Petition: R-90-35/PU-90-27 : James A. Davis of Coastal
Engineering Consultants, Inc. , representing
Hospice of Naples, Inc. ; requesting a zoning
change from A-2 to RMF-6 and a provisional use "f"
of RMF-6 for a hospice.
Considerations:
The ± 5. 82 acre parcel is located near the I-75/Pine Ridge
Road Intersection, approximately 1200 feet south of Pine
Ridge Road on Whipperwill Lane. This parcel is surrounded by
undeveloped and developed A-2 agricultural zoned lands.
Hospice of Naples plans to construct a Hospice House.
Most of the site, approximately seventy-five percent (75%) ,
has been previously cleared. The remaining twenty-five
percent (25%) consists of slash pine (Pinus ellottii) ,
Brazilian pepper (Schinus terebinthifolius) , saw palmetto
(Serenoa repens) , wax myrtle (Myrica cerifera) , grape vine
(Vitus spp. ) , and other graminoid groundcover species. Along
the south property line there is a 0. 5 acre portion of a 7.5
acre lake that extends to the south of the property.
Excluding the lake, ground elevations range from 10. 0 to 11. 3
feet above mean sea level. This season's high water
elevation appeared to reach its maximum at approximately 9. 5
feet above mean sea level.
Recommendations:
Staff recommends administrative approval of petition
R-90-35/PU-90-27 subject to the following stipulation:
1. All existing native trees within the dry detention areas
and open space areas shall be retained on the site.

Petition: PU-90-24 : Donald A. Pickworth of Asbell, Hains,
Doyle & Pickworth, P. A. , representing St. John's
Episcopal Church of Naples, Inc. ; requesting a
provisional use "a" of "E" for a church.
Considerations:
The ±4 .24 acre parcel is located on the south side of
Immokalee Road, approximately 0. 6 miles east of Oaks
Boulevard, across from the Quail Creek PUD. The parcel is
surrounded by undeveloped and developed estate zoned lands.
The proposed development is to construct a mission church for
St. John's Episcopal Church.
Throughout the site there is a dominant slash pine (Pinus
elliottii) canopy with cajeput or punk tree (Melaleuca spp. ) ,
and a few cypress (Taxodium distichum) . Vegetation such as
wax myrtle (Myrica cerifera) , myrsine (Myrsine quianensis) ,
strangler fig (Ficus aurea) and earleaf acacia (Acacia spp. )
constituted a sparse midstory. The ground cover mostly
consisted of pine needles with swamp fern (Blechnum
serrulatum) , musky mint (Hyptis auata) , black-eyed susan
(Rudbecka hirta) and other herbaceous species. Existing land
elevation is approximately fourteen (14) feet above mean sea
level.
Recommendations:
Staff recommends administrative approval of petition PU-90-24
subject to the following stipulations:
1. Petitioner shall retain at least a fifty (55) foot wide
naturally vegetated buffer along the south property line
and at least a forty (40) foot wide naturally vegetated
buffer along the east property line.
2 . All exotic vegetation shall be removed from the site, per
Ordinance No. 82-37 as amended. The exotics shall be
replaced with appropriate South Florida native species
where required for landscaping and/or buffering.

3 . All applicable Federal, State and Local permits shall be

Considerations:
The ±1. 0 acre parcel is located on the southwest corner of
Golden Gate Parkway and 47th Street Southwest, in Golden Gate
City. The parcel is comprised of four (4) lots that are
bisected laterally into C-4 and RMF-12 zoning districts. The
land use determination for this property, under the Collier
County Comprehensive Plan adopted January 1989, is an
Activity Center. The proposed development is to construct a
service station with a mini-mart, with sales of convenience
items, administrative office, service bays, a canopy area
with gas pumps underneath and an area for water and air
amenities.
-- The parcel consists of mostly graminoid ground cover with
several cabbage palm (Sabal palmetto) , a few Brazilian
pepper (Schinus terebinthifolius) , and some muscadine
grapevine (Vitis rotundifolia) .
Recommendations:
Staff recommends administrative approval of petition R-90-32
subject to the following stipulation:
1. Native vegetation, specifically eighteen (18) cabbage
palms that cannot be retained shall be incorporated into
open space or landscaping by transplanting.

