II. LOCATION:
About three miles southeast of Port of the Islands on the south
side of U. S. Highway 41 (Tamiami Trail) at Big Cypress Bend,
surrounded on all sides by land zoned conservation with an Area of
Critical State Concern/Special Treatment overlay (CON-ACSC/ST) , in
Section 13 , Township 52 South, Range 28 East, Collier County,
Florida.
III. PROJECT DESCRIPTION:
The applicant is proposing to restore the Old Weaver Station on
U. S. Highway 41 at Big Cypress Bend. Proposed improvements
include paved parking areas, restoration of existing cottages,
an Indian museum, Indian, aviary and alligator display huts
(chikkees) , reptile pond, walkways and caretakers quarters.

IV. STAFF COMMENTS:
Water Management:
Engineering and water management will be reviewed during site
development plan review.
Environmental:
Basically the subject property consists of a centrally located
upland parcel, the Old Weaver Station, surrounded on three sides
by brackish water marsh. Immediately to the north lies the old
(historic) Tamiami Trail with existing access to U. S. 41.

The marsh appears to be in good health with some Brazilian pepper
on the surrounding mangrove islands. Dominate vegetation includes
cordgrass (Spatina sp. ) , black needle rush (Juncus roemerianus) ,
saltgrass (Distichlis spicata) , sea purslane (Sesuvium sp. ) ,
cabbage palm (Sabal palmetto) and white mangrove (Laguncularia
racemosa) .
Areas north of the old "Trail" are wetland in origin and are
hydrologically connected to the surrounding marsh. Vegetation to
be impacted on the north side of the road consists of ST.
Augustine grass (Stenotaphrum secundatum) , Spanish needles (Bidens
alba) , cabbage palm (Sabal palmetto) , Brazilian pepper (Schinus
terebinthifolius) and roadside grasses.
The Weaver Station itself is an upland parcel vegetated with both
native and exotic "weedy" flora. Dominant vegetation includes
Australian pine (Casuarina sp. ) , royal palm (Roystonea sp. ) ,
ivy-arum (Scindapsis sp. ) , strangler fig (Ficus aurea) , moon vine
(Ipomoea alba) , Spanish needles (Bidens alba) and roadside
grasses. The historic structures have deteriorated over the years
and others were severely damaged by Hurricane Andrew in 1992 .
The historical/archaeological probability maps of Collier County
give an historic designation to the subject property. The
proposed project has been granted a Certificate of Appropriateness
by the Collier County Historic Preservation Board. Site
improvements are subject to the following provisions:
That the replication of Weaver Station keep to the original design
as much as possible. Any enlargement of the principal building be
proportional in size.
V. RECOMMENDATIONS:
Staff recommends approval of rezone and conditional use petition
numbers R-94-2/CU-94-4, "Old Weaver's Station" with the following
stipulations:
Environmental:
1. Permits of letters of exemption from the U. S. Army Corps of
Engineers (ACOE) , Florida Department of Environmental
Protection (DEP) and South Florida Water Management District
(SFWMD) shall be presented prior to final site development
plan approval.

2 . Upon approval by the Board of County Commissioners, this
rezone and conditional use are subject to a forty-five (45)
day appeal period by the Florida Department of Community
Affairs pursuant to Chapter 9J-1 of the Florida Statutes.

approval pursuant to Section 2 .2 .24 of the Collier County Land
Development Code (CCLDC) .

II. LOCATION:
Section 34 , Township 49 South, Range 26 East; bounded on the north
by I-75 right-of-way; on the east by Palm Springs County Park and
Palm Springs subdivision (residential zoning) ; on the south by
Woodside Lanes PUD, partially developed, commercially zoned
property, and Radio Road right-of-way; and on the west by Green
Heron PUD (Sapphire Lakes) . The subject parcel is currently zoned
PUD (Sherwood Park PUD) .
III. PROJECT DESCRIPTION:
The petitioner proposes a 336 unit multi-family residential
development on 80± acres of forested land. The previous master
plan included a golf course. The proposed master plan adds 20±
acres of retained native vegetation.

