Petition: PDA-89-13 ; James E. Vensel, of James E. Vensel and
Associates, representing Antaramian Development
Corporation; requesting PUD amendment to Point
Marco PUD.
Considerations:
The property on the extreme southern tip of Marco Island was
approved as a PUD in 1981. This PUD was originally approved
on 5/12/81 as Ordinance No. 81-25 and amended later that year
on 12/22/81 as Ordinance No. 81-98. This PUD provides for
901 dwelling units of a mixture of residential apartments,
apartment hotel units and hotel units. The PUD also provides
for varying heights of the buildings of ten and fifteen
stories. According to Collier County O.R. 1163 , page 1358
the owner of the property has contributed a parcel of the
property as a public beach access as is required by the PUD.
The primary reason for this PUD amendment request is to
revise the project to meet the goals of the Department of
Natural Resources (DNR) Coastal Construction Setback Line.
The owners have negotiated with the DNR and have reached an
agreement (Florida Department of Natural Resources Agreement
No. AGR-CO 0003) as to how this will change their development
plans.
Several other amendments are also requested:
1. Building sites four and five have been moved twenty-five
feet landward.
2 . Building sites four and five have been separated to
comply with the DNR agreement.
3 . All five building sites have been changed in shape to
comply with the present plans for development.
4 . The number of units has been adjusted to comply with the
present plans for development. No increase in total
density.

5. Building sites one and five are proposed for the lower
height of twelve stories. Building sites two and four
are now proposed for thirteen stories instead of ten.
This sets the lowest height buildings adjacent to the
property boundaries and reduces the number of sites
permitting the maximum height of fifteen stories from
three to one.
6. Proposed that the language about the permitted users of
the common facilities be broadened to include residents
and their guests.
7 . Proposed that platting be made optional. It is presently
not provided for.
All other provisions of the PUD are to remain unchanged.
The site has been previously cleared. There are several
cabbage palms (Sabal palmetto) , Australian pines (Casuarina
sp. ) and a few buttonwoods (Conocarpus erecta) on site.
According to the DNR agreement, prior to submission to the
DNR for the first permit application the owner shall submit a
mitigation plan, including a completion timetable and
financial or other assurances satisfactory to the DNR to
insure completion and perpetual maintenance. The plan shall
specify a proposed dune system protection and enchancement
program for the dune system lying within the northern parcel.
Recommendations:
Considering the above, staff administratively approves
petition PDA-89-13 subject to the following stipulations:
1. Outdoor lighting associated with such construction or
development, within 300 feet of the high tide line, shall
be in compliance with Section 3 of Collier County
Ordinance No. 88-52 .
2 . Petitioner shall not construct any structure, add any
fill, mechanically clean any beach, or grade any dirt
within 100 feet of the nesting zone of a beach where sea
turtles nest or may nest during the nesting season
(period between May 1 - October 31) without first
obtaining a Construction in Sea Turtle Nesting Area
Permit pursuant to Collier County Ordinance No. 88-52 .

3 . If it is necessary for vehicles to be on the beach for
construction of the walkovers and dune enhancement,
petitioner shall apply for a Vehicle on the Beach Permit,
subject to review and approval by the Planning Services
Environmental Review Staff, prior to any construction
activity.
4 . Petitioner shall notify the Planning Services
Environmental Review Staff prior to commencing work
seaward of the Coastal Construction Control Line and
shall contact the Planning Services Environmental Review
Staff within two weeks following its completion.

Petition: PU-89-25: James L. Harper of A-i Gas Company,
representing Naples Fertilizer and Supply
Company. ; requesting a provisional use "3k" of C-4
for retail sale of propane.
Considerations:
The Naples, Fertilizer and Supply Company is located on the
west side of Goodlette-Frank Road and on the east side of
14th Street, approximately 1/8 mile south of Solona Road.
The portion of the site to be used for the installation of
one 1, 000 gallon above ground propane gas tank and pump is an
existing paved area. The tank will be secured by four mobile
— home augers with an empty weight of 2200 pounds. The unit
(tank and pump) will be protected by barricades. According
to the applicant the unit does not generate any refuse.
No vegetation of any kind presently exists in this area.
Therefore, the area has been completely impacted.
Recommendations:
Considering the above, staff administratively approves
petition PU-89-25.

