into it. MS. CURLEY: I'll just bring my glasses next time. MS. NICOLA: You can get those cheaters. MS. CURLEY: But I found this really easy to go though. MR. LAVINSKI: I have glasses, and it doesn't work. CHAIRMAN KAUFMAN: Maybe we can move the screen closer to your head. MR. LAVINSKI: That's an idea. CHAIRMAN KAUFMAN: But I agree. And I'm familiar with October 27, 2017 Page 54 programming. Making it bold is not a difficult thing to do, and enlarging the print should not be difficult either. So hopefully we can get that resolved. Any other comments from the Board? I think we did really well with the computer for the first time and -- MS. CURLEY: Thanks, Danny. MS. ADAMS: Thank you, everyone. CHAIRMAN KAUFMAN: Nobody was injured during the course of the meeting. Okay. MR. LAVINSKI: Yeah. I just I think, if you can get us to switch to that stuff a little more -- MS. ADAMS: Unfortunately, I don't think there's any way to make that simpler. I think that that's the only way is you have to just select the arrow and then -- and go back and forth between HDMI or the display port. You know, maybe you can try it a few times. I think -- you know, the more I use it, it becomes, you know, a lot easier. CHAIRMAN KAUFMAN: Maybe they can put a shortcut on there. MS. CURLEY: Well -- also, if you sit on the end, if there's an open seat, then you can have that screen here and your regular agenda here, and you can sort of just look over. MR. LAVINSKI: Give us two screens then. MR. LEFEBVRE: So if someone's not here, just commandeer their screen. MR. ASHTON: I think if they can make it bolder -- if somehow they can just make it bolder -- MS. ADAMS: Okay. MR. ASHTON: -- it would solve the problem. MS. NICOLA: Do you guys know that Terri's still taking all this down? MS. CURLEY: No. Oh, motion to adjourn. October 27, 2017 CHAIRMAN KAUFMAN: We have a motion to adjourn. MR. ASHTON: Second. CHAIRMAN KAUFMAN: We are adjourned. ***** There being no further business for the good of the County, the meeting was adjourned by order of the Chair at 10:23 a.m. CODE ENFORCEMENT BOARD ROBERT . I.
