STIPULATIONS:
Water Management:
1. Based on surrounding control elevations, which, at
the time, may have been set with an insufficient
knowledge of wet season behavior, the control
elevation of 7 . 5 is probably justifiable from an
engineering viewpoint. It should be remembered
that the existence of Wiggins Pass Road may have
served to hold back water that would have
historically drained rapidly to the southwest.
2 . The engineer should verify the capacity of the
existing offsite drainage system to convey the
flows exiting this site. If the capacity is
insufficient, the developer/owner shall pay their
fair share of any necessary off-site improvements.
Environmental:
1. Amend Section 2 . 3 (A) of the PUD document to read
as follows by adding the underlined language and
deleting the struck through language.
2 . 3 GENERAL COMPLIANCE WITH COUNTY ORDINANCES
A. Regulations for development of Tarpon Cove
shall be in accordance with the contents of
this PUD Ordinance and applicable sections of
the Collier County Land Development Code (to
the extent they are not inconsistent with this
PUD Ordinance) and Collier County Growth
Management Plan - Conservation and Coastal
Management Element which are in effect at the
time of issuance of any development order to
which said regulations relate which authorizes
the construction of Development Plan,
Excavation Permit and Preliminary Work
Authorization. Where this PUD Ordinance fails
to provide developmental standards, then the
provisions of the most similar zoning district
or section of the Collier County Land
Development Code shall apply.

2 . 11 REQUIRED ENVIRONMENTAL PERMITS
Where the development of land within the Planned
Unit Development requires a permit from a local,
state, or Federal Agency with jurisdiction over
the property (regulating agency) proposed for
development, then the Developer shall obtain such
permits as may be required prior to the
commencement of construction or alteration of the
land specifically requiring such permit. Where
County shall not impose conditions, exactions or
modifications that arc in conflict with or exceed
the requirements of the issued permit, provided
that Collier County may impose conditions that
exceed and arc not in conflict with the i,sued
permit if Collier county's regulatory jurisdiction
as provided in the Collier county Crowth
Management Plan and Land Development Codc exceeds
that of the other regulating agencies. In such a
case, Collier County's environmental permitting
guidelines and requirements shall control relative
to the specific County permit only.
3 . Amend Section 2 . 14 of the PUD document to read as
follows by adding the underlined language and

2 . 14 NATIVE VEGETATION RETENTION REQUIREMENTS
Pursuant to Policy 6.4 . 6 of the Conservation and
Coastal Management Element of the Collier County
Growth Management Plan, 25% of the viable
naturally functioning native vegetation on site
shall be retained. The total area of viable
natural functioning native vegetation within the
PUD boundary is 3G. 5 97 . 3 acres, therefore 24 . 3
acres are required to be retained. This
requirement is fully satisfied within the Reserve
District and no further preservation is required.
4 . Amend Section 5. 3 of the PUD document to read as
follows by adding the underlined language and
deleting the struck through language.
5 . 3 PERMITTED USES AND STRUCTURES
No building or structure, or part thereof, shall
be erected, altered or used, or land or water
used, in whole or in part, for other than the

5. 4 DEVELOPMENT STANDARDS
A. All structures shall setback a minimum of five
roads, except for pathways, boardwalks and
no required setback. Setbacks shall be in
accordance with Section 3 . 2 . 8 . 4 . 7 (3) of the
Collier County Land Development Code.
6. Amend Section 5. 5 of the PUD document to read as
follows by adding the underlined language and

5. 5 RESERVE DISTRICT CONSERVATION EASEMENT
A non reclusive non-exclusive conservation
easement or tract is required by Collier County
Land Development Code Section 3 . 2 . 8 . 4 . 7 . 3 for
preservation lands included in the Reserve
District. In addition to Collier County, a
conservation easement may also be required by
other regulatory agencies with jurisdiction over
Reserve District lands. In addition to complying
with provisions of the Collier County Land
Development Code, said easement shall be provided
in accordance with the terms set forth in the
applicable permit granted by said agencies and as
cct forth in PUD Section 6. 11 hereof. The
developer, their successor or assigns, or the
property owner's association shall be responsible
for control and maintenance of lands within the
Reserve District.

