In consideration of the disposition and resolution of the matters outlined in said Citation for which a hearing is
currently scheduled for June 2, 2017 to promote efficiency in the administration of the code enforcement
process; and to obtain a quick and expeditious resolution of the matters outlined therein, the parties hereto
agrees as follows:
1) The violations noted in the referenced Citation are accurate and I stipulate to their existence.
2) The violations are that of Code of Laws Section(s) 134-174 B1 and are described as a hose

Agreement with Collierocounty as to the resolution of the Citation in reference, Case No. PU5227-
CEEX20170006471 dated the 12th day of April 2017.
In consideration of the disposition and resolution of the matters outlined in said Citation for which a hearing is
currently scheduled for June 2, 2017 to promote efficiency in the administration of the code enforcement
process; and to obtain a quick and expeditious resolution of the matters outlined therein, the parties hereto
agrees as follows:
1) The violations noted in the referenced Citation are accurate and I stipulate to their existence.
2) The violations are that of Code of Laws Section(s) 134-62 1.9 Utilities Standards Manual and
are described as the back leg of the RPZ out of the ground with a hose connected going
towards barrels. Illegal tampering. Health, Safety, &Welfare.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $50.00 incurred in the prosecution of this case.
2) Pay administrative fee of$5.00 incurred in the processing of this case.
3) Pay civil penalty of $1000.00.
4) Total Ch. ges are $1055.00. .,

(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is nota Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property
owner.

Problem: OUT-Keegan received call from 1-3 in in regards to a tampering on a locked

Problem: OUT-Tech ran water through test port prior to digging out water box.
May 23 2017 8:18AM Keegan_T Photos downloaded into illegal tampering folder.Tech dug out sand and lock was
still there but was opened. Tech stated resident must have a key.

Problem: OUT--while Keegan and techs were leaving site a vehicle pulled into

The utility has confirmed that the lock applied to the meter on March 28. 2017 has been tampered with and the curb
stop valve opened to enable water to flow into the property.The meter was re-locked yesterday,May 22,2017.
The state of the meter will be checked regularly to ensure that it remains locked. If the lock is again found to have been
removed,technicians will be directed to pull the meter.A meter pull charge will then be applied to the account.
Tampering with utility assets is an offence in accordance with the Collier County Water-Sewer District Uniform
Billing.Operating and Regulatory Standards Ordinance:

If the lock has been tampered with and the street cock has been turned on prior to full payment of all fees the meter
may be removed from the property, and the property owner shall be subject to penalties in accordance with Section
134-178. Should the property owner request renewal of service for the property. service will be restored upon full
payment of: i)all past due bills plus a late payment fee where applicable: ii)a meter removal fee;and iii)any other
fees or deposits that may be due to the District from the property owner(Appendix A-Schedule 5).
Unless the full outstandipgialance of$277.74 is paid, water service will not be restored. Under the circumstance of
meter tampering,theiutility will not permit a Customer Payment Agreement to be approved.

A. Respondent is found guilty of violation of Collier County Code of Laws and Ordinances,Chapter
22,Article VI,Section 22-231 (2).
B. Respondent must abate the violation by restoring water to the property with an active account
with Collier County Public Utilities or vacate the property until an active account with Collier
County Public Utilities is obtained and water has been restored to the property on or before
September 20,2013,or a fine of$500.00 per day will be imposed for each day the violation
remains thereafter.
C. In the event that the Respondent does not comply,all buildings on the property are ordered
to be vacated,and the County may use the assistance of the Collier County Sheriff's Office to
effectuate this order to vacate.This order to vacate shall remain in effect until such time that the
water is restored to the property with an active account with Collier County Public Utilities.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of
$112.47 on or before October 6,2013.