IV. STAFF COMMENTS:
Water Management:
The surface water management system for Sherwood Park will consist
of four (4) interconnected lakes using equalize pipes. The lakes
will comprise approximately 12 . 3 acres of the 79 . 5± acre property.
Surface runoff will be conveyed to the lakes through catch basins
and culverts . The water management system will be designed to
control approximately 58 . 5 acres of the property. The northern 21
acres of the site will not be developed and is to be left in its
natural state through a platting restriction. The water
management system will be designed to control the 25 year, 3 day
storm event over the developed portion of the property at a
discharge rate of 0. 15 cfs/acre. The system will discharge to the
I-75 right-of-way conveyance facilities under a drainage
connection permit to be obtained from the Florida Department of
Transportation. The discharge connection to the I-75 facilities
will be through an open grassed swale from the project's control
structure which will be located in the northeast corner of the
site's northernmost lake. The ultimate point of discharge will be
to the Golden Gate Canal .
Environmental:
The 80± acre site is primarily pine flatwoods with several small
hardwood hammocks and a small (0 . 57± acre) cypress wetland
claimed as jurisdictional to Collier County. South Florida Water
Management District has since determined that this area does not
function as a wetland. The wetland and the hammocks lie outside
the area proposed for preservation.
The soils on site include Boca fine sand and Pineda fine sand,
limestone substratum, a hydric soil . (Yamataki, Collier County
soil Legend, Revised 1990) .
A listed species survey was conducted by the petitioner. Nine
gopher tortoise (Gopherus polyphemus) burrows were found. The
gopher tortoise is listed as a species of special concern by the
Florida Game and Fresh Water Fish Commission (FGFWFC) . The
petitioner proposes relocation of the tortoises to the northern
preserve.
The site was also surveyed for red cockaded woodpeckers (Picoides
borealis) . This bird is listed as threatened by the FGFWFC and as
endangered by the U. S. Fish and Wildlife Service (USFWS) . No red
cockaded woodpeckers or their nest cavities were observed by the

petitioner. A tree containing an abandoned cavity was removed
from the right-of-way adjacent to the property. Two inactive red
cockaded woodpecker cavities have been documented on the adjacent
parcel to the west. The 20± acres of pine flatwood proposed to be
retained appears to be suitable for red cockaded woodpecker
foraging.
The site is not within a wellfield protection zone or a zone of
archaeological and historical probability.
V. RECOMMENDATIONS:
Staff recommends approval of Preliminary Subdivision Plat Petition
Number PSP-94-9 , "Sherwood Park" with the following stipulations:
Water Management:
1. A Florida Department of Transportation (FDOT) right-of-way
permit and drainage connection permit will be required prior
to final site development plan approval for construction of
water management facilities within I-75 right-of-way.
2 . A copy of South Florida Water Management District (SFWMD)
permit with staff report is required prior to final site
development plan approval .
3 . An excavation permit will be required for the proposed lakes
in accordance with Division 3 . 5 of the Collier County Land
Development Code and South Florida Water Management District
rules.
4 . Final site development plan will locate the project's control
structure in the northeast corner of the site's northernmost
lake.
Environmental:
1. Protective covenants for tract G shall be recorded on the
plat.
2 . Prior to approval of infrastructure construction plans submit
a management plan for tract G.
3 . Prior to approval of infrastructure construction plans submit
a permit from Florida Game and Fresh Water Fish Commission for
gopher tortoise relocation.

II. LOCATION:
The subject property is located on Marco Island approximately four
miles southwest of the U.S. 41/S.R. 92 intersection and just south
of S.R. 92 on Goodland Drive in Section 15, Township 52 South,
Range 26 East, Collier County, Florida. Barfield bay borders the
west edge of the property.
III. PROJECT DESCRIPTION:
Vintage Bay is a multi-family condominium complex located within
the Marco Shores planned unit development (PUD) . Proposed
improvements include four, 76 foot high, six-story buildings with
associated parking facilities located under the buildings and in
separate parking lots, recreation center, pool and preservation
areas.
This project was previously approved by the Environmental Advisory
board and issued a Final Site Development Plan. The applicant has
elected to institute changes to the approved site plan. The
proposed changes are actually more desirable from a water
management and environmental standpoint.

IV. STAFF COMMENTS:
Water Management:
The petitioner has obtained a South Florida Water Management
District Modification for the proposed site plan and Project Plan
Review is in agreement with the water management design.

