COMMENTS: Mr . Jassy indicated his goal is to establish an
affordable housing project for Collier County.
The site of the project is on old U. S. 41 , Mr.
Jassy stated, north of the intersection of new
U.S. 41 , and is designed to be in accordance
with environmental issues in the area. He indi-
cated that 40% of the ground in the project is
wetland preserve area, with the balance designed
for residential and recreational use.
Mr . Jassy stated that he believes the project
will benefit the county by bringing affordable
housing to the area.
A slight modification, Mr. Jassy continued, is
needed in Stipulation 9, Specific Area Setbacks.
He said because of the reference to an average
of 25 feet he would request that the language
read "the petitioner shall retain a buffer zone
landward from the edge which is acceptable to
the Water Management District . " Then, he
explained, he wouc, work out a satisfactory
arrangement due to the site constraints.
Mr. Addison asked Mr. Jassy if the Water
Management District considers this an isolated
wetland, and if so what are the specific guide-
lines for this situation.
Mr . Amad Cura with Alpha Engineers addressed
Stipulation 9 quoting from South Florida
Management District Guidelines that it does not
specifically indicate that a site developer "has
to" or "should" or that "it is required" but
only that "he may" if it is functional , develop
specific buffer zones of specific widths.
Mr. Cura further stated that their proposal is
to design and implement an abatement berm
instead of the buffer to purify the water before
discharging to the wetlands, and indicated that
DER has been accepting this type of design for
sometime now.
Mr. Jassy indicated that the idea is to scrub
the outflow before it comes into the wetland,
and an abatement berm does a very effective job
of that .

Discussion followed regarding the existing
vegetation and and it was noted that there are
palms around a portion of the wetland, as well
as wax myrtle, which gives it an excellent
wildlife buffer, but no natural vegetation
around 2/3 of the entire wetland fringe at all
times.
Ms. Polen indicated that the area from a north
to south line on the eastern portion would fall
under stipulation 9, and the rest could be under
the berm system designed by the engineers.
Mr. Terrell indicated the EAC is willing to
relax the guideline for the 25 feet but they
reminded Mr. Jassy and Mr. Cura that they need
to make sure it is good vegetation.
After additional discussion regarding the
preservation of the wetlands and the feasibility
of the project with additional stipulations
being placed upon it, Mr. Jassy indicated that
if they are to revegetate the north/south line
and construct a berm, both goals will be
achieved.
Mr. Cura indicated that the 16 foot area between
the building footprint and the berm will be a
3 : 1 slope, however, due to building constraints
it will require revegetation during project
completion.
Mr. Cura added that the balance of the sheet
shows that he is preserving more than is
required, indicating that he is sincere about
building a good project which is in compliance.
Mr. Phil Scheff remarked that the petitioner is
trying to satisfy a county objective in pro-
viding affordable housing, however, due to the
site it is difficult develop and be conscious of
environmental concerns. He continued that he is
not in a position to judge the environmental
issues, however, there are specific setbacks
that must be maintained.
Discussion ensued regarding the specific stan-
dards of building affordable housing including

set backs. With the suggestion of buying space
from the road set back, the petitioner noted
they will need a variance which involves peti-
tioning the board and a fast track schedule for
financing purposes.
Further discussion about using a stem wall to
reduce the the fill area needed for the slope
and the relaxation of the standards set by the
Comprehensive Plan resulted in Mr. Jassy
advising the council that any leeway that the
EAC can give him will be appreciated.
Ms. Polen indicated that after viewing the
aerial photos she has concluded that what the
EAC wants to accomplish can be done with a 15
foot buffer around the eastern portion of the
site, consequently Stipulation 9 should read:
Along the Eastern edge of the wetland pre-
serve, Petitioner shall retain naturally vege-
tated buffer zones which extend at least
fifteen feet landward from the edge of the
wetland in all places (Collier County
Comprehensive Plan, Objective 6. 2 and asso-
ciated policies) . The North, South, and
Western edges of the wetland preserve may be
bermed with abatement berm and replanted with
native vegetation where that area is
disturbed.

