EXECUTIVE SUMMARY
Recommendation not to proceed with construction of an Off-Highway Vehicles (OHV) Park at the
Immokalee Regional Airport due to prohibitive project development cost projections and to re-
institute a modified version of the “Tickets to Ride” program for Board consideration.
OBJECTIVE: To provide opportunities for OHV enthusiasts to ride their vehicles using funds from the
2011 South Florida Water Management District (SFWMD) settlement agreement.
CONSIDERATIONS: In 2011, Collier County and the SFWMD entered into a Settlement Agreement
wherein the SFWMD paid Collier County $3M to dispose of litigation arising out of a 2003 Agreement
between the parties in which the SFWMD was to convey 640 acres to Collier County for recreational all
terrain vehicle (ATV) use. An ATV is a type of Off Highway Vehicle (OHV).
In 2012, The Board created the Collier County ATV Park Ad Hoc Committee with the issuance of
Resolution No. 2012-110 to research potential opportunities for OHV use in Collier County. T he Collier
County Growth Management Department and Collier County Parks and Recreation Division were tasked
with searching for land appropriate and suitable for an ATV Park site. To date, and despite an exhaustive
search, no land suitable for an ATV Park has been located within or outside of Collier County.
On March 22, 2016, based on the Committee’s recommendation, the Board directed staff to explore the
use of the Immokalee Airport for a potential location for riders and to conduct an environmental study on
the lands identified for OHV use (Agenda Item# 16D8).
A feasibility analysis was conducted for the project, which included a preliminary site review to
document existing site conditions within the project site and attending pre-application meetings with the
environmental permitting agencies to determine the feasibility of obtaining environmental permits for the
proposed project. The project was deemed permittable by these agencies.
Within the airport property, there is an “Area Reserved for Future Non-Aviation Development” and an
“Area Reserved for Future Aviation Development.” The Parks and Recreation Division understands that
if a future aviation development were proposed, the property must be returned to an aviation use in the
required time period per FAA regulations (see attached correspondence from FAA).
The Parks and Recreation Division hired RWA to design a conceptual plan for the airport site to
determine the parameters related to the improvements required to support recreational ATV use at t he
airport. Part of this strategy was also to attempt to minimize affecting the Secondary Panther Zone, which
would drive upward mitigation costs associated with the project.
RWA as part of this contract, subcontracted with Passarella and Associates to approach the US Fish and
Wildlife Service with this conceptual plan to determine mitigation costs further. US Fish and Wildlife
confirmed the entire area would be impacted thus subject to the panther mitigation requirements. It is
estimated that costs associated with panther mitigation would be from $2.5M to $3.6M alone.

Also, as part of this discussion, the Parks and Recreation Division provided a preliminary operating
budget associated with the project. The current proposal shows an anticipated cost recovery of 84% (see
table below).

Finally, with permitting and design costs estimated at $3.6M to $3.9M, capital construction is anticipated
to be in the $3M range for a total anticipated project cost of $6.6M to $6.9M. The project currently has a
little over $3M available.
Grant funds are another way to subsidize the effort and can be pursued through the T Mark Schmidt and
Recreational Trails grant opportunities identified by the State of Florida. However, to pursue those funds,
a long-term agreement must be solidified by the Board for the use of the Airport lands of approximately
25 years.
Since 2003, efforts from the Board and SFWMD have attempted to locate a suitable place for enthusiasts
who used to enjoy the “south blocks” associated with Picayune Strand State Forest. Several efforts, both
to locate leased and purchased lands have not resulted in a suitable location. Locating land within the
confines of the budgeted amount available present a challenge as land costs, permitting, and construction
costs have escalated since 2003. While the Immokalee Airport site could be potentially developed, it
would be with considerable expense and permit requirements.
Ad Hoc Committee Recommendations:
The OHV Ad Hoc Committee met on October 12, 2017 and voted 4-0 to:
1. Recommend to the Board to accept the report regarding the Immokalee Airport site and continue
to pursue developing the site as an ATV Park.
2. Continue to the duties of the Ad Hoc Committees until a suitable location is found for OHV
enthusiasts.
3. Re-institute the “Tickets to Ride” program after reviewing the parameters of the program and
making needed improvements before its implementation.
Staff respects and appreciates the diligent, persistent work of the Ad Hoc Committee and their desire to
move forward with developing the Airport site. That said, staff does not concur with that recommendation
due to the prohibitive cost to develop the site coupled with the knowledge that the FAA could reclaim the
land for aviation purposes at any time in the future.
FISCAL IMPACT: Currently, there is $3,016,261.52 remaining from the settlement fund, with interest
accruing on the principal. This interest is being kept within the same cost center and used as revenue for
the program.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.

LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Advisory Committee approval. - JAB
RECOMMENDATION(S): Staff recommendations include:
1. Accept the report provided regarding the OHV Park at Immokalee Airport.
2. Do not proceed with plans to construct an OHV park at the Immokalee Airport.
2. Convene the Ad Hoc in the future on an “as needed” basis to evaluate any potential properties
that may be identified for purchase.
3. Bring back a separate agenda item to re-institute a modified version of the “Tickets to Ride”
program.

Good afternoon Justin,
I apologize for the delay in getting back to you on this proposed land use. As you are aware, the
southern 2/3rds (approximate) of the land in question is designated as future aeronautical use. The
northern 1/3 (approximate) is designated as non-aeronautical use. Grant Assurances 5b and 29 address
changing the use of airport land from aeronautical to nonaeronautical use.
5b. [The sponsor] will not sell, lease, encumber, or otherwise transfer or dispose of any part of its title or
other interests in the property shown on Exhibit A to this application or, for a noise compatibility
program project, that portion of the property upon which Federal funds have been expended, for the
duration of the terms, conditions, and assurances in this grant agreement without approval by the
Secretary. If the transferee is found by the Secretary to be eligible under Title 49, United States Code, to
assume the obligations of this grant agreement and to have the power, authority, and financial
resources to carry out all such obligations, the sponsor shall insert in the contract or document
transferring or disposing of the sponsor's interest, and make binding upon the transferee all of the
terms, conditions, and assurances contained in this grant agreement.
29.a.4 and b.- all proposed and existing access points used to taxi aircraft across the airport’s property
boundary. Such airport layout plans and each amendment, revision, or modification thereof, shall be
subject to the approval of the Secretary which approval shall be evidenced by the signature of a duly
authorized representative of the Secretary on the face of the airport layout plan. The sponsor will not
make or permit any changes or alterations in the airport or any of its facilities which are not in
conformity with the airport layout plan as approved by the Secretary and which might, in the opinion of
the Secretary, adversely affect the safety, utility or efficiency of the airport. b. If a change or alteration in
the airport or the facilities is made which the Secretary determines adversely affects the safety, utility,
or efficiency of any federally owned, leased, or funded property on or off the airport and which is not in
conformity with the airport layout plan as approved by the Secretary, the owner or operator will, if
requested, by the Secretary (1) eliminate such adverse effect in a manner approved by the Secretary; or
(2) bear all costs of relocating such property (or replacement thereof) to a site acceptable to the
Secretary and all costs of restoring such property (or replacement thereof) to the level of safety, utility,
efficiency, and cost of operation existing before the unapproved change in the airport or its facilities
except in the case of a relocation or replacement of an existing airport facility due to a change in the
Secretary’s design standards beyond the control of the airport sponsor.
For certain types of releases, FAA must provide the public an opportunity for notice and comment at
least 30 days prior to approving the release request (typically through the Federal Register Notice),
unless the use is an interim change of 5 years or less. We typically recommend month to month type
leases of nonaeronautical uses on land that is designated as aeronautical use, however for a
development of this size, a month to month lease may not be appropriate for the size and cost of the
development. If the lease is less than 5 years, then you should follow the guidelines in the Compliance
Manual chapter 22 paragraph 22.6.

Are you anticipating leasing the property for longer than a period of 5 years? If so, they you have to
provide a formal request for concurrent use of aeronautical property for other uses. In this situation,
no request for release is required, however if you are considering to use the land for recreational
purposes, then you need to assess the potential applicability of section 4(f) of the DOT Act of 1966. (We
want to ensure that this land will not be converted or presumed to become a park which could not be
returned to aeronautical use.)
If the lease is for longer than 5 years and you don’t anticipate an aeronautical need for this land over the
next 50 to 100 years we would recommend requesting a release from the surplus property obligations
to change the land use permanently from aeronautical to nonaeronautical or a complete release and
disposal of the property. (See paragraph 22.16 of the Compliance Manual.)
If the property has always been owned by the sponsor and has never been surplus property, then no
release is required, simply an ALP update is required.

As a reminder, all development must be reviewed through iOEAAA for airspace compatibility prior to
construction.