Petition: PU-90-26: Dr. Neno J. Spagna of Florida Urban
Institute, Inc. , representing Unity Faith
Missionary Baptist Church; requesting a
provisional use "a" of Estates zoning for a
church.
Considerations:
The ± 5. 0 acre parcel is located approximately 300 feet north
of 15th Avenue Southwest on the east side of 39th Street
Southwest, across from the Golden Gate commercial strip along
C.R. 951. The parcel is surrounded by undeveloped and
developed estate zoned lands.
Approximately fifty percent (50%) of the site consists of
remnant wetland species, such as swamp bay (Persea
palustris) , cypress (Taxodium distichum) , and cabbage palm
(Sabal palmetto) . The central portion, approximately ten
percent (10%) of the site, consists of several upland species
such as saw palmetto (Serenoa repens) , rusty lyonia (Lyonia
ferruginea) , shining sumac (Ritus copallina) , American
beautyberry (Callicarpa americana) and yellow-eyed grass
(Xyris spp. ) . The remaining eastern portion of the site,
approximately forty percent (40%) , consists of mostly wetland
species. These species are cypress, swamp bay, cabbage palm,
wax myrtle (Myrica cerifera) , Brazilian pepper (Schinus
terebinthifolius) , strangler fig (Ficus aurea) , saltbush
(Baccharis halimifolia) and arrowheads (Sagittaria spp. ) .
Recommendations:
Staff recommends administrative approval of petition PU-90-26
subject to the following stipulations:
1. Prior to preliminary site development plan approval,
Project Review Services Environmental Staff shall field
verify and approve County wetland jurisdictional areas
which shall be flagged by the petitioner. These approved
wetland jurisdictional areas shall be designated as
Conservation Easements which shall be recorded in the
official County Records prior to final site development
plan approval. As part of the water management system
for this site, all required stormwater retention shall be
directed into these preserve areas after a 1/2 inch dry
water quality pre-treatment.

2 . All buildings, parking and associated infrastructure
shall be situated to avoid the designated wetland
conservation areas.
3 . All applicable Federal, State and Local permits shall be

Petition: PU-90-22 : Richard L. Houghton; requesting a
provisional use 3 (b) of A-1 zoning district for a
hunting camp.
Considerations:
The petitioner is requesting an after-the-fact provisional
use in an A-i/ST zoning district for the construction of a
boardwalk (75 feet long by 32 inches wide) and a hunting
camp.
Upon completion of two site visits it is staffs
recommendation that the provisional use be granted and
stipulated to respond to the items which are needed to bring
this project into compliance. Several trees were removed in
construction of this project. In discussions with the
petitioner, staff has decided that a certain number of trees
shall be replanted as mitigation. If the existing additional
hunting camp is found to be in compliance with the zoning
ordinance and the use of the building is found to be in
compliance with the determined acceptable use of the Big
Cypress National Preserve by the Secretary of the Interior or
their designee (Mr. Fred J. Fagergren, Superintendent of the
Big Cypress National Preserve) , staff would support the
structure and its current use. The petitioner shall get a
determination from the Superintendent of the Big Cypress
National Preserve as to what the acceptable use is.
It has been determined that the type of waste disposal which
was designed for the additional camp could be in violation of
Health and Rehabilitative Services (HRS) requirements and
shall be removed if deemed necessary by the HRS. If it is
determined that a bathroom facility can remain, the
petitioner shall contact HRS and obtain necessary permits.
If installation of a septic tank is found to be necessary a
Special Treatment (ST) permit would be required.
If the hunting camp is found not to be an acceptable use as
was stated in the letter from Mr. Fagergren of August 8, 1990
to Mr. Houghton, the kitchen and bathroom shall be removed,
and the building shall be used for storage or other
acceptable use.
Recommendations:
Staff recommends approval of petition PU-90-22 with the
following stipulations:

1. The petitioner shall plant twelve trees to mitigate for
the trees removed during construction. The trees shall
be native species which will enhance the existing habitat
for protected species, such as the liguus snails,
observed during previous site visits.
2 . The petitioner shall remove the waste disposal system
if found to be in violation with HRS requirements.
3 . The petitioner shall comply with the decision of the
Superintendent of the Big Cypress National Preserve
regarding the determination of the use of the structure.