shall be identified on the Site Clearing Plans.
8 . All conservation/preservation areas shall be
depicted on the final recorded plat by survey
and dedicated with protective convents to main-
tain the area(s) in their natural pre-
development state.
9. Along the Eastern edge of the wetland preserve
petitioner shall retain naturally vegetated
buffer zones which extend at least fifteen feet
landward from the edge of the wetland in all
places (Collier County Comprehensive Plan,

approval . Compensation proposals shall provide
reasonable assurance that resource impacts will
be offset .
a. Mitigation plans proposed in wetlands to be
preserved, restored, enhanced shall include a
statement indicating why no other reasonable
options to impacting jurisdictional wetlands are
available, a description of area ( location and
size) , vegetation proposed to be planted, source
of vegetation (transplantation from impacted
areas preferred) , hydrologic regime, exotic
vegetation removal, monitoring and maintenance
plan.
b. Mitigation proposed in upland areas shall
emphasize establishment of habitat value.
Vegetation retained and supplemented shall focus
on wildlife value and establishment of native
vegetative "communities" .
11 . Petition shall be subject to all Collier County
Ordinances in effect at commencement of
construction.

COMMENTS: Mr . Dombrowski summed up the request by saying
that the site proposal is for 10 units on exten-
sively altered land. He said wetland species
will not be removed and all stipulations pro-
posed by Ms. Polen are agreed to except stipula-
tion 9 regarding future docks, and their length
not exceeding other existing docks in the vici-
nity.

He noted that the builder is not proposing to
build docks, however, he does anticipate that
upon the sale of the unit the landowners will
provide docks if they desire, and those docks
will meet county, state, and federal regulations

Ms. Polen responded that she is comfortable
leaving this stipulation out because as owners
permitted to build their docks, all requirements
will be met .

COMMENTS: Ms. Polen indicated she has received a letter
from Mr . Dombrowski on March 20, 1990,
requesting the petition be postponed from March
21 , 1990, until the April 18 , 1990, meeting in
order to have ample time to address some of the
marina issues and resolve any potential impacts.
She recommends that the entire staff report be
dropped, up to the recommendations, because the
recommendations represent the best management of
the project. Ms. Polen further indicated that
the project could be revisited in April , or they

could look at the recommendations only, and Mr.
Dombrowski could advise his preference.
Mr. Dombrowski remarked that he is not prepared
to discuss any potential problems, and noted
that the staff report , in his clients opinion,
indicated a lot of doubt on the integrity of the
project, even though it is recommended for
approval .
Mr. Addison indicated that he agrees with Mr.
Dombrowski and would prefer to see the item
brought back at the meeting of April 18, 1990.

ADDENDA: A short discussion was held regarding status of
the county recycling effort and Ms. Pole indi-
cated that she did not have any additional
information.
Mr. Phil Scheff responded saying that Ray
Bellows of Planning Services is working on a
proposal for a recycling center in Immokalee, as
directed by the County Manager ' s office. He
suggested that Ms. Polen and Mr. Adiar needs to
coordinate their work with Mr . Bellows.
Mr. Adair indicated that part of the problem is
that the county does not have a surveyor and
when the site was visited it turned out not to
be the actual site. He suggested that the site
be surveyed to determine its exact location
prior to another visit .
Ms. Polen indicated that Mr. Bellows has asked
for an EIS waiver, and further noted that this
is the proposed site for the plastics recycling
project .
Mr. Scheff suggested that Planner Bellows be
invited to the EAC meeting to update the mem-
bers. He remarked that he has some information
from some private industry regarding operating
recycling centers.
Mr. Scheff indicated he felt to the EAC that a
provisional use request for a salvage yard has
been requested on an industrial site south of
Rattlesnake Hammock Road on U.S. 41 .

Mr. Addison stated that it is his understanding
that there will be no recycling done on this
site.
Mr. Addison reported to the council on the
discussion regarding the future of the EAC,
indicating that he informed the Board that pro-
jects seldom get turned down, however, they are
reviewed extensively, and fine tuned to be more
environmentally sensitive. He continued by
saying that the EAC often acts as a liaison bet-
ween staff and the petitioner . The issue of
combining the EAC and the Water Management Board
and using it as an appeals Board has been
discussed, however, Mr. Addison added, he would
rather see the petitions come before the EAC
because the Water Management Advisory Board has
had a rapid turnover of members.
Mr. Neale indicated that his understanding of
the current plan is to dissolve both Boards and
reconstitute a new board with 7 new members
drawn from both old boards and the proposed new
members, but he commented that he would like to
know the Board' s intention.
Mr. Terrell suggested that a letter be drafted,
circulated for signature, and sent to the Mr.
Lorenz, with a copy to County Manager Dorrill
requesting him to advise of the current EAC ' s
status and what is being proposed.
Mr . Neale feels that the EAC supports a merger
but would rather see a new board membership
through attrition.
There being no further business to come before the EAC, the
meeting was adjourned by Order of the Chair.

