AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA
AMENDING ORDINANCE NO. 99-53, THE WALGREENS PUD, TO
CORRECT A SCRIVENER'S ERROR DUE TO THE
INADVERTENT OMISSION OF TEXT IN THE PUD DOCUMENT
AND PROVIDING FOR AN EFFECTIVE DATE. THE SUBJECT
PROPERTY IS LOCATED ON THE SOUTHWEST CORNER OF
AIRPORT-PULLING ROAD AND VANDERBILT BEACH ROAD
IN SECTION 2, TOWNSHIP 49 SOUTH, RANGE 25 EAST,
COLLIER COUNTY, FLORIDA. [SE-PL20170001679]
WHEREAS, on August 3, 1999, the Board of County Commissioner adopted Ordinance
No. 99-53, the Walgreens PUD, concerning the development of property located on the
southwest corner of the intersection of Airport Road and Vanderbilt Beach Road in Collier
County, Florida; and
WHEREAS, Ordinance No. 99-53 repealed Ordinance No. 98-84, the former Walgreens
PUD; and
WHEREAS, Planning Staff has determined that a large amount of text was inadvertently
omitted on page 10 of the PUD document attached as Exhibit A to Ordinance No. 99-53, which
constitutes a scrivener's error.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that Ordinance No. 99-53, the
Walgreens PUD, is hereby amended by replacing Page 10 of the PUD Document attached as
Exhibit A to Ordinance No. 99-53, with the revised Page 10 attached herewith as Exhibit A.
This Ordinance shall become effective upon filing with the Department of State.

3.4 Signs
Sign regulations of Division 2,5 and Division 2.8 of the Collier County Land
Development Code shall apply.
3.5 PROVISION FOR OFF-SITE REMOVAL OF EARTHEN MATERIAL
The excavation of earthen material and its stock piling in preparation of water
management facilities or to otherwise develop water bodies is hereby permitted. If after
consideration of fill activities on those buildable portions of the project site it is evident
that there is a surplus of earthen material, then its off-site disposal Is hereby permitted
subject to the following conditions:
1. Excavation activities shall comply with the definition of a "development
excavation"pursuant to Division 3.5 of the Land Development Code whereby off-
site removal shall be limited to 10% of the total up to a maximum of 20,000
cubic yards.
2. All other provisions of said Division 3.5 are applicable.
