CASE IN SUPPORT OF PROPOSED NIM ADMINISTRATIVE PROCEDURE Concerns raised by citizens and commitments or representations made by developers, at a NIM, are often very useful not only to Staff, but also to the BCC and CCPC as they carry out assigned responsibilities under the GMP and LDC. The stated Goal in Part II ("Implementation Strategy") of the Future Land Use Element of the GMP highlights the importance of public input as an antecedent to all land use decision-making. See, for example, the first sentence of Policy 4.10: "Public participation and input shall be a primary feature and goal of the planning and assessment effort." A review of recent NIM transcripts found them frequently wanting in regard to disclosure of who is speaking. For instance, see attachments. Under the current process, a tape recording is made at the NIM and later someone who was most likely absent then transcribes the tape. Understandably, it is often impossible for the transcriber to know who is speaking, because the official proponents don't always identify themselves. Also, frequently multiple people will attempt to speak at the same time. In order to encourage full and free expression on the part of members of the public in the land use process, whatever solution is devised should also protect the identity of those persons who wish to speak at a NIM but not to be named. The proposed Procedure requires each official proponent of the matter under discussion at the NIM to be identified each time he or she speaks. Unidentified comments and questions may then be presumed to be those of concerned citizens. It also requires the staff facilitator and official proponents to encourage all participants to speak one at a time. This is a lower cost solution than requiring a court reporter to attend NIM meetings in person. Also, the absence of a court reporter retains the informal and less intimidating character of the meetings. Finally, it allows for persons other than the official proponents to speak without attribution. I have spoken with the County Commission Chair about this problem and a proposed solution. She encouraged me to initiate a corrective process, which I wish to do today. 3.05.07 Preservation Standards * * * * * * * * * * * * * H. Preserve standards. 1. However, a certain on-site preserve may be less viable as a functional preserve because it is one acre or less and isolated. Therefore, in limited situations, providing for a preserve off site can achieve the goals of the GMP. Affordable housing projects may request approval from the Board of County Commissioners prior to SDP or final plat and construction plans approval to satisfy the on- site preserve requirement off site at a rate of 50 percent of affordable housing units provided, not to exceed 3 acres. PUD deviations. Requests for deviations from the on-site native vegetation retention requirement shall be prohibited where the preserve requirement for the PUD is greater than two acres. Additionally, no deviations shall be approved to preserves identified on an approved SDP or final plat and construction plans, except as provided for in LDC sections 3.05.07 H.1.f.tb) and c), above. The applicant shall provide justification for the requested deviations and explain the unique situation for exceeding the thresholds in LDC section 3.05.07 H.1.f.i above. Lands donated to Collier County must include a cash endowment for management of the land.
