EXECUTIVE SUMMARY
Recommendation to direct staff to process a fee reduction for a Planned Unit Development
Amendment to the Calusa Island Village PUD.
OBJECTIVE: To provide direction to staff to accept a fifty percent reduced application fee to amend
the Calusa Island Village PUD to allow two single-family residential units to be developed in lieu of the
four multi-family units currently provided for in the Commercial/Mixed use portion of the PUD.
CONSIDERATIONS: The Calusa Island Village PUD was approved by Ordinance #04-20 for “a
mixed-use residential and community, which may feature residential dwelling types, limited commercial
uses and accessory residential and commercial uses”. The PUD is approximately 6.2+ acres, with 5.75+
acres allocated to the Residential area of the PUD and 0.45+ acres allocated to the Commercial/Mixed
Use area of the PUD.
The Commercial/Mixed Use area of the PUD is described as, “designed as a mixed-use area that will
accommodate a variety of limited commercial and personal services, including a maximum of four (4)
multi-family residential units”. Within the section, Permitted use #13 provides for, “Any other
commercial use, which is comparable in nature with the forgoing uses that is primarily a limited
commercial and personal services”, but does not extend the comparable use determination to the
residential use allowed. Based upon the absence of this language, neither a comparable or compatible use
determination is permitted, nor an insubstantial change to the PUD, due to the limited nature of the
insubstantial change process.
The applicant in February of 2016 submitted an application (PL20160000087 - Attachment “A”) for an
insubstantial change to the PUD, referred to as a PDI, but after extensive discussion with st aff and the
County Attorney’s Office it was determined that the PDI process could not be utilized due to the specific
language in the PUD and the absence of the comparable use determination being extended to residential
use. As such the application fee for a PUD amendment is $6,000, compared against the $1,500 required
for a PDI. Staff recognizes the limited nature of the change proposed, in relation to infrastructure
demands and compatibility with surrounding development is constant, no matter the specific application
type, and with this recognition is requesting the Board of County Commissioners (Board) provide
direction to staff to allow for a fifty percent reduction in the PUDA fee, from $6,000 to $3,000 dollars.
The applicant will also be required to pay for all legal advertising for the public hearings associated with
the petition. The reduction request is based upon the limited nature of staff review and estimated time
associated with the request.
FISCAL IMPACT: The reduced application fee is estimated to satisfy staff’s time in work associated
with processing the petition, therefore, there is no fiscal impact associated with the request.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK

units currently provided for in the Commercial/Mixed use portion of the PUD.