6. 9 ENVIRONMENTAL
A. Development orders submitted after five (5)
years (from date of original Environmental
Impact Statement) shall include an
environmental impact statement, except that
the applicant may request an administrative
waiver of this provision where Staff
determines that there are no additional
environmental issues or where a prior
environmental impact assessment was prepared
or updated for the same area of land within
five (5) years.
B . Pursuant to Collier County Land Development
Code Article 3, Division 3 .8 , Section 3 .8 . 4,
the Tarpon Cove PUD EIS cited in 6.9A above
shall constitute Collier County's review and
approval of all environmental resources and
environmental quality i.sucs contained in the
Tarpon Covc PUD.
CB. Provisions 6.9A and 6.9B above does not
relieve the Developer from providing, or
foreclose the County from requesting,
information relative to new or changed
environmental conditions on the site relative
to species of special status pursuant to
Collier County Land Development Code Section
3 . 8 . 5. 4 . 1. 5.d and e.
C. In accordance with Policy 7 . 3 . 5 of the
Conservation and Coastal Management Element of
the Collier County Growth Management Plan,
gopher tortoises shall be relocated.
Compensation for lost habitat whose extent has
been approved by the Florida Game and Fresh
Water Fish Commission (FGFWFC) shall be in
accordance with FGFWFC policy.
Collier County shall defer all environmental
permitting regarding wetlands, wetland
impacts, and wetland mitigation to South
Florida Water Management District. The
Collier County on all approved permits.

by Planning and Technical Services Environmental
Review Staff. Removal of exotic vegetation shall
not be counted towards mitigation for impacts to

F. Prior to any site alterations, final plat/plans or
final site development plan approvals the
petitioner shall submit a copy of a letter from U.
S. Fish and Wildlife Service (USFWS) stating that
they have approved the project and construction

The subject property is located on the north side of Wiggins Pass
Road immediately west of Tamiami Trail North (U. S. 41) in Section
16, Township 48 South, Range 25 East, Collier County, Florida.

IV. PROJECT DESCRIPTION:
Tarpon Cove is a proposed 97 . 3 acre residential community with
single family, zero lot line and multi-family housing,
recreational facilities, stormwater management lakes and reserve
areas.
The project outfalls into an existing swale which runs through the
property, then goes through culverts under Wiggins Pass Road and
through roadside swales toward the south into Wiggins Bay.

IV. STAFF COMMENTS:
Water Management:
The size of the project (97 . 3 acres) and the presence of wetlands
mean that this project will be reviewed and permitted by the South
Florida Water Management District (SFWMD) .
A review of the project yielded the following observations:
The engineer's narrative states "on-site topography ranges from a
low of 6. 1 to a high of 10. 5 NGVD. Those extremes appear to have
been the result of human activity. Historic topography seems to
range from elevation 7 . 5 to elevation 9 . 5. The engineer's
estimated W. S.W.T. is at elevation 7 . 5. Wetland elevations vary
from elevation 7 . 7 to elevation 8 . 7. The control elevation of 7 . 5
will leave the wetlands drier than, perhaps,they have historically
been.
The three projects north of this project, Village Place, The
Retreat, and Audubon are controlled, respectively, at elevations
8 . 0, 8 . 3 , and 8 . 5 going north. The project downstream, to the
southwest, known as Wiggins Bay PUD, is controlled at elevation
4 . 0.
There is an existing drainage "canal" within a forty foot (40' )
drainage easement that cuts through the parcel. It enters from
the east and discharges at the S.W. Corner. This canals drain the
U. S. 41 roadside swales as well as the developments to the north
between new U. S. 41 and the railroad right-of-way to the east.
The largest of those developments, Sterling Oaks, is controlled at
elevation 10. 5.
Tarpon Cove plans on discharging into that existing canal at
several points along its length.

Environmental:
The project site contains numerous habitat types. Uplands consist
of pine flatwoods, xeric oak scrub and saw palmetto prairie.
Wetlands are located predominantly in sloughs which run
north/south on the subject property. They include cypress stands,
wet prairies and hardwood swamps. A preliminary plant list from
Environmental Staff's site visit on October 10, 1995 is included
with this staff report. Although downy rose myrtle has invaded
the southern end of the site, the subject property remains
relatively free of exotic vegetation.
Hydrology on the subject property is excellent and accounts for
the healthy nature of the wetlands on site. Like the petitioner,
staff also noticed sheet flow through the slough areas. Walking
the site could easily give one a glimpse of what the urban coastal
area of Collier county may have looked like prior to the
installation of our man made drainage system.
The final control elevation for the proposed project will
determine the long term viability of the wetlands on site. A
control elevation of 7 . 5 may not be adequate to provide a
sufficient hydroperiod. Presently wetland elevations vary from
elevation 7 . 7 to elevation 8 . 7 (see water management comments for
additional information) .
33 . 18 acres of Collier County jurisdictional wetlands occur on the
property as determined by the petitioner's environmental
consultant. In order to offset adverse environmental impacts
resulting from development activities in 1. 8 acres of wetlands,
the development plan calls for preservation and restoration of
on-site wetlands. Approximately 31. 38 acres of wetlands and 4 . 6
acres of uplands are proposed for preservation.
The petitioner reports finding fifty-four (54) gopher tortoise
(Gopherus polyphemus) burrows in two separate populations on the
subject property. Forty-two (42) of these burrows are reported as
being active. A gopher tortoise relocation/management plan has
not been proposed at this time.
Several listed plant species occur on the subject property (see
Table 1 of Threatened and Endangered Species Survey) . Most of the
threatened and/or endangered vegetation is located within the
slough areas and therefore will be preserved.
A letter from the State of Florida, Division of Historical
Resources, lists one archaeological site and no historical
standing structures as occurring in Section 16, Township 48 South,
Range 25 East, Collier County, Florida. Maps provided by the
petitioner confirm the archaeological site to be located off the
subject property.