Considerations:
The Fountain View Apartment Project is located on the
northeastern corner of the intersection of Airport-Pulling
Road and Cougar Lane, approximately 3/4 mile north of Pine
Ridge Road.
The portion of the site to be used for the proposed child
care enter is an existing cleared area. No vegetation of any
kind presently exists in this area. Therefore, the area has
been completely impacted.
Recommendations:
Considering the above, staff administratively approves
petition PU-89-26.

Petition: PU-90-3 : A. A. Reeves of Florida Cities Water
Company, representing Robert A. Billings and Sally
Billings; requesting provisional use "b" of
Section 8 . 10 ("E" Estates) zoning for essential
services - water storage tank.
Considerations:
Petitioner requests a provisional use for the construction of
a water storage tank on a five acre parcel. The property is
located on the north side of Green Blvd. , directly east of
the Lambert Canal. The access will be off Green Blvd. and
the facility will be located entirely on the southern half of
the property.
The petitioner proposes to construct a water storage tank,
booster pump station, fuel oil tank on a pad, and associated
paved driveway. The facility has been field located to have
the least amount of impact on the site, in terms of native
vegetation removal.
The property is mostly covered with pine trees and palm
trees, with a small cluster of cypress along the eastern
boundary two-thirds of the way back on the site.
Recommendations:
In consideration of the above, staff recommends approval of
Petition PU-90-3 subject to the following conditions:
1. Petitioner shall comply with Ordinance No. 75-21 as
amended by Ordinance No. 89-58 (preservation of native
habitat) . Petitioner shall also comply with Ordinance
No. 89-51 and Collier County Comprehensive Plan Policy
6.4 . 7.
2 . Petitioner shall comply with the tree clearing Ordinance
No. 75-21 and exotic removal Ordinance No. 89-53 .

FOR EAC MEETING 2/28/1990
Petition: PU-89-22 : Terrance L. Kepple of Bruce Green and
Associates, Inc. , representing Jeff and Cynthia
Zwerin; requesting a provisional use "3a" of C-3
zoning for indoor recreation (bowling alley) .
Considerations:
Petitioner requests a provisional use for the construction of
a bowling alley on a 1. 56 acre parcel. The property is
located on SR 92 , 200 feet east of Balmoral Court and 300
feet west of Covewood Street. Petitioner plans to clear the
entire site and put in a parking lot and bowling alley.
A site inspection was conducted on January 3 , 1990. The
property is roughly divided into three habitats. The north
one-third, along SR 92 is heavily vegetated with scrub oak
(Quercus ilicifolia) , saw palmetto (Serenoa repens) , American
beautyberry (Callicarpa americana) muscadine (Vitis
munsoniana) , love vine (Cassytha filiformis L. ) and lyonia
(Lyonia ferruginea) . The middle portion of the property
drops in elevation and exhibits a number of large live oaks
(Quercus virginiana) , myrtle oak (Quercus myrtifolia) ,
prickly pear (Opuntia humifusa) , saltbush (Baccharis
halimifolia) , smylax (Smilax auriculata) , winged sumac, (Rhus
copallina) , wax myrtle (Myrica cerifera) and wild coffee
(Psychotria hervous) . The northern edge of the mangroves is
located approximately two-thirds of the way back on the site.
Within this mangrove area several different species were
noted; including buttonwood (Conocarpus erectus) , sea purse
lane (Sesuvium portulacastrum) , myrsine (Myrsine quianensis) ,
swamp bay (Persea palustris) and hog plum (Ximenia americana
L. ) .
Staff initially had environmental concerns with the use of
the property. Staff requested copies of letters verifying
that the location of the site is within the Deltona
Settlement Area. A letter from the Deltona Corporation
confirmed that the lot is developable, subject to the
provisions of the settlement agreement. The Department of
Environmental Regulation (DER) found the project to be in
compliance with the Deltona Settlement.
The provisional use requested does not have any greater
impact on the site than the approved uses within this zoning.

