RE: EIS - Requirements
Per your direction, Staff has investigated the requirements for
biophysical impacts in an Environmental Impact Statement (EIS) .
The impact categories of "Air Quality" and "Noise" are frequently
deemed "not applicable" by the petitioner, and accepted as such by
Staff. However, if Staff determines that air quality and noise
may be affected by the proposed project, the two impact categories
are regulated by the following standards:
Biophysical
Air Quality - The petitioner must indicate anticipated changes in
levels of air pollutants as defined by current regulations. The
Florida Department of Environmental Protection standards are the
current regulations
Noise - The petitioner must describe the changes in decibels and
duration of noise generated during and after the project (both day
and night) that will exceed Collier County regulations. Collier
County Ordinance No. 93-77 (Noise Ordinance) regulates decibels
and duration of noise. Blasting noise is regulated by the
individual blasting permit.
The petitioner must also demonstrate compliance with Federal Aid
Highway Program Manual 7-7-3 noise regulations.

PROCESS AND PROCEDURE
ORDINANCE 91-68 governs the policy and procedure of the EAB.
The following petitions must be heard by the EAB:
A. Regular Agenda
1) All land development petitions which require an
Environmental Impact Statement (EIS)
2) All Developments of Regional Impact (DRI)
3) Lands with Special Treatment (ST) or Area of Critical
State Concern/Special Treatment zoning overlays
4) Areas of the County covered by interlocal agreements
5) Any petitions which cannot be resolved between the
applicant and staff and which is requested to be heard by
the the Environmental Advisory Board by either party
6) Any petition which requires approval of the Collier
County Planning Commission or the Board of County
Commissioners and staff receives a request for the
petition to be heard by the Environmental Advisory Board
from the chairman of the Environmental Advisory Board or
chairman of the Board of County Commissioners.
B. Administrative Agenda
1) Land development petitions which received an EIS waiver
but have water management lakes which must, by the
Excavation Section of the Collier County Land Development
Code (Division 3 .5) , be heard by the EAB.
2) Land Development petition which receive an EIS waiver but
have other environmental concerns which Staff feels
should be made known to the EAB.
