you'd like to present?
MS. GIGUERE: Yes, I do.
Therefore, it is agreed between the parties that the respondent
shall: Pay operational costs in the amount of $65.82 occurred in the
prosecution of this case within 30 days of this hearing;
Two, abate all violations by: Remove any and all prohibited
and/or unauthorized storage of materials, vehicles, litter, trash, and the
like, from the vacant property to a place intended for such
storage/disposal within 90 days of this hearing, or a fine of $100 a day
will be imposed until the violation is abated;
Three, the respondent must notify Code Enforcement within 24
hours of abatement of the violation and request the investigator
perform a site inspection to confirm compliance; and,
Four, that if the respondent fails to abate the violation, the county
may abate the violation using any method to bring the violation into
compliance and may use the assistance of the Collier County Sheriff's
Office to enforce the provisions of this agreement, and all costs of
abatement shall be assessed to the property owner.
CHAIRMAN KAUFMAN: Okay. The only question I have is
this case goes back to 2015.
MS. GIGUERE: It does, yes. Originally the complaint had
come in for multiple issues on the property with inoperable
commercial vehicles, vegetative piles of debris, and the representative
for property, who signed the stip here, had a vegetation removal permit
for the property. So he complied temporarily by removing any
inoperable commercial vehicles that were on the property and all the
litter that was there that did not pertain to what they were doing, and
all he was left with were the vegetative piles of debris.
The permit was valid for several months. He got an extension
before it expired. Then we had a burn ban last summer, if you guys

remember, in May, so that kind of took some time from that as well.
And so he's been kind of moving slowly with these, but we've just
gotten to the point where we need to get these piles that are left, the
vegetative debris, removed off the property. That's all that remains at
this time.

for the dumpster enclosure and relocate the dumpster to a location

that is expired and did not receive a certificate of completion, located
at 1462 Churchhill Circle, Unit 103, Naples, Florida, 34116; Folio No.

MS. PULSE: Okay. The complaint was received from the
Building Department stating that permit PRBD20130204009 for
interior demo was expired.
Review of permit information shows also there is a CO hold on
the permit with the following condition: A CO hold until permit
pulled for reconstruction.
I made contact with the owner to advise, and a notice of violation
was issued. As of October 26th, the permit remains in expired status.
CHAIRMAN KAUFMAN: Okay. Kerry or Danny, from a
computer perspective, if we want to see that, we use the same process
that we did to look at the stips?
MR. BLANCO: Yes.
CHAIRMAN KAUFMAN: Okay. And the purpose of this

I am not here to shirk responsibility. I am well aware that this
matter needs to be taken care of, and it is long overdue.
I am here to ask you if you would please consider giving me time
to go ahead and get this properly done with a contractor so that this
matter can be rectified.
I have not been in the home for a very long time. I just want to
give you a little bit of background information as to what delayed me.
At the time that the dwelling came damaged with a flood and water,
we had received notice that my sister, who was in the military at that
time, had been struck, driving her car, by a drunk driver.

So when we left the area, I had no idea that my place had flooded.
So when I came back, it was flooded. I went ahead and got the permit
to have the demolition done. And, unfortunately, during that time I've
had some other hardships with some personal health issues, financial
issues. I've had a source that was going to loan me the funds that I
needed to pull out.
And at that time, just dealing with other personal things, I did not
take care to take care of the matter; however, I have been in contact
with the association since the beginning. I have maintained my
mortgage payments and my association fees.
As a matter of fact, upon speaking with someone down at the
association, they are going to be in contact with an insurance adjustor
on Monday at 9:00 so that I can get additional assistance. But it is my
desire to take care of this as soon as possible, and I'm asking you to
please consider -- and I know that it is up to the Board. A year would
be good, but six months is really what I need so that I can make sure
that everything is done from start to finish and the way that it needs to
be. Because I do apologize for not having it done sooner. So if you
would please hear me and at least consider my request.

and passed for the demolition.

contractor now, so I'm -- you know, he say he willing to work with me
as far as the financial part of trying to get permits pulled and the work
done.
And so I think he just submitted the permit this past -- this week.
You know, it's in the process of being pulled now. I don't know how
long it's actually going to take to get -- you know, to be pulled.

There was a building permit applied for earlier this week for

about April 2018. I don't know if any interior work has been done up
till now, but they've at least shown some type of progress by at least

I'm -- my take on this is a permit -- there is progress recently, this
week. I would like to review this in a short period of time to see that
work is going on and this thing is going to be completed, not to grant
an extended period of time.
How long do you think this is going to take to go through the
process of getting the work done and getting the inspections done and,
ultimately, getting a CO?
MR. GADSDEN: I would say at least three or four months, at
least once we get the permit pulled, and I don't know how long that
going to take, you know, for us to actually get the permit pulled and
start the work. Once we get that done, then I can, you know, start;
work need to be done on the building.
CHAIRMAN KAUFMAN: Okay. You say "building." This is
the interior of a home or a --
MR. GADSDEN: No, it's a commercial building. It's
commercial.
CHAIRMAN KAUFMAN: Okay. So they're doing electrical,
drywall and plumbing and air?
MR. GADSDEN: Yes, yes.
CHAIRMAN KAUFMAN: Okay. Any other comments from

2016. This was when construction first started on the fascia of the

This is -- currently it's occupied, and it's a supermarket.

earlier this week, of the after-construction. They added a covered

terrace, concrete posts or pillars out front, and they've updated or
upgraded the fascia up top.

MR. LOPEZ-SILVERO: On May 4th, 2016, said case was
referred to our office from the Contractors Licensing Division for
further follow-up and enforcement. Said division did not find any
licensing violations at the time and has since completed their
investigation.
On May 19th, 2016, mentioned violation was observed. I met
with the store manager to advise of the violation and provide the
correction -- the corrective action needed for compliance.
Property history research relieved that a building permit,
PRBD20150826986, to replace and/or repair canopy and entry doors
had been obtained but is currently in expired status with no recent
activity.
As of August 26th, 2017, the building permit in question remains
expired -- correction -- remains in expired status, and the violation
remains.
CHAIRMAN KAUFMAN: Okay. Have you spoken with the
respondent?
MR. LOPEZ-SILVERO: Not recently, sir. They were advised
of today's hearing.
CHAIRMAN KAUFMAN: Okay. Has anybody from Code
Enforcement had the opportunity to touch base with the respondent?
MR. LOPEZ-SILVERO: In email exchange, but not -- I feel
he's -- the property owner's kind of dragging his feet on this case,
because it's been -- this case was initiated back in May of 2016.

June 3rd, '16.

expired and reactivated several times back and forth.

done more than six months ago, and then --

MR. LETOURNEAU: No. The permit expired on July 18th of
this year, yes.

sometime at the beginning of the year.

PRBD20150826986 to repair/replace canopy and entry doors to
include inspections and certificate of completion/occupancy or obtain a
demolition permit, inspections, certificate of completion/occupancy
within blank days of this hearing, or a fine of blank dollars per day will
be imposed until the violation is abated.
Number 2, the respondent must notify the code enforcement
investigator when the violation has been abated in order to conduct a
final inspection to confirm abatement. If the respondent fails to abate
the violation, the county may abate the violation using any method to
bring the violation into compliance and may use the assistance of the
Collier County Sheriff's Office to enforce the provisions of this order,
and all costs of abatement shall be assessed to the property owner.

MS. GIGUERE: So this complaint originated from the
Contractor Licensing Department where they went on site and
observed multiple unlicensed contractors working with no permits on
file.
On October 3rd, 2016, the building official, Jonathan Walsh,
determined permits were required for the work being done.
The notice of violation was issued, and contact was made with the
owner. Permit PRBD20161039954 was applied for and issued in
January of 2017. The permit expired due to lack of activity in August
of 2017.
The permit was actually reactivated after the notice of hearing
was posted and mailed on October 20th and is now valid until
February of 2018.
CHAIRMAN KAUFMAN: Okay. So January they applied for
a permit to do this work, six months goes by, that takes you to June or
so, and then at that time this thing was put on the calendar for -- to be
brought before the Board.
MS. GIGUERE: Yes. Actually in September, but the hearing
was canceled.
CHAIRMAN KAUFMAN: I don't know why, but okay.
And then it -- and then knowing that this was coming before the
Board, they reactivated the permit.

