#14-6277 (CaterMaster, Inc. - Amendment #2) SECOND AMENDMENT TO AGREEMENT #14-6277 "FACILITY EVENT COORDINATOR" BETWEEN COLLIER COUNTY AND CATERMASTERS, INC. THIS AMENDMENT, made and entered into on this 21/44` day of Ockober 2017, by and between CaterMasters, Inc., authorized to do business in the State of Florida, whose business address is 2391 Davis Boulevard, Naples, Florida 34112 (the "Lessee") and Collier County, a political subdivision of the State of Florida, (the "County" or"Lessor"): WHEREAS, on September 23, 2014, Item 16.D.19, the County entered into an Agreement with Lessee to implement and professionally manage, promote and coordinate rental of Museum facilities for private functions after normal business hours; and WHEREAS, on December 15, 2014,the first amendment to agreement was administratively approved by the Procurement Director to add the Everglades Museum, location address and include operational hours for event rental times at that location; and WHEREAS,the parties desire to amend the Agreement further to remove the renewal options and the exclusive use provision. The County will be extending the contract administratively,as allowed by the Agreement, for the sole purpose of allowing the Lessee to honor pre-booked events. ' intention to renew the Agreement term not less than The County Manger, or his designee, may, at this discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or his designee, shall give the Lessee written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term then in effect. Exclusive Use: Lessee shall have the exclusive right to use the Premises during the Events. Except for Event's with a value of less than five hundred dollars ($500),the Lessee releases the County from being bound to the Lessee's Exclusive Use. The County reserves its right to schedule Events,either during normal Museum hours or after hours. * * * * * 33.