Environmental:
Pursuant to Collier County Ordinance No. 84-42 Section
12 . 2 .B. 1 (e) , the final site development plans and drainage plans
shall be submitted to the Environmental Advisory Board for review
and approval.
The subject property is an undeveloped fifteen acre parcel
composed of three naturally occurring sand hills surrounded on all
sides by mangrove swamp. Vegetatively the site consists of
tropical hardwood hammock, mangrove forest, xeric oak hammock and
scrub communities. Most of the xeric scrub like vegetation occurs
on the northern most hill. The remaining uplands are dominated by
tropical hardwood hammock. A preliminary plant list of woody
vegetation from a site visit on February 4, 1994 by Stephen
Lenberger, Current Planning Environmental Staff, and Michael
Langston, engineering consultant, is included with this staff
report. Exotic pest plants are few in number.
Presently the site contains several dirt roads which transverse
the north half of the property. Wetland areas within the
previously approved site development plan have now been filled.
Turbidity curtains and hay bails were both utilized in these
areas. The southern most hill (tropical hardwood hammock) has not
been impacted at this time.
Protected species and preserve management plans have been
previously submitted and approved with the initial site
development plan. Listed species which occur on the property
include gopher tortoises. These are to be relocated to the
preservation area located on the north end of the site. No live
Florida tree snails or shells have been found on the property.
Prior to removal of any vegetation, the site will be resurveyed
for tree snails and if found they will be relocated to the
preserve areas at the north and south ends of the property.
The proposed project is presently in for a PUD amendment (PDI) for
density changes (85 units to 132 units) which are consistent with
the Marco Shores PUD. Density changes if not approved will change
the site development plan by removing one of the buildings,
thereby lessening the impact on the site.

II. LOCATION:
The subject property is located west of Eagle Creek PUD at the
northwest corner of the intersection between Tower Road and
Barefoot Williams Road, and is about 3/4 mile southwest of the
intersection between U.S. 41 and C.R. 951 in Sections 4 and 5 ,
Township 51 South, Range 26 East, Collier County, Florida.
III. PROJECT DESCRIPTION:
The proposed project is a multi-phased, residential project with a
mixture of single-family and multi-family units with a maximum of
786 residential units. Appropriate recreational facilities may be
provided for the use of the residents. Depending on market
conditions, churches and/or nursing homes may be constructed in
lieu of some of the dwelling units. The exact mix of dwelling
unit types will be determined as the project develops.

IV. STAFF COMMENTS:
Water Management:
This project was previously permitted as a commercial excavation
under Permit No. 59 . 308 and provisional use petition PU-87-24C.
The excavation permit was approved by the Board of County
Commissioners on April 12 , 1988 and allowed the excavation of 124
acres of lakes with the off-site removal of 1. 6 million cubic
yards of material. A surface water permit was issued by the South
Florida Water Management District (SFWMD) on January 1, 1988 .
Due to the concerns of adjacent property owners, the Board of
County Commissioners imposed the following conditions of approval
on the original commercial excavation permit issuance:
1) No blasting allowed.
2) No dewatering nor water pumping which would affect ground
water conditions.
3) Waiver of "minimum" depth requirement subject to detailed
information from applicant to determine extent of need to
waive depth requirements beyond slope of excavation.
4) No removal of rock or impervious layer separating shallow
water aquifer (fresh water) from deeper ground water aquifer
(salt water) .
5) Monitoring wells to be installed north and south of excavation
to provide test data applicable to shallow water aquifer.
6) Applicant remains liable to surrounding owners for adverse
effects from operations.
Commercial excavation activities began shortly after permit
issuance on June 22 , 1988. On October 2 , 1991 the commercial
excavation permit expired through lack of activity and was deemed
null and void. It appears that with the conditions of no blasting
and no dewatering, it was impossible for the contractor to
excavate the lakes to the required depths due to the presence of
rock. There are currently six shallow excavations on-site which
are infested with cattails. Again, no activity has occurred
on this site within the last four years and all previous
excavation permits are null and void.
The applicant now proposes a Planned Unit Development with two
water management lakes. These lakes are in the area of the two
largest existing lakes on-site. The four smaller lakes on-site
will be filled in for development.
The proposed water management system consists of interconnected
lakes with three outfalls; two outfalls will discharge south into
on-site wetlands adjoining state owned wetlands (Rookery Bay
Preserve) . The other outfall will discharge north to on-site
wetlands at the northeast corner of the property. Discharge to
the on-site wetland areas will enhance the hydroperiod and
will mimic natural conditions through the use of spreader swales.
Discharge from properties to the north will be routed around this