CHAIRMAN KAUFMAN: So my question to the county is, if
the permit is now active, what are we hearing?
MR. LETOURNEAU: Well, I mean -- for the record, Jeff
Letourneau, Collier County Code Enforcement.
I just felt that because they had allowed it to expire for three
months and then all of a sudden they get a hearing notice, and then
they rush down here to get it reapp'ed and reissued, I felt that we
should bring it before the Board because they were dragging their feet
on this thing, obviously.
CHAIRMAN KAUFMAN: Okay.
MS. GIGUERE: If I may, I've also attempted contact with the
contractor multiple times, and he doesn't respond to my attempts.
And when they had it issued, they just didn't do anything with it. They
just let it sit there, and that's why it expired.
MR. LETOURNEAU: I'm just afraid if we don't hold their feet
to the fire at this point, they're going to let it expire again.
CHAIRMAN KAUFMAN: Well, I don't disagree with you. I
just -- I'm concerned on how we hold their feet to the fire if they have a
valid permit right now. And they pulled the permit when, did you
say? This week or last week?
MS. GIGUERE: They reactivated it on October 20th. Excuse
me.
CHAIRMAN KAUFMAN: So they have six months to have at
least one inspection?
MS. GIGUERE: Correct. If they don't do anything with it, it
will expire in February.
CHAIRMAN KAUFMAN: Okay. So I'm trying to grasp at
straws now.
MR. LETOURNEAU: If you're uncomfortable, we can
withdraw it. That's no issue. I just -- we were just going to ask for

a -- to see if there was a violation and make sure they get the CO
within a certain amount of time.
CHAIRMAN KAUFMAN: And I agree with you. I'm just
trying to figure a way -- what could be done since there is an active
permit right now.
MS. CURLEY: So this case was one that was postponed
because of last month's meeting?
CHAIRMAN KAUFMAN: That's correct.
MS. CURLEY: So they wouldn't have had this permit active as
of last month's meeting.
MR. LEFEBVRE: But since we had this meeting now, they beat
us to the punch.
MS. CURLEY: Right.
CHAIRMAN KAUFMAN: It's hard to turn the clock back.

MS. NICOLA: I'm concerned a little bit about the notice,
because the normal person reading this notice might think that by
obtaining the permit that the violation has been cured. So that's
probably why they rushed out and got the permit.
MS. GIGUERE: Well, I know that I made -- the notice of
violation that's originally issued states specifically on there that you
have to have your permit all the way through a certificate of
completion to be in compliance. And so when they don't do that
within the time frame, that's when we prep it for a hearing, and that's
where we are today as far as it was expired up until they got the notice
and said, oh, well, maybe if I just reactivate it, they'll leave it alone, but
they're still not technically in compliance because they haven't gotten
any inspections, let alone a certificate of completion.
CHAIRMAN KAUFMAN: But the rule is that you have six
months to have an inspection, unless I'm missing the ball here.
MS. GIGUERE: No, that is correct.

