PARTIAL RELEASE OF SECURITY INSTRUMENTS
KNOW ALL MEN BY THESE PRESENTS that REGIONS BANK, an Alabama state charted
bank, having a mailing address of 100 N. Tampa Street, Suite 3400, Tampa, Florida 33602
("Mortgagee"), is the owner and holder of the following documents (collectively, the "Security
Instruments"):
1. Mortgage, Security Agreement and Fixture Filing given to Mortgagee by IC AQUA II, LLC,
a Delaware limited liability company ("IC Aqua"), recorded in Official Records Book
5216, Page 1438, of the Public Records of Collier County, Florida (the "Records");
2. Collateral Assignment of Leases, Rents and Contract Rights given to Mortgagee by IC
Aqua, recorded in Official Records Book 5216, Page 1461, of the Records; and
3. Collateral Assignment of Declarant Rights given to Mortgagee by IC Aqua, recorded in
Official Records Book 5216, Page 1471, of the Records.
NOW, THEREFORE, for and in consideration of the sum of Ten and No/100 Dollars
($10.00) and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, Mortgagee hereby releases from the lien, operation and effect of ;he
Mortgage that certain real property more particularly described on Exhibit A attached hereto
and incorporated herein by this reference.
PROVIDED, HOWEVER, that this Partial Release is not intended and shall not be
construed to constitute, evidence or give rise to the release, satisfaction or discharge, in < ny
way or to any extent whatsoever, of (i) any indebtedness or other obligations secured and/or
evidenced by the Security Instruments (collectively, the "Secured Obligations"), or (ii) any of
Mortgagee's other security for the payment and performance of the Secured Obligations
(including without limitation any of the real and personal property encumbered by the Security
Instruments which is not expressly released hereby), all of which shall be entirely unaffeccec
and unimpaired by this Partial Release.
IN WITNESS WHEREOF, Mortgagee has caused this Partial Release to be duly executed
to be effective for all purposes as of the Q7 day of 72c , 2017.
