CCPC Resolution 2017-05 (BDE-PL20160001764) CCPC RESOLUTION NO. 17 - 05 A RESOLUTION OF THE COLLIER COUNTY PLANNING COMMISSION FOR A 13.4-FOOT BOAT DOCK EXTENSION OVER THE MAXIMUM 20 FEET ALLOWED BY SECTION 5.03.06 OF THE LAND DEVELOPMENT CODE, FOR A TOTAL PROTRUSION OF 33.4 FEET, TO ACCOMMODATE A NEW BOAT DOCK FACILITY WITH ONE BOAT SLIP FOR THE BENEFIT OF LOT 20, BLOCK E, LITTLE HICKORY SHORES UNIT NO. 2 SUBDIVISION, ALSO DESCRIBED AS 258 6TH STREET WEST. THE SUBJECT PROPERTY IS LOCATED ON THE SOUTH SIDE OF 6TH STREET WEST, APPROXIMATELY ONE- QUARTER MILE WEST OF WEST AVENUE, IN SECTION 5, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. [BDE-PL201600017641 WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS. the County pursuant thereto has adopted a Land Development Code (LDC) (Ordinance 04-41, as amended) which establishes regulations for the zoning of particular geographic divisions of the County, among which are provisions for granting extensions for boat docks; and WHEREAS, the Collier County Planning Commission (CCPC), being duly appointed, has held a properly noticed public hearing and has considered the advisability of a 13.4-foot extension over the maximum 20-foot limit provided in LDC Section 5.03.06 to allow for a 33.4- foot boat dock facility in a Residential Single Family (RSF-4) zoning district for the property hereinafter described; and WHEREAS. the CCPC has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by LDC Section 5.03.06; and WHEREAS, all interested parties have been given the opportunity to be heard by this Commission at a public hearing, and the Commission has considered all matters presented. NOW, THEREFORE, BE IT RESOLVED BY THE COLLIER COUNTY PLANNING COMMISSION OF COLLIER COUNTY, FLORIDA, that: Petition Number BDE-PL20160001764, filed on behalf of Windover 258 6th, LLC, by Nicole Pelham of Stokes Marine, Inc., with respect to the property located at 258 6th Street West in Collier County, Florida, further described as: 116-CPS-0158611339191!1149 5/16/17 Windover 258 6th, LLC-BDE-PL20160001764 1 C1Q Lot 20, Block E, LITTLE HICKORY SHORES UNIT NO. 2, a subdivision according to the plat thereof as recorded at Plat Book 3, Page 79, in the Public Records of Collier County. Florida. be and the same is hereby approved for a 13.4-foot extension of a boat dock over the maximum 20-foot limit to allow for a 33.4-foot boat dock facility to accommodate a new boat dock facility with one boat slip, as shown on the Proposed Site Plan attached as Exhibit "A", in the RSF-4 zoning district wherein said property is located, subject to the Conditions of Approval attached as Exhibit -Tr. BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this Commission and filed with the County Clerk's Office. This Resolution adopted after motion, second and majority vote. This Boat Dock Extension approval is subject to approval of a building permit and Certificate of Occupancy for the single-family dwelling on the subject property. 2. All other applicable state or federal permits must be obtained before commencement of the development. 3. Pursuant to Section 125.022(5) F.S., issuance of a development permit by a county does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the county for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law.