V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-95-11, "Tarpon Cove" with the following stipulations:
Water Management:

5. 5 RESERVE DISTRICT CONSERVATION EASEMENT
A non-reclusive non-exclusive conservation easement or tract
is required by Collier County Land Development Code Section
3 . 2 . 8 . 4 . 7 . 3 for preservation lands included in the Reserve
District. In addition to Collier County, a conservation
easement may also be required by other regulatory agencies
with jurisdiction over Reserve District lands. In addition to
complying with provisions of the Collier County Land
Development Code, said easement shall be provided in
accordance with the terms set forth in the applicable permit
granted by said agencies_ and as set forth 4n PUD Section 6. 11
hereof. The developer, their successor or assigns, or the
property owner's association shall be responsible for control
and maintenance of lands within the Reserve District.

6. 9 ENVIRONMENTAL
A. In order to avoid repetitive review of environmental
issues in subsequent stages of the County development
approval process, the requirement for obtaining approval
of an Environmental Impact Statement (EIS) pursuant to
Division 3 . 8, Section 3 . 8 . 3 of the Collier County Land
Development Code shall be deemed satisfied for all future
activities which take place with the Tarpon Cove PUD
boundaries that require County permits for or County
approval of development or site alteration. This
provision is based upon the Tarpon Cove PUD EIS. This
provision shall apply to the Developer, its successors, or
assigns.

C. In accordance with Policy 7. 3 . 5 of the Conservation and
Coastal Management Element of the Collier County Growth
Management Plan, gopher tortoises shall be relocated.
Compensation for lost habitat whose extent has been
approved by the Florida Game and Fresh Water Fish
Commission (FGFWFC) shall be in accordance with FGFWFC
policy.
Collier County shall deer all environmental permitting
regarding wetlands, wetland impacts, and wetland
mitigation to South Florida Waterment District.
The developer shall coordinate with and copy Collier

II. LOCATION:
The parcel is located at the southeast corner of Pine Ridge Road
and the proposed Livingston Road extension in Section 18, Township
49 South, Range 26 East.
III. DESCRIPTION OF SURROUNDING PROPERTIES:
The subject property is bounded on the north and southwest by
residential property, on the east by undeveloped and commercial
property and on the south and west by undeveloped property.

IV. PROJECT DESCRIPTION:
The subject property is a 17 . 5 acre parcel zoned Agriculture at
the southeast corner of Livingston Road and Pine Ridge Road. The
surrounding properties are vacant and zoned either Agriculture or
Estates. The northern portion of the property was previously
drained and farmed. Those fields have been inactive for over ten
years. The remainder of the property consists of an eleven acre,
drained cypress swamp which is heavily impacted with exotics and a
small (less than one acre) wet prairie. The petitioner proposes
to construct a golf driving range and to preserve the undeveloped
portion.

V. STAFF COMMENTS:
Water Management:
The proposed surface water management system to serve the project
will consist of a combination of on-site retention and detention
to provide for water quality and peak flow attenuation. Discharge
will be through a control structure along the southern property
line. The surface water management system will restore sheet flow
from the upland area into the wetland system. The detention
system will also improve the existing hydroperiod of the wetland
to be preserved by re-establishing the historic hydroperiod. The
system has been designed to produce low peak stages in order to
maintain the range area free from standing water and to also mimic
the historic wet season inundation frequency for the preserved
wetlands. The control structure as designed will maintain the
historic runoff patterns by discharging through a spreader swale
along the south property line.
The site grading will convey all rainfall falling on the site to
the south of the project where the control structure is located.
A perimeter berm will contain all runoff on site. The proposed
grading plan specifies an elevation of 12 . 3 ft. NGVD at the golf
tees and a range slope of 0. 1% to an elevation of 11. 5 ft. , 275
feet downrange from the tee.
No offsite flows enter the project site.
Stormwater runoff modeling using the SCS Method was conducted to
determine peak storm stages, minimum travelway elevations and
finished floor elevation. The three day - twenty-five year storm
event model produced a peak stage of 11. 6 ft. NGVD at a discharge
rate of 2 . 3 cfs which is below the allowable discharge rate of 2 . 6
cfs (0. 15cfs/acre) . This project will be reviewed and permitted
for surface water management by the South Florida Water Management
District (SFWMD) .
Environmental:
The 17 . 5 acre parcel is comprised of approximately 12 acres of
wetlands, the vast majority of those being a drained cypress swamp
with a cypress, pine and melaleuca canopy; wax myrtle, downy
rosemyrtle and Brazilian pepper midstory and sparse ground cover.
The consultant believes that due to the severe drainage there is
little hydrologic function remaining on-site. The remainder of
the property is upland and either fallow crop land or pine
flatwoods. The consultant conducted transects throughout the
property in March and August 1995 and found no evidence of any
state or federally listed species.