AGREEMENT
I, George Archibald, as owner or authorized agent for
Petition R-90-15, agree to the following stipulations requested
by the Collier County Planning Commission in their public
hearing on April 19, 1990.
Water Management and Engineering:
a. Detailed paving, grading, site drainage and utility
plans shall be submitted to Project Review Services
for review. No construction permits shall be issued
unless and until approval of the proposed
construction in accordance with the submitted plans
is granted by Project Review Services.
b._ Design and construction of all improvements shall be
subject to compliance with the appropriate provisions
of the Collier County Subdivision Regulations.
c. In accordance with the Rules of the South Florida
Water Management District, (SFWMD) Chapters 40E4 and
40E-40, this project shall be designed for a storm
event of 3-day duration and 25-year return frequency.
d. If applicable, an Excavation Permit will be required
for the proposed lake(s) in accordance with Collier
County Ordinance No. 88-26 and SFWMD rules.
e. This project is recommended for approval for rezoning
purposes only. Detailed water management plans and
calculations will have to be submitted prior to SMP
approval and be scheduled for review by WMAB.
f. A copy of SFWMD Permit or Early Work Permit is
required prior to construction plan approval.
g. Platting is required in accordance with Collier
County Subdivision Regulations, if any lots, tracts,
or parcels are to be sold.
h. Work within Collier County right-of-way shall meet
the requirements of Collier County right-of-way
Ordinance 82-91.

STAFF REPORT
FOR EAC MEETING 4/18/1990
Petition: PU-90-4 : Dr. Neno J. Spagna of Florida Urban
Institute Inc. , representing the Mayflower United
Church of Christ; requesting a provisional use "c"
of A-2 for a church.
Considerations:
Petitioner requests a provisional use for the purpose of
constructing a one hundred and forty two (142) seat church
with sufficient parking for eighty (80) cars, and desires the
ability to expand the church to a maximum of four hundred
(400) seats and two hundred (200) parking spaces should the
congregation require the additional space on the 7.8 acre
site. The subject property is located in the northwestern
quadrant of the intersection of Grand Lely Drive and SR 951,
approximately 1/3 mile south of Rattlesnake Hammock Road and
is bounded on the north by uncleared agricultural land, on
the south and west by the Lely PUD, and on the east by SR
951.
The site has not been cleared and contains wetland, upland,
and transitional plant species. The majority of the site has
a slash pine (Pinus elliottii) canopy, with a understory of
cypress (Taxodium spp. ) , cabbage palm (Sabal palmetto) , and
Melaleuca (Melaleuca quinquenervia) , and ground cover
including muscadine grape (Vitis rotundifolia) , blue maiden-
cane (Amphicarpum muhlenbergianum) , saw-grass (Cladium
lamaicense) , and gulf mulhy (Muhlenbergia capillaris) . In
the few areas where the slash pine canopy is absent, dense
saw palmetto (Serenoa repens) and rusty lyonia (Leonia
ferruginea) dominate.
Although the floral composition of the subject property does
not characterize a unique habitat, the site is located in an
area known by Florida Game and Fresh Water Fish Commission
(FGFWFC) and County environmental review staff to be utilized
by red-cockaded woodpeckers (RCW's) (Picoides borealis) which
are listed as threatened by the FGFWFC, and as endangered by
the United States Fish and Wildlife Service (USFWS) .

Recommendations:
Since the petitioner recognizes the need to develop the
project with constraints addressing the environmental
sensitivity of the site, staff recommends approval of
petition PU-90-4 subject to the following stipulations:
1. No clearing of any kind shall be permissible outside the
development envelope needed for the construction of the
142 seat church, its 80 parking spaces, and installation
of associated roads and utilities. Approval of this
petition shall grant to the petitioner the right to
construct the church building as set forth generally on
the conceptual site plan. The construction of additional
or future building(s) and additional clearing (other than
validly permitted accessory maintenance or storage
facilities) is prohibited unless and until considered and
approved by the Board of County Commissioners in a
separate Provisional Use hearing.
— 2 . The northern four (4) acre portion of the property shall
not be developed and shall be dedicated as a preserve.
This preserve may be used for passive recreation such as
nature trails. Boardwalks are not permissible.
3 . A red-cockaded woodpecker (RCW) survey shall be submitted
concurrent with site development plan (SDP) submittal for
County review. The survey shall follow the criteria set
forth in the Wildlife Methodology Guidelines" published
by the FGFWFC.
4 . A letter verifying that a representative of the FGFWFC
have inspected the site shall also be submitted to the
County Project Review Services staff prior to SDP
approval should the FGFWFC deem a site visit necessary.