Since the land is within the Deltona Settlement limit of
development and single family lots are planned along Dogwood
Drive to the south the staff understands that the mangrove
area will be filled.
Recommendations:
In consideration of the use and location of the property
within the Deltona Settlement line, Staff recommends approval
of petition PU-89-22 subject to the following conditions:
1. Petitioner shall comply with Ordinance No. 75-21 as
amended by Ordinance No. 89-58 (preservation of native
habitat) . Petitioner shall also comply with Ordinance
No. 89-51 and Collier County Comprehensive Plan Policy
6. 4 . 7 .
2 . Petitioner shall obtain and submit documentation of
necessary local, state and federal permits in regard to
the mangrove area.
3 . Petitioner shall comply with the tree clearing Ordinance
No. 75-21 and exotic removal Ordinance No. 89-53 .
4 . In the event protected species nests or burrows are
encountered during development activities, the Collier
County Planning services Environmental Review Staff shall
be notified immediately and project design may be
adjusted if warranted (Collier County Comprehensive Plan
Policy 7 . 3 . 4) .
5. Petitioner shall comply with Ordinance No. 82-2 as
amended by Ordinance No. 89-57 (use of native species in
landscaping) .

provisions of the Stipulation for Dismissal and Settlement
Agreement, dated July 20 , 1982 between The Deltona Corporation
and various governmental and public interest groups.
For your convenience, I am enclosing a bound copy of the
Stipulation. We would appreciate being reimbursed for the cost
of reproduction and postage in the amount of $5. 00, payable to
"The Deltona Corporation" .
Although Deltona does not endorse any particular firm, it is our
understanding that Stephen P. Erek, P.L.S. of Bruce Green and
Associates, Inc. of Naples, Florida has handled similar matters
in the past. For your convenience, I am enclosing his business

You subsequently sent a letter dated October 13 , 1983 , from a

Petition: DRI-89-2 : George L. Varnadoe of Young, van
Assenderp, Varnadoe and Benton, P.A. , representing
Cedar Bay Marina; requesting development approval
for a dry storage marina.
Considerations:
Petitioner requests development approval for construction of
a 568 dry slip marina with marine sales, ship's store, office
space, fueling and maintenance facilities and twenty-five wet
slips for engress/egress of boats on the 3 . 6 acre parcel.
Subject property is located on Elkcam Circle, Marco Island,
and is bounded on the north by property zoned commercial
(C-5) ; on the south by a shopping center (Chamber of Commerce
Plaza) ; on the east by the Cedar Waterway; and on the west by
Elkcam Circle.
Subject property is completely cleared and seawalled along
the Cedar Waterway perimeter. The marina basin is within an
artificial waterway, the Cedar Waterway, whose waters are
contiguous to the Marco river (Class II State Waters) . The
northern half of the Marco River is Outstanding Florida
Waters. The existence of the West Indian manatee (Trichechus
manatus latirostris) , listed as endangered by the Florida
Game and Fresh Water Fish Commission (FGFWFC) and the United
States Fish and Wildlife Service (USFWS) , seagrasses, and
other natural marine habitats make the Cedar Waterway and the
Marco River an area of particular environmental sensitivity
and concern. Manatees were observed by County Enviornmental
Staff in the Cedar Waterway. Turbidity plumes from small
watercraft exiting the Cedar Waterway were also observed,
demonstrating the potential for reduced light penetration and
water quality degradation in the Marco River as a consequence
of small power boats.
Recommendations:
Since the subject property is appropriately zoned for the
proposed use, Staff recommends approval of Petition DRI-89-2
subject to the following stipulations:
1. Petitioner shall be subject to Ordinance No. 82-37 as
amended by Ordinance No. 89-53 (removal of exotic
species) .

