WOODR~F, CITY ~AGER ~ ~~ 1997 ~' AG~E~ - C~Y/CO~Y BEACH P~G ISS~S On November 3rd the Mayor and Council will meet with the Chairman and Members of the County Commission to further discuss the issue of beach parking stickers. I would like to encourage the City Council Members to support the adoption of the new Interlocal Agreement, subject to the following changes: 1. Calculation of fees -the City initially calculated the fee structure based upon permits issued in 1994/1995. This showed an 80% County and 20% City issuance ratio. The County suggested that we use the utilization study of the Coquina Sands Association, thereby resulting in a . 70%/30% split. Government works predominantly by compromise. Either of these formulas has a reasonable basis. In. the spirit of moving this matter forward, I would recommend that we agree to a 75%/25% split, thereby resulting in the annual fee for FY'98 being $220,443. (County proposal would have equaled $217,443, with the City proposal being $223,443.) The term of the agreement shall be for a five-year period, commencing October I, 1997, and expiring September 30, 2002. This is the time period in the County's proposal. Termination of the agreement may be by either party. The current contract calls for a ninety- day notice of termination, with that ninety days being measured as the last ninety days of the fiscal year. The County proposal calls for termination by either party by giving written notice at least one year prior to the next October 1st. Because budgeting in the City and the County begins in March or April of each year, a realistic notice of termination should be 180 days. Therefore, it is proposed that this termination language read as follows: This Agreement may be amended by mutual agreement of both parties in writing. This Agreement may be terminated by either party giving the other party written notice of termination, not later than April 1 st of each calendar year. Failure to notify the other party in writing by that date results in the automatic continuance of the Agreement. Please find attached a revised interlocal agreement which contains these changes. INTERLOCAL AGREEMENT . FOR CITY-COUNTY BEACH PARKING TKIS AGREEMENT, made and entered into this ~ day of ..,, 1997, by and between the CITY OF NAPLES, a municipal corporation, hereinafter called 'City' and COLLIY_.R COUNTY, a political subdivision of the State of Floilda, hereinafter called 'County~, to provide for the maintenance and operation of the beach areas and related parking sites within the City of Naples and to provide for the County to pay a portion of the expenses to provide for beach maintenance and free parking for Collier County residents. W'ITNESSETH: WHE~, the City has built and maintained the beach area and related parking sites within the City; and WHEREAS, the County desires to provide for continued free parking for all County residents at the beach area and related parking sites within the City. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereby agree as follows: 1. A certain number of parking spaces at each beach area and related parking site will be reserved for permit parking and will not be metered. 2. The City and the County have implemented a reciprocal beach parking program whereby all residents of Collier County may obtain, at no charge, a beach parking sticker valid for free parking at any County or City beach parking location. The City agrees to maintain a program to distribute beach parking stickers to ali County residents at no charge. The County agrees to provide County beach parking stickers at no co~ to the City. 3. The City will operate a beach patrol and maintenance program to provide for beach and beach parking regulation enforcement; beach and beach parking cleanup and beach and beach parking maintenance. 4. All expenses and revenues for the beach and beach parking program will be accounted for as separate funds of the City in accordance with generally accepted accounting principles. 5. In return for free parking permits, regardless of the number issued to County residents, ~nd for beach maintenance services by the City, as described in Paragraph three of this agreement, the County shall remit an annual payment to the City. The payment amount for Fiscal Year 1997-1998, beginning October 1, 1997 and ending September 30, 1998, shall be in the amount of $220,443. For fiscal years 1999, 2000, 2001, and 2002 the County shall pay to the City the amount of the previous fiscal year payment plus the amount of the annual percentage change in the Consumer Price Index (CPI). The CPI for purposes of this agreement shall be measured by the 12 month change in the unadjusted U.S. Bureau of Labor Statistics CPI for the Southeast United States, October through September annually. 6. One-half of the payment amount due shall be paid to the City not later than November 1 of each fiscal year. The remaining one-half shall be paid not later than May 1 of each fiscal year. Interlocal Agreement Page For the term of this agreement the City agrees to provide at least 1,156 free parking spaces located at street beach ends or City Beach Parks that will be available for vehicles of County residents with valid beach parking stickers. These spaces may be metered, re,ztricted for permit parking or handicapped parking spaces as determined by the City but will be made equally available at no cost to City and County residents. Any adjustments made to the types of parking spaces will not be a basis for any adjustment to the annual payment made by the County to the City under this agreement. The City shall provide annual budgets and annual financial reports to the County each year as soon as reasonable aRer publication. This Agreement may be amended by mutual agreement of both parties in writing. This Agreement may be terminated by either party giving the other party wri~aen notice of termination, not later than April 1 st of each calendar year. Failure to notify the other party in writing by that date results in the automatic continuance of the Agreement. 10. The term of this agreement shall be for a period of five years commencing on October 1, 1997 and expiring on September 30, 2002. 11.