2 . Site Description/Vegetation:
A jurisdictional walk of the subject property was conducted
on December 7, 1989, by Kimberly Polen and Barbara Prynoski
(Collier County Project Review Services) , Skip Bergmann (U. S.
Army Crops of Engineers) , accompanied by Gary Beardsley
(Tropical Environmental Consultants) .
On February 27, 1990 a site inspection of the subject
property was conducted by Kimberly Polen and Kimberly Dryden
(Florida Game and Fresh Water Fish Commission, FGFWFC) .
On March 1, 1990 a site visit of the subject property was
made by Kimberly Polen and Gary Beardsley (Tropical
Environmental Consultants) .
All jurisdictional wetlands, 12 .9 acres indicated on the
vegetation map, have been determined to be jurisdicional by
U. S. Army corps of Engineers and Collier County. The
Department of Environmental Regulation determined the
wetlands to be non-contiguous, isolated and therefore
non-jurisdictional.

In the northern central half and central portion of the site
there are two (2) cypress wetlands that are dominated mostly
by cypress (Taxodium distichum) , dahoon holly (Ilex cassine) ,
swamp fern (Blechnum serrulatum) , and saw grass (Cladium
iamaicensis) . Some maiden cane (Panicum hemitomon) , red bay
(Persea borbonia) , buttonbush (Cephalanthus occidentalis) and
St. John wort (Hypericum sp. ) was scattered within the
wetlands.
Throughout the site there are smaller transitional wetlands
which consist of Cypress, Sawgrass, sedge (Fimbristylis sp. ) ,
melaleuca (Melaleuca sp. ) , yellow-eyed grass (Xvris stricta)
(Xyris Fimbriata) , and few slash pine (Pinus elliottii) .
The remaining portions of the site mostly consists of hydric
pine flatwoods, except within 300 feet east of the western
property boundary, where inactive agricultural land exists
with dominate upland species. In the central and
southeastern portions there are scattered and clustered saw
palmetto (Serena repens) /rusty Lyonia (Lyonia fruticosa)
islands among open nature pine canopies.
3 . Comments and Concerns:
In the Environmental Impact Study (Section 5.b. ) one
abandoned cavity nest of the red-cockaded woodpecker was
located in the southeastern portion of the site.
On February 27, 1990 FGFWFC and Collier County Staff
discovered additional cavity nests/holes, on the proposed
Richland PUD site.
Staff and FGFWFC requested the project consultant adequately
establish whether the colony site was "active" or "inactive" .
To accomplish this determination, staff recommended a survey
of three (3) consecutive days, in the early morning hours
(6: 00 a.m. until 8: 30 a.m. ) to all four slash pine cavity
nest sites on the subject property.
On March 12, 1990 Kimberly Polen received a letter from
Kimberly Dryden, FGFWFC regarding the red-cockaded woodpecker
colony, Richland PUD, (See Attachment 1) .
There are approximately thirty-five (35) acres of potential
red-cockaded woodpecker (RCW) foraging habitat on the site
which shall require a portion of it to be set aside as RCW
preserve. In accordance to FGFWFC and U. S. Fish and
Wildlife Service (FWS) guidelines and authorization, viable

foraging habitat within a RCW range becomes jurisdictionals
to these agencies. Guidelines are set forth for development
and management of these habitats.
Staff believes that the preservation of pine habitat is the
most positive conservation measure that will help sustain
this species. This preservation shall be accomplished by
upland preserves, wooded community open space, and natural
vegetational buffers on all one story/single family home
sites. All lakes shall be located outside the eastern half
of the southeastern quadrant. Higher density, two or three
story development shall be sited in melaleuca - impacted
areas of the project site.
There are 12 . 9 acres of jurisdictional wetlands on site of
which 1.98 are being proposed for development and 10.92 acres
for preservation/retention; therefore, additional mitigation
shall be required. This mitigation will reflect the intent
of Collier County Comprehensive Plan, Objectives 6.2 and 6. 3
and associated policies.
— Recommendations:
Considering the above, staff recommends approval of petition
R-90-1 subject to the following stipulations.
1. All stipulations and approvals herein refer to the revised
3/20/90 Richland PUD Master Plan.
2. Petitioner shall comply with Ordinance No. 82-2 as amended by
Ordinance No. 89-57 (Use of Native Species in Landscaping) .
3 . Petitioner shall be subject to Collier County Comprehensive
Plan Objectives 6.4 . 6 and 6.4 .7, Ordinance No. 82-2 as amended
by Ordinance No. 89-49, and Ordinance No. 75-21 as amended by
Ordinance No. 89-58. The 25% of naturally functioning
vegetation to be retained on site shall include the following:
a. eleven (11) acres of wetland preservation;
b. six (6) acres of upland preservation, specifically, within
a two hundred (200) foot radius around the cluster of
three red-cockaded woodpecker cavity trees that includes a
fourth cavity tree and a great horned owl nest;
c. three (3) acres of one-story/single family 20-foot rear
yard buffers, specifically, within a two hundred (200)
foot radius around the fourth cavity tree;
d. remaining acres of tree preservation shall include all
eight (8) inch and greater diameter at breast height trees
outside of the approved footprints of buildings and
infrastructure.

4 . Boundaries of the County jurisdictional wetland/upland
preservation areas shall be flagged by the petitioner and
field verified by Collier County Enviornmental Staff prior to
any subsequent site plan approvals.
5. Site clearing approvals shall be phased with construction. All
single family home site shall be required to submit a site
clearing plan and obtain a building permit prior to tree
removal.
6. Petitioner shall comply with Ordinance No. 82-37 as amended by
Ordinance No. 89-53 (Removal of Exotic Species) .
7. Petitioner shall be subject to the Collier County
Comprehensive Plan Policy 12 . 1. 3 (discovery of an
archaeological or historical site, artifact or other indicator
of preservation) .

Petition: R-89-35: George L. Varnadoe of Young, van
Assenderp, Varnadoe and Benton, P.A. , representing
Germain Properties of Columbus Inc. ; requesting a
zoning change from A-2 and C-4 to PUD and
Preliminary Site Development Plan approval.

Considerations:
1. Location/Proposal:
The subject property is a ± 13 acre tract located on the
west side of U. S. 41 (Tamiami Trail North) approximately
five hundred (500) feet south of Wiggins Pass Road. The
proposed building structures include two automobile
dealerships, one use car sales building, a body shop and
a showroom. The proposed water, sanitary sewer, and
storm water management facilities will be owned, operated
and maintained by the owner. Approximately thirty-five
percent (35%) of the site is proposed as open space with
1. 9 acres of bald eagle preserve area in the southwest
corner of the site.
2 . Site Description/Vegetation:
There are approximately twelve (12) acres of uplands on
site. A third of the twelve (12) acres have been
previously cleared. Another third of the site is
dominated by slash pine (Pinus elliottii) , cabbage palm
(Sabal palmetto) , and Brazilian pepper (Schinus
terebinthifolius) midstory, and a scattered herbaceous,
vine, or fern ground cover. Laurel oak (Quercus
laurifolia) and wax myrtle (Myrica cerifera) are found on
the site. The remaining third has been invaded by
Brazilian pepper and Australian pines (Casuarina sp. ) .
Approximately 0. 90 acres of wetlands exist on site.
These consist of 0. 33 acres of man-made pond, 0.42 acres
of mostly coastal willow (Salix caroliniana) and
Brazilian pepper surrounding the pond, and 0. 15 acres of
drainage ditch.

3 . Comments and Concerns:
The Natural Resource Management staff visited the site on
May 26, 1989. At that visit staff agreed with the
flagged wetland line. Representatives from the U. S.
Army Corps of Engineers (ACOE) and the Florida Department
of Environmental Regulation (FDER) visited the site on
June 8, 1989. The ACOE will exert wetland jurisdiction
over the flagged 0. 33 acre pond and the surrounding 0.42
acre fringe of willow and Brazilian pepper. The FDER
will exert wetland jurisdiction over the 0. 15 acre
drainage ditch as well as the flagged pond and
surrounding willow/Brazilian pepper fringe.
The majority of these wetlands are planned to be filled
by the proposed development, therefore; additional
mitigation shall be required, if wetland impacts are
approved. Mitigation plans shall reflect the intent of
Collier County Comprehensive Plan Objectives 6.2 and 6. 3
and associated policies.
An active bald eagle (Haliaeetus leucocephalus) nest is
located approximately 450 feet southwest of the southwest
property corner. Consultations with the Florida Game and
Fresh Water Fish Commission (FGFWFC) have produced a bald
eagle management plan accepted by both State and Federal
agencies. This plan states that 1.9 acres of the
property which is within a 750 foot radius of the nest
tree will remain undeveloped. In addition, potential
nuisance activities such as land clearing, blasting, and
burning will be restricted to the non-nesting season.
A pedestrian survey of the project site was conducted to
determine the presence of species listed by the FGFWFC.
The gopher tortoise (Gopherus polyphemus) was observed on
site within the 1. 9 acre eagle buffer. Two active gopher
tortoise burrows are located along the western property
line in an area of open pine flatwoods. Other gopher
tortoise may exist in the numerous fill piles previously
deposited on site.
Recommendations:
Considering the above, Staff recommends approval of petition
R-89-35 subject to the following stipulations.
1. Petitioner shall comply with Ordinance No. 82-2 as
amended by Ordinance No. 89-57 (Use of Native Species in
Landscaping) .

2 . Petitioner shall comply with Collier County Comprehensive
Policy 6. 4 .7, Ordinance No. 82-2 as amended by Ordinance

to be retained on site shall include the following:

construction shall be incorporated into the
landscaping plan.
3 . Petitioner shall be subject to the Collier County
Comprehensive Plan Policy 12 . 1. 3 (discovery of an
archaeological or historical site, artifact or other
indicator of preservation) .
4 . Prior to Preliminary Site Development Plan approval,
mitigation shall be required for any approved wetland
impacts. If wetland impacts are approved the petitioner
must submit a mitigation plan, reflecting a 2 . 5 : 1 area
ratio, that must be approved by Collier County Project
Review Services Environmental Staff (Collier County
Comprehensive Plan Policy 6. 2 . 10) .
5. All heavy equipment operation and other activities
necessitating excessive noise shall be restricted to the
non-nesting season (May 15 thru October 1) .
6. All lighting shall be positioned/shielded in such a way
that no light illuminates the bald eagle preserve and
buffer zone.
7. Pursuant to Collier County Growth Management Plan Goal 7,
Objective 7. 3 , Policies 7. 3 . 4 and 7 . 3 .5, the petitioner
shall retain gopher tortoises on site or shall relocate
them according to Florida Game and Fresh Water Fish
Commission (FGFWFC) protocol after contacting and
receiving approval from the FGFWFC.

Tempustech, Inc. ; requesting a zoning change from
A-2 to RO and a provisional use "b, m, and n" of
RO for marina, boat ramp, restaurant, clubs and
private yacht club.
Considerations:
Petitioner requests development approval for construction of
a sixty (60) dry slip marina with twenty-six (26) wet slips,
boat ramp, restaurant and private yacht club on a 2 . 41 ± acre
parcel. Subject property is located on Bonita Beach Road,
north Naples, and is bounded on the south and west by Little
Hickory Bay; on the east by property zoned commercial (C-4) ;
and on the north by Bonita Beach Road. The proposed marina
is in close proximity to Wiggins Pass, the Gulf of Mexico and
Fish Trap Bay (Lee County) .
Subject parcel has been previously cleared. There are
several red mangrove (Rhizophora mangle) , white mangrove
(Laguncularia racemosa) , black mangrove (Avicennia
Germinans) , and Brazilian pepper (Schinus terebinthifolius)
on site.
On November 13, 1989, an Environmental Impact Statement (EIS)
waiver was granted by Staff Member, Kimberly Polen. This
waiver does not preclude the petitioner from addressing
environmental concerns that may present themselves during the
petition review, preliminary and final site development plan
review process.
Several Objectives in the Conservation and Coastal Management
Element of the County Growth Management Plan provide outlines
on protection of native habitats including Objectives 6. 6,
6.7, and 6.8 and the policies within each. Goal 7 addresses
protection of fisheries and wildlife within the County;
specifically, Objective 7.2 outlines precautions to be taken
to maintain our resident manatee population.

Petition: PDA-89-17: William R. Vines, AICP of Vines and
Associates, Inc. , representing Naples Associates,
an Ohio Corporation; requesting a PUD Amendment to
Heron Lakes.
Considerations:
1. Location/Proposal:
The 101. 52 acre site is bounded on the south by I-75 and
on the north by the Golden Gate Canal. It is accessible
via Recreation Lane, which extends easterly from Santa
Barbara. Recreation Lane is also the access road to the
Golden Gate Community Park which lies adjacent to the
west boundary of the Heron Lake site.
The Heron Lake PUD was initially filed as rezone petition
R-18-12C and was approved on September 6, 1983 as
Ordinance No. 83-47. Development of the project has not
been initiated due to various external factors.
Development is to be initiated in the near future, and
determination has been made to make some changes to the
development plan and to reduce the project density, which
will bring the project into compliance with the Growth
Management Plan.
The difference between the original and the proposed
amended PUD are set fourth in the following table:

2 . Comments and Concerns:
According to Kimberly Dryden, Florida Game and Fresh
Water Fish Commission, there are known red-cockaded
woodpecker colonies located in this vicinity. Therefore,
staff believes that the preservation of pine habitat
onsite is the most positive conservation measure that
will help sustain this species. This preservation shall
be accomplished by upland preserves, wooded community
open space and naturally vegetated buffers on all single
family home-sites.
Local archaeologist John Beriault reports finding
evidence of an Indian encampment in the small "Bullseye"
hammock. This hammock is to be preserved as a part of
the 2 . 86+ acre recreational commons tract within the
project, which will allow future archaeological
exploration activities, but which are not detrimental to
the vegetational integrity of the hammock and which must
be approved by Collier County Project Review Services
Environmental Staff.
In March staff addressed various environmental concerns
to the petitioner. On April 5, 1990 staff received a
letter proposing several options of retaining twenty-five
percent (25%) of the naturally functioning vegetation
onsite. These options have been incorporated into
staff's recommendations.
Recommendations:
Considering the above Staff recommends approval of PDA-89-17
subject to the following stipulations:
1. Petitioner shall comply with Ordinance No. 82-2 as
amended by Ordinance No. 89-57 (Use of Native Species in

2 . Petitioner shall be subject to Collier County
Comprehensive Plan Objectives 6.4. 6 and 6.4.7, Ordinance
No. 82-2 as amended by Ordinance No. 89-49, and Ordinance
No. 75-21 as amended by Ordinance No. 89-58. The 25% of
naturally functioning vegetation to be retained on site
shall include the following:
a. Two acres of the 2 .86 acre recreational commons tract
shall remain as a contiguous naturally vegetated
preserve easement, including the entire oak hammock
area.

b. The petitioner shall provide at least a thirty (30)
foot wide naturally vegetated buffer easement,
extending the entire length of the northern property
boundary and outside of any other existing or
proposed easements.
c. The petitioner shall provide at least a thirty (30)
foot wide buffer along the eastern, western and
southern boundaries. The buffer shall have at least
a twenty (20) foot width of naturally retained
vegetation and the remaining width shall be enhanced
after the water management berm has been established.
If a wall is to be constructed it shall only be
situated and approved by Collier County Environmental
Staff on top of the water management berm.
d. .75 acres shall be retained and enhanced as a platted
five (5) foot naturally vegetated buffer easement,
excluding all utilities, on each side and outside of
all the street right-of-ways.
e. 1. 4 acres of native wetland vegetation shall be
planted around the lake.
f. the remaining 18. 2 acres shall be retained through
maximum tree preservation within the entire property,
specifically, all eight (8) inch and greater diameter
at breast height trees shall be preserved outside of
the approved footprints of buildings and
infrastructure.
3 . Boundaries of the upland preservation areas shall be
flagged by the petitioner and field verified by Collier
County Environmental Staff prior to construction permits.
4 . Site clearing approvals shall be phased with
construction. All single family home-sites shall be
required to submit a site clearing plan and obtain a
building permit prior to tree removal.
5. Petitioner shall comply with Ordinance No. 82-37 as
amended by Ordinance No. 89-53 (Removal of Exotic
Species) .
6. Petitioner shall be subject to the Collier County
Comprehensive Plan Policy 12 . 1. 3 (discovery of an
archaeological or historical site, artifact or other
indicator of preservation) .

7 . In accordance to Florida Game and Fresh Water Fish
Commission (FGFWFC) and U. S. Fish and Wildlife Service
(USFWS) guidelines and authorization, viable foraging
habitat within a red-cockaded range becomes
jurisdictional to these agencies. Guidelines are set
forth for development and management of these habitats
(Collier County Comprehensive Plan, Policy 7 . 3 . 4) .