2 . Petitioner shall be subject to Ordinance No. 89-57 (use
of native species in landscaping) .
3 . Pursuant to the Growth Management Plan, Goal 7, Objective
7. 2, Policies 7.2 . 1, 7.2 .2 and 7. 2 . 3 and Policy 11. 1. 5,
petitioner shall be subject to the Manatee Protection
Plan adopted by the County at the time of site
development plan (SDP) review.
4 . Pursuant to the Growth Management Plan, Goal 2; Objective
2 . 2 , Policy 2 .2 .4; Objective 2 . 3, Policies 2 . 3 . 1 and
2 . 3 . 6, petitioner shall be subject to a water quality
monitoring program and sediment analysis plan designed by
County Environmental Review Staff. Water quality shall
be evaluated using State water quality standards (403 . 061
F. S. ; F.A.C. 17-3 . 051, 17-3 . 061, 17-3 . 111, and 17-3 . 121) .
5. Petitioner shall submit additional information as
requested by Planning Services Environmental Review Staff
pursuant to the Environmental Impact Statement (EIS)
— Ordinance (Ordinance No. 77-66 as amended by Ordinance
No. 89-52) . Such information shall include, but is not
limited to, hydrological data and a benthic invertebrate
study.
6. Petitioner shall receive the necessary State and Federal
authorization prior to development.

Petition: R-90-3/PU-90-2/SMP-90-4 : J. Gary Butler of Butler
Engineering, Inc. , representing Immokalee Habitat
for Humanity, Inc. ; requesting a zoning change
from RMF-6 to RSF-5, a provisional use "d" of
RMF-6 for Civic and Cultural Facility and
Subdivision Master Plan approval for Mission
Village.
Considerations:
1. Proposal/Location:
The proposed project is a 5. 34 acre residential
development with a portion of the site designated for
construction of a mission. The site will include
twenty-one homesites. The site is located in Immokalee
on the east side of Ninth Street, lying south and west of
Jefferson Avenue and north and west of Hendry Street.
2 . Site Description/Vegetation:
A site visit of the subject property was conducted on
February 7, 1990, by Kimberly Polen and Jeff Adair, staff
members of Collier County Planning Services.
The site has been invaded by exotic species and impacted
by human activities, such as excavation and drainage.
On the southern third along the western boundary there is
an intermittent pond with cattail (Typha sp. ) , which is
approximately 3500 square feet of area. Along most of
the interior boundary there is evidence of coastal willow
(Salix caroliniana) , according to the Department of
Environmental Regulation (DER) this plant would be a
transitional wetland species.
The canopy and midstory consists of mostly slash pine
(Pinus elliotti) , cabbage palm (Sabal palmetto) , saw
palmetto (Serenoa repens) , Brazilian pepper (Schinus
terebinthifolius) . There are some oak (Quercus sp. ) , hog
plum (Ximenia americana) , mimosa (Albizia lulibrissin)
and American beautyberry (Callicarpa americana) .
Groundcover consists of lantana (Lantana camera) ,
beggar-ticks (Bidens pilosa) wiregrass (Aristida stricta)
and other graminoid species.

3 . Comments and Concerns:
There are several snags within the southern portion of
the site. These snags are being utilized by many bird
species. For example, red-bellied Woodpeckers were
actively feeding during the site visit.
Recommendations:
In consideration of the above concerns, staff recommends
approval of Petition R-90-3/PU-90-2/SMP-90-4 subject to the
following conditions:
1. Petitioner shall be subject to Ordinance No. 75-21 as
amended by Ordinance 89-58 (preservation of native
habitat) .
2 . Petitioner shall be subject to Ordinance No. 82-2 as
amended by Ordinance 89-57 (use of native species in
landscaping) .
3 . Petitioner shall be subject to Ordinance No. 82-37 as
amended by Ordinance 89-53 (removal of exotic species) .
4 . Petitioner shall be subject to the Collier County
Comprehensive Plan Policy 12 . 1. 3 (discovery of an
archaeological or historical site, artifact or other
indicator of preservation) .
5. Petitioner shall obtain and submit documentation of all
necessary local, state and federal permits.
6. The petitioner will make every reasonable attempt to
preserve pines, oaks and snags on the site, especially
within the rear yards and retention areas.