Petition: PU-90-1: William C. McAnly, P. E. of William C.
McAnly and Associates, P. A. , representing College
Properties of Southwest Florida, Inc. ; requesting
a provisional use "b" of A-2 for Earth Mining.
Considerations:
The 83 .7 acre parcel is situated 3 . 5 miles east of CR-951 and
.25 miles north of Sabal Palm Road in Section 20, Township 50
South, Range 27 East. Petitioner proposes to excavate a 62
acre commercial fill pit. The petitioner is presently
addressing an illegal excavation and land clearing violation
on said site with Collier County Compliance Services (see
enclosed memo dated 7/9/90) . It should be noted that the
petitioner, in the aforementioned violation cleared and
excavated outside of the College of Southwest Florida
property lines, (northern property line area) ± 200 feet x
2000 feet.
Water quality monitoring will be required by Project Review
Services for the excavation permit, since the petitioner will
be excavating at or below thirty (30) feet. The petitioner's
environmental impact statement states that the proposed lake
will be vegetated.
Mitigation for wetland violations was determined to be the
purchase of ten (10) acres of wetlands within the Fakahatchee
Strand and the deeding of said acreage to the State of
Florida Department of Natural Resources Carl Project. Copies
of the deeds are enclosed. The transfer of the deeds to the
State is in its final stages.
Recommendations:
While present staff does not agree that the mitigation
adequately addresses the amount of illegal destruction to the
environment, staff recognizes that the petitioner has acted
in good faith to satisfy the specified required mitigation.
Therefore, staff recommends approval of petition PU-90-1
subject to the following stipulations:
1. This project is recommended for provisional use approval
only, and does not absolve the applicant from complying
with all environmental ordinances in effect at the time
of final development order approvals or from supplying
necessary information as required for any subsequent

approval (i.e. , wildlife surveys, etc. ) . In the event
of disagreement between applicant and Project Review
Services staff as to environmental stipulations, the
Environmental Advisory Council or its successor body
shall make recommendations to the Board of County
Commissioners as part of the effected approval process.
2 . Documentation that the ten (10) acres (3 parcels) in the
Fakahatchee area owned by College Properties of
Southwest Florida, Inc. have been deeded to and accepted
by the State of Florida, Department of Natural
Resources, Bureau of Land Acquisitions, shall be
submitted to Project Review Services prior to the
issuance of an excavation permit.
3 . All conditions stipulated by Collier County Compliance
Services as a consequence of any past or present
violations including any unresolved tree removal
violations shall be satisfied prior to the issuance of
an excavation permit.
— 4 . If the resolution of the incursion onto and excavation
on the adjacent property to the north includes the
filling and grading of said area (approximately 200' x
2000' ) , the petitioner shall re-vegetate the area with
native species representative of the previous habitat.
All three strata shall be planted.
5. Petitioner shall submit a littoral zone planting plan,
to Project Review Services for review and approval prior
to excavation permit issuance.

Petition: PU-90-14: Dr. Neno J. Spagna of Florida Urban
Institute Inc. , representing New Hope Ministries,
Inc. ; requesting a provisional use "c" of A-2
zoning for a church/related facilities.
Considerations:
The applicant is requesting a provisional use "c" of the A-2
zoning district for a church and related facilities. The
total site covers 19 . 9 acres; approximately half of that area
will be preserved. The petitioner has proposed to
concentrate all of the planned development in the southern
half of the parcel to allow the northern half to remain as a
naturally vegetated habitat for wildlife; specifically
red-cockaded woodpeckers (RCW) which have been observed
on-site.
The property is comprised of a pine flatwoods area with
scattered melaleuca throughout much of the site. One
red-cockaded woodpecker cavity tree is located along the
eastern boundary and several birds (RCW) were observed
foraging in the northwest quarter of the property.
A red-cockaded woodpecker cavity tree survey was conducted on
site by Mr. Neno Spagna, Florida Urban Institute Inc. , and
accepted by Ms. Kimberly Dryden, Biological Scientist III
with Florida Game and Fresh Water Fish Commission. A letter
of technical assistance was received from Ms. Dryden which
responded to the proposed development and preservation of the
site. Staff has incorporated some of these comments into the
stipulations for development in recommending approval of the
proposed provisional use.
Recommendations:
Staff recommends approval of petition PU-90-14 subject to the
following stipulations:
1. The applicant shall be subject to all environmental
ordinances in effect at the time of development order
approvals.
2 . Provisional use approval does not absolve the applicant
from supplying necessary information as required for
subsequent site plan approval (i.e. wildlife surveys,
etc. ) .

3 . The layout of the church and related facilities
(structures, infrastructure and parking) shall be
adjusted to comply with the recommendations of Florida
Game and Fresh Water Fish Commission as follows:
a. Re-site the parking areas in the southeast project
corner and along the eastern property boundary to
allow maximum tree preservation. This will
accommodate observed foraging behavior of
red-cockaded woodpeckers accessing the site from the
east.
b. Re-site the gymnasium and mutli-purpose building into
areas invaded by melaleuca in the central portion of
the site.
4. The following comments from Florida Game and Fresh Water
Fish Commission, shall be complied with: regarding
habitat protection,
a. We recommend preservation of existing pines on site
in lieu of planting live oaks along the southern
property boundary. Research on red-cockaded
woodpeckers indicates a preference for open pine
mid-stories and and aversion to hardwood sub-canopy.
Landscaping on site should be primarily existing
slash pine.
b. Additional tree protection should be effected in the
proposed grass parking lot areas by adoption of
stringent tree protection efforts (barricading,
restrictions on fill, etc. ) during project
construction.
c. We recommend development of a red-cockaded woodpecker
habitat management plan which will maintain and
improve the quality of the habitat on site.
d. The habitat set aside for red-cockaded woodpecker
foraging habitat must be designated as a preserve or
conservation area with restrictions pursuant to
chapter 704. 06 Florida Statutes and which requires
the conservation area to be maintained exotic free.