project to a spreader swale at the southwest corner of this
project. Peak discharge from the developed site will not exceed
pre-development rates nor will the Barefoot Williams Road roadside
swales be impacted by this development.
Although the Board of County Commissioners imposed conditions of
no blasting and no dewatering (among others) with the commercial
excavation, blasting in conjunction with localized dewatering is
necessary to bring the two lakes into compliance with the minimum
depth requirements of the Excavation Ordinance.
Acknowledging the fact that these lakes will be turned over to a
homeowner's association for maintenance, it is imperative both
lakes be constructed to the correct depths to ensure undo
maintenance hardships are not incurred by the future homeowners.
Based on a January, 1990 report prepared by Missimer & Associates
(included in support documents) which analyzes the effects of
shallow blasting operations on the quality of water in the
surficial aquifer, blasting performed by a competent contractor
will not cause the vertical migration of the higher chloride
content groundwater of the upper Tamiami Limestone Aquifer, into
the lower chloride groundwater of the surficial aquifer. This
conclusion in conjunction with the observation that lakes were
previously constructed within five hundred feet (500' ) of the
subject property (as part of Eagle Creek Golf Course) with no
apparent adverse impacts to the surrounding properties, are
adequate justification for Project Plan Review to recommend
blasting be permitted in conjunction with localized dewatering to
facilitate the completion of the water management lakes.
Environmental:
The site itself is principally an upland parcel ringed on its
north, west and south sides by wetlands of various types. About
thirty (30) years ago large scale disturbances to the site's
central uplands occurred through drainage and cultivation for
vegetable farming. In the late 70's and 80's earth mining
the upland substrate for construction fill material resulted in
six borrow ponds on the site ranging from 3 . 7 acres to 25. 4 acres.
The remaining upland acreage continued to be farmed until a few
years ago when the fields were left to fallow.
Approximately two hundred twenty (220) acres or eighty-four
percent (84%) of the site (263 acres total) has been striped of
its original vegetation. Dominant vegetation now consists of
Brazilian pepper (Schinus terebinthifolius) , wax myrtle (Myrica
cerifera) , salt bush (Baccharis sp. ) , water primroses (Ludwigia
spp. ) , coastal plain willow (Salix caroliniana) , false nettle
(Boehmeria cylindrica) , cattail (Typha sp. ) , torpedo grass
(Panicum repens) , sedges (Cyperus sp. ) , cow pea (Vigna luteola) ,
para grass (Panicum purpurascens) , Caesar weed (Urena lobata) ,
carpetweed (Lippia nodiflora) , Sida sp. , Spanish needles (Bidens
alba) , white vine (Sarcostemma clausum) , etc. Three of the borrow
ponds are currently about ninety percent (90%) covered in
cattails.

Native plant communities presently found on site include a cypress
swamp, pine flatwoods, mesic oak-palm forest and cordgrass
(Spartina) marsh. These are mostly located in pockets along the
edge of the site and are difficult to access due to exotic plant
species (Brazilian pepper) invasion.
Collier County jurisdictional wetlands occur on 27 .7 acres of the
property, of which 4 . 25 acres are proposed for impacts. The
wetland areas proposed for impact are heavily (60-100%) invaded by
Brazilian pepper.
Listed wildlife species found on the subject property include the
American alligator (Alligator Mississippensis) , little blue heron
(Egretta caerulea) and tricolored heron (Egretta tricolor) .
Collier County zoning maps also indicate a bald eagle overlay for
the site. Contacts with the Florida Game and Fresh Water Fish
Commission (FGFWFC) Naples office and field observations indicate
that the bald eagle nest location is over 1, 500 feet from the
project site boundary. A copy of the map obtained from Joe Bozzo,
Biologist, FGFWFC, giving the bald eagle nest site location is
included in the Environmental Impact Statement Addendum.
A review of the index maps of historical/archaeological
probability of Collier County, Florida, reveals no archaeological
of historical sites likely to be present within the project area.
V. RECOMMENDATIONS:
Staff recommends approval of Planned Unit Development Petition No.
PUD-89-33 , "Land's End Preserve" . This recommendation carries
specific stipulations as identified below.
Water Management:
1. Dewatering shall be limited to the blasting activities only.
If dewatering is deemed necessary by the blasting contractor,
then cells no greater than one acre in area may be dewatered
to the top of the caprock and blasted one at a time.
Dewatering for the lake excavation shall not occur; removal of
the material shall be performed under wet conditions.
All necessary permits for dewatering shall be obtained from
the South Florida Water Management District (SFWMD) prior to
commencement. Groundwater pumped during dewatering shall be
retained on-site for recharge purposes. Under no circumstance
shall any off-site pumping occur.
2 . A groundwater monitoring plan shall be submitted with
specific parameters, monitoring schedules, proposed allowable
variations, and contingency plan if variables exceed their
allowable limits. This plan shall be reviewed and approved by

