A public meeting will be held to discuss environmental Land Development Code amendments on
Tuesday August 4 at 9:00 a.m. in conference room 610 at the Community Development and
Environmental Services Division Service Center, 2800 N. Horseshoe Drive, Naples.
Attention: two or more members of the Collier County Planning Commission may be
present and may participate at the meeting. The subject matter of this meeting may be a
future item for discussion and action at a Collier County Planning Commission meeting.
Attention: two or more members of the Environmental Advisory Council may be present
and may participate at the meeting. The subject matter of this meeting may be a future item
for discussion and action at an Environmental Advisory Council meeting.

Environmental LDC Amendments Stakeholders Meeting

The following items were discussed:
Next meeting tentatively set for August 26th
Stakeholders requested that LDC amendments scheduled for DSAC LDR subcommittee
meeting, be distributed to stakeholders
Recreational uses in preserves
Possibly restrict use of impervious pathways and golf cart pathways in preserves
Is there currently a problem with these facilities in preserves?
Percent impervious
Bisecting preserves
Limit number of golf cart pathways through preserves
Size of preserves (perhaps 2 acres) a factor
Separate golf cart paths from other uses
Safety an issue
Motorized vehicles an issue
Limit number of golf cart travel ways
Need to provide for golf cart crossing of preserves
"Paths for golf cart use shall be separately designed", language suggested
Limit speed of golf carts on pathways such as at clam pass
Speed limits not a land development regulation
Limit to pervious pathways
Impervious promotes more usage of preserve (Autumn Woods given as an example)
Concern over finished surface of pervious pathways
Better Roads is a good source of information for types of pervious pathways
County image regarding use on pervious pathways, should promote

SFWMD does not allow pervious pavement

Water quality possibly an issue (concrete vs. asphalt)

Surface for end use a concern, how smooth?
LDC amendment language:
v) Pathways shall not interfere with the
following listed or protected species;
gopher tortoise, red-cockaded
woodpecker, Big Cypress fox
squirrel or the nests of bald eagle.
Where these species occur within
preserves, pathways shall comply
with guidelines or recommendations
of the FFWCC or USFWS.
What about potential use by listed species
CCPC wanted staff to list individual species
Use language such as: "Pathways shall be in harmony with listed species" or
"Pathways shall be in accordance with agency permit conditions"
Change to Pathways shall comply with the guidelines or recommendations of the FFWCC
or USFWS for listed species and the nests of bald eagles
Already covered by listed species section?
LDC amendment language:
i) Pathways may provide access to the
different types of habitats and
natural features within the preserve.
Different types of habitats can also occur within small preserves

Use "tram" instead of"golf cart" for use

vi) Pathways, other than for
boardwalks, must be at natural
grade. If not at natural grade,
provisions shall be made to allow for
the passage of surface water, unless
constructed on berms for the
stormwater management system.
Slopes adjacent to elevated
pathways shall be stabilized with
pine straw or similar type (use
"other") natural material, or be
planted with 100% south Florida
native species compatible with the
(use "habitat instead) species
present in the preserve.
LDC amendment language:
iii. Fences and walls may be utilized outside of
preserves to act as structural buffers for preserves
and to provide protection for listed or protected
species in accordance with 3.04.01. No setback
from preserves is required for fences. Retaining
and decorative walls must be set back a minimum
of five feet from the boundary of preserves.
Permanent fences and walls are prohibited within
preserves. Where construction of such structures
impacts the native vegetation in the preserve, a
restoration plan shall be provided and included as
part of the preserve management plan. No
trenching for wall/fence installation is allowed within
10 feet from preserve boundary, except for
installation of gopher tortoise fencing.
Do not require setback for retaining walls
Re-vegetation plan in place to take care of habitat disturbance during construction
Remediation for fencing and walls
Not trenching (adjacent?) within 10 feet of a pine flatwoods
Firebreak allowed and would provide the 10 foot separation
Other habitats a concern as well, since fire breaks would not be needed in some types of
habitats
Need to check on how retaining walls are constructed
Limit number of shelters on coastal barriers
Would be determined during review of CCSL variance
CCSL variance for Delnor-Wiggins State Recreation Area given as an example
LDC amendment language:
f) Conservation related activities comparable in nature with the aforementioned
uses, as determined by the County Manager or designee

Dimensional Criteria for Preserves
LDC amendment language:
Minimum dimensions. -- •• - • - •_ - - -- _ - - -
shall be: Thin linear and perimeter "picture frame-shaped"
preserves are discouraged, unless such preserve shapes
are dictated by environmental (or environmental
regulatory) considerations. Connections to other
preserves, natural flowways, natural water bodies,
estuaries, government owned or government targeted
lands for preservation purposes or existing listed wildlife
habitat, when present, is encouraged to establish the
largest contiguous natural area possible.
Add water management lakes to amendment language
Include conservation areas in language as preserves
Does language only apply to County required preserves?
LDC amendment language:
The following minimum widths shall apply.
twenty feet, for property less than ten acres.
ii. an average of thirty feet in width but not less than
twenty feet in width, for property equal to ten acres
and less than twenty acres.
iii. an average of fifty feet in width but not less than
twenty feet for property of twenty acres and greater.
Keep "average"language in amendment. Initially placed in the code to provide
flexibility, particularly with regards to roads (cul-de-sacs) and lot-lines adjacent to the
perimeter of projects
Section 3.05.07(H)(1)(h) Allowable and Exempt Uses Within Preserves
(v) Oil and Gas exploration and oil and qas field development and production
activities are uses which are exempt from the foregoing preserves limitations subiect to
the following.
Directional-drilling techniques and/or previously cleared or
disturbed areas shall be utilized for oil and gas exploration
and oil and gas field development and production
activities in preserves in order to minimize impacts to native
habitats, when determined to be practicable. This
requirement shall be deemed satisfied upon issuance of a
state permit in compliance with the criteria established in
Chapter 62C-25 through 62C-30, F.A.C., regardless of
whether the activity occurs within the Biq Cypress
Watershed, as defined in Rule 62C-30.001(2), F.A.C. All
applicable Collier County environmental permitting
requirements shall be considered satisfied by evidence of
the issuance of all applicable federal and/or state oil and qas
permits for proposed oil and gas activities in Collier County,
so long as the state permits comply with the requirements of
Chapter 62C-25 through 62C-30, F.A.C. For those areas of
Collier County outside the boundary of the Biq Cypress
Watershed, the applicant shall be responsible for convening
the Biq Cypress Swamp Advisory Committee as set for in
Section 377.42, F.S., to assure compliance with Chapter
62C-25 through 62C-30, F.A.C., even if outside the defined
Biq Cypress Watershed. All oil and gas access roads shall
be constructed and protected from unauthorized uses
according to the standards established in Rule 62-
30.005(2)(a) 1 through 12, F.A.C.
Any conservation easement or other document restricting uses in a preserve
area shall contain the following statement:
"Oil and qas exploration and oil and qas field development
and production activities are uses which are exempt from the
restrictions herein and shall remain allowed uses on the
lands described herein.