CHAIRMAN KAUFMAN: So by them reactivating the permit
in October, they're actually in compliance right now; is that correct?
MR. LETOURNEAU: I wouldn't say that, because I'm looking
at the actual ordinance that we cited, and no building or structure shall
be erected, moved, added to, altered, utilized, allowed to exist, blah,
blah, blah, without first obtaining the authorization of the required
permits, inspections, and certificate of occupancy as required by the
Collier County building.
They haven't obtained inspections, they haven't obtained a
certificate of occupancy. They hired unlicensed contractors, got
busted by Contractor Licensing, pulled the permit, did nothing, and let
it expire, and then when they get a hearing notice, they rush out and get
it reissued. I think they're -- I think they're in violation right now. I
do, but --
MS. CURLEY: So they didn't call for any inspections on the
first permit which was opened and expired, so that's what --
MR. LETOURNEAU: I have to look at that permit.
MS. GIGUERE: I do believe that is correct.
CHAIRMAN KAUFMAN: They couldn't have because they're
unlicensed.
MS. CURLEY: No, no. This was after the unlicensed people.
MS. GIGUERE: Right. So Contractor Licensing found
contractors that had no licenses and no permit doing work. That
was -- the pictures are what the state of the unit was by the time
Contractor Licensing was notified. So they had clearly started on a lot
of work without any permits, and then they hired a contractor who
obtained a permit in January, but there was no activity done with it
whatsoever, and it expired in July. And they let it sit expired from
July until they got the hearing notice in October.
MS. CURLEY: So then the violation exists that they had a
permit open that it expired with no calls for inspections?

MS. CURLEY: What would we have done a month ago before
this new permit was pulled?

MR. LEFEBVRE: I think -- two ways of going on this. One
would be we find that there's no violation currently, or the county
withdraws the case.

occupancy.
Past orders: On May 25th, 2017, the Code Enforcement Board
issued a finding of fact, conclusion of law and order. Respondent was
found in violation of the referenced ordinances and ordered to correct
the violation. See the attached order of the board, OR Book 5400,
Page 3534, for more information.
The violation has not been abated as of October 27th, 2017.
Fines and costs to date are as follows: Fines have accrued at a
rate of $200 per day for the period from August 24th, 2017, to October

CHAIRMAN KAUFMAN: Could you bend the microphone

MS. FRANCOIS: I do, sir.
CHAIRMAN KAUFMAN: Okay. You're before us now.
This is an old case that dates back to July of '16, so it's over a year old.
This has to do with unpermitted interior/exterior improvements
on a structure, et cetera. And I know you've been before us before, if
I'm not mistaken.
MS. FRANCOIS: Yes.
CHAIRMAN KAUFMAN: So we're all ears.
MS. FRANCOIS: I applied for the permit. There were two
things going on. I applied for the permit. They had issued me -- they
said that there were some things wrong with it. The guy went back
and refixed the permit. So the permit, it's in there now, you know, so I
could just call for the --
MR. LEFEBVRE: Inspection.
MS. FRANCOIS: Yeah, inspection, but everything's already
been through. The drawing already been submitted, which is here.
He gave me a copy, and the receipt. So I'm just waiting to -- you
know, to finish with it.
CHAIRMAN KAUFMAN: So all the work has been done, the
electrical, windows, all of that is completed?
MS. FRANCOIS: Yeah, yeah.
CHAIRMAN KAUFMAN: And it's been inspected?
MS. FRANCOIS: No, it's not inspected.
CHAIRMAN KAUFMAN: Because you haven't gotten the
permit yet.
MS. CURLEY: When you got the permit and you fixed it, then
when you resubmitted it, it was approved?
MS. FRANCOIS: No, it wasn't approved the first time, ma'am.

It wasn't. They had sent a paperwork that said what needed to be
fixed, and the guy went back and fixed it, and --
MS. CURLEY: Then it got approved?
MS. FRANCOIS: No, it haven't -- I think it is. I should know
by this afternoon, because he told me to go ahead call him. I should
know by the end of this afternoon.
CHAIRMAN KAUFMAN: So as far as the work, there's just
two things. The work is done, but without the permit, the inspections
can't be done, if I'm not mistaken, so that's what -- we're waiting for the
permit so that the inspections can be done. Is that --
MR. LOPEZ-SILVERO: That's correct, sir.
CHAIRMAN KAUFMAN: That's correct, okay.
MS. CURLEY: And this was your son's -- this property was in
your son's name?
MS. FRANCOIS: Uh-hmm.
MS. CURLEY: Yeah. There was a little bit of a delay because
she wasn't able to put the permits in because it wasn't in her name.
MS. FRANCOIS: No. He had to give me a paper to sign, and
he had to come here with it. And he's in school. So he had to give
me a paper to sign so I could pull the permit, which was fine. And
then we had another issue, too, due to the fact that the they put the
property under the LLC. It had to be a construction, had to do -- the
guy from the construction have to come in, I think, look at it, but he
did come.
CHAIRMAN KAUFMAN: On this case, I'd almost like the
county to pull it for one month. Let's see if the permit gets approved,
et cetera. We'll be in a lot better position to address this case, in a
month.

