LETHAL YELLOWING EMERGENCY
Notice is hereby given that the Board of County Commissioners of Collier County will
hold a special meeting on TUESDAY, SEPTEMBER 2, 2003, at 9:00 A.M. in the Boardroom,
3rd Floor of the W. Harmon Turner (Administration/F) Building, Collier County Government
Center, 3301 East Tamiami Trail, Naples, Florida. The Board's agenda will include:
A. Consideration of Recommendation of the Public Services Administrator to
Declare a Lethal Yellowing Emergency under Collier County Ordinance No.
2000-23.
All interested parties are invited to attend, to register to speak and to submit their
objections, if any, in writing, to the Board prior to the special meeting.
All registered public speakers will be limited to five (5) minutes unless permission for
additional time is granted by the Chairman.
Any person who decides to appeal a decision of the Board will need a record of the
proceedings pertaining thereto, and therefore, may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which the appeal is
to be based.
Collier County Ordinance No. 99-22 requires that all lobbyists shall, before engaging in
any lobbying activities (including, but not limited to, addressing the Board of County
Commissioners), register with the Clerk to the Board at the Board Minutes and Records
Department.

EXECUTIVE SUMMARY
AUTHORIZATION TO DECLARE A COUNTYWIDE EMERGENCY TO PROVIDE FOR
REMOVAL AND INOCULATION OF AT-RISK PALMS AFFECTED BY THE LETHAL
YELLOWING DISEASE AND APPROVE A BUDGET AMENDMENT FOR $20,000
FROM GENERAL FUND RESERVES
OBJECTIVE: To obtain Board of Commissioners' approval to remove affected palms and to
inoculate at-risk palms within the Collier County area.
CONSIDERATION: The plant disease known as Lethal Yellowing affects over thirty (30)
plant species and specifically attacks the Coconut palm and the Christmas palm, thereby posing a
continuous and dangerous threat to the existence of the Coconut palm as a viable plant species.
This disease spreads easily and rapidly through the air and requires immediate action to prevent
further spread of the disease.
Since the continuous health of existing Coconut palms promotes the economic welfare and the
general prosperity of Collier County, Ordinance No. 2000-23 was enacted to provide for the
expeditious removal of affected palms and the inoculation of at-risk palms. In accordance with
the provisions of the Ordinance, the Board is requested to declare a countywide emergency and
to authorize the removal/inoculation of affected palms. The antibiotic which will be used is
oxytetracycline. The declaration of emergency shall continue until a determination is made by
the Public Services Administrator that the threat or danger no longer exists, a recommendation is
made to the Board of County Commissioners to terminate this declared state of emergency, and
the Board of County Commissioners approves such recommendation.
Pursuant to Subsection 138-41 (3), Code of Laws and Ordinances of Collier County, County
expenditures, not to exceed $20,000 in a fiscal year, are authorized to inoculate and/or remove
coconut palm trees suspected to be infested with the lethal yellowing disease. A budget
amendment is required to appropriate the $20,000 for FY 03
FISCAL IMPACT: Funding is available in General Fund Reserves. Approving the necessary
budget amendment would reduce General Fund Reserves by $20,000.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
RECOMMENDATION: Authorization to declare a countywide emergency to provide for
removal and inoculation of at-risk palms affected by the Lethal Yellowing Disease. Approve the
necessary budget amendment.

LETHAL YELLOWING DISEASE
Declaration of County-Wide Emergency
This 2nd day of September, 2003, a state of emergency is hereby declared to exist in Collier
County, Florida, regarding the threat of the Lethal Yellowing Disease, pursuant to Collier
County's Lethal Yellowing Disease Prevention and Control Ordinance (Ordinance No. 2000-23).
This Declaration is made upon recommendation of the County's Public Services
Administrator. The lethal yellowing disease infests and kills coconut palm trees, spreads
easily through the air, and requires immediate, emergency action to prevent further spread of
this disease.
Based upon an in-house cost benefit analysis, it has been determined that the County itself
shall have the suspected trees removed in lieu of mandating inoculations and/or removals by
the various respective landowners on whose property these suspected coconut palm trees
exist. The antibiotic to be used is oxytetracycline.
3. The geographic area covered by this emergency declaration is Countywide.
