The Landscape & Safety Committee of the Pelican Bay Services Division met on Tuesday, July
18 at 1:00 p.m. at the Community Center at Pelican Bay, located at 8960 Hammock Oak Drive,

Mr. Cravens motioned, Mr. Ventress seconded to approve the 06/20/17 meeting
minutes as presented. The motion carried unanimously.
AUDIENCE COMMENTS
Mr. John D'Aquanno commented on his observations of (1) cracked pavers in the
crosswalk at Pebble Creek, and (2) service trucks in front of the Montenero, often
blocking/parked in the right lane of PB Blvd. Mr. Dorrill will follow up on the service truck
nuisance issue.
DAY AND TIME FOR FUTURE L&S COMMITTEE MEETINGS (ADD-ON)
By committee consensus, it was agreed that (1) the next L&S Committee meeting would
be held on Tuesday, Aug. 29 at 1:00 p.m., and (2) subsequent meetings would be scheduled for
either the third Monday or Thursday of each month at 1:00 p.m., pending Community Center
room availability.
UPDATE ON GULF PARK DRIVE MEDIAN CUT-THROUGH
Mr. Dorrill reported on his recent meeting with personnel from the County
Transportation Dept. and County Manager's Office. Mr. Mark McCleary, Principal Project
Manager of the Transportation Engineering & Construction Management Division confirmed
that all engineering and project management costs associated with the Gulf Park Drive median
cut-through project will be paid for by the County. Ms. Jacob commented that her most recent
engineer's estimate of cost for construction of the project is approximately $34,000, and she will
obtain an updated estimate of cost.
Mr. Cravens commented on the $5,000 pledged by Oak Lake Sanctuary residents for cost
sharing of this project. Mr. Jim Issenmann, resident of Oak Lake Sanctuary, commented that the
OLS community is willing to provide cost sharing of$5,000 only if(1) the PBSD can"move up"
the schedule of this project from 2025, and (2) this is a "stand-alone" project. Mr. Shepherd
expressed concerns over"setting a bad precedent" if these funds are accepted. By consensus, the
committee agreed that the PBSD Board should make the decision as to whether to accept these
cost sharing funds.
VISUAL MITIGATION FOR OAK LAKE SANCTUARY & THE VILLAGE
Dr. Chicurel commented on a recent Oak Lake Sanctuary/The Village site visit with Mr.
Bolick and OLS residents Mr. Jim Issenmann and Mr. Ray Kretz. After observing the recent
trimming of vegetation along US 41, the attendees agreed that planting additional vegetation is
not necessary at this time, and that the area should be reassessed after the existing vegetation has
been given time for regrowth.
SIDEWALKS/COUNTY UPDATE & DISCUSSION
Mr. Dorrill commented again on his recent meeting with County Transportation Dept.
and County Manager's Office personnel which also included a discussion on Pelican Bay
sidewalks. Highlights included:
1. Discussed widespread PB resident dissatisfaction with the quality of County sidewalk
repairs, and provided photos and documentation of PB sidewalks in disrepair.
2. Discussed the possibility of amending the PBSD ordinance to allow for funding of
sidewalk maintenance from PBSD Fund 778 (revenues from ad-valorem based taxation).

3. County personnel suggested that Mr. Dorrill contact Mr. Mark Isackson, Director,
Office of Management & Budget to discuss a County subsidy for the PBSD to maintain PB
sidewalks.
Included in the agenda packet were copies of examples of MSTU ordinances for four
communities (Forest Lakes, Vanderbilt Beach, Bayshore, and Immokalee) which provide for
their own sidewalk maintenance and levy special ad-valorem taxes on their residents for this
purpose.
Committee members suggested that staff provide the following information to the L&S
Committee:
1. Estimate of cost to annually maintain the existing PB sidewalks.
2. Estimate of cost to annually maintain the existing PB sidewalks at a superior service
level.
3. Analysis of the cost differential between concrete and asphalt.
4. Analysis of the benefits of concrete over asphalt(such as estimated lifetime).
5. Estimate of cost to replace all PB sidewalks with concrete at a width of 5 ft. & 6 ft.
6. Estimate of the millage rate required for the PBSD to take over PB sidewalks.
Mr. Trent Waterhouse commented on (1) the possible need for additional bollard lighting
along PB sidewalks, and (2)the County's plan to build a parking garage at Clam Pass Park.
TWO SABAL PALMS NEXT TO NEW STREET LIGHT
Mr. Dorrill commented on the response received from Mr. Tom Hollis, our street lighting
consultant, in regards to our inquiry on the placement of a recently installed street light between
two sabal palms on Laurel Oak Drive. Mr. Hollis does not feel that the palm fronds from these
sabal palms are affecting the street light.

Agnoli Barber& Brundage Plans to widen sidewalks to 8' on west side of Pelican Bay
Blvd (from Commons to North Tram) Total Area = 1.3 miles OR 46,503 square feet
8' widening of existing asphalt sidewalks to asphalt estimated cost is $312,888
Unit cost for asphalt = $312,888/46,503 square feet = $6.73 per square foot
8' widening of existing asphalt sidewalks to concrete estimated cost is $443,160
Unit Cost for concrete = $443,160/46,503 square feet = $9.53 per square foot
Total linear feet of existing asphalt sidewalks in Pelican Bay is approx. 13.5 miles
Total square feet to widen to 6' = 13.5 miles * 5,280 feet/mile * 6' = 427,680 square feet
Total cost to replace all Pelican Bay asphalt sidewalks with 6' concrete sidewalks =
427,680 square feet * $9.53 per square foot = $4,075,790
If a replacement plan cost was distributed over a six-years, the cost per year is approx.
$679,298/year

Maintenance of Traffic Plans
I Maintenance of Traffic Plans must meet or exceed the minimum requirements specified in the most current
edition of both the Manual on Uniform Traffic Control Devices (MUTCD) and the FOOT Design Standard Index 600
series. Additionally, all work h County Right-of-Way shall follow the requirements adopted in and Collier County's
Maintenance ofTraffic Policy# 5807.
DESIGN FOR ALTERNATIVE MODES: SIDEWALKS, BICYCLE LANES AND TRANSIT
Sidewalks
Sidewalks are required to be constructed within subdivisions,and within parking lots. Sidewalks are also required along
public Rights-of-Way (6"thick concrete minimum) and private Rights-of-Way (4"thick concrete minimum) adjacent to
development sites.
Six-foot wide sidewalks are required on both sides of Arterial and Collector Streets. Five-foot wide sidewalks are
required on both sides of local streets and internal accessways. The County has a program for payment-in-lieu ofsidewalk
in situations where a sidewalk is not practical. For more information, refer to Land Development Code Section 6.06.02.

ORDINANCE NO. 201 -
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO. 2002-27,
AS AMENDED, WHICH CREATED THE PELICAN BAY MUNICIPAL
SERVICE TAXING AND BENEFIT UNIT, BY AMENDING SECTION
FOUR, PURPOSE AND POWERS, TO CLARIFY THAT BEACH
RENOURISHMENT IS ONE OF THE PURPOSES OF THE UNIT;
PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR
INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on May 28, 2002, the Board of County Commissioners (Board), adopted
Ordinance No. 2002-27, which superseded, repealed, and consolidated prior ordinances relating
to the Pelican Bay Municipal Service Taxing and Benefit Unit ("Unit"); and
WHEREAS, the Board subsequently amended Ordinance No. 2002-27 by adopting
Ordinance No. 2006-05, Ordinance No. 2009-05, and Ordinance 2013-19; and
WHEREAS, the Board desires to further amend Ordinance No. 2002-27, as amended, h
order to clarify that beach renourishment is one of the purposes of the Unit
NOW, THEREFORE, BE TT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that
SECTION ONE: AMENDMENT TO SECTION FOUR OF ORDINANCE NO. 2002-27,
AS AMENDED.
Section Four is hereby amended as follows:
SECTION FOUR: Purpose; powers.
The Unit is formed for the purpose of providing street lighting, water management, the
installation of sidewalks, beach renourishment,, ambient noise management, extraordinary
law enforcement service and beautification, including but not limited in beautification o f
recreation facilities, sidewalk, street and median areas, identification markers, the maintenance
of conservation or preserve areas including the restoration of the mangrove forest preserve
and to finance the landscaping beautification of only that portion of U.S. 41 from Pine Ridge
Road to Vanderbilt Beach Road inthe above-described taxing and benefit unit and to that end
shall possess all the powers io do all things reasonably necessary to provide such services and
maintain any improvements. The Unit will be solely responsible for advising the County on
dredging and maintaining Clam Pass for the purpose of enhancing the health of the affected
mangrove forest, and will manage such activities for the County.

SECTION TWO: CONFLICT AND SEVERABILITY.
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion ofthe Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity o f the
remaining portion.
SECTION THREE: INCLUSION IN THE CODE OF LAWS AND ORDINANCES.
The provisions of this Ordinance shall become and be made a part o f the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed to "section," "article,"
or any other appropriate word.
SECTION FOUR: EFFECTIVE DATE.
This Ordinance shall be effective upon filing with the Department of State.
PASSED AND DULY ADOP IED by the Board of County Commissioners of Collier
County, Florida, this day of 2017.

Good morning Ms. Jacobs,
I hope this email finds you well. In regards to your question, per Florida State Statute
316.003 (3), a bicycle is defined as follows:
(3) BICYCLE.—Every vehicle propelled solely by human power, and every motorized bicycle
propelled by a combination of human power and an electric helper motor capable of propelling
the vehicle at a speed of not more than 20 miles per hour on level ground upon which any
person may ride, having two tandem wheels, and including any device generally recognized as a
bicycle though equipped with two front or two rear wheels. The term does not include such a
vehicle with a seat height of no more than 25 inches from the ground when the seat is
adjusted to its highest position or a scooter or similar device. A person under the age of 16
may not operate or ride upon a motorized bicycle.
(4) BICYCLE PATH.Any road, path, or way that is open to bicycle travel, which road, path, or
way is physically separated from motorized vehicular traffic by an open space or by a barrier
and is located either within the highway right-of-way or within an independent right-of-way.
**In summary, bicycles equipped with electric assist motors are legal vehicles that can be
ridden on roadways and sidewalks; so long as they meet the definition in the state statute
and no registration or driver's license is required. **
***As for bicycles equipped with a gas assist motor would NOT be considered a legal vehicle
and cannot be operated on sidewalks.***
****A bicycle with gas assist motors may be operated on Florida roadways if they meet the
statutory definition and construction/safety requirements of a "moped," and are registered
and licensed with DHSMV and. . . .the driver has a valid driver's license. ****
MOPED.—Any vehicle with pedals to permit propulsion by human power, having a seat or saddle
for the use of the rider and designed to travel on not more than three wheels, with a motor
rated not in excess of 2 brake horsepower and not capable of propelling the vehicle at a
speed greater than 30 miles per hour on level ground and with a power-drive system that
functions directly or automatically without clutching or shifting gears by the operator after
the drive system is engaged. If an internal combustion engine is used, the displacement may
not exceed 50 cubic centimeters.
I hope this answers your question. . .keep in mind that should someone choose to ride a bicycle
on a sidewalk with an electric assist, they still need to operate their bicycle in a
responsible manner and have the same responsibilities as pedestrians.

Dear Dr. Chicurel,
I am writing to you as Chairman of the Landscape and Safety Committeefor Pelican Bay. I have
lived in Pelican Bay for nineteen years and feel that being able to walk in a beautiful,safe area is
an asset to this community. I now question this and would like to explain.
Five months ago I was walking on Pelican Bay Blvd when a man on a bicycle passed me and
brushed against my shoulder with enough force that he surely felt this and I felt fortunate that I
did not fall. He never made a sound before or after passing me;he never looked back even
though I called out in surprise.
On Saturday,August 19, I was again walking on Pelican Bay Blvd. I heard music and a singer
and assumed it was coining from a car in the street. There was no car. It was a man on a
motorized unicycle. He passed me going at least 20 mph.He brushed against my arm,and
continued on never looking back,never apologizing. After passing me he pulled off the sidewalk
and into the street to avoid a sprinkler,and the unicycle was able to keep up with traffic.
If riding motorized bikes becomes more popular and is permitted on our sidewalks
a serious injury could occur. I hope that you and your committee will give this careful thought
and attention. We have people of all ages who enjoy walking year round in this wonderful
community.
