Potential items for Collier County 2004 Legislative Agenda:
Legislative Chanqe Request: A change is needed to modify the state's public records statutes
allowing for an exemption to the release of personal contact information provided by private
citizens to local or state government agencies for the purpose of receiving services related to
emergency services and homeland secur:ity.
Discussion: In the event of a terrorist attack and during disaster scenarios (both man-made and
natural), the ability of Government to notify citizens who are customers of government services
(water, sewer, and electric utilities; special emergency services, etc.) of imminent dangers is
paramount to the effectiveness of public safety endeavors. In order to establish this capability,
government must solicit and maintain personal contact information - telephone numbers (home,
work, mobile) and email addresses. Under current legislation, this information is public and
subject to release without the permission of the customer. Many citizens are reluctant to provide
such information without a reasonable assurance of confidentiality. Commercial utilities, which
are not subject to Florida's Government in the Sunshine laws, solicit this information with
assurance to their customers that they can choose to keep this information private. Legislation is
needed to allow Government services providers the ability to offer a level of confidentiality equal
to that of a comparable commercial service.
Le.qislative Chanqe Request: Request amending the language of Florida Statute 125.0104 the
"Local Option Tourist Development Act," to reflect the purchase of beach access as an authorized
use of revenue.
Discussion: The current Statute language indicates that Tourist Development Tax proceeds may
be used to finance beach park facilities or beach improvement, maintenance, renourishment,
restoration and erosion control, including shoreline protection, enhancement, cleanup, or
restoration of inland lakes and rivers to which there is public access as those uses relate to the
physical preservation of beach shoreline or inland lake or river, Collier County Board of County
Commissioners may wish to pursue expansion of the language to specifically indicate the
purchase of beach access as an allowable use of tourist revenues.
Le.qislative Chan.qe Request: Increase State funding for red tide research and prediction.
Discussion: Beautiful beaches and a healthy tourism trade in Southwest Florida are critical to
sustaining our economy. Collier County Board of County Commissioners may wish to request
that the State of Florida increase the current level of funding for red tide research.
Legislative Chanqe Request: Request amending statutory language that would allow the review
and possible revision of the Collier County Occupational License Tax.
Discussion: The County's Occupational License Tax was adopted in 1981 (Collier County
Ordinance 81-42). The rates established in 1981 closely mirror the maximum authorized by
Florida Statutes in at that time (Chapter 80-274). The Legislature then amended the pertinent
statute reducing the maximum rates on certain categories (Chapter 82-72). "The rate at which a
county may increase the taxes levied on occupational licenses is limited to the amount based on
the rate adopted in 1982 [by the Florida Legislature] unless the county implements s. 205.0535."
(AGO 96-83) Collier County did not avail itself to s. 205.0535, which had a deadline of October 1,
1995.

Policy, opposing amending Florida's Water Resource Policy (see attached)

EXECUTIVE SUMMARY
Chapter 189 Florida Statutes, Special Districts
PURPOSE
· To provide general provisions for the definition, creation and operation of special
districts.
· Have one centralized location ~br all legislation governing special districts
· Improve enforcement of statutes currently in place that help ensure accountability
· Improve coordination and communication between state agencies and between
special districts and other local entities
· Move toward greater uni~bnnity in special district elections and non-ad valorem
assessment collection procedures at the local level
· Encourage creation of municipal service taxing units and service benefit units for
providing municipal services in unincorporated county areas
· There is a need for uniform, focused and fair procedures in state law to provide a
reasonable alternative lbr the establishment, powers, operation and duration of
independent special districts
· SDs are a legitimate alternative method for use by the private and public sectors
to manage, own, operate, construct and finance basic capital infrastructure,
facilities and services.
· Growth and development issues transcend the boundaries and responsibilities of
individual units of government, and often no single unit of government can plan
or implement policies to deal with these issues w/o affecting other units of
government
· The provision of capital infrastructure, facilities and services for the preservation
and enhancement of the quality of life of the people of this state may require the
creation ofmulticounty and mulitjurisdictional districts
HOW SPECIAL DISTRICTS ARE CREATED
A Special District is created in the following ways:
· A municipality may create a SD, established by ordinance
· A county may create a SD, adopted by a charter
· The Governor and Cabinet may create a SD, established by rule, and may also
approve a chatter created by county
· Two or more counties may create a regional SD in accordance with s. 950.001 or
s. 373.1962 or s. 163.567
Except as otherwise authorized by general law, only the Legislature may create ISDs.
It is the specific intent of the Legislature that dependent special districts shall be created
at the prerogative of the counties and municipalities and that independent special districts
shall only be created by legislative authorization.