3 . The applicant will remain liable to the surrounding property
owners for adverse effects from the excavation operations.
4 . Prior to Preliminary Subdivision Plat approval, written
confirmation from Collier County Water Management Department
shall be provided to Project Plan Review verifying that the
water management system is in compliance with the District 6
plans.
5. Due to the void status of the previous excavation permit for
this property, a new excavation permit will be required in
accordance with Division 3 . 5 of the Collier County Land
Development Code.
6. A copy of the South Florida Water Management District (SFWMD)
permit shall be provided prior to excavation permit issuance.
Environmental:
1. Amend section 5. 3 (B) (1) of the PUD document to read as
follows:
Boardwalks, pedestrian/bicycle paths, picnic areas, fishing
piers, and other recreational uses not having a significant
and negative impact on the environment, and approved by
applicable County, State and Federal regulatory agencies.
2 . All jurisdictional wetlands and/or mitigation areas shall be
designated as conservation/preservation tracts or easements on
all construction plans and shall be recorded on the plat with
protective covenants per or similar to Section 704 . 06 of the
Florida Statutes.
In the event the project does not require platting, all
jurisdictional wetlands and/or mitigation areas shall be
recorded as conservation/preservation tracts or easements
dedicated to an approved entity or to Collier County with no
responsibility for maintenance and subject to the uses and
limitations similar to or as per Florida Statutes Section
704 . 06. The tracts or easements shall be indicated on all
future site plans noting Official Record Book and Page of the
public records.
Preservation areas may be donated to the Rookery Bay Aquatic
Preserve if agreed upon by the petitioner and Rookery Bay
Management.
3 . All proposed mitigation for wetland impacts to Collier County
jurisdictional wetlands shall comply with Appendix 7 of the
South Florida Water Management District rules and be subject
to review and approval by Community Development Environmental
Review Staff.

4 . An exotic vegetation removal, monitoring, and maintenance
(exotic-free) plan for the site, with emphasis on the
conservation/preservation areas, shall be submitted to
Community Development Environmental Review Staff for review
and approval prior to final site plan/construction plan
approval.
5. Prior to any site alteration or final development order
approval petitioner shall comply with the recommendations and
guidelines of the Florida Game and Fresh Water Fish Commission
(FGFWFC) and United States Fish and Wildlife Service (USFWS)
regarding the management and protection of the Bald Eagles
associated with Henderson Creek nest No. CO-03 .

RE: EAB Applicants for two vacant positions
Two vacancies are coming up for the EAB. The following is a very
brief summary of the applicants background, with resumes attached
for further detail.
The Board of County Commissioners office has asked that we
distribute this information to you as individual members and ask
that you as a Board make a recommendation to appoint two people to
the upcoming vacancies. That decision needs to be made at the
upcoming EAB meeting and will be discussed under "New Business" .
The EAB is a Board which by ordinance reviews water management and
environmental issues and shall be made up of a balance of
representatives of both professions. The make-up of the Board
with the two vacant positions is: three professional engineers,
one professional biologist, and a citizen active in environmental
issues.
Staff will forward the Boards recommendation to the County
Commissioners office immediately after the meeting to expedite the
process of having those vacancies filled.

Dear Mr. Butler:
This is to inform you of the proceedings of the July 6, 1994
Environmental Advisory Board (EAB) meeting with respect to the
above referenced petition. When this item came up on the
agenda, a representative for the petitioner was not present
and, due to the significance of the project, the Board members
decided by unanimous vote to postpone the hearing of this
matter to the next meeting date (August 3, 1994) .
A concerned adjacent property owner (Mr. Dan Goodacre) was
permitted to speak with the understanding that the hearing was
continued and no decision would be made at this time. Mr.
Goodacre and several neighbors have serious concerns regarding
the effects blasting and dewatering may have on the surface
water aquifer with respect to salt water intrusion.
This issue will be addressed at the next Board meeting and all
applicable consultants should attend to answer any questions
the Board members may have; the taped recording of Mr.
Goodacre's presentation and the proceedings are available in
the Clerk to the Board's Office, Fifth Floor of Building F.
Subsequent to Mr. Goodacre's presentation, a representative
(Mr. George Botner) for the petitioner entered the hearing
room. Mr. Botner apologized for his tardiness and the Board
members recognized the atypical meeting location of Building H
was a factor in the tardiness. A motion was made by Pat Neale
to hear the petition at this time but a second was not offered
and the hearing was left as continued.
