Permits are required for ail work performed in any rights-of-way or easements provided for public use in the unincorporated area of Collier County and in those public rights-of-way or easements maintained by Collier County, but which tie within municipal boundaries. 2. Permits shall `generally iee, inia.;form approved by the Board of County Commissioners and shall include the time of commencemeel, the numtere'of days- the job is expected to take, and the approximate date of completion. The permit wilt expire ninety (90) days after the designated completion date, unless authorized in the specific instance for a longer or shorter period. If the work has not been completed by the expiration date, there will be a renewal fee, set by Resolution, payable upon extending the expiration date for an additional ninety (90) days. 15. The Project is consider a demonistration project with the expectation of providing a buffer to U.S . 41 Traffic and an esthetic/value improvement to the community. Accordingly, the Transportation Division may recommend waivers and exceptions provided such action in no way reduces the existing roadway level of service. 2 . Plantings and maintenance thereof shall at all time conform to safe sight-distance as set forth in the FDOT Design Manual and the County's LDC. 3 . The County reserves the right to remove and/or trim landscaping without notice should a traffic hazard exist and permittee contact is not immediately available. 4 . The permittee gain approval of affected adjacent property owners. 5. Through this cooperative working agreement, we have eliminated the need for a tight-of-way acquisition phase, Not only does this save significant dollars, it reduces the overall time needed to get this project "production ready" by approximately two years. In order to construct the roadway, we must utilize a portion of Trail Boulevard right-of-way from the western edge of pavement to the westerly right-of-way line. The property will be utilized for the 4:1 back slope of the new ditch. This Concept was reviewed and approved by Mr, George Archibald several years ago_ Mr. Archibald informed me that the Department would need to apply for a right-of-way use permit from Collier County before construction commenced, While construction is not funded until our next fiscal year (1998/1999), it may be prudent for us to apply for the permit now, The reason for this is recent correspondence and conversations with Ms, Wilma DeHart of the Pine Ridge Civic Association, As we discussed, the civic association is desirous of planting live oaks west of Trail Boulevard between Ridge Drive and Banyan Road, It is also my understanding that trees have already been planted between Gulf Park Drive and Myrtle Road. Therefore, we are requeating that no new plantings be permitted until after our project is completed. They wanted to go over three items regarding the beautification of the Trail Boulevard area that is being performed under permit from the County: 1. Placement of community identification signs. They will come up with some suggested locations for our review and approval. The existing permit may he modified to accommodate this item. 2. Locution of new plantings. I suggested that a minimum distance of 60' from the Stop Bar be the location of the first tree as one approaches the intersection. This distance should provide fi.,r a reasonable cone of sight given the roadway speed and physical characteristics. 3. Relocation of the stop sign captioned above. Although there is an interference from one of the tees planted by the Committee, I agreed to relocate the subject stop sign about one foot to the east to accommodate the existing foliage. If the sign becomes either a nuisance or a hazard,we will have no choice but to relocate it to the standard position called for in the MUTCD. The MUTCD location will then require that the Committee relocate at least the one offending tree so adequate sight distance may be maintained. cc: David F. In that letter you indicated that the department wished to apply for a County right-of-way permit to utilize the backslope along US 41 within the County's right-of-way adjacent to Trail Boulevard. Enclosed with this letter is a blank permit application form for your use. In that letter you also requested that no additional trees be planted along Trail Boulevard until the widening project is completed. We have had a conversation with Mr. and Mrs.Arnold DeHart,the Pine Ridge Civic Association representatives in charge of the planting program,and they are aware of your request and will honor it.