VI. RECOMMENDATIONS:
Staff recommends approval of Conditional Use Petition No.
CU-95-17, "Jon Ebert golf Teaching Center" with the following
stipulations:
Water Management:
1. A copy of South Florida Water Management District Permit or
Early Work Permit with staff report is required prior to
final site development plan approval.
Environmental:
1. A conservation easement shall be placed over the wetland
preserve area by plat or by separate instrument with the
appropriate protective covenants similar or pursuant to
Section 704 . 06 of the Florida Statutes.
2 . All proposed mitigation for wetland impacts to Collier County
jurisdictional wetlands shall comply with Appendix 7 of the
South Florida Water Management District (SFWMD) rules and be
subject to review and approval by Current Planning Services
Environmental Review Staff.
3 . The conditional use shall be consistent with the Environmental
sections of the Collier County Growth Management Plan
Conservation and Coastal Management Element and the Collier
County Land Development Code at the time of final development

V. STAFF COMMENTS:
Water Management:
Portions of existing site were previously cleared and filled as a
single family homesite. Additionally, retention areas (ponds) and
drainage ditches have been constructed in the western portion of
the project. Existing on-site topography ranges from a high of
5. 5' NGVD near the eastern property line at Bayshore Drive to a
low of 2 . 0' NGVD at the western boundary line.
The proposed water management system will consist of a 1. 0± acre
on-site lake. The control elevation of the lake will be 4 . 0'
NGVD. All stormwater run-off from the parking and residential
areas will be routed to the lake via a system of pipes and swales,
where it will be stored prior to discharge. The outfall structure
will consist of a concrete weir (crest elevation 7 . 0' NGVD) with a
3" diameter bleeder orifice. Proposed on-site road grades will be
set at the 25 year - 3 day flood stage of 7 . 0' NGVD. Minimum
finished floor elevations will be based on FEMA flood elevations
of 9 . 0' or 10. 0' depending on the buildings location on-site.
Allowable discharge will be 0. 06 CFS/Acre. A spreader swale
system at the point of discharge simulates the historical
sheetflow pattern to Naples Bay via the existing saltwater marshes
and wetlands which cover the western half of the site. These
wetland areas are being preserved as a Conservation Area.
This project will be reviewed and permitted for surface water
management by the South Florida Water Management District (SFWMD) .
Environmental:
The subject property is a fifteen acre parcel located on the West
side of Bayshore Drive approximately one-half mile south of the
intersection with Thomasson Drive. Twelve acres of the site are
jurisdictional wetlands. The proposed development will impact
five acres and preserve seven.
The site is heavily invaded by exotics such as Brazilian pepper,
melaleuca and Australian pine. A salt marsh and other lower areas
that were previously dredged will be enhanced and restored in
accordance with the approved agency wetland mitigation plans.

information relative to various petitions, and in order to better
meet the needs of this important advisory Board, the 'following
policy and procedural changes shall be implemented immediapely.
1. STAFF REPORT
Please note some additions to the staff report format
(attached) .
2 . PRESENTATIONS
a) The presentation for each petition will commence with a
brief description of the petition (i.e. , location,
nature of petition, etc. ) , followed by a summary of the
staff's recommendation. This presentation should be made
by the Environmental Specialist, unless it is strictly
an Engineering Review Section petition with no
environmental considerations, in which case the Senior
Engineer should make the presentation. At the
completion of this brief presentation, staff should
indicate who is in attendance, on behalf of the
applicant, and available to either answer questions or
make a presentation to the Board.
b) Presentations should be made at the podium. Staff should
wear proper business attire (this includes slacks &
sport jacket or suit for men; and a suit, dress, or
jacket, blouse & skirt for women.
- c) Staff should utilize any audio-visual aides as may be
available, including aerial photos, master plans, and so
on.