The permit itself was submitted on October 11th. It was rejected
on October 18th, and there are no current revisions that have been
resubmitted as of right now when I checked the permit.
There's -- in reviewing the correction letter, there's some concerns
on the county's behalf that they refer to it as a commercial building and
that it requires a site plan. So I don't know if the information that
they've submitted confused the process, thinking that it's a commercial
building. And I know that they want to use it as a residential building.
So that's one of the rejections on there that it says, you know, for
commercial buildings there has to be an approved site plan. That's
one of the holdups.
And then it also requests for plans showing what the existing
building was prior to them making the corrections, and then it wants
specifications on the rooms that are, you know, within the building.
So there's still some corrections that need to be submitted. As of
right now that has not been completed. So the permit is still in
rejection status.
The other issue that came up when we presented this as an
imposition of fines before was that there was people living in this
building, and there has been electrical alterations, you know, along
with the structural alterations.
We did give her additional time for her to be able to get her son's
authorization to do an eviction notice with the Sheriff's Office, where
she claimed that her husband was the one who allowed these people to
be here.
I drove by the building on Tuesday, and there were still people
utilizing the building as living quarters.
MS. FRANCOIS: That is true what Ms. --
CHAIRMAN KAUFMAN: Perez.
MS. FRANCOIS: -- Perez say. That is true. The people that are
living there -- the first people had moved out. They went to live on

2nd Street across the casino. And the -- we got four people
living -- one is living, like, in the -- she just sleeps there, you know,
like in the back room. She just sleep there, because her trailer -- FEMA
supposed to bring her a new trailer on -- this month. The reason they
haven't bring it in is the -- they say the -- there's something with the
land. It has -- I think it's -- what she said?
CHAIRMAN KAUFMAN: It really doesn't matter. If someone's
there --
MS. FRANCOIS: There is. There's someone there, sir, Mr.
Robert. And I have the evictions.
CHAIRMAN KAUFMAN: Okay. But they're there. And if
you have evictions and you have the ability to contact the Sheriff to get
them out, has that been done?
MS. FRANCOIS: Oh, yeah. The -- when the first
people -- they did move out with the Sheriff help. They did move out,
because they had put a sticker there. They did move out. Now
it's -- I had allowed her to come stay, because she didn't have no where
to go, and I thought that would be a good -- because she just didn't
have nowhere to go.
CHAIRMAN KAUFMAN: I'm sorry, but that's -- you're
confusing the issue.
MS. FRANCOIS: Yes, sir.
CHAIRMAN KAUFMAN: Okay? There's no reason in the
world that anybody should be permitted to stay in a place that's unsafe.
I don't care if they have to apply to the government to put them in
FEMA housing or whatever. That's a problem.
MS. FRANCOIS: Okay.
CHAIRMAN KAUFMAN: Okay. That's number one. Number
two, you said you're waiting for a call from somebody. And Ms.
Perez said that there's nobody that's going to call from you the county
to say that this is okay; am I correct?

