No claims have been made to the Groveway, nor is any suit now pending on behalf of any contractor, subcontractor, sub-subcontractor, supplier, laborer or materialman, and that no chattel mortgages or conditional bills of sale have been given or are now outstanding as to the subject utility facilities placed upon or installed in or on the aforesaid premises. 5.