Special district means a local unit of special purpose, as opposed to general-purpose,
government within a limited boundary, created by general law, special act, local
ordinance, or by rule of the Governor and Cabinet. The special purposes of special
districts are implemented by specialized functions and related prescribed powers.
Dependent special districts must meet at least one of the tbllowing criteria:
Membership ot'its governing body is identical to that of a single county
· All member of its governing body are appointed by the governing body of a single
county or municipality
· During their unexpired terms, members of the special district's governing body
are subject to removal at will by the governing body of a single county
The district has a budget that requires approval though an affirmative vote or can
be vetoed by the governing body of a single county
Independent special districts are not dependent special districts as defined above and
include more than one county unless the district lies wholly within the boundaries of a
single municipality
MINIMUM REQUIREMENTS
General laws or special acts that create or authorize the creation of special districts must
address the following in their charters:
· Powers, functions and duties of the district regarding ad valorem taxation, bond
issuance, other revenue-raising capabilities, budget preparation and approval,
liens, and ibreclosure of liens, use of tax deeds and tax certificates as appropriate
for non-ad valorem assessments, and contractual agreements
· Membership and organization of the governing board of the district. If a district
uses a one acre/one vote election principle, it shall provide fbr a governing board
of 5 ~nembers.
· Maximum compensation of a governing board member
· Administrative duties of the governing board
· Applicable financial disclosure, noticing and reporting requirements
· Procedures and requirements lbr issuing bonds
· Procedures ibr conducting any district elections or referenda required and the
qualifications of an elector of the district
· Methods fbr financing a district
· Planning requirements
· Geographic boundary limitations
· Explanation of why the district is the best alternative
· Declaration that the creation of the district is consistent with the approved local
government comprehensive plans
GOVERNANCE
Elections
· Elections in a DSD shall be conducted by the Supervisor of Elections

Elections in an lSD may be conducted by the Supervisor of Elections, however, if
they are not, then the lSD must report to the supervisor in a timely mmmer and
lbllow Florida Election Code
Elections based on 1 acre/1 vote principle, require a referendum to determine
whether qualified electors should elect certain members of the governing board.
A petition signed by at least 10% of at least 500 qualified voters must be filed
with the governing board and supervisor of elections. Urban area maps shall be
presented to the governing board and any landowner or qualified elector may
contest the accuracy of the urban maps. Accuracy shall be determined and the
maps shall be adopted as the o~'ficial maps fbr the determination of the extent of
the urban area and the maps shall be updated and readopted every 5 years.
Governing Board
· Members of the board shall be elected in accordance with the following
determinations of urban area
1. urban areas constitute 25% or less of the district, 1 board member shall be
elected by electors and 4 shall be elected w/the 1 acre/1 vote principle
2. 26 - 50% urban areas, 2 members shall be elected by voters and 3 by 1 acre/1
vote
3. 51 - 70% urban areas, 3 members elected by electors and 2 by 1 acre/1 vote
4. 71 - 90% urban areas, 4 members elected by electors and 1 by 1 acre/1 vote
5. 91% or more urban areas, all members elected by electors
· All governing board members serve a term of 4 years except members elected at
the first election and the first landowners' meeting following the referendum.
· Qualifications are pursuant to the Florida Election Code and only apply to those
governing board member candidates elected by qualified electors
Landowner's Meetings
· An annual landowners' meeting shall be held as long as there are governing board
members elected on the 1 vote/1 acre principle. If electors elect all members,
there will be no landowners' meetings.
· 50% of all acreage in a district is not required; the member shall be elected by a
majority of the acreage represented.
All landowners' meetings shall be set by the board within the month preceding
the month of the election of the governing board members by electors
Bond Issttance
If no referenda are required, the district shall ensure that, at the time of the closing, the
bonds met at least one of the following:
· Bonds were rated in one of the highest four ratings
· Bonds were privately placed with or otherwise sold to accredited investors
· Bonds were backed by a letter of credit fi'om a bank, or other creditworthy
guarantor
· Bonds were accompanied by an independent financial advisory opinion stating
that estimates of debt service coverage and probability of debt repayment are
reasonable