MS. PEREZ: I think she said that her contractor had asked her to
call her -- call him this afternoon in regards to the permit. But he
needs to first resubmit the plans for the county to review them, and
then, you know, they'll know if it's approved or denied again.
CHAIRMAN KAUFMAN: Okay.
MS. CURLEY: So just for clarification, so you allowed
somebody to temporarily sleep there. Were they displaced because of
the hurricane?
MS. FRANCOIS: Yeah. I mean --
CHAIRMAN KAUFMAN: Doesn't matter.
MS. CURLEY: That's what I was just wanting -- you didn't say
that, but I wanted to clarify that. You know that that's not a good idea?
MS. FRANCOIS: Well -- yeah. It's -- because I had
to -- because I had put my stuff there, and they were getting stoled.
And so she told me, can she stay there till she get her trailer? And it's
right -- her trailer, it's right across the property, so...
MS. CURLEY: Get her out of there.
MS. FRANCOIS: Okay. I'll take care of that.
MR. LEFEBVRE: The issue we have, if we pull this to next
meeting, it's only, roughly, three weeks off, a lot more than three
weeks, so it's probably not going to give her enough time to resubmit
for the permit and go ahead and get everything permitted. And then
we don't have a meeting in December. So that, time-wise --
MS. CURLEY: Is there an office in Immokalee where the
permitting is -- do they have -- does the county have an office out
there?
MS. PEREZ: Yes, we do. I believe our permit runner works
out here in Naples, you know, does the primary work out here. So he
may be submitting the work out here. But at any time they can go to
the Immokalee office. We are there Monday through Friday.
MS. NICOLA: I think if the Board gave her 90 days, it would

be -- it would make it to January 25th. I'm not sure when the January
meeting is. But I'm just looking at my timeline, so I just thought I'd
bring that up.
CHAIRMAN KAUFMAN: They left on your position the --
MR. LEFEBVRE: The 26th.
MS. NICOLA: Okay. So it would get us to the January
meeting.
MR. LEFEBVRE: But it won't give time to prepare the case.
CHAIRMAN KAUFMAN: Okay. Jeff?
MR. LETOURNEAU: The county has no issue withdrawing this
until January; however, I'd just like to point out that we're reluctantly
doing it. She's been here a lot of times.
MR. LEFEBVRE: Right.
MR. LETOURNEAU: And she hasn't really followed through
with anything she was going to say, even though they did try to get a
permit here. So I would hope the Board really -- if nothing gets done
by January, I would really hope the Board would make a decision at
that point.
CHAIRMAN KAUFMAN: I would say that if it's not done in
January, that the fines will be imposed, probably.
MR. LETOURNEAU: Okay. So we'll withdraw, having said
that, till January.
CHAIRMAN KAUFMAN: Okay.
MR. LEFEBVRE: I'm just going to make a comment that come
January, I am not going to be in favor of extending this any further.
MS. FRANCOIS: Yes, Mr. Gerald.
MR. LEFEBVRE: And I'm just going to be very clear about
that.

MS. CURLEY: It's like -- and I even stretched it so I could read

CHAIRMAN KAUFMAN: If you take a look on the right-hand
side, you can see that plain as day. I made my screen bigger. I don't

MS. CURLEY: I did, very much so, and I stretched the column

MR. LEFEBVRE: It makes it better.
MS. CURLEY: This is great. So now I have higher
expectations of the bookmark.
CHAIRMAN KAUFMAN: Okay.
MS. CURLEY: So now you've set yourself up. We want it
bigger.
MS. ADAMS: I mean, it may involve, like, changing the entire,
like, computer programming to change it, because this is a whole
computer system, a brand new computer system. But I'll definitely
look into it.
MS. CURLEY: I'll just bring my glasses next time.
MS. NICOLA: You can get those cheaters.
MS. CURLEY: But I found this really easy to go though.
MR. LAVINSKI: I have glasses, and it doesn't work.
CHAIRMAN KAUFMAN: Maybe we can move the screen
closer to your head.

programming. Making it bold is not a difficult thing to do, and
enlarging the print should not be difficult either. So hopefully we can
get that resolved.

make that simpler. I think that that's the only way is you have to just

the display port. You know, maybe you can try it a few times. I
think -- you know, the more I use it, it becomes, you know, a lot easier.
CHAIRMAN KAUFMAN: Maybe they can put a shortcut on
there.
MS. CURLEY: Well -- also, if you sit on the end, if there's an
open seat, then you can have that screen here and your regular agenda
here, and you can sort of just look over.
