Agenda 09/26/2017 Item #16A2809/26/2017 EXECUTIVE SUMMARY Recommendation to approve an Easement Use Agreement (Agreement) for Lot 15, Nature Pointe, according to the plat thereof as recorded at Plat Book 20, Pages 20 through 22 of the public records of Collier County. ____________________________________________________________________________________ OBJECTIVE: To approve an Easement Use Agreement between the County, the current property owners of Lot 15, Nature Pointe and the Nature Pointe Homeowner’s Association, Inc. CONSIDERATIONS: The property is located at 1635 Gordon River Lane. There are exiting steps and a planter on the subject property that encroach 6.1 feet into a 25-foot Drainage Easement. The steps are connected to a wood deck that extends into the abutting Golden Gate canal. Th e subject 25-foot drainage easement is dedicated to Collier County with no responsibility for maintenance and to Nature Pointe Homeowner’s Association, Inc. with responsibility for maintenance, according to the plat. The Homeowner’s Association is a party to the Agreement, and has issued a letter of no objection to the encroachment because there remains sufficient area to use and maintain the easement. Moreover, there are no drainage facilities within the easement. Staff has reviewed the Agreement and Exh ibits and recommends approval of the Easement Use Agreement. The current owners purchased the property with the encroachment in place. FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the recording fees. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. SAS RECOMMENDATIONS: To approve the Easement Use Agreement between the County, current property owners of Lot 15 of Nature Pointe, and the Nature Pointe Homeowner’s Association and authorize the Chairman to execute the Agreement; and to direct the Clerk to record the Easement Use Agreement.
