A public meeting will be held to discuss environmental Land Development Code amendments on
Wednesday July 29 at 9:00 a.m. in conference room 610 at the Community Development and
Environmental Services Division Service Center, 2800 N. Horseshoe Drive, Naples.
Attention: two or more members of the Collier County Planning Commission may be
present and may participate at the meeting. The subject matter of this meeting may be a
future item for discussion and action at a Collier County Planning Commission meeting.
Attention: two or more members of the Environmental Advisory Council may be present
and may participate at the meeting. The subject matter of this meeting may be a future item
for discussion and action at an Environmental Advisory Council meeting.
Attention: two or more members of the Development Services Advisory Committee may be
present and may participate at the meeting. The subject matter of this meeting may be a
future item for discussion and action at a Development Services Advisory Committee
meeting.
Attention: two or more members of the Conservation Collier Land Acquisition Advisory

Discussion on the following amendments:
Environmental Data Submittal Requirements
Environmental Advisory Council
LDC amendment language:
L9. Scope of land development project reviews. The EAC shall review the following
1. Any PUD that requests a deviation from environmental standards of the
LDC or any development order that requests a deviation from the
provisions identified in GMP CCME Policy 6.1.1 (13).
2. Any petition for which environmental issues cannot be resolved between
the applicant and staff, and which is requested by either party to be heard
by the EAC.
3. Any petition which requires a hearing by Collier County Planning
Commission (CCPC) or the Board of County Commissioners (BCC), and
by vote of CCPC or BCC requires the petition to be reviewed by the EAC.
4. Conditional Use (CU) petitions for commercial excavations which are not
part of an approved subdivision.
5. Any CU or rezone within Undeveloped Coastal Barriers, the Area of
Critical State Concern/Special Treatment (ACSC/ST) overlay or RFMU
Sending Lands.
ST & RFMU district neutral lands should be included in number 5 of the scope of
projects to be reviewed by the EAC
Mangroves and manatee concerns should be addressed
Concern that coastal projects should be heard by the EAC
Concern on public input for code of laws and ordinances and new administrative code
Issue needs to be taken up with the Zoning Department and County Attorney Office
County attorney staff will check to see if other EAC requirements are in the LDC
Suggestion that the following be added to the scope of projects to be reviewed by the
EAC
Neutral lands within the NBMO
Coastal projects with waterfront on gulf or estuary (possibly use tidally influenced or
mangroves?)
SRAs
LDC amendment language:
Any petition which requires a hearing by Collier County Planning Commission (CCPC)
or the Board of County Commissioners (BCC), and by vote of CCPC or BCC requires the
petition to be reviewed by the EAC.
Suggestion that the following language be left in:
where staff receives a request from the chairman of the EAC, CCPC or the BCC for that
petition to be reviewed by the EAC
EAC changes to the Code of Laws and Ordinances need to be a part of the LDC
amendment process
Control elevations and how they affect adjacent properties and on-site wetlands a concern
BCC current policy decision to let SFWND to permit
Remove SDPs and PPLs from EAC review process
Coastal projects with waterfront on gulf or estuary should be reviewed if they have the
following:
Environmental contamination (superfund site example given)
Listed species issues
Mangroves impacts
Shoreline alteration
Marinas
Dredge/spoil disposal
For SDPs and PPLs, have EAC review after first or second submittal instead of after final
plans are approved by staff
Need checklist for public to know what environmental information was submitted
Collate information separately for zoning applications
Environmental information could be submitted separately as new information in
requested, like is done for the SFWMD
LDC amendment language:
Soil and/or ground water sampling shall be required at the time of
first development order submittal for sites that occupy farm
fields, golf courses, landfill or junkyards or for sites where
hazardous products exceeding 250 gallons of liquid or
1,000 pounds of solids were stored or processed or where
hazardous wastes in excess of 220 pounds per month or
110 gallons at any point in time were generated or stored.
The amount of sampling and testing shall be determined
by a registered professional with experience in the field of
Environmental Site Assessment and shall at a minimum
test for organochlorine pesticides (U.S. Environmental
Protection Agency (EPA) 8081) and Resource
Conservation and Recovery Act (RCRA) 8 metals using
Florida Department of Environmental Protection (FDEP)
^ soil sampling Standard Operating Procedure (SOP) FS
3000, in areas suspected of being used for mixing and at
discharge point of water management system. Sampling
should occur randomly if no points of contamination are
obvious. Include a background soil analysis from an
undeveloped location hydraulically upgradient of the
potentially contaminated site. Soil sampling should occur
just below the root zone, about 6 to 12 inches below
ground surface or as otherwise agreed upon with the
registered professional with experience in the field of
Environmental Site Assessment. For sites where
contamination is found, provide an analysis of the
measures needed to clean up the site or encapsulate the
contamination to meet applicable FDEP standards. If this
analysis has been done as part of an Environmental Audit
then the report shall be submitted.
Require that the state and federal acceptable pollutant levels and other standards looked
at, be included in the environmental report, and indicate in the report when they are over
these levels

LDC amendment language:
