Agenda 07/11/2017 Item #16C 907/11/2017 EXECUTIVE SUMMARY Recommendation to approve a Bill of Sale conveying a portion of the existing Irrigation Quality Water facilities to Las Brisas Neighborhood Association, Inc., for ownership and maintenance consistent with existing utility practice. _____________________________________________________________________________________ OBJECTIVE: To convey the existing Irrigation Quality (IQ) Water facilities in accordance with the Collier County Water-Sewer District (CCWSD) utility practices consistent with previous Board of County Commissioners direction. CONSIDERATIONS: In a continuing effort to improve the IQ Water system, the Public Utilities Department embarked on a multi-year program to upgrade its customer meters. The current meter serving the Las Brisas community in Pelican Bay is located within the community and buried in a vault. The proposed new meter will be located near the entrance to the community adjacent to Gulf Park Drive. The new meter will be more accessible, easier to calibrate, and more accurate than the current meter. Whenever possible, it is desirable to locate the Point of Delivery (that point where the CCWSD’s responsibility for ownership and operation ends and the customer’s begins) near the meter. In accordance with existing utility practices, the IQ Water facilities within private property should be owned and maintained by the respective property owner; therefore, approximately 150 feet of 8 -inch IQ Water main downstream of the new meter should be transferred to Las Brisas for ownership and operation. Consistent with principle in the standard IQ Water Major Users Agreement, the CCWSD will agree to repair any facilities conveyed to Las Brisas that break down or otherwise fail to function as intended within five years of the effective date of transfer, unless the failure is directly attributable to Las Brisas or its agents. Public Utilities staff recommends approval of this request. FISCAL IMPACT: The total cost to record the Bill of Sale will be approximately $18.50 and will be paid from Wastewater User Fee Fund (414). GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires majority vote for approval. - JAB RECOMMENDATION: To approve the attached Bill of Sale; authorize the Chairman to execute the Bill of Sale; and authorize the County Manager or his designee to record the Bill of Sale in the Public Records of Collier County, Florida.