Petition: PDA-89-16: Barbara Henderson Cawley of Wilson,
Miller, Barton, & Peek, Inc. , representing Amnon
Golan; requesting a PUD Amendment to Orangetree.
Considerations:
Petitioner proposes an amendment to PUD Ordinance No. 87-13
(Orangetree PUD) . Proposed changes are contained in the
revised PUD amendment dated September 10, 1990. The property
is ± 2 , 752 . 8 acres and is bounded on the West by Immokalee
Road, on the south by Randall Boulevard and on the north and
east by drainage ways. Oil Well Road (CR 858) runs east-west
through the site. Environmental conditions of Ordinance No.
87-13 are found on pages 9-10 and 9-11 of the enclosed PUD
document.
The PDA proposes changes to the size of R-1 lots from 1 acre
to 1/2 acre and site width from 150 feet to 120 feet. Other
changes can be found in the attached "Summary of PUD
Amendment for Orangetree" . The project is proposed in phases
and is conceptual at this time.
South Florida Water Management District (SFWMD) , 5-23-88,
claimed fifteen (15) wetland areas, primarily cypress, as
jurisdictional (reference aerial) . The Army Corps of
Engineers is scheduled for a jurisdictional determination in
November, 1990.
Areas of concern are:
- wetlands; Collier County lines concur with SFWMD with the
exception that Collier County also claims the isolated
circular shaped wetland shown on the western portion of the
site (former agricultural use area) . Reference 1986
aerial.
- pine/saw palmetto habitat
- burrowing owls
Recommendations:
Given the conceptual nature of the plan and proposed phasing
of the project, staff recommends approval of petition
PDA-89-16 subject to the following stipulations that shall
pertain to the PDA and all separate and associated site plans
submitted to Collier County for approval:

1. This project is recommended for PDA approval only. The
applicant shall be subject to all environmental
ordinances in effect at the time of development order
approvals unless specifically exempted or modified by
PDA-89-16 or PUD Ordinance No. 87-13 .
2 . Protected plant and animal species surveys as per the
requirements of policies 7. 3 .4, 7. 3 . 6 and 7. 3 . 8 of the
Conservation and Coastal Management Element of the
Growth Management Plan shall be required for all separate
and additional site plans submitted to Collier County for
approval. If protected species surveys are over two (2)
years old, a new survey shall be required.
3 . Wetlands shall be flagged by the petitioner, to include
Collier County jurisdictional lines, and shall be field
verified by Collier County Project Review Services
Environmental Staff prior to and as part of the <SDP>
submittal. Said approved wetland boundary shall be
indicated on final site plan.
4 . All proposed mitigation for impacts to Collier County
jurisdictional wetlands shall comply with the ratios and
requirements of Appendix 7 of the South Florida Water
Management District rules. Mitigation areas shall be
surveyed prior to final (site plan) approval and
designated as a conservation easement and/or tract with
protective covenants pursuant to Florida Statutes,
Chapter 704 . 06.
5. Plans for any required State and Federal wetland
mitigation shall be submitted to Project Review Services,
Environmental Staff, for review and incorporation into
the final site plan.
6. A minimum separation distance between protected wetlands
and proposed lake(s) shall be two hundred (200) feet
unless adjacent lakes are controlled at the lichen
line/water marks of the affected wetlands. Any deviation
from the 200 feet separation distance shall require
South Florida Water Management District approval.
7 . In the event active, protected species' nests or burrows
and/or foraging habitat are encountered prior to or
during construction activities, construction activities
shall cease and Collier County Project Review Services,
Environmental Staff shall be notified immediately.
Project designs may be adjusted, if warranted.

8. Protected plant species sighted prior to or during
construction shall be protected from injury and/or
relocated on site, preferably to preserve or landscape
areas.
9. Petitioner shall be subject to Development Standards and
Environmental stipulations in Ordinance No. 87-13 , unless
amended by PDA-89-16.�
