Ordinance 2003-43 ORDINANCE NO. 03- 43 AN ORDINANCE AMENDING ORDINANCE NO. 89-05, AS AM~:NDED' THE COLLIER COUNTY GROWTH MANAGEMENT PLAN FO~.~THE~~' UNINCORPORATED AREA OF COLLIER COUNTY, BY PRO~U~ FOR A SMALL SCALE AMENDMENT TO THE FUTURE LAN~ USE ELEMENT, MAP OF ACTIVITY CENTER NUMBER 16 BY INCREASING THE ACREAGE OF THE EXISTING NORTHWEST QUADRANT OF ACTIVITY CENTER NUMBER 16 FROM 189 ACRES TO 189.99 ACRES FOR AN INCREASE OF .99 ACRES, LOCATED IN SECTION 11-, TOWNSHIP 50 SOUTH, RANGE 25 EAST; PROVIDING FOR , SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the Collier County Board of County Commissioners adopted the Collier County Growth Management Plan (GMP) on January 10, 1989; and WHEREAS, the Collier County Board of County Commissioners adopted the Future Land Use Element, Activity Center No. 16 Map on January 10, 1989; and WHEREAS, site specific boundaries for Activity Centers were adopted on May 9, 2000 by Ordinance No. 2000-26. WHEREAS, Charles Failer III, representing Richard Santerre, property owner of 189 acres of the N.W. quadrant, Activity Center No. 16, has submitted a request to amend the Future Land Use Activity Center No. 16 Map of the Collier County GMP; and WHEREAS, the request is for an amendment to the Future Land Use Activity Center No. 16 Map, involving .99 acres of land; and WHEREAS, the amendment does not involve a change to the text of any part of the GMP including the Goals, Objectives, or Policies; and WHEREAS, pursuant to Subsection 163.3187(1 )(c), Florida Statutes, this amendment is considered a Small Scale Amendment; and WHEREAS, all applicable substantive and procedural requirements of law have been met. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY FLORIDA, that: SECTION ONE: ADOPTION OF SMALL SCALE AMENDMENT TO THE FUTURE LAND USE ELEMENT ACTIVITY CENTER NO. 16 MAP. This Ordinance as described herein shall be known as the CPSS-2003-1, Small Scale Amendment to the GMP, Activity Center No. 16 Map of the Future Land Use Element of Collier County's GMP. The Amendment, attached hereto and incorporated herein by reference as Exhibit A, is hereby adopted to establish the amended Future Land Use Map as a component of FLUE, an individual element of Collier County's GMP. SECTION TWO: SEVERABILITY. ' If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION THREE: EFFECTIVE DATE. This Ordinance (Small Scale Amendment) shall not become effective until 31 days after its adoption. If challenged within 30 days after adoption, this Ordinance shall not become effective until the State Land Planning Agency or the Administration Commission, respectively, issues a final order determining the adopted Small Scale Amendment to be in compliance.
