CCPC Minutes 08/20/2003 RAugust 20, 2003 August 20, 2003 TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY PLANNING COMMISSION/LAND DEVELOPMENT COUNCIL Naples, Florida, August 20, 2003 LET IT BE REMEMBERED, that the Collier County Planning Commission in and for the County of Collier, having conducted business herein, met on this date at 5:05 pm in REGULAR SESSION in Building "H", Room 216, of the Government Complex, East Naples, Florida, with the following members present: CHAIRMAN: Kenneth Abemathy Mark Strain Dwight Richardson Lora Jean Young Lindy Adelstein Brad Schiffer Paul Midney Russell Budd David Wolfley-Absent (Excused) ALSO PRESENT: Susan Murray Nancy Siemion Russell Webb Joe Schmitt Russ Mueller Marjorie Student Page 1 August 20, 2003 LDC Amendment Meeting Roll Call Call to Order LDC Amendments: Russell Webb: Announced that only the grey items on the agenda will be discussed. The following amendments were voted on from Cycle 2 of the Summary Sheet: Sec. 1.8.10.2.1' Docks and Boathouses. The proposed amendment provides an exception to the 50% destruction requirement for a legal nonconforming use. - Joe Schmitt discussed the policy. The structure may exceed 50% as long as it does not go beyond initial non-conforming structure. They are awaiting policy development. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.2.33.22.13: Garages and Driveways (Bayshore Mixed Use Overlay District). The proposed amendment adds a separation requirement from the garage to the back of the sidewalk. - Mark Strain asked about the space of a parallel space. Discussion between Mr. Strain and Mr. Stan Chrzanowski regarding size -20 feet versus 23 feet. - Mr. Richardson questioned if this was only pertinent to this issue or to the county as a whole. It was determined that it was pertinent to this issue. Footage will be revisited. Mr. Abernathy made a motion to approve with the "at least" correction added to the verbiage. Mr. Strain opposed Motion for approval to move forward: 7-1 Sec. 2.2.34.5: Goodland Overlay (Parking and Storage): Proposed amendment allows commercial vehicles to be parked in the driveways and swales of Goodland homeowner's with certain restrictions. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Page 2 August 20, 2003 Sec. 2.2.34.7: Goodland Overlay (Signs). Proposed amendment allows an exemption from the sign ordinance for a short period of time. - Mr. Schiffer questioned the date of approval and if existing signage would be "grandfathered in." Michaelle Crowley of code enforcement confirmed that they would be. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.4.3.1: Landcaping and Buffering: Proposed amendment requires installation of landscape buffers prior to vertical construction when a nonresidential project is constructed adjacent to an existing residential development. Nancy Siemion was available to answer questions from the committee: - Discussion over whether this applies to all zoning districts and not just commercial. - Mr. Budd addressed net cost increases. Motion to recommend with disapproval by Mr. Abernathy. Seconded by Mr. Budd. Motion recommended disapproval passed 8-0. Sec. 2.4.3.5: Landscaping and Buffering: Proposed amendment recommended moving lighting and landscape language from the architectural section into landscaping buffering. Discussion over whether this applied to all zoning districts. Ms. Siemion confirmed that it did. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.4.6.6: Landscaping and Buffering: Proposed amendment is restatement of the landscape requirements for building foundation plantings. - Discussion over fiscal impact. Adds non-buildable area to the site. - Discussion of setback criteria. - Clarification to the code is needed. - Mr. Schiffer commented that it seemed excessive. Public Speaker: Mr. George Fogg Landscape architect. He discussed the size of the landscape buffer and the issue of"breathing space" and attractiveness. Page 3 August 20, 2003 Public Speaker: Wayne Hood Landscape architect. Spoke about the impact of property value. Discussed classification of plant materials and stated that we want to avoid a "concrete jungle." Stan K. addressed the issue of long-term maintenance. Motion to approve by Mr. Richardson with the addition of verbiage, at Ms. Siemion's suggestion, to be changed to "contiguous area." Motion seconded by Mr. Midney Mr. Schiffer and Mr. Strain opposed Motion for approval to move forward passed 6-2. Sec. 2.4.7.3: Landscaping and Buffering. Proposed amendment is restatement of the water management areas in relation to landscape buffer areas. Ms. Siemion suggested keeping the original language and removing the proposed Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.5.5: Permitted Signs. Proposed amendment will allow barber pole signs that otherwise meet requirements for permitted on-premises signs to be considered a s new class of special purpose sign which allows the pole of a barber pole sign to rotate when illuminated. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.6.9.1 and Sec. 2.6.9.2: Essential Services: Proposed amendment will add fire stations, EMS sub stations and sheriff substations to the permitted uses in the agricultural district. Also, adding ancillary fire station services to the conditional use section. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 3.2.4.11: Pulled from the agenda for lack of appropriate information Sec. 6.1.4: Day Definition: Proposed amendment will revise this section to define day and specify when a calendar day as opposed to a business day is applicable. - Discussion over uniform applications. Page 4 August 20, 2003 - Ms. Student suggested impact assessment and proposed "exception." The amount of days needs to be clarified. Mr. Abemathy made a Motion to send forward with disapproval Mr. Midney seconded. Motion to disapprove: 8-0 Sec. 6.3: Definitions: Proposed amendment adds educational definitions from the School Board interlocal agreement. Discussion regarding limiting the term "adjacent" to school board issues. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Appendix B: Typical Street Sections and Right-of-Way Design Standards. Proposed amendment- this is a housekeeping issue. Appendix B was not included in the ordinance title page for Cycle 1 although the appendix was presented to the various boards for approval. - Discussion over limerock issue. Stan Chrzanowski confirmed 6" limerock. Ms. Student suggested bringing this issue back in Cycle 3 as it was advertised as a housekeeping issue and has now changed its course. Mr. Strain made motion to recommend denial. Ms. Young seconded. Approved 8-0 The following two items were added to the agenda: Sec. 2.2.16.21: Permitted Uses (Industrial district). Proposed amendment suggests adding "wholesale trade- nondurable goods back into the permitted uses in the industrial district. Also, adding indoor shooting ranges as a permitted use. - Discussion about the N. Collier Industrial Center. Motion to Approve Mr. Strain Motion seconded by Mr. Midney Motion for approval to move forward: 8-0 Sec. 2.4.4.2: Currently the code allows for a 30% substitution of palms for canopy trees. Add the following language to the end: "with the following exceptions. No more than 30% of palms may be substituted for required canopy trees within the interior of a vehicular use area and within each individual Type D road right of way landscape buffer."
