County Evidence Entered: Composite Exhibit#1: 7 photos dated 5/3/17 Composite Exhibit#2: 3 photos date 5/11/17 6 June 2, 2017 Investigator Keegan testified: • On May 3, 2017, he responded to the scene to investigate a complaint filed with the Code Enforcement Division. • Upon arriving on scene, he documented the refuse strewn about the ground as shown in the photos. • On May 11, 2017, he returned to the scene and the violation had been mostly abated. • The case is a repeat violation with a fine and additional costs being imposed on the property owner in the amount of$305.00 in December • There are (3) 8 cubic yard dumpsters on site and Ms. Jeffery is responsive to the issue and understands the County's concerns. Ms. Jeffery testified: • There is refuse removal two days a week and the situation arises due to non-compliance with the residents. • There is a notice posted on the dumpster and she has periodically obtained the names of those responsible for non-compliance and fines have been issued. Discussion occurred on the feasibility of installing security cameras to aid in identifying non- complying residents or others with Ms. Jeffery noting,the owner has chosen not to pursue installing the devices. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence UPHELD issuance of the Citation and ordered the respondent to pay a $1,000.00 fine, $50.00 in Operational Cost and a $5.00 Administrative Fee for a total amount due of$1,055.00. Said costs to be paid by August 2, 2017. 15. CASE NO: DAS22119-CEEX20170008294 OWNER: CORNELIUS BILLIE OFFICER: HANNAH MCQUEEN VIOLATIONS: CODE OF LAWS&ORDINANCES SECTION 14-34(1)(B) DOG FOUND RUNNING AT LARGE. 8TH IMPOUNDMENT. VIOLATION ADDRESS:TAMIAMI TRL E,NAPLES Mr. Billie was present and testified: • His dog escaped the property by digging under the fence in his yard. • He has taken measures to address the situation including fixing the fence and tethering the dog in the yard. • There has not been a running at large issue since the April 23, 2017 incident. Officer McQueen represented the County and testified: • The incident involved an emergency stray animal call as the dog was hit by a car. • The dog was uninjured, but during these events, officers had to immediately travel to Ochopee to investigate the call, taking available resources away from other calls that may occur in the Officer's area of responsibility. • The dog is well behaved, however Mr. Billie should be aware a dog may not be left unattended when he is tethered in the yard. • Based on the emergency nature of the event she recommended a$500.00 fine be imposed. 7 June 2, 2017 Special Magistrate Garretson noted there has not been an incident since 4/23/17 and the Mr. Billie has taken measures to address the situation. Special Magistrate Garretson, after hearing the testimony, and ordered the respondent to pay a fine of$350.00, Operational Costs of$50.00 and$5.00 Administrative Fee for a total of $405.00. VIOLATION ADDRESS:7812 STRATFORD DR,NAPLES Officer Whaley represented the County noting the Citation was for an incident on 12/8/16. Evidence Entered: Composite Exhibit 1: 10 photos of the dog indicating its' malnourished state. Natalie West (formerly Porter) was present and testified: • She no longer has possession of the dog in question, and it was her boyfriend's dog who intermittently lives on the premise. • He claimed the dog had an eating disorder and could not properly digest food. • She acknowledged the dog was malnourished at the time of the incident. Investigator Whaley testified: • When Officer's arrived on scene, the neighbors were feeding and watering the dog, which was receptive to the treatment. • The dog's condition, as exhibited in the photos was due to malnutrition and potentially a lack of exercise. • The dog is licensed under the Respondent's name. • The dog gained 18 lbs in two months while in the custody of Domestic Animal Services and was subsequently"adopted out." • The recommended maximum fine of$500 be imposed for the violation. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence ordered the Respondent to pay a fine of$200.00, Operational Costs of$50.00 and an Administrative Fee of$7.00 for a total amount due of$257.00. CASE NO: DAS21973-CEEX20170008296 OWNER: NATALIE PORTER OFFICER: SHANNON WALKER VIOLATIONS: CODE OF LAWS&ORDINANCES SECTION 14-35(1)(D) ANIMAL WITHOUT SUFFICIENT FOOD OR WATER. VIOLATION ADDRESS:7833 STRATFORD DR,NAPLES Officer Walker represented the County noting the Citation was issued as the result of an incident on 4/3/17. She testified: • A neighbor reported a dog was outside on a lanai in a cage with no access to food and water. 8 June 2, 2017 • When she arrived on scene, she verified the complaint and no one was present at the residence. • She returned the following day and spoke to Ms. West and issued the Citation for the incident the day before. • M . West claimed ownership of the dog and signed the Citation. Natalie West(formerly Porter)was present and testified: • The dog belongs to her boyfriend and she was under the impression he was present the evening before when the Officer was on scene. • She was not at the residence at the time the Officer investigated the complaint. • She signed the Citation and claimed ownership the following day so the Officer would leave the property. Special Magistrate Garretson, after hearing the testimony and reviewing the evidence ordered the Respondent to pay a fine of$200.00, Operational Costs of$50.00 and an Administrative Fee of$7.00 for a total amount due of$257.00. Mr. Abel was present and testified: • The only remaining item to be abated is the screen on the roof of the pool cage. • He•has constructed the necessary staging to access the area(See Exhibit#1)however has not replaced the screening. • He has been assisting a resident in the home with cancer treatment, which is scheduled to be completed on June 7, 2017, at which time he will have time to abate the violation. • He requested a 7-day continuance to finish abating the violation. Investigator Connetta did not object to the request.