Public Facilities Report
Each lSD shall submit a public facilities report and an annual notice of any changes and
the report shall contain the following:
Description of existing public facilities owned or operated by the SD, and each
public facility that is operated by another entity
· Description of each public facility the district is building, improving or expanding
or Proposing in the next 5 years. The anticipated date of completion of future
projects
· Anticipated capacity'and demands on each public facility when completed
Facilities Report shall be prepared and submitted within I year after the district's creation
Construction or expansion of a public facility that affects the quantity or quality of the
level of service shall be consistent with the local comp plan. However, the comp plan
cannot require an ISD to construct, expand or perform a major alteration on a public
facility.
Within 30 days after the first meeting of its governing board, each SD shall designate a
registered office and agent and file such info with the local governing authority and with
DCA.
Budget
The governing body of each SD shall adopt a budget by resolution each fiscal year.
A local governing authority may review the budget or tax levy of any SD.
Failure to disclose financial reports shall result in DCA filing a petition for a hearing on
the question of inactivity of the district. An administrative law judge assigned by the
Division of Administrative Hearings of the Department of Management Services shall
conduct proceedings and heatings. Within 30 days of the hearing, the ALJ shall file a
report with DCA.
Special District Oversight Review Process
It is in the public interest to establish an oversight review process tbr SDs wherein each
SD in the state may be reviewed by the local government in which the district exists.
· All SDs, governmental entities, and state agencies shall cooperate with the
Legislature and with any local government seeking info or assistance with the
oversight review process.
Those conducting the process shall look at minimum requirements but may also
consider any additional factors.
· An SD may provide written responses to requests made by the government
conducting the review
· The final report of the review shall be filed with the government that created the
district and shall serve as the basis for any modification to the charter or to its
dissolution or merger

Dear Mr. Mudd:
The Citrus County Board of County Commissioners during their August 26, 2003, regular
session, executed a Resolution establishing the Board's support for the continued inclusion of
a Local Sources First Policy as noted in Chapter 373 F.S. as well as it's opposition to any
amendment to Florida's Water Resource Policy which allows, encourages or promotes water
transfers.
The Board strongly believes the continued retention of this policy is integral to protecting
Florida's water resources and the development of long-term sustainable use without
adversely impacting our unique natural resources. Therefore, Citrus County wishes to go on
record that we believe the proposal made by the Florida Council of 100 is ill considered and
will put Florida's surface waters and aquifers at risk of irreparable damage for irresponsible
short-term gain.
Citrus County encourages you to act against this proposal and initiate the necessary steps to
support Citrus County in its' efforts as outlined in the attached Resolution.

COMMISSIONERS OF CITRUS COUNTY, FLORIDA,
ESTABLISHING IT'S SUPPORT FOR THE ,CONTINUED
INCLUSION OF A LOCAL SOURCES FIRST POLICY IN
CHAPTER 373 F.S. AND IT'S OPPOSITION TO ANY
AMENDMENT TO FLORIDA'S WATER RESOURCE
POLICY WHICH ~ ALLOWS, ENCOURAGES OR
PROMOTES WATER TRANSFERS.
WHEREAS, Florida's water resources are a natural resource and not a
commodity to be sold or transferred to the highest bidder; and
WHEREAS, the Board of County Commissioners of Citrus C'6unty have been
staunch supporters of a State local sources first policy within Florida's Statutes; and
WHEREAS, the Board of County Commissioners of Citrus County believe the
continued retention of this policy is integral to protecting Florida's water resources and
the development of long-term sustainable use without adversely impacting our unique
natural resources; and
WHEREAS, the Board of County Commissioners of Citrus County unanimously
agrees with the Florida Association of Counties' support of the fundamental principles
of Florida water law which requires a showing that a proposed use of water is a
reasonable, beneficial use, will not interfere with an existing legal use of water, and is
consistent with the public interest; and
WHEREAS, the Board of County Commissioners of C. itrus County supports the
Florida Association of Counties' opposition to legislation that shifts water supply
allocation from a publicly regulated process to a market driven process; and
WHEREAS, the Board of County Commissioners of Citrus County supports the
Florida Association of Counties' opposition to legislation that undermines the
fundamental principles of. Florida'Water Law which establishes a right-of-use - not a
right-of-ownership; and ".
WHEREAS, the Board of County Commissioners of Citrus County have recently
seen documentation which indicates the Florida Council of 100 will request repeal or
modification to Chapter 373 F.S. to eliminate the local-sources-first language; and
WHEREAS, the Board of County Commissioners of Citrus County wish to go on
record early and unequivocally that such a proposal is ill considei'ed and will put
Florida's surface waters and aquifers at risk of irreparable damage for irresponsible
short-term gain by limited special interest groups; and
WHEREAS, the Board of County Commissioners of Citrus County believes that
any discu's'sion of regional water transfer is premature until Minimum Flows and Levels
have been established for all of Florida's water resources.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Citrus County, Florida, in regular session this 26 day of August 2003, as follows:
