RE: PU-89-1C: Jack Elliot of J.L. Kidd Corporation; requesting
a provisional use "a" of C-4 zoning for a car wash .
The subject property of the above-referenced petition is
located on the southeast side of Golden Gate Parkway, between
50th Street SW and Tropicana Boulevard in Golden Gate City (828,
T49S, R26E) . The petitioner is requesting a provisional use of
the 0.43 acre commercially zoned parcel to allow for a car wash .
The property was inspected on February 7, 1989. The site is
almost entirely sodded (although not maintained ) with frequent
spots of bare soil . There are no remaining native habitats or
even examples of native vegetation on the parcel . One or two
Brazilian pepper trees were noted along the southern property
boundary.

RE: Environmental Review of Petitions
On Monday (January 23, 1989) , I met with Ray Smith in an
effort to coordinate the petition review (rezones, provisional
uses, etc . ) procedure of the Environmental Resources Management
(ERM) sub-section. In the past , the Court Plaza ERM Staff has
summarized their petition comments in a memo directed to the
Planning Staff. These comments typically address concerns /
regarding sewage treatment plant operation, wellfields,
excavation depths, surface water runoff, etc . Such comments have
rarely been reviewed by the Environmental Advisory Council (EAC) .
Ray Smith oversees the review of petitions by the Court
�...
Plaza Staff. We have agreed that it would be appropriate for the
EAC to have the opportunity to review the environmental concerns
of Ray ' s group . Therefore, from this time onward , Ray will be
sending a copy of his comments ( in the form of a memo , probably
to Ken Baginski ) to our office within three weeks from the date
which he receives the petition materials. This memo could then
be attached to the ERM Staff Reports prepared for the EAC. Ray
should be contacted regarding fast-tracked petitions which may
require a shorter processing time.
Upon receipt of Ray ' s comments in this office, Staff should
make sure that the memo is filed with the appropriate petition.
ENVIRONMENTAL RESOURCES STAFF REPORT

Petition R-89-1C: William C. McAnly, P.E. , of William C. McAnly
and Associates, PA, representing GMA Development
Corporation; requesting a zoning change from A-2 to
RMF-6 for a multi-family residential project known as
"Pelican Lake Club" .

The property under consideration for rezoning is a 20.4 acre
rectangular parcel located on the north side of Davis Boulevard ,
1 1/2 miles east of Airport Road , and 1/2 mile west of County
Barn Road (86, T50S, R26E) . The Moon Lake PUD is located to the
west and to the north of the site, and undeveloped land remains
to the east of the subject property.
The petitioner is requesting a rezoning of the parcel from
A-2 to RMF-6 for a 120-unit multi-family development . The PUD
will be known as the "Pelican Lake Club" , and will include open
space and preserve areas, recreation uses, and a lake, in
addition to residential homes. The project density will be 5
units per acre.
The site was inspected by Andrea Stevens (Environmental
Resources Staff) on January 16, 1989.
The southern 1/3 of the site (adjacent to Davis Boulevard ) ,
and three additional smaller areas on the property support a
dense, low saw palmetto (Se[enoz! rege2�) habitat with widely
scattered and infrequent slash pines (pipus glligttii, with
diameters of up to 6 inches) . Groundcover and shrub layer
vegetation noted among the palmetto include rusty lyonia (Lyonia
fgE[uginga) , wax myrtle (Myrica ce[ifgra) , gallberry (Ilex
gl�bEa) , pennyroyal (pilobleghis Eigida) , and various grass
species. The open nature of the habitat (few canopy trees) and
the sandy soils are site characteristics beneficial to the
protected gopher tortoise, although burrows were not found during
the site inspection.
The petitioner is advised that gopher tortoise handling
and/or relocation will require permits from the Florida Game and
Freshwater Fish Commission.
The northeast corner of the parcel supports a 5-acre cypress
wetlands, which is contiguous with an offsite system. The canopy
is made up of 75%-80% cypress (Ta25gdium distighurT) , with an
occasional slash pine and cabbage palm (Sabal palTgtto ) . The
cypress are often significantly buttressed , and diameters of the
trees range up to 8 inches. The cypress provide support for a
diversity of epiphytes. Corkwood agutiga) in this
habitat indicate water levels of up to 5 inches. Additional

wetland vegetation among the cypress includes wax myrtle,
sawgrass, and swamp fern (Blechnum serrulatum) . Various wetland
grasses were also noted throughout this area. The exotic
Brazilian pepper (Schinus te[ebinthifolius) is infrequent .
The site plan indicates that the cypress habitat in the
northeast corner of the parcel will be preserved . This area has
already been flagged (by the previous property owner ) to the
satisfaction of the Environmental Resources Management Staff.
The remaining areas on the parcel are characterized by an
open pine canopy (pines with 4-8 inch diameters) with scattered
cypress, and a graminoid groundcover . A moderate to severe
infestation of the exotic melaleuca (Melalegg ggingggne,[yia ) in
these pine areas is crowding out some of the native species. Saw
palmetto , wax myrtle, and rusty lyonia are among the shrub layer
species.

petition R-89-1C subject to Standard Stipulations 1 ,3, and 4, as

COMMENTS: Mr . Reynolds advised that this petition was
approved once before by Collier County as a
PUD in October of 1985 . He stated that
the uses in a DRI had changed and because of
this, this petition must now be approved as a
DRI .
Mr . Reynolds advised that the land use plan
and all the information in the petition is

consistent with that which was previously
reviewed and approved. He said there have
been no changes to the master plan or any
other significant changes since the project
was originally approved.
Mr . Reynolds stated that the 1985 EAC approval.
contained the four standard stipulations plus
a 5th stipulation requiring boardwalk
crossings on the 5th and 17th holes of the
golf course.
Ms. Stevens advised that this project had been
thoroughly reviewed by Dr . Proffitt in 1985 .
She recommended that Stipulation #5 for the
boardwalk crossovers in the conservation areas
of golf course holes 5 and 17 be retained.
Ms. Stevens also recommended that a survey be
conducted on the site for red-cockaded wood-
peckers . She advised that there are indica-
tions of the woodpeckers presence on a 40 acre
tract south of the subject site.
Ms. Stevens stated that Staff recommends
approval of the petition with the updated
standard stipulations and a 6th stipulation
requiring a red-cockaded woodpecker survey of
the property.
Mr . Reynolds stated that they have already
begun reviewing the red-cockaded woodpecker on
the subject site and have sent information to
Ms. Stevens. He stated they do not object to
the stipulations, however , he is concerned
with Stipulation #2 as updated by the EAC on
December 7 , 1988 .
Mr . Reynolds reminded the EAC that the County
will be adopting a Landscape Ordinance in
August of this year and he pointed out that
placing interim requirements on only projects
which come before the EAC between now and the
time the Ordinance is adopted is inappropri-
ate. He distributed a copy of a recommended
stipulation requiring that they comply with
whatever is in effect at the time that they
present their landscape plan. He also noted
that any project appearing before the EAC
between now and August, will not be in a

position to put in any landscaping before
the Landscape Ordinance is adopted.
In answer to Mr. Addison, Mr . Reynolds stated
that the only landscaping requirement in
Collier County at this time is contained in
the Zoning Ordinance or the EAC stipulations.
Mr . Addison stated that the numbers contained
in Stipulation #2 were put in in response to
the Growth Management Act.
Ms. Kurgis stated that if there is no
landscape code in effect at this time, she
would like to see the current language stand.
Mr . Reynolds stated that it is his opinion
that not enough public input was received from
the landscape professionals at the time EAC
wrote the stipulation. He said he does not
believe it is appropriate to apply these sti-
pulations to the few projects .
Mr . Burch stated that Staff ' s position on this
issue is that old Stipulation #2 was
unworkable and unmeasurable and that is the
reason that a percentage was assigned to the
new Stipulation #2. He stated that some
flexibility may be appropriate for what will
be in effect at the time they bring in their
plan.
County Landscape Architect McCoy stated that
it is very difficult to work with the new
Stipulation #2 because the numbers become very
confusing during plan submittal . She advised
that from her point of view, they should be
looking for diversity. She stated she would
like the NRMD Staff to provide some guidelines
on what species of plants do well together .
She said the County is becoming wax-myrtled to
death. She pointed out that without diversity
there is danger of massive amounts of
landscaping being destroyed by a single
disease.
Mr . Addison stated that one of the problems
with diversity is that there is no lack of
variety and a lot is left up to the landscape
architects. He said they need to find a way
to get the information out for the variety of
species and color .

Mr . Reynolds indicated that this whole issue
has nothing to do with the petition in front
of the EAC. He suggested that a workshop be
held with the proper professional people to
decide this matter .
Ms. McCoy stated that people were much more
comfortable with Stipulation #2 as it was ori-
ginally written and they are having trouble
trying to comply with the stipulation as it is
now written.
MOTION: Made by Ms. Kurgis to recommend approval of Petition
DRI-88-1C sub'ect to the sti.ulations listed below.
Seconded by Mr. Turrell. Carried unanimously.
STIPULATIONS:
1. Petitioner shall be subject to Ordinance 75-21 (or the
tree/vegetation removal ordinance in existence at the time of
permitting) , requiring the acquisition of a tree removal per-
mit prior to any land clearing. A site clearing plan shall
be submitted to the Natural Resources Management Department
for their review and subject to approval prior to any work on
the site. This plan may be submitted in phases to coincide
with the development schedule. The site clearing plan shall
clearly depict how the final site layout incorporates
retained native vegetation to the maximum extent possible and
how roads, buildings, lakes, parking lots, and other facili-
ties have been oriented to accommodate this goal .
2 . Native species shall be utilized, where available, to the
maximum extent possible in the site landscaping design. A
landscaping plan will be submitted to the Natural Resources
Management Department and the Community Development Division
for their review and subject to their approval . This plan
will depict the incorporation of native species and their mix
with other species, if any. The goal of site landscaping
shall be the re-creation of native vegetation and habitat
characteristics lost on the site during construction or due
to past activities. Landscaping plans shall be prepared,
reviewed, and approved in accordance with Collier County
Zoning Ordinance Requirements and landscaping ordinances in
effect at the time of landscaping plan preparation and
review. Landscaping plans shall depict and quantify the
native species retained or required by applicable ordinances .
3 . All exotic plants, as defined in the County Code, shall be
removed during each phase of construction from development

areas, open space areas, and preserve areas. Following site
development, a maintenance program shall be implemented to
prevent reinvasion of the site by such exotic species. This
plan, which will describe control techniques and inspection
intervals, shall be filed with and subject to approval by the
Natural Resources Management Department and the Community
Development Division.
4 . If, during the course of site clearing, excavation, or other
constructional activities, an archaeological or historical
site, artifact, or other indicator is discovered, all deve-
lopment at that location shall be immediately stopped and the
Natural Resources Management Department notified.
Development will be suspended for a sufficient length of time
to enable the Natural Resources Management Department or a
designated consultant to assess the find and determine the
proper course of action in regard to its salvageability. The
Natural Resources Management Department will respond to any
such notification in a timely and efficient manner so as to
provide only a minimal interruption to any constructional
activities.
5 . As provided in County Ordinance 75-21 (Sec. Two: 6 .A) , a red-
cockaded woodpecker survey of the subject property shall be
completed by an environmental professional. A report sum-
^ marizing the survey metho9ds and results shall be subject to
the review and approval of the County Environmental Staff and
the Florida Game and Freshwater Fish Commission. A Tree
Removal Permit (Ordinance 75-21) for the property shall not
be considered until the survey has been approved by these
agencies.
6 . The conservation areas at golf course holes 5 and 17 shall be
preserved and the crossings will be accomplished by
boardwalks.
