EXECUTIVE SUMMARY
Recommendation to approve a release of lien for full payment of an Immokalee area Residential
Impact Fee Deferral Agreement approved as part of an impact fee deferral program for properties
located within the Immokalee Enterprise Zone.

OBJECTIVE: To approve a release of lien for 1205 Allegiance Way, Immokalee, Florida, for an impact
fee deferral that has been paid in full.
CONSIDERATIONS: Pursuant to Section 74-201 of the Collier County Code of Laws and Ordinances
the County deferred the payment of the impact fees for any qualified owner for a new owner-occupied
dwelling unit within the geographic boundaries of the Immokalee Enterprise Zone . This
program sunsetted in 2006, three years from the effective date of the program. The program was
subsequently replaced with the Countywide Impact Fee Deferral Program.
Section 74-201(g) of the Code authorized the County Manager to enter into an impact fee deferral
agreement with the owner. The deferred impact fees became a lien on the property and the
agreement accepted by the County in lieu of prompt payment of the impact fee that would
otherwise then be due and payable but for the agreement. The impact fees deferred for the construction of
the residential dwelling unit listed below have been paid in full. Per the agreement, payment is
without interest as the agreement was not breached. As such, the repayment obligation has been fulfilled
and a release of lien is needed. The following table sets forth the lien to be released:

FISCAL IMPACT: The deferral program was partially funded from a portion of the Immokalee
Community Redevelopment Area tax increment funding (TIF) generated by ad valorem property taxes
associated to the qualifying developments. The individual impact fee trust funds were reimbursed by TIF
funds each tax year from 2007 through 2016 for a total of $1,108.13. Therefore, the Immokalee CRA
(Fund 186) has been reimbursed $1,108.13 and the remaining amount of $5,919.21 has been deposited into
the individual impact fee trust funds for the remaining fees due to those funds.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority support for approval. JAK
RECOMMENDATION: To approve and authorize the Chairwoman to sign a release of lien for 1205
Allegiance Way, Immokalee, FL, for an Immokalee Residential Impact Fee Deferral Agreement for which
full payment of Collier County impact fees has been received.
