07/11/2017 EXECUTIVE SUMMARY Recommendation to approve Petition VAC-PL20170000756, to quitclaim and release the County’s interest in the Park tract of Edgewild, as recorded in Plat Book 13, Pages 44 -45 of the public records of Collier County, Florida. The subject property is located just west of Livingston Road, approximately one half mile south of Immokalee Road, in Section 25, Township 48 South, Range 25 East, Collier County, Florida. OBJECTIVE: To quitclaim and release the County’s interest in the Park Tract o f Edgewild, as recorded in Plat Book 13, Pages 44-45 of the public records of Collier County, Florida, in Section 25, Township 48 South, Range 25 East, Collier County, Florida. CONSIDERATIONS: Petition VAC-PL20170000756 has been received by the Development Review Division, Growth Management Department from R. Bruce Anderson of Cheffy Passidomo, P.A., as agent for the property owner, Paul P. and Anna P. Cammuso, to request the County to quitclaim and release the Park tract of Edgewild, as recorded in Plat Book 13, Pages 44-45 of the public records of Collier County, Florida, in Section 25, Township 48 South, Range 25 East, Collier County, Florida. The subject parcel was platted as a “Park” on the Edgewild plat (Plat Book 13, Page 44-45, approved on January 12, 1982). The subject parcel is depicted on the plat as a 0.52 acre parcel with the label “Park.” According to the Property Appraiser, Paul and Anna Cammuso are the owners of the subject “Park” tract. The Petitioner seeks to have the County quitclaim and release its interest in the Park tract in order to build a single family home. The applicant originally submitted this petition as a request to vacate the Park tract, but at the recommendation of the County Attorney it was converted to a request to have the County quitclaim its interest in the Park tract via quitclaim deed. There is no public detriment in quitclaiming the Park tract because the County has not used, and has no desire to use, this property as a park or for any other public purpose. Letters of no objection from abutting property owners have been received or certified receipts that a letter was sent, and a letter of no objection was received from Quail Woods Estates Homeowner’s Association. The County does not acknowledge having any interest in the subject property, but the Petitioner has requested a quitclaim deed from the County to clear possible clouds on the property’s title in order to build a single family home. A quitclaim deed conveys whatever title or interest a grantor has in the described real estate. The instrument operates as a release of the grantor’s title or interest in the property. A quitclaim deed contains no covenants of title or warranty, and it does not purport to convey any particular type of estate. The form’s main use is to clear possible clouds on the property’s title. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of 07/11/2017 recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. The issue arose following a title search in which the property had as an exception the dedication on the plat as a park. The County does not now, or ever has had, an interest in this small parcel as a park. To cure this exception, the applicant filed for a vacation. On my agenda review of the item I questioned whether a quick claim deed was the more appropriate legal mechanism, and spoke with counsel for the applicant, who stated his preference for and then prepared a quick claim deed, and the item was converted. This item is approved as to form and legality and requires a majority vote for Board approval. - JAK RECOMMENDATION: To approve and authorize the Chairman to execute the attached Quitclaim Deed relating to Petition VAC-PL20170000756, which will quitclaim and release the County’s interest in the Park tract of Edgewild, as recorded in Plat Book 13, Pages 44-45 of the public records of Collier County, Florida, in Section 25, Township 48 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A, and direct the Clerk to the Board to record a certified copy of the Quitclaim Deed in the public records of Collier County, Florida.
