EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement for Lot 63, Palm River Shores,
according to the plat thereof as recorded at Plat Book 3, Page 27 of the public records of Collier
County.
OBJECTIVE: To approve an Easement Use Agreement between the County and the current property
owners of Lot 63, Palm River Shores.
CONSIDERATIONS: The property is located at 88 Shores Avenue. The purpose of this Agreement is
to allow an existing pool enclosure and patio pavers to encroach 1.34 feet into a 15-foot drainage
easement located in the rear of the property. The subject drainage easement is dedicated to the perpetual
use of the public according to the plat, and the easement is maintained by the property owner. There are
no drainage facilities within the easement area, and the encroachment will not interfere with the County's
use of the easement. Development Review staff has reviewed the Agreement and Exhibits and
recommends approval of the Easement Use Agreement. The current owners purchased the property with
the encroachment in place.
FISCAL IMPACT: There is no fiscal impact associated with this action. The property owners will be
responsible for the recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. SAS
RECOMMENDATION: To approve the Easement Use Agreement between the County and the current
property owners of Lot 63 of Palm River Shores, and authorize the Chairman to execute the Agreement;
and to direct the Clerk to record the Easement Use Agreement.
