Page 1 ENVIRONMENTAL ADVISORY BOARD APRIL 5 , 1995 ****** PETITION NO: Planned Unit Development, PUD-95-2 , "Bailey Lane PUD" FILED BY/FOR: Robert L. Duane of Hole, Montes & Associates, Inc. / Steve Loveless REOUESTING: The petitioner proposes to rezone and develop the parcel into a single family neighborhood with seventy-five residences located on approximately 25 acres at the west terminus of Bailey Lane in Naples, Florida. REPRESENTED BY: Robert L. Duane of Hole, Montes & Associates, Inc. COMMENTS: For a complete record of the proceedings reader is directed to the tape recording of this meeting, located in the Office of the Clerk to the Board, 5th Floor, Building "F" , Collier County, Government Complex. MOTION: Made by Dr. Gore, seconded by Mr. Foley and carried 5/0, to approve Petition PUD-95-2 with Staff's stipulations. Mr. Saadeh abstained from the vote. (See attached request for legal services. ) STIPULATIONS: Environmental: 1. Add the following language to the end of the paragraph in Section 9 . 1. , "Conservation areas (native habitat areas) shall be identified by survey and preserved on the plat documents by easement or tract. Setbacks from those tracts shall be in accordance with Section 3 . 2 . 8 .4 .7 . 3 of the Collier County Land Development Code. " 2 . Delete Sections 9 . 2 , 9 . 3 and 9 . 4 and replace them with the following statement: The PUD shall be in compliance with the environmental sections of the Collier County Land Development Code and the Growth Management Plan, Conservation and Coastal Management Element at the time of final development order approval. 3 . Section 9 . 1 of the PUD document says that the PUD Master Plan proposes 4 . 75 acres of native habitat but the plan does not reflect this. The Proposed Land Usage Data chart shall be revised to identify the 4 . 75 acres of native habitat. Page 2 ENVIRONMENTAL ADVISORY BOARD APRIL 5, 1995 For the petitioner's edification the County landscape requirements are no longer 60%/60% as proposed in Section 9 . 3 . BACKGROUTIO OF REQUEST/PROBLEM: The petitioner of a current project being heard by the Environmental Advisory Board, and boardmember Saadeh will be entering into a joint venture on another project in the future. Boardmember Saadeh asked if he had to abstain from voting on the current project in which he has no financial interest. This item has not been previously submitted. (If previously submitted provide County Attorney's Office file no. ) ACTION REQUESTED: Do you feel there is a conflict of interest requiring Boardmember Saadeh to abstain from voting. III. PROJECT DESCRIPTION: The petitioner proposes to rezone and develop the parcel into a single family neighborhood with seventy-five residences located on approximately 25 acres at the west terminus of Bailey Lane in Naples, Florida. Environmental: Environmental Impact Statement for Bailey Lane 25 Acre Tract, prepared by Southern Biomes dated 1/16/95 and Bailey Lane PUD document prepared by Hole, Montes & Associates, Inc. dated February 1995 . EAB Meeting 4/5/1995 PUD-95-2, "Bailey Lane" Page 2 IV. STAFF COMMENTS: Water Management: Plans received at this stage of review are usually conceptual in nature. Staff's only concern at this time is the route of the off-site runoff from the on site lake to the receiving water body. Environmental: The subject property consists of 16 . 9 acres of pine flatwoods, . 4 acres of herbaceous wetland, 1 . 8 acres which was a single family residence and the remainder of the property has been previously impacted or disturbed. No endangered or threatened species were observed on the property by either the environmental consultant or County staff. There will be . 4 acres of wetlands, 6 acres of altered uplands and 13 . 85 acres of naturally vegetated uplands unavoidably cleared and filled for the proposed development, leaving 4 . 75 acres of native habitat for retention. V. RECOMMENDATIONS: Staff recommends approval of Planned Unit Development Petition No. PUD-95-2 , "Bailey Lane PUD" with the following stipulations: Water Management: Covered by Section VIII of the rezone submittal. Environmental: 1.
